About approval of Aviation rules of the organization and accomplishment of flights of experimental aircrafts of the Republic of Belarus
Based on Articles 6, of 18, of Chapter 9 of the Air code of the Republic of Belarus, resolutions of Council of Ministers of the Republic of Belarus of November 9, 2006 "About procedure for the organization and accomplishment of experimental flights in the Republic of Belarus" and of August 6, 2015 No. 665 "About approval procedure of the aviation rules regulating activities in the field of experimental aircraft, and the list of positions of aviation personnel of experimental aircraft of the Republic of Belarus" the State military-industrial committee of the Republic of Belarus DECIDES: No. 1500
1. Approve Aviation rules of the organization and accomplishment of flights of experimental aircrafts of the Republic of Belarus (are applied).
2. This resolution becomes effective in 15 working days after its signing.

1. These Aviation rules developed according to the Air code of the Republic of Belarus (further - the Air code), regulate procedure for the organization and accomplishment of flights experimental (piloted, pilotless) aircrafts of the Republic of Belarus.
2. Requirements of these Aviation rules are obligatory for all legal entities performing the organization and accomplishment of flights of experimental aircrafts of the Republic of Belarus.
In the organizations - owners of experimental aircrafts, based on the requirements stated in these Aviation rules, taking into account structure of the located forces and means, type of the aircraft equipment, conditions of basing instructions (management) in which the procedure for the organization and accomplishment of flights in the organization, the list of documentation and the requirement for its maintaining are determined are developed.
3. In these Aviation rules the terms established in the Air code, the Law of the Republic of Belarus of January 9, 2006 No. 93-Z "About hydrometeorological activities" and also the following are applied:
3.1. main terms and their determinations:
aviation division – division (calculation) of pilotless aviation complex, aviation link, group, squadron (the station of flight testing), and also other primary aviation structure;
fighting use of unmanned aerial vehicles – the type of flight training of operators of unmanned aerial vehicles directed to training in use in flight of arms and the equipment of unmanned aerial vehicles for defeat of land (sea), air targets or solutions of other fighting and special tasks;
air reconnaissance (additional exploration) of weather – special flight of the aircraft for refining of meteorological and ornithological situation in the area (on routes) the forthcoming flights, and also for check of operability of means of communication and radio engineering ensuring flights;
time of preparation of the aircraft for repeated departure – period of time from the moment of switching off of the engine (engines) after flight (landing in case of switching off of the engine (engines) in air) to readiness for taxiing-out of the aircraft from the place of preparation for the place of take-off (to take-off of the unmanned aerial vehicle);
time of flight of the aircraft – period of time from the moment of the beginning of running start (start of motion of the unmanned aerial vehicle on landing strip, descent of the unmanned aerial vehicle from hand, the catapult structure, the moment of department from the land surface in case of vertical take-off of the aircraft or increase in the mode of engines up to the take-off mode in case of take-off without stopping (conveyor) until contact of the land surface (engine drosselirovaniye after landing in case of vertical landing) and the ends of run (the moment of achievement by the aircraft on run of the maximum speed of taxing determined by management by flight operation of this aircraft);
cool qualification – exponent of development of specialty by aviation personnel, appropriated in accordance with the established procedure: "The test pilot of the 1st class", "The test pilot of the 2nd class", "The test pilot of 3rd class", "The military pilot-sniper", "The military pilot of the 1st class", "The military pilot of the 2nd class", "The military pilot of 3rd class", qualification (class, category) "The first class of the pilot of civil aviation", "Second class of the pilot of civil aviation", "The third class of the pilot of civil aviation", "The specialist of the 1st class", "The specialist of the 2nd class", "The specialist of 3rd class", "Master" (further – respectively 1 class, the 2nd class, 3rd class);
the commander of crew (the commander of the aircraft) – person having the existing certificate (the certificate, the flight book) of the pilot (pilot), and also the preparation and experience necessary for independent control of the aircraft of certain type;
control flight – the flight which is carried out by the trainee with the instructor for the purpose of control (check) of level of proficiency in the aircraft, its equipment and arms according to flight task;
control management of the operator of the unmanned aerial vehicle – flight, management of which are carried out by the trainee under control of the instructor, for the purpose of control (check) of level of training of the operator to control of the unmanned aerial vehicle, its equipment and arms according to flight task;
control flight of the aircraft – the special flight which is carried out for the purpose of check of operability of separate nodes, aggregates, devices, flight and navigation systems after elimination of defects and also for the purpose of check of compliance of copy of the aircraft of standard design;
flight training – training (enhancement) of aircrew (operators of unmanned aerial vehicles) in flight (in flight control of the unmanned aerial vehicle) to its types – technology of piloting, navigation, fighting application;
flight change – the period of time determined in the planned table of flights during which flights of aircrafts are carried out. Time for accomplishment of air reconnaissance of weather does not join in duration of flight change;
person organizing flights – the head of the organization or the person authorized by it from among administrative board, having flight education and experience of the organization of flights to which the obligation on the organization (the organization and accomplishment) of flights in the organization is assigned;
bodies of management and management of flights (further – bodies of RUP) – bodies (group of management of flights) of users of airspace of the Republic of Belarus performing management and management of flights in airfields (platforms, polygons) of aircrafts of the state, civil and experimental aviation;
the organization – the owner of the experimental aircraft (further – the organization) – the legal entity performing development, production, upgrade, testing, operation, one of them or other actions concerning the experimental aircraft belonging to it on the property right, the right of economic maintaining or operational management or other bases, stipulated by the legislation or the agreement;
the organization of flights – the complex of the events held by officials, including decision making on carrying out flights, determination of tasks of flights, procedure and the sequence of their accomplishment and reduction in readiness of aviation personnel, aircrafts, airfield, forces and controls and ensuring flights for their accomplishment, interaction working off;
flight task (task for flight) – established (set) to aircrew (the operator of the unmanned aerial vehicle) the direct head, the program of flight testing (researches), rate of flight training set of elements of flight, procedure and the sequence of their accomplishment;
checking – person determining the level of professional readiness of the crew member on the earth and in flight in case of accomplishment of the job responsibilities by it;
production of flights – approved on time and the purposes of action of aviation personnel, directed to accomplishment of flights;
developer – the organization performing process of creation of new type of object of experimental aircraft, development of technical documentation and production of prototype;
administrative board of the organization – officials of aviation personnel from division managers above to whom functions of management of activities in the field of experimental aircraft are assigned;
certified basis – the complex of requirements to object of experimental aircraft and environmental protection extending to this type;
the certificate of the flight validity – the document certifying compliance of the aircraft of the standard design specified in the certificate of type, and being necessary condition of the admission to flight operation of this aircraft with the restrictions set for it;
special flight – the flight on task performance demanding from crew of the aircraft of special knowledge and skills which accomplishment is provided by special programs;
specialists testers are participants of testing which based on the program of testing carry out the obligations in flight according to flight task (task for flight) on specially equipped workplaces not provided by the management on flight operation operating for carrying out testing;
starting time – period of time during which the crew of the aircraft has the right to carry out flight. Starting time of crew of the aircraft is counted in case of accomplishment of airfield flights from actual (the first flight according to the planned table), and in case of flights – from the planned time of the first departure;
training flight – the flight which is carried out by aircrew for the purpose of fixing of the acquired skills and their further enhancement;

4. The experimental AF (piloted, pilotless) are subdivided into the experienced, modified, flying laboratories, serial and auxiliary.
The experimental AF used for check of the set flight technical characteristics and design decisions for the purpose of production of serial experimental AF or carrying out flight researches in the field of creation of new samples of AT belongs to experienced.
The experimental AF created based on experienced or earlier accepted in operation of AF by introduction in design and (or) onboard systems of the changes significantly changing its flight technical characteristics, and (or) used for carrying out testing after their modification belongs to modified.
The experimental AF created based on experienced or earlier accepted in operation and used for carrying out on them the advancing testing and researches in flight of onboard systems and (or) the equipment belongs to the flying laboratories.
The experimental AF made by results of accomplishment of developmental works (to their exception of the State register of experimental aircrafts of the Republic of Belarus), and also the state and (or) civil AF who is temporarily transferred to the organizations for carrying out testing belongs to serial.
The experimental AF used for providing in flight of flight testing belongs to auxiliary.
5. The piloted experimental AF on number of crew members is subdivided on single and many-placed.
6. Flights of experimental AF are special flights. To destination they are subdivided on research, test, certified test, auxiliary, flights (control flights) and demonstration.
Research flight - the special flight which is carried out for researches of opportunities of experimental AF, its systems, arms, aeronautical, radio-electronic, special and other equipment, the power plant (engines) for their more effective use in case of the solution of tasks on purpose.
Test flight - the special flight which is carried out by developer of prototype of experimental AF at stage of preliminary testing for determination of the main flight and operational characteristics of AF, the power plant (engines), the aeronautical and special equipment, arms and other equipment, compliance of their characteristics to the set requirements and regulations of the validity, and also check of correctness and efficiency of design decisions.
Certified test flight - the special flight which is carried out at stage of certified testing for the purpose of check and confirmation of conformity of characteristics of prototype of object of experimental aircraft to certified basis.
Auxiliary flight - the special flight which is carried out for preparation and ensuring flight testing (maintenance, filming, trainings in accomplishment of the modes of the program of testing and techniques of flight testing, trainings in landing approaches on devices, fighting application and another).
Flight (control flight) - the special flight which is carried out for the purpose of check of operability of the power plant (engines) and systems, separate aggregates and nodes, devices after repair and replacement of aggregates, scheduled works, completions, elimination of defects.
Flight (control flight) is carried out also for the purpose of check of compliance of copy of experimental AF of the standard design specified in the certificate like sample in case of issue (prolongation) of the certificate of the flight validity.
Demonstration flight - the special flight which is carried out for demonstration of flight and technical and other characteristics of experimental AF.
Auxiliary, demonstration flights and flights (control flights) provided by programs of flight testing and also flights for training (input in system) aircrew and specialists testers (operators of BLA) are considered as test flights.
7. Under the terms of piloting and navigation flights are subdivided into visual flights and flights on devices.
8. On weather conditions of accomplishment flights of the piloted experimental AF are subdivided into flights in VMU and PMU which are carried out on PVP and PPP respectively.
Flights in clouds, between layers of clouds and behind clouds belong to flights in PMU in case of cloudiness of 7 and more points, and also under clouds in case of the lower bound of clouds and (or) flight visibility according to the maximum parameter values of meteorological elements in case of which flights are considered executed in PMU odinochno and as a part of groups according to appendix 1 to these Aviation rules.
Flight time over water space out of visual visibility of coastal line and in stratosphere is considered the same as time of flight in PMU.
All other flights belong to flights in VMU.
9. Pilots (pilots) - the testers, navigators-testers and other persons who had special training, having the corresponding specialty or the appropriate certificate (certificate) which underwent medical examination and recognized suitable for flight work and fulfillment of duties in flight as a part of crew according to requirements of RLE (the program of testing or researches AF) treat aircrew of experimental aircraft.
The list of positions of aviation personnel of experimental aircraft (aircrew and non-flying aviation personnel) affirms Goskomvoyenprom.
10. The crew of experimental AF consists of citizens of the Republic of Belarus. Inclusion in flight crew of experimental AF of foreign citizens and persons without citizenship is performed by the order (decision) of the head of the organization.
11. The foreign citizens (having the corresponding specialty confirmed with the certificate (certificate) recognized in the Republic of Belarus, suitable according to the medical certificate to flights) can be included crew of experimental AF in the following cases:
in case of accomplishment of programs for carrying out flight testing (researches) jointly made by the organizations of the Republic of Belarus and foreign states of experimental AF;
when carrying out joint flight testing (researches) experimental AF on adopted agendas;
in need of the admission of aviation personnel of the Republic of Belarus to flights and management of BLA (input in system, accomplishment of checks and another);
when holding air shows (exhibitions) and practical displays of AT in the Republic of Belarus and beyond its limits.
12. Faces of foreign aircrew are allowed to flight after the special preparation which is carried out by specialists of the organization. Preparation for flight shall correspond to task for flight and safety. The admission to flight is given by the order of the head of the organization.
13. Faces of aircrew of the organizations, and also the state or civil aviation are included crew of experimental AF according to the program of testing and in the presence at them the existing certificates of testers or the admission on the corresponding specialties.
14. The structure of crew of the experimental (piloted) AF is determined by RLE operating for carrying out testing and consists of flight crew and kabinny crew.
To flight crew the aircrew, the acting as on management of AF, treats kabinny crew - the aircrew operating systems and the equipment of experimental AF. The pilot (pilot) is appointed the commander of crew of experimental AF.
According to the program of testing (researches) of experimental AF by developer the structure of crew (certain RLE) can in addition include other necessary specialists testers (participants of testing) who had training, having the corresponding admission and suitable according to the medical certificate to flights on this type of experimental AF.
The crew of experimental AF, management of which in flight is provided with one pilot (pilot) and does not require onboard other crew members, consists of the commander of AF.
15. The structure of crew of BLA consists of the operator (operators) of BLA (the operator of BLA and the instructor - the commander of crew). Person having in stipulated by the legislation cases the certificate (certificate) on the right of management of BLA of certain type can be the operator of BLA.
16. Flights shall be carried out by crew of experimental AF en banc. The crew of experimental AF in the reduced structure allowed to carry out flights if it is provided by RLE, the program of testing (researches) of experimental AF.
17. The structure of crew of the experimental AF who is carrying out distant flight, by the solution of the face organizing flights can in addition include the pilot (pilot), the navigator and the onboard engineer (technician) if potrebny starting time for flight exceeds 14 hours.
18. Can be included in structure of crew of experimental AF checking (instructors). At the same time workplaces of the trainees (checked) are forbidden to be taken. The total quantity of checking (instructors) from faces of aircrew shall not be more than two.
Checking (instructor), carrying out inspection or training of the pilot in flight (the operator of BLA in management), is commander of experimental AF and bears responsibility for safety of flight, including by transfer of management to the checked (trained) pilot (the operator of BLA).
19. Checking (instructor) in the specialty (except the pilot), carrying out inspection or training of crew members of experimental AF in flight, submits to the commander of experimental AF and bears responsibility for accomplishment by the checked crew members of experimental AF of obligations and safety requirements of flight on the specialty.
20. Crew members of experimental AF in case of fulfillment of duties shall be dressed in the individual (special) flight dress code determined by the head of the organization.
21. The crew member of experimental AF has the right to refuse flight accomplishment if, in his opinion, there are reasoned bases to be afraid for safe completion of flight.
22. Crew members of the piloted experimental AF in case of accomplishment of flight shall:
observe procedure for accomplishment of flight task, requirements of RLE and the program of flight testing (researches);
follow instructions of body of RUP exercising flight control of experimental AF. In case of explicit safety hazard of flight, and also for the purpose of rescue of life of the people who are onboard experimental AF, the commander of AF can make the decision on departure from flight plan, instructions of body of RUP and flight task, following (whenever possible) statutory rules of flights. The crew is forbidden to stop radio communication with the body of RUP exercising flight control of experimental AF and also to pass without its permission to communication with other body of RUP;
conduct aviation meteorological observations, observation of air, ornithological situation visually and with use of onboard RTS. In case of detection of OGYa or dangerous rapprochement with other AF to take exhaustive measures for ensuring safe continuation of flight with the report to the body of RUP exercising flight control.
23. In case of flight safety hazard the commander of experimental AF and crew members shall take exhaustive measures for preserving life and health of passengers and crew members, and also experimental AF and being onboard property.
24. Prior to flight the crew (the operator of BLA) shall be convinced that:
experimental by AF it is prepared for flight and there is documentary confirmation about accomplishment of its maintenance;
fuelling and special liquids of experimental AF, charge of the BLA accumulators, options of suspension bracket of arms and the special equipment are executed according to flight task;
the load which is available onboard experimental AF is correctly distributed and reliably fixed;
onboard the piloted experimental AF are:
the weather report (in case of accomplishment of VRP of weather and flights);
flight maps;
documents ANI (statements from them);
the mate flight plan put on the scheme or the map (in case of accomplishment of route flight);
engineering and mate calculation of flight (according to legal acts of the Republic of Belarus on mate ensuring flights);
are in workplace of the operator:
flight map;
necessary documents ANI (statements from them);
mate flight plan of BLA;
engineering and mate calculation of flight of BLA (according to legal acts of the Republic of Belarus on mate ensuring flights).
25. The commander of experimental AF directs work of crew, is responsible for discipline and procedure onboard, takes necessary measures for safety of flight of experimental AF.
26. The commander of experimental AF shall:
prepare for flight according to flight task;
direct preparation and estimate readiness of crew members for accomplishment of flight task;
train crew for actions in SMALLPOX, and also for actions after emergency landing (escape) of experimental AF;
study safety requirements on the planned flight task and bring them to crew;
observe the preflight mode and try to obtain its accomplishment by crew members;
inspect, check and accept experimental AF before flight in the amount established by RLE;
check equipment of crew of experimental AF;
control placement onboard experimental AF of passengers, distribution and fixture (mooring) of the equipment and loads;
organize instructing of passengers about rules of conduct onboard experimental AF and bring to them procedure for use of necessary rescue means and the equipment;
take necessary measures for safety being onboard people, safety of experimental AF and being onboard property;
make the decision on departure;
direct in flight work of crew of experimental AF;
observe safety requirements in flight taking into account level of training of crew of experimental AF, features of flight task, weather conditions and ornithological situation in the area and on flight route, to demand their observance from crew;
execute commands of body of RUP, the commander (leader) of group under control of whom there is experimental AF;
follow statutory rules of conducting radio exchange and control their observance by crew of experimental AF;
carry out flight according to flight task;
conduct orientation in flight;
control the actual remaining balance of fuel onboard experimental AF, its expense and time of flight;
analyze hydrometeorological information, ornithological and air situation before flight and in flight, report on OGYa on body of RUP under control of which it is;
make decisions on continuation (termination) of flight in case of situation complication in air;
not allow dangerous rapprochement with other AF and land obstacles;
