About change and about recognition voided some acts of the Government of the Russian Federation concerning functioning of the wholesale market of electrical energy and capacity, and also carrying out long-term competitive selections of capacity

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning functioning of the wholesale market of electrical energy and capacity, and also carrying out long-term competitive selections of capacity.

2. To the Ministry of Energy of the Russian Federation in coordination with the Ministry of Economic Development of the Russian Federation and Federal Antimonopoly Service:

a) develop and bring in the Government of the Russian Federation till February 1, 2016:

offers on the price parameters determining demand for capacity as function of the price of capacity, on the long-term competitive selections of capacity made in 2016 and in the years ahead;

offers on introduction of amendments to acts of the Government of the Russian Federation, the replacement actions necessary for possibility of conclusion of the generating object providing the termination of delivery of capacity in the forced mode after realization from operation, for the generating objects put into operation till January 1, 2008 and carried to the generating objects which capacity is delivered in the forced mode, based on threat of approach of the effects provided by the Inference rules of power generation facilities in repair and from operation approved by the order of the Government of the Russian Federation of July 26, 2007 No. 484 "About conclusion of power generation facilities in repair and from operation", as a result of conclusion of the generating objects from operation;

offers on introduction of amendments to acts of the Government of the Russian Federation, the maximum values of the coefficients applied to scoping of underdelivery of capacity in case of failure to carry out (partial failure to carry out) by the supplier of conditions of maintenance of the generating equipment in ready state to development of electrical energy providing updating and also gradual increase in the specified coefficients to the maximum value by 2020 (for the generating objects which capacity is on sale under agreements on capacity provision, - by 2017);

b) develop and approve till March 1, 2016 procedure for determination of size of demand for capacity for carrying out long-term competitive selection of capacity, including procedure for determination of sizes of planned coefficients of reservation of capacity in price zones of the wholesale market of electrical energy and capacity.

3. Recognize invalid:

paragraph two of Item 1 of the order of the Government of the Russian Federation of April 13, 2010 No. 238 "About determination of price parameters of trade in capacity in the wholesale market of electrical energy and capacity" (The Russian Federation Code, 2010, No. 16, the Art. 1922);

Item 2 of the order of the Government of the Russian Federation of August 16, 2014 No. 820 "About change and about recognition voided some acts of the Government of the Russian Federation concerning functioning of the wholesale market of electrical energy and capacity, and also carrying out competitive selection of capacity in 2014" (The Russian Federation Code, 2014, No. 34, the Art. 4677).

4. This resolution becomes effective from the date of its official publication, except for subitems "t" - "ф" and "ш" Item of 2 changes approved by this resolution which become effective since January 1, 2016, and subitems "g" - "е", "c" and "h" Item of 2 changes approved by this resolution who become effective since February 1, 2016.

Changes which are made to acts of the Government of the Russian Federation concerning functioning of the wholesale market of electrical energy and capacity, and also carrying out long-term competitive selections of capacity

1. Item 3 Corrected price indexations on capacity, approved by the order of the Government of the Russian Federation of April 13, 2010 No. 238 "About determination of price parameters of trade in capacity in the wholesale market of electrical energy and capacity" (The Russian Federation Code, 2010, No. 16, Art. 1922; 2014, No. 34, of the Art. 4677) to state in the following edition:

"3. The price of capacity determined by results of competitive selection of capacity is indexed since January 1 the year following after year in which the corresponding competitive selection of capacity, till January 1 of year in which delivery of capacity by results of this selection is performed was made.

Price indexation on capacity, the capacity determined by results of competitive selection, is performed according to the change of the consumer price index determined and published by the federal executive body performing functions on forming of official statistical information reduced by 1 percent point.

Price indexation, determined by results of the competitive selection of capacity made in year, prior year in which delivery of capacity by results of this selection is performed is not made.".

"55. In 2011 - 2012 values of the coefficients specified in Items 53 and 54 of these rules are established on the lower bound of the range. In 2013 - 2016 values of coefficients are established by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of fuel and energy complex taking into account the requirement about gradual increase in these values during the specified period to the upper bound of the range.

For the generating objects for which the utilization rate of installed capacity for the prior year calculated according to the Treaty of Accession to trade system of the wholesale market is less than 30 percent and at the same time value of coefficient of reliability exceeds 0,1, of value of the coefficients specified in Items 53 and 54 of these rules, are established by the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of fuel and energy complex proceeding from condition of increase in these values during the specified period to the upper bound of the range the rates advancing increase in the corresponding values for other generating objects. The coefficient of reliability is determined according to the Treaty of Accession to trade system of the wholesale market as average for prior year value of the relation of the following amounts:

the capacity underdelivery amount reduced by the amount equal to limiting excess of scope of supply of capacity over the capacity amount considered concerning the generating object when carrying out competitive selection of capacity for the corresponding year;

the capacity amount considered concerning the generating object when carrying out competitive selection of capacity for the corresponding year (but no more extreme scope of supply of capacity).

Before approval the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of fuel and energy complex, procedure for determination of the coefficients applied according to these rules in case of failure to carry out (partial failure to carry out) by suppliers of requirements regarding readiness of the generating equipment for development of electrical energy applies the values of coefficients corresponding to the lower bound of the specified ranges.

Since January 1, 2017 the values of the specified coefficients corresponding to the upper bound of the ranges are applied.";
