About Rules of forming and maintaining the unified register of checks

The government of the Russian Federation decides:

1. Approve the enclosed Rules of forming and maintaining the unified register of checks.

2. Determine that provisions of the Rules approved by this resolution regarding assignment of accounting number to checks and inclusions in the unified register of verifications of information on checks are applied to the inspections which are carried out when implementing federal state control (supervision) of subjects of the Russian Federation by executive bodies and the inspections which are carried out when implementing regional state control (supervision) since July 1, 2016, to the inspections which are carried out when implementing municipal control since January 1, 2017.

3. The realization of this resolution is enabled within the number of workers of the federal executive bodies and means provided to the specified bodies on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

4. This resolution becomes effective since July 1, 2015.

Rules of forming and maintaining the unified register of checks

I. General provisions

1. These rules establish procedure for forming and maintaining the unified register of checks when implementing the state control (supervision) and municipal control in the Russian Federation.

2. The unified register of checks contains information:

a) about scheduled and unscheduled inspections of the legal entities and individual entrepreneurs who are carried out according to the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" (except for the unscheduled inspections which are carried out according to Item 1.1 of part 2 of article 10 of the specified Federal Law including concerning the license applicant who submitted the application for provision of the license, the licensee, submitted the application for renewal of the license, prolongation of effective period of the license), about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations;

b) about scheduled and unscheduled inspections of public authorities of subjects of the Russian Federation and officials of public authorities of the subjects of the Russian Federation which are carried out according to article 63 of the Federal law "About the General Principles of the Organization of the Public Power in Subjects of the Russian Federation" about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations;

c) about scheduled and unscheduled inspections of activities of the local government bodies and officials of local self-government who are carried out according to article 77 of the Federal law "About the General Principles of the Organization of Local Self-government in the Russian Federation" about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations;

d) about the scheduled and unscheduled inspections which are carried out by antimonopoly authority according to article 25.1 of the Federal law "About Protection of the Competition" concerning federal executive bodies, performing functions of other federal executive bodies, public authorities of subjects of the Russian Federation, local government bodies of bodies or organizations, and also state non-budgetary funds, the physical persons which do not have the status of the individual entrepreneur about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations;

e) about the scheduled and unscheduled inspections which are carried out by antimonopoly authority according to article 25.1 of the Federal law "About Protection of the Competition" concerning public authorities of subjects of the Russian Federation, local government bodies, commercial and non-profit organizations, individual entrepreneurs about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations. The specified information is entered in the unified register of checks concerning commercial and non-profit organizations, individual entrepreneurs according to the subitem "an" of this Item, concerning public authorities of subjects of the Russian Federation - according to the subitem "b" of this Item, concerning local government bodies - according to the subitem "v" of this Item;

e) about the test purchase which is carried out according to article 16.1 of the Federal law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control" and results of its carrying out;

g) about the scheduled and unscheduled inspections of activities of federal executive bodies which are carried out within implementation of powers, the stipulated in Article 27 Federal Laws "About Protection of the Population and the Territories against Emergency Situations of Natural and Technogenic Nature" and article 13.1 of the Federal law "About Civil Defence" about their results and about the taken measures for suppression and (or) elimination of effects of the revealed violations;

h) about scheduled and unscheduled inspections (inspections) which are carried out by Federal Service for Environmental, Technological and Nuclear Supervision according to Chapter V.1 of the Federal Law "About Use of Atomic Energy" concerning activities of legal entities in the field of use of atomic energy about results of such checks (inspections) and about the taken measures for suppression and (or) elimination of effects of the revealed violations.

2-1. Set of information included in the unified register of checks, stipulated in Item 2 these rules, makes the electronic passport of check or test purchase.

3. Forming and maintaining the unified register of checks are performed by his operator in accordance with the legislation of the Russian Federation about information, information technologies and on information security, the legislation of the Russian Federation on contractual system in the field of purchases of goods, works, services for ensuring the state and municipal needs taking into account functional requirements to the specified system, the checks developed by the operator of the unified register in coordination with the Ministry of Economic Development of the Russian Federation.

4. Commissioning of the unified register of checks is performed by the operator of the unified register of checks according to the order of the Government of the Russian Federation of September 10, 2009 No. 723 "About procedure for commissioning of separate state information systems" following the results of acceptance tests.

5. Functioning of the unified register of checks is performed with use of infrastructure of single digital platform of the Russian Federation Gostekh and infrastructures providing information and technological interaction of the information systems used for provision of the state and municipal services and execution of the state and municipal functions electronically.

6. Interaction with the federal state information system "Single Portal of the State and Municipal Services (Functions)" is performed with use of single system of interdepartmental electronic interaction.

7. Provision of consulting support to state control (supervision) bodies, bodies of municipal control and to the public institutions authorized according to the Federal Laws on implementation of the state control (supervision) (further - control facilities), concerning use of the unified register of checks is performed by the operator of the unified register of checks.

8. Forming and maintaining the unified register of checks are performed with use of the technologies allowing to provide collection, entering into the unified register of verifications of information by control facilities, storage of information, its systematization, updating, transfer, protection, analytical processing, and also modification of the unified register of checks.

9. The unified register of checks is kept in state language of the Russian Federation.
