About measures for enhancement of contractual relations and increase in responsibility of the parties for accomplishment of obligations in agricultural production

For the purpose of implementation of the Presidential decree of the Republic of Uzbekistan of March 24, 2003 of NUP-3226 "About the Most Important Directions of Deepening of Reforms in Agricultural Industry", enhancement of contractual relations and increase in responsibility for accomplishment of undertaken obligations under the agreements signed between producers of agricultural products, the procurement and servicing organizations, the Cabinet of Ministers decides:

1. Approve Regulations on procedure for the conclusion, registration, execution of contracts between producers of agricultural products and the procurement, servicing organizations, and also monitoring of their execution according to appendix No. 1.

2. To the Ministry of Agriculture of the Republic of Uzbekistan to establish system monitoring of accomplishment by the procurement and servicing organizations of the agreements signed with agricultural producers.

Determine that the staff of district departments of agricultural industry bears the personal responsibility for timely registration of agreements, and also implementation of permanent monitoring of accomplishment by the procurement and servicing organizations of the agreements signed with agricultural producers.

4. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 16.06.2020 No. 384

5. To the Ministry of Justice, the Ministry of agricultural and water economy of the Republic of Uzbekistan together with the interested ministries and departments to make in the Cabinet of Ministers offers on the changes and amendments in the current legislation following from this resolution in a month.

Recognize invalid some decisions of the Government of the Republic of Uzbekistan according to appendix No. 2.

6. To impose control over the implementation of this resolution on the Counselor of state of the President of the Republic of Uzbekistan Dzhurabekov I. H. and Deputy prime minister of the Republic of Uzbekistan Azimov R. S.

Regulations on procedure for the conclusion, registration, execution of contracts between producers of agricultural products and the procurement, servicing organizations, and also monitoring of their execution

I. General provisions

1. This Provision governs the relations between producers of agricultural products, the procurement and servicing organizations arising in case of the conclusion and execution of agreements and also determines procedure for their registration in district departments of agricultural industry and carrying out monitoring of their execution.

2. Action of this provision extends to agreements of contracting (irrespective of availability of government procurement in them), the deliveries of material resources, rendering services (performance of works) concluded between agricultural cooperatives (shirkat), farmer and Dehkan farms, other agricultural producers (further - farms), and the procurement, servicing organizations which are engaged in the procurement, conversion of agricultural products, delivery of material resources performing the mechanized works, the field, agrochemical, agrotechnical and other service of farms connected with production of agricultural products (further - the procurement and servicing organizations).

3. Under the agreement of contracting economy shall sell in the caused terms agricultural products to the supplier - person conducting procurement of such products for conversion or sale, and the supplier shall buy these products, having paid it in the caused terms for determined price.

Under the delivery agreement of material resources (spare parts, seeds, remedies of plants, fuels and lubricants, mineral fertilizers, etc.) supply agency shall deliver in the caused time the material resources made or purchased by it to economy for use in production of agricultural products, and economy shall accept and pay their cost for the established or agreed prices.

According to the service provision agreement (performance of works) the organization contractor shall custom-make farms the mechanized works, provide the field, agrochemical, agrotechnical and other service connected with production of agricultural products, and economy shall accept and pay these services (works) on the established or agreed prices.

4. In the presence of government procurement of separate types of agricultural products procurement organizations sign with Fund for calculations for the agricultural products which are purchased for the state needs under the Ministry of Finance of the Republic of Uzbekistan agreements on financing of purchase of agricultural products in accordance with the established procedure.

5. The agreements of all types signed between farms and the procurement and servicing organizations on realization of agricultural products, delivery of material resources and rendering services (performance of works) are subject to execution after their registration in district departments of agricultural industry.

Khokimiyats of areas (cities) within the powers coordinate work on the conclusion and execution of contracts for the state needs between farms and the procurement, servicing organizations.

6. In case of the conclusion and execution of agreements each of the parties shall fulfill the obligations with the maximum economy, respect for economic interests of other parties, to take necessary measures for prevention of damage which can result from improper execution of obligations and timely inform other party on these measures, and also render her assistance performed by obligations.
