About approval of the Program of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020

According to article 7 of the Law of the Republic of Tajikistan "About the state forecasts, concepts, strategy and programs of social and economic development of the Republic of Tajikistan", and for the purpose of creating favorable conditions for development of entrepreneurship, the Government of the Republic of Tajikistan decides:

1. Approve the Program of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020 and the Actions plan on program implementation of the state support of entrepreneurship in the Republic of Tajikistan for the first three years (appendices No. 1, No. 2, No. 3 and No. 4).

2. Determine the State committee on investments and management of state-owned property of the Republic of Tajikistan of the coordinator of program implementation of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020.

3. To the Ministry of Finance of the Republic of Tajikistan to provide allocation of necessary means from the Government budget for implementation of the Actions plan on program implementation of the state support of entrepreneurship for 2012 - 2020 for the first three years.

4. Annually to represent to the relevant ministries and departments to the State committee on investments and management of state-owned property of the Republic of Tajikistan information on course of execution of implementation of the Actions plan on program implementation of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020 for the first three years.

5. To the state committee on investments and management of state-owned property of the Republic of Tajikistan:

- to annually submit in the Government of the Republic of Tajikistan the report on the course of program implementation of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020;

- in the first half of the year 2014 to develop and provide for approval to the Government of the Republic of Tajikistan the Plan of further actions for program implementation of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020.

The program of the state support of entrepreneurship in the Republic of Tajikistan for 2012 - 2020

The program of the state support of entrepreneurship in the Republic of Tajikistan for 2012-2020 (further - the Program) is the program of long-term measures which will be accepted and realized by the Government of the Republic of Tajikistan, for the purpose of creating favorable conditions for establishing activities of subjects of entrepreneurship as major factor of the solution of social and economic tasks of the country by employment and increase in real welfare of the population of the Republic of Tajikistan.

The program is directed to further work on carrying out step-by-step, complex legal reforms of the Republic of Tajikistan, upgrade of production and engineering procedures, attraction of foreign and domestic investments, strengthenings of state-private cooperation, enhancement of credit and financial system of support of subjects of small and medium entrepreneurship, provision to subjects of small and medium entrepreneurship of government subsidies and soft credits, quality improvements, growth in volumes of the made domestic production and increase in amounts of its export.

1. General provisions

1. For development of entrepreneurship in the Republic of Tajikistan number of regulatory legal acts was accepted, namely:

- The law of the Republic of Tajikistan of May 10, 2002, No. 46 "About the state protection and support of entrepreneurship in the Republic of Tajikistan";

- The strategy of reducing poverty approved by the resolution of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan of June 19, 2002, No. 666;

- The law of the Republic of Tajikistan of May 17, 2004, No. 37 "About licensing of separate types of activity";

- The concept of development of entrepreneurship of the Republic of Tajikistan till 2015 approved by the order of the Government of the Republic of Tajikistan of December 3, 2004 No. 469;

- The law of the Republic of Tajikistan of July 28, 2006, No. 19 "About checks of activities of business entities in the Republic of Tajikistan";

- The strategy of national development till 2015 approved by the resolution of Majlisi namoyandagon of Majlisi Oli of the Republic of Tajikistan of June 28, 2007, No. 704;

- The law of the Republic of Tajikistan of March 26, 2009, No. 505 "About the moratorium on checks of activities of subjects of small and medium entrepreneurship in the Republic of Tajikistan";

- The law of the Republic of Tajikistan of May 19, 2009, No. 508 "About state registration of legal entities and individual entrepreneurs";

- The program of improvement of the entrepreneurial circle - 200 days of reforms, approved by the order of the Government of the Republic of Tajikistan of July 2, 2009, No. 386.

2. Reforms on simplification of the procedure of state registration of subjects of entrepreneurship, licensing, receipt of different licensed documents are undertaken, the procedure for conducting checks of activities of subjects of business activity, insolvency proceeding of the companies are simplified, and also other actions which are directed to improvement of the entrepreneurial circle in Tajikistan are realized.

3. According to the Agency according to the statistics in case of the President of the Republic of Tajikistan and the Tax Committee under the Government of the Republic of Tajikistan for the period 2005 - 2010 in the republic observe strong growth of subjects of business activity.

4. According to the table it is traced that the number of subjects of entrepreneurship in 2010 in comparison with 2009 decreased. It is connected, first of all, with impact of the global financial crisis, increase in prices for oil products that in turn negatively affected social and economic situation in the country and generated other negative factors.

5. As a result of adoption of law of the Republic of Tajikistan of May 18, 2009, No. 643 "About state registration of legal entities and individual entrepreneurs" and the Law of the Republic of Tajikistan of December 29, 2010, No. 669 "About modification and amendments "About state registration of legal entities and individual entrepreneurs" was entered into the Law of the Republic of Tajikistan new order of registration of subjects of entrepreneurship that allowed to exclude duplications and to determine the real number of entrepreneurs.

6. Despite the measures taken by the Government of the Republic of Tajikistan for mitigation of the consequences of financial crisis, there is need of acceptance of the additional specific measures directed to rendering the real help to entrepreneurship as to one of sectors promoting growth of national economy.

7. According to the annual report of the World Bank "Business", by results of the undertaken reforms in 2009 and 2010 the Republic of Tajikistan improved the indicators on 25 Items and entered ten the countries leading in carrying out the reforms directed to creating favorable conditions for business activity. Simplification of procedures of creation and activities of the companies, strengthening of the property rights and enhancement of insolvency proceedings, settlements of commercial disputes and improvement of conditions of registration of the companies were main goals of the undertaken reforms.

8. Despite positive tendencies of development of entrepreneurship in the Republic of Tajikistan, number of factors which interfere with production development is observed:

- imperfection of the regulatory legal acts regulating development of entrepreneurship, licensing, certification, conducting checks, the taxation of subjects of small and medium entrepreneurship, export and commodity import;

- lack of financial and investment resources;

- high level of corruption in state bodies;

- insufficient professional training level of qualified personnel of public authorities and entrepreneurship;

- undeveloped infrastructure of support of entrepreneurs, and in particular beginners;

- weak state-private cooperation;

- imperfection of credit and financial system of support of subjects of small and medium entrepreneurship;

- low labor productivity level.

9. The existing credit and financial system of support of subjects of small and medium entrepreneurship in the Republic of Tajikistan is not up to the end created and does not conform to international standards. In particular, in case of issuance of credits to subjects of small and medium entrepreneurship from banks and

other financial organizations high interest rates and for rather short term are applied. In this connection, to subjects of small and medium entrepreneurship access to finance is limited owing to what in the republic are observed:

- low level of development of industrial and agricultural enterprises;

- use of the obsolete equipment and production equipment;

- low level of technological production;
