1. Approve the enclosed Rules of subsidizing at the expense of budgetary funds of losses of the carriers connected with implementation of socially important transportations of passengers, except for the cities of republican value, the capital and their agglomerations.

2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan to direct it to the copy to official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing at the expense of budgetary funds of losses of the carriers connected with implementation of socially important transportations of passengers, except for the cities of republican value, the capital and their agglomerations

Chapter 1. General provisions

1. These rules of subsidizing at the expense of budgetary funds of losses of the carriers connected with implementation of socially important transportations of passengers, except for the cities of republican value, the capital and their agglomerations (further - Rules) are developed according to subitem 23-16) of article 13 of the Law of the Republic of Kazakhstan "About road transport" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law on the state services) and determine procedure for subsidizing at the expense of budgetary funds of losses of the carriers connected with implementation of socially important transportations of passengers, except for the cities of republican value, the capital and their agglomerations, and also rendering the state service "Subsidizing of the losses of carrier connected with implementation of motor passenger traffic according to socially important messages in interdistrict (long-distance intraregional), raionwide city (rural) and suburban messages".

2. Socially important transportations the transportations of passengers in the regular message exerting impact on economic and social situation of society and organized for the purpose of ensuring available price level and possibility of free movement of the population on the territory of the Republic of Kazakhstan are recognized.

3. The losses of carrier formed by results of accomplishment of transportations according to socially important messages, rates on which are established by local executive bodies of areas, cities of Astana, Almaty and Shymkent, areas and cities of regional value (further – local executive body), are subject to subsidizing.

4. If the difference between the rate for transportation of passengers determined according to the Method of calculation of rates for rendering services in the transportation of passengers and baggage along regular routes approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of October 13, 2011 No. 614 "About approval of the Method of calculation of rates for rendering services in transportation of passengers and baggage along regular routes" (it is registered in the Register of state registration of regulatory legal acts at No. 7297) (further – the Technique) and the rate for socially important messages established by local executive body is not subsidized from the local budget, then rate size is established by local executive body at the level of rate for transportation of passengers, determined according to the Technique.

Chapter 2. Socially important transportations of the passengers by road transport who are subject to subsidizing and the sizes of subsidies

5. If the rate for transportation of passengers established by local executive body, below rate for transportation of passengers, determined according to the Technique, this route belongs to the category of socially important.

6. The local executive body of the corresponding administrative and territorial unit constitutes the list of the socially important automobile communications which are subject to subsidizing, in form, according to appendix 1 to these rules, determined by local representative body of areas, cities of republican value, the capital according to the subitem 5) of Item 1 of article 14 of the Law, based on the minutes of the Commission on rates and (or) the Commission on cost determination of route (interdistrict (long-distance intraregional), raionwide, city (rural) and suburban messages) (further – the Commission). In the list of socially important automobile communications modification and (or) amendments is allowed.

7. The carrier represents to local executive body of the corresponding administrative and territorial unit in paper or electronic form calculations for the rate for route determined according to the Technique by form according to appendix 2 to these rules, and when implementing transportations along route which cost is determined according to Chapter 4 of these rules, proceeding from general annual run of vehicles by route (kilometer), calculation for route cost for form, according to appendix 3 to these rules.
