2. To committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (Ergozhin of E.) in the procedure established by the legislation to provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order its direction on official publication in periodic printing editions and information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan.
3. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of forming of personnel reserve, requirements to qualification of the employees enlisted in personnel reserve and works with departmental databank of the employees enlisted in personnel reserve of operational investigative divisions of bodies for financial monitoring (service of economic investigations) (further - Rules) are developed according to Item 10 of article 34 of the Law of the Republic of Kazakhstan of January 6, 2011 "About law-enforcement service" and determine procedure for forming of personnel reserve, requirements to qualification of the employees enlisted in personnel reserve and works with departmental databank of the employees enlisted in personnel reserve of operational investigative divisions of bodies for financial monitoring (service of economic investigations) (further - the SIR).
2. For the purpose of forming of personnel structure the SIR, ensuring completing of executive positions in the SIR is created personnel reserve the SIR.
3. Term of stay of the employee in personnel reserve three years. The persons enlisted in personnel reserve, but not appointed during stay in personnel reserve to the positions planned for them are enlisted in personnel reserve in accordance with general practice.
4. The vacant executive position is replaced with the employee consisting in personnel reserve the SIR. In case of refusal of the employees consisting in personnel reserve of the offered position the vacant position is replaced with other employee by results of certification or for selection of personnel.
5. The personnel reserve the SIR is created on planned basis for the subsequent substitution of vacant executive positions of number of persons employed which by results of certification are recommended for promotion for executive positions or for work with large volume, and also from persons who showed managerials ability on duty or in case of accomplishment of special tasks.
6. Responsibility for forming of personnel reserve and the organization of work with it it is assigned to the vice-chairman of Committee on financial monitoring of the Ministry of Finance of the Republic of Kazakhstan (further - Committee) supervising law-enforcement activities, and on territorial authorities - to deputy managers of departments of economic investigations on areas, the cities of republican value and the capital (further - territorial authorities on financial monitoring) supervising law-enforcement activities and also to division on work with personnel of bodies for financial monitoring (further - personnel service).
7. Sources of forming of personnel reserve are:
1) the recommendation of transfer in personnel reserve according to the solution of certifying commission of Committee or territorial authorities;
2) representations for transfer in personnel reserve of the vice-chairman of the Committee supervising law-enforcement activities, directors of departments, heads of independent managements of Committee and territorial authorities on the employees who caused a stir on duty or in case of accomplishment of special tasks on the basis of studying and assessment of personal and business qualities and results of their office activities for form according to appendix 1 to these rules.
8. Candidate screen in personnel reserve is made once in three years for transfer.
9. In case of candidate screen for transfer in personnel reserve it is considered:
1) compliance to the qualification requirements provided to the offered position;
2) indicator of competitiveness of the employee;
3) results of assessment of activities of the employee;
4) availability of the corresponding professional training and work experience on expected type of activity;
5) knowledge of the regulatory legal acts regulating activities of categories of the corresponding heads;
6) results of occupational retraining and advanced training;
7) availability of authority and (or) administrative punishment.
10. Transfer of the employee in personnel reserve is performed based on its statement.
11. For the purpose of high-quality selection and preparation of the recommendation of transfer of candidates for personnel reserve the commission on transfer in personnel reserve or to exception of it is created.
12. The structure of the commission on transfer in personnel reserve (further - the commission) affirms:
1) for Committee the order of the chairman of Committee;
2) for territorial authorities the order of heads of territorial authorities.
The commission chairman and her members hold higher position, than the employees who are subject to inclusion in personnel reserve.
13. Commission sessions it is carried out in process of receipt of representations for transfer to personnel reserve and solutions of certifying commission.
14. Personnel service, having considered the arrived materials of candidates for transfer for personnel reserve on compliance to qualification requirements, sends them for consideration to the commission, in time at least in ten calendar days prior to holding meeting.
15. The commission makes the decision open voting and the decision is deemed accepted if the majority of votes from among the members of the commission who were present at meeting voted for it. In case of equality of votes the decision for which the commission chairman voted is deemed accepted.
The secretary of the commission has no right to vote.
The decision of the commission is drawn up by the protocol which is signed by all members of the commission who were present at its meeting and the secretary.
16. Lists of personnel reserve on the corresponding categories of positions affirm the order of the chairman of Committee or the head of territorial authorities on financial monitoring in form according to appendix to these rules.
17. Employees are not enlisted in personnel reserve:
1) before position assignment in case of stay on hand;
2) in the presence of not remitted authority and (or) administrative punishment;
3) to the solution of question of post compliance in case of repeated certification;
4) before the termination of criminal case on the rehabilitating bases;
5) to the introduction in legal force of the verdict of not guilty;
6) before the end of office investigation.
18. The basis for exception of personnel reserve are:
1) occupation of the employee of vacant executive position;
2) the stay expiration in personnel reserve;
3) imposing on the employee of authority punishment for corruption offense, the warning of incomplete office compliance, releases from post or lowering in qualification class on one step;
4) sending out on business of the employee in other law enforcement agency for further service;
5) dismissal from service.
19. The personnel service informs employees of the decision on exception of personnel reserve within five working days from the date of the publication of the order.
20. In case of the employee's disagreement with the decision on exception it from personnel reserve he has the right to appeal this decision to the higher official or in court.
21. By personnel service it is recorded the employees enlisted in personnel reserve or excluded from it by means of the created departmental databank.
22. The departmental databank functions on the basis of the automated information system with use of computer aids, and also by accumulating of documentary materials on paper and electronic media.
23. Information on personnel reserve accumulates in the integrated automated information system E-Ministry of Finance to subsystem "Managements of personnel potential, forming and provision of reports on personnel structure of the Ministry of Finance of the Republic of Kazakhstan" which contains the following information about the employee enlisted in personnel reserve:
1) surname, name, middle name (in case of its availability) the employee;
2) birth date;
3) nationality;
4) post, qualification class;
5) education, scientific degree;
6) length of service in law enforcement agencies;
7) knowledge of foreign languages;
8) the name of divisions in which the employee consists in personnel reserve;
9) category and the name of executive position for which purpose the employee consisting in personnel reserve applies;
10) the term of transfer of the employee in personnel reserve.
24. The personnel service updates departmental databank after each commission session.
