The Cabinet of Ministers of Ukraine decides:

Approve Regulations on the Ministry of social policy of Ukraine which are applied.

Regulations on the Ministry of social policy of Ukraine

1. The ministry of social policy of Ukraine (Minsotspolitiki) is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine and which provides forming and realization of state policy in the field of social policy, obligatory national social and pension insurance, social protection of the population, volunteer activities, concerning family and children, improvement and rest of children, adoption and protection of the rights of children, internally displaced persons, prevention and counteraction to domestic violence, violence on the basis of sex, human trafficking, providing the equal rights and opportunities of women and men, provision of social services and carrying out social work, social and professional adaptation of the military personnel, the dismissed persons discharged from military service, the veterans of work, veterans of war, persons having special merits before the Homeland injured participants of Revolution of Advantage, members of families the died (died) veterans of war, members of families of the died (died) defenders and defenders of Ukraine regarding the organization of payment by it by the Independence Day of Ukraine of one-time money payment, veterans of military service, the victims of Nazi prosecutions, children of war and the victims of political repressions, provision of pensions and accounting of persons which are subject to obligatory national social insurance, implementation of the state control of observance of requirements of the legislation by provision of social support (government assistance, privileges, housing subsidies and other payments which are carried out at the expense of the government budget, social services) and behind observance of the rights of children and also provides forming and realizes state policy on implementation of the state supervision in the field of obligatory national social insurance from labor accident and occupational disease which entailed disability, in connection with temporary disability regarding ensuring compliance to the legislation of decisions of authorized body of management in system of obligatory national social insurance in connection with temporary disability and from accident (further - authorized body of management), state regulation and supervision of respect for the provisions of the law of Ukraine "About obligatory national pension insurance" concerning appointment (recalculation) and pension payment in solidary system, in the field of the humanitarian assistance.

Minsotspolitiki is specially authorized central executive body concerning providing the equal rights and opportunities of women and men, humanitarian assistance.

2. Minsotspolitiki in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of Minsotspolitiki are:

1) ensuring forming and realization of state policy:

in the field of social policy, obligatory national social and pension insurance, volunteer activities, provision of pensions and accounting of persons which are subject to obligatory national social insurance;

in the field of social protection of the population, in particular, persons with disability, veterans of work, the victims of Nazi prosecutions, children of war and the victims of the political repressions, citizens who were injured owing to the Chernobyl catastrophic crash; veterans of military service regarding provision of pensions;

in the field of social protection of veterans of war, persons having special merits before the Homeland, injured participants of Revolution of Advantage, members of families the died (died) veterans of war, members of families of the died (died) Defenders and Defenders of Ukraine regarding the organization of payment by it by the Independence Day of Ukraine of one-time money payment;

concerning payment of stipulated by the legislation social grant to students (cadets) of the public institutions of the higher education studying in day form according to the state order;

concerning provision of privileges on payment of housing and communal services, solid fuel and the liquefied gas, and also housing subsidies;

concerning family and children, improvement and rest of children, adoption and protection of the rights of children;

concerning social support of internally displaced persons;

concerning prevention and counteraction to domestic violence, violence on the basis of sex;

concerning providing the equal rights and opportunities of women and men;

concerning prevention and counteraction of human trafficking;

concerning provision of social services and carrying out social work;

concerning social and professional adaptation of the military personnel, the dismissed persons discharged from military service;

the paragraph the thirteenth is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 28.06.2022 No. 740

concerning providing the state social standards and the state social guarantees for the population;

in the field of implementation of the state control of observance of requirements of the legislation by provision of social support (government assistance, privileges, housing subsidies and other payments which are carried out at the expense of the government budget, social services) and behind observance of the rights of children;

2) ensuring forming and realization of state policy in the field of:

humanitarian assistance;

implementation of the state supervision in the field of obligatory national social insurance from labor accident and occupational disease which entailed disability, in connection with temporary disability regarding ensuring compliance to the legislation of decisions of authorized body of management;

implementation of state regulation and supervision of respect for the provisions of the law of Ukraine "About obligatory national pension insurance" concerning appointment (recalculation) and pension payment in solidary system;

4. Minsotspolitiki according to the tasks assigned to him:

1) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine and in accordance with the established procedure submits them for consideration of the Cabinet of Ministers of Ukraine;

2) develops drafts of the laws and other regulatory legal acts on the questions which are within its competence;

2-1) performs preparation and representation to the Cabinet of Ministers of Ukraine of the offers on application, cancellation and modification of special economic and other rationing measures (sanctions) submitted by the Cabinet of Ministers of Ukraine for consideration of the National Security and Defense Council of Ukraine according to the Law of Ukraine "About sanctions" and participates in forming, realization and monitoring of efficiency of the state sanctions policy on issues, being within its competence;

3) approves drafts of the laws, other acts of the legislation which arrive on approval from other ministries and the central executive bodies, prepares within the powers provided by the law, conclusions and offers to drafts of the laws, other acts of the legislation which move for consideration of the Cabinet of Ministers of Ukraine, and drafts of the laws submitted for consideration of the Verkhovna Rada of Ukraine by other persons of law of the legislative initiative, regulatory legal acts of the Verkhovna Rada of the Autonomous Republic of Crimea;

4) prepares within the powers provided by the law notes and offers to accepted by the Verkhovna Rada of Ukraine of the laws which arrived for the signature to the President of Ukraine;

Performs 5) within the powers provided by the law, coordination of activities central and local executive bodies, local government bodies on application of the state social standards and standard rates and standard rates of financial provision of rendering the state social guarantees;

Performs 6) within the powers provided by the law, coordination of activities central and local executive bodies, local government bodies, in particular in the conditions of the special period and in case of introduction of legal regime of emergency or warlike situation;

Performs 7) within the powers provided by the law, coordination of activities of structural divisions of the local state administrations concerning the social protection of the population, the companies, organizations and the organizations relating to the sphere of management of Minsotspolitiki, in particular on their preparation for functioning in the conditions of the special period and in case of introduction of legal regime of emergency or warlike situation;

8) determines monthly actual size of subsistence minimum on one person, and also for persons belonging to the main social and demographic national groups; prepares and makes offers on approval of the size of subsistence minimum in the government budget taking into account forecast consumer price index;

9) carries out coordination and analytical work on overcoming poverty, prepares suggestions for improvement of technique of evaluating poverty and carries out monitoring of indicators of poverty;

10) participates in carrying out the analysis of drafts of the state target programs for the purpose of determination of social effects of accomplishment of programs, including concerning their influence on social protection of the population, considers and approves drafts of concepts and programs;

Develops 12) and makes in accordance with the established procedure suggestions for improvement of state policy concerning demographic development, including increase in level of birth rate and development of family; improvement of health of the population, overcoming negative effects of aging of the population, regulation of migration flows;

22) exercises the state supervision in spheres of obligatory national social insurance from labor accident and the occupational disease which entailed disability in connection with temporary disability regarding ensuring compliance to the legislation of decisions of authorized body of management;

Develops 28) and makes in accordance with the established procedure offers on provision of the government public assistance to families with children, to needy families, persons with disability since the childhood and to children with disability, the temporary government assistance to children whose parents have no opportunity to contain them either the residence or stay of parents of which does not know, the help to needy persons who live together with persons with disability of I or II groups owing to mental disturbance which according to the conclusion of the medical commission of healthcare institution need permanent foreign care, to persons with disability, to persons who move from temporarily occupied territory and areas of conducting anti-terrorist operation, to other socially vulnerable segments of the population;

28-1) participates in ensuring forming and realization of state policy in the field of antimine activities within the powers in interaction with National authority concerning antimine activities, the center of antimine activities and the center of humanitarian mine clearing;

28-2) develops and makes in accordance with the established procedure offers on provision of immediate compensation, the annual help on improvement and will organize actions for rehabilitation of persons with disability and children with disability to 18 years to which disability owing to the injuries of health received in the territory of Ukraine caused by the explosive objects determined in Item of 1 part one of article 1 of the Law of Ukraine "About antimine activities in Ukraine" is established;

36) coordinates work central and local executive bodies, local government bodies, the companies, organizations and the organizations for implementation and implementation of the Convention of the UN on the rights of persons with disability;

37) promotes work of public organizations, including public organizations of persons with disability, attracts them to cooperation and partnership;

38) participates together with other central executive bodies in forming of state policy on creation of the free circle for persons with disability and other handicapped national groups;

52) is provided by forming and maintaining the Single information database about internally displaced persons;

52-1) promotes in the procedure established by the legislation to social support of internally displaced persons;

52-2) collects and analyzes information on availability of the needs for social support among internally displaced persons;

52-3) performs methodical ensuring activities and within the powers determined by the law, coordination of interaction central and local executive bodies, local government bodies, in particular the centers of provision of administrative services concerning social support of internally displaced persons;

52-4) develops and submits to the Cabinet of Ministers of Ukraine proposals on social support taking into account requirements of internally displaced persons;

52-5) develops state programs on the questions concerning social support of internally displaced persons;

52-6) coordinates implementation of actions for return to the territory of Ukraine in which public authorities perform the powers in full, the children who are compulsorily moved (deported) on temporarily occupied territory or on the territory of the Russian Federation, other states;

52-7) coordinates activities for humanitarian assistance to the civilian population during armed conflict;

64) performs actions for creation (upgrade, modification, development), administration and ensuring functioning of the Unified information system of the social sphere, creates and supports in urgent condition the state information resources and systems which holder are Minsotspolitiki, for the purpose of ensuring transparency of social support, maximum efficiency and increase in level of availability to social support;

64-1) performs within competence of action for ensuring cryptographic and technical information security, cyberprotection, protection of the state information resources and systems, requirements for which protection are established by the law, in information, electronic communication and information and communication systems and on subjects to information activities, and also in spheres of use of the state information resources regarding information security, counteraction to technical investigations;

65) accounting of the foreigners and citizens of Ukraine living outside Ukraine - candidates for adoptive parents and the children adopted by them keeps centralized account of the orphan children and children deprived of parent guardianship who can be adopted and also;

Accepts 100) within the powers provided by the law, participation in implementation of actions for adaptation of the legislation of Ukraine to the legislation of the EU;

102) acts in accordance with the established procedure as the customer of research works on determination of strategy of social policy, in particular, of obligatory national social insurance, social protection of the population, in particular persons with disability, the citizens who were injured owing to the Chernobyl catastrophic crash, and also social services, providing the equal rights and opportunities of women and men;

Informs 103) within the powers provided by the law and makes explanations on realization of state policy on the questions which are within Minsotspolitiki's competence;

104) is performed by recognition of loads, means, including in foreign currency, the performed works, the provided services by the humanitarian assistance;

105) exercises control of transportation, obtaining, storage, protection, warehousing, distribution, target use, accounting of the humanitarian assistance, preparation of the corresponding statistical reporting;

Performs 106) within the powers provided by the law, control of activities of Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city state administrations;

107) is conducted by the Unified register of receivers of the humanitarian assistance;

108) is provided by lighting in mass media of the activities for obtaining, distribution and use of the humanitarian assistance;

110) is performed by consideration of addresses of citizens on the questions connected with Minsotspolitiki's activities, the companies, organizations and the organizations relating to the sphere of its management;

111) performs functions on management of objects of state-owned property which belong to the sphere of its management;

112) is performed by distribution of the means provided in the government budget for support of public organizations of persons with disability having the status of All-Ukrainian;

Directs 113), coordinates and controls activities of Social Security Fund of persons with disability;

114) performs other powers determined by the law.

5. Minsotspolitiki for the purpose of the organization of the activities:

Provides 1) within the powers provided by the law, implementation of actions for prevention of corruption and control of their implementation in Minsotspolitiki's device at the companies, in organizations and the organizations which belong to the sphere of its management;

2) is performed by personnel recruitment in Minsotspolitiki's device, on the companies, in the organizations and the organizations relating to the sphere of its management will organize work on preparation, retraining and advanced training of government employees and workers of the device of Minsotspolitiki;

3) is controlled by activities of the relevant structural divisions of the local state administrations for the questions which are within Minsotspolitiki's competence;

4) will organize planned and financial work in Minsotspolitiki's device, at the companies, in organizations and the organizations which belong to the sphere of its management, exercises control of use of financial and material resources, provides the organization and enhancement of financial accounting;

5) is provided by effective and target use of budgetary funds;

5-1) provides self-representation of interests of Minsotspolitiki in judicial and other public authorities of Ukraine, in particular through authorized persons;

Provides 6) within the powers provided by the law, realization of state policy of rather state secret, control of its preserving in Minsotspolitiki's device;

Provides 7) within the powers provided by the law, accomplishment of tasks on mobilization preparation and mobilization readiness of the state;

8) provides within the powers provided by the law, involvement of citizens to participation in administration of state affairs, effective interaction with institutes of civil society, implementation of public control over Minsotspolitiki's activities, accounting of public opinion during the forming and realization of state policy on the questions which are within Minsotspolitiki's competence;

9) will be organized by record keeping and archive document storage according to statutory rules;

10) is provided by functioning of internal control and performs internal audit in Minsotspolitiki's device, at the companies, in the organizations and the organizations relating to the sphere of its management.

6. Minsotspolitiki according to assigned to him tasks has the right:

1) to involve in accordance with the established procedure specialists central and local executive bodies, the companies, organizations and the organizations (in coordination with their heads), scientists, representatives of institutes of civil society (in consent) in consideration of the questions which are within its competence;

To receive 2) gratuitously from the ministries, others central and local executive bodies, local government bodies necessary for accomplishment information, documents and materials of the tasks assigned to it, including from bodies of statistics - statistical data;

3) to convene meetings, to form the commissions and working groups, to hold scientific conferences, seminars on the questions which are within its competence;

4) to use the corresponding information databases of state bodies, the state system of government communication and other technical means.

approves and submits the Cabinet of Ministers of Ukraine developed by the central executive bodies which activities direct and the minister, drafts of the laws, acts of the President of Ukraine and the Cabinet of Ministers of Ukraine coordinates;

determines the priority areas of work of the central executive bodies which activities direct and the minister, and ways of accomplishment of the tasks assigned to them coordinates, approves work plans of such bodies;

approves structure of the office of the central executive bodies which activities direct and the Minister coordinates;

publishes obligatory for accomplishment by the central executive bodies which activities direct and the minister, orders and orders on the questions which are within the competence of such bodies coordinates;

approves position assignment and dismissal of heads and deputy managers of territorial authorities of the central executive bodies which activities direct and the Minister coordinates;

resolves other issues connected with the direction and coordination of activities of the central executive bodies which activities direct and the Minister coordinates;

4) determines priorities of work of Minsotspolitiki and way of accomplishment of the tasks assigned to it, approves plans of its work, reports on their accomplishment;

10-1. Powers of the head of public service in Minsotspolitiki are performed by the state secretary Minsotspolitiki.

8) employs and discharges from office according to the procedure, stipulated by the legislation about work, workers of the device of Minsotspolitiki, makes the decision on their encouragement, attraction to disciplinary responsibility;

Approves 9) in the cases of position assignment and dismissal of heads of the relevant structural divisions of the regional, Kiev and Sevastopol city state administrations provided by the law;

10) appoints to position and dismisses employees of foster service of the Minister of its representation, and also in connection with release of the Minister;
