RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

of September 22, 2016 No. 714

Some questions of implementation of infrastructure projects

(as amended on 23-05-2023)

The Cabinet of Ministers of Ukraine decides:

1. Rename the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects on the State agency of infrastructure projects of Ukraine.

2. Ceased to be valid according to the Resolution of the Cabinet of Ministers of Ukraine of 21.02.2023 No. 193

3. To the ministry of infrastructure together with the Ministry of Finance to prepare and submit to the Cabinet of Ministers of Ukraine proposals concerning the expenses necessary for providing the organization of work of the State agency of infrastructure projects.

4. To the ministry of infrastructure together with the State agency of infrastructure projects and Fund of state-owned property to introduce in accordance with the established procedure to the Cabinet of Ministers of Ukraine offers on placement of the State agency of infrastructure projects.

5. To the ministry of infrastructure together with the State agency of infrastructure projects to develop and in accordance with the established procedure to submit to the Cabinet of Ministers of Ukraine the draft of the act of determination of procedure for financing of some infrastructure facilities which preparation was performed within carrying out in Ukraine final part of the European championship of 2012 on soccer, at the expense of the means borrowed according to resolutions of the Cabinet of Ministers of Ukraine of August 18, 2010 No. 766 (The Official Bulletin of Ukraine, 2010, No. 65, by the Art. 2280, No. 94, the Art. 3335), of October 12, 2010 No. 936 (The Official Bulletin of Ukraine, 2010, No. 78, the Art. 2768), of February 16, 2011 No. 104 (The Official Bulletin of Ukraine, 2011, No. 12, the Art. 506), of April 6, 2011 No. 387 (The Official Bulletin of Ukraine, 2011, No. 28, the Art. 1171), of April 25, 2012 No. 347 (The Official Bulletin of Ukraine, 2012, No. 33, the Art. 1232), of November 7, 2012 No. 1034 (The Official Bulletin of Ukraine, 2012, No. 86, the Art. 3510).

6. Permit the State agency of infrastructure projects to allocate part of the funds borrowed according to resolutions of the Cabinet of Ministers of Ukraine of August 18, 2010 No. 766 (The Official Bulletin of Ukraine, 2010, No. 65, of the Art. 2280, No. 94, of the Art. 3335), of October 12, 2010 No. 936 (The Official Bulletin of Ukraine, 2010, No. 78, of the Art. 2768), of February 16, 2011 No. 104 (The Official Bulletin of Ukraine, 2011, No. 12, of the Art. 506), of April 6, 2011 No. 387 (The Official Bulletin of Ukraine, 2011, No. 28, of the Art. 1171), of April 25, 2012 No. 347 (The Official Bulletin of Ukraine, 2012, No. 33, the Art. 1232), of November 7, 2012 No. 1034 (The Official Bulletin of Ukraine, 2012, No. 86, the Art. 3510), for financing of accomplishment of tasks and implementation of actions, the provided appendix 2 to the State target development program of the airports for the period till 2023 approved by the resolution of the Cabinet of Ministers of Ukraine of February 24, 2016 No. 126 (The Official Bulletin of Ukraine, 2016, No. 18, Art. 740.

7. To the ministry of infrastructure together with the State agency of infrastructure projects to develop and approve funding mechanism for accomplishment of tasks and implementation of the actions provided by appendix 2 to the State target development program of the airports for the period till 2023 approved by the resolution of the Cabinet of Ministers of Ukraine of February 24, 2016 No. 126.

8. Provide to the public treasurer service the direction of the means specified in Item 6 of this resolution, to the state company "Financing of Infrastructure Projects" for financing of accomplishment of tasks and implementation of the actions provided by appendix 2 to the State target development program of the airports for the period till 2023 approved by the resolution of the Cabinet of Ministers of Ukraine of February 24, 2016 No. 126, according to the funding plan approved with the Ministry of Finance and the signed agreements.

9. To provide to the ministry of infrastructure together with the State agency of infrastructure projects and the Public treasurer service control of target and effective expenditure of means.

10. Make changes which are applied to resolutions of the Cabinet of Ministers of Ukraine.

11. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine

1. In the Scheme of the direction and coordination of activities of the central executive bodies by the Cabinet of Ministers of Ukraine through the corresponding cabinet ministers of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of September 10, 2014 No. 442 "About optimization of system of the central executive bodies" (The Official Bulletin of Ukraine, 2014, No. 74, the Art. 2105, No. 93, Art. 2685; 2015, No. 24, Art. 664, No. 30, Art. 873, No. 72, Art. 2363, No. 87, Art. 2907, No. 88, Art. 2927; 2016, No. 18, Art. 722, Art. 743):

The Section II to add 1) with the paragraph of the following content:

"The state agency of infrastructure projects of Ukraine";

Item 8 of the Section III to add 2) with the paragraph of the following content:

2. In Regulations on the Ministry of infrastructure of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of June 30, 2015 No. 460 (The Official Bulletin of Ukraine, 2015, No. 54, Art. 1755; 2016, No. 55, Art. 1911):

Item 1 paragraph two after the words "and also provides forming and realization of state policy in the field of the air transportation and use of airspace of Ukraine" to add 1) with words ", developments, constructions, reconstruction and upgrades of air, sea and river transportation";

The subitem 2 of Item 3 after paragraph two to add 2) with the new paragraph of the following content:

"Developments, constructions, reconstruction and upgrades of air, sea and river transportation;".

With respect thereto third - the seventh to consider paragraphs respectively paragraphs chetvertymvosmy;

3) in item 4:

to add the subitem 6 after words of "urban electric transportation" with words ", developments, constructions, reconstruction and upgrades of air, sea and river transportation";

In the resolution of the Cabinet of Ministers of Ukraine of August 18, 2010 No. 766 "About provision in 2010 of the state guarantees according to obligations of the National agency concerning preparation and carrying out in Ukraine final part of the European championship of 2012 on soccer and implementation of infrastructure projects" (The Official Bulletin of Ukraine, 2010, No. 65, the Art. 2280, No. 72, the Art. 2578, No. 94, the Art. 3335):

1) in the name and the text of the resolution of the word "The National Agency concerning Preparation and Carrying Out in Ukraine Final Part of the European Championship of 2012 on Soccer and Implementation of Infrastructure Projects" in all cases shall be replaced with words "The state agency of infrastructure projects" in the corresponding case;

2) according to the procedure and provision conditions in 2010 of the state guarantees according to obligations of the National agency concerning preparation and carrying out in Ukraine final part of the European championship of 2012 and implementation of the infrastructure projects approved by the specified resolution:

in the name of the Procedure and conditions of the word "The national agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 and implementation of infrastructure projects" shall be replaced with words "The state agency of infrastructure projects";

in Item 1 Ukrevroinfraproyekt to replace the word with the word Ukrinfraproyekt;

in the paragraph the second Item 3 to replace the word Ukrevroinfraproyekt with the word Ukrinfraproyekt.

4. In Item 2 of the resolution of the Cabinet of Ministers of Ukraine of October 12, 2010 No. 936 "Questions of implementation of borrowings for financing of projects within accomplishment of the tasks and actions provided by the State target program of preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer" (2010, No. 78, the Art. 2768, No. 94, the Art. 3335) words and figures "The national agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" shall be replaced with words the Official Bulletin of Ukraine "The state agency of infrastructure projects".

5. In the resolution of the Cabinet of Ministers of Ukraine of February 16, 2011 No. 104 "About provision in 2011 of the state guarantees according to obligations of subjects of managing which objects of state-owned property belong to the sphere of management of the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" (The Official Bulletin of Ukraine, 2011, No. 12, of the Art. 506, No. 55, of the Art. 2179, No. 67, of the Art. 2593):

2) according to the procedure and provision conditions in 2011 of the state guarantees according to obligations of subjects of managing which objects of state-owned property belong to the sphere of management of the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of the infrastructure projects approved by the specified resolution:

in the name of the Procedure and conditions of the word "The national agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" shall be replaced with words "The state agency of infrastructure projects";

in Item 1 to replace the word of "Ukrevroinfraproyekt" with the word of Ukrinfraproyekt;

in paragraphs second and third Item 3 to replace the word Ukrevroinfraproyekt with the word Ukrinfraproyekt.

In Item 2 of the resolution of the Cabinet of Ministers of Ukraine of April 6, 2011 No. 387 "Some questions of implementation in 2011 of borrowing for accomplishment of obligations within the tasks and actions provided by the State target program of preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer" (2011, No. 28, the Art. 1171) words and figures "The national agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" shall be replaced with words the Official Bulletin of Ukraine "The state agency of infrastructure projects".

In the resolution of the Cabinet of Ministers of Ukraine of April 25, 2012 No. 347 "Questions of provision in 2012 of the state guarantees for ensuring accomplishment of debt obligations on borrowings of subjects of managing which objects of state-owned property belong to the sphere of management of the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" (The Official Bulletin of Ukraine, 2012, No. 33, of the Art. 1232, No. 68, of the Art. 2777, No. 97, of the Art. 3921):

2) according to the procedure and provision conditions in 2012 of the state guarantees for ensuring accomplishment of debt obligations on borrowings of subjects of managing which objects of state-owned property belong to the sphere of management of the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of the infrastructure projects approved by the specified resolution:

in Item 1 to replace the word of "Ukrevroinfraproyekt" with the word of Ukrinfraproyekt;

in Item 3 to replace the word Ukrevroinfraproyekt with the word Ukrinfraproyekt.

In Item 2 of the resolution of the Cabinet of Ministers of Ukraine of November 7, 2012 "Questions of provision in 2012 of the state guarantees for ensuring accomplishment of debt obligations on borrowings of subjects of managing which objects of state-owned property belong to the sphere of management of the National agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" (The Official Bulletin of Ukraine, 2012, No. 86, of the Art. 3510) of the word and figures "The national agency concerning preparation and carrying out in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" shall be replaced with words No. 1034 "The state agency of infrastructure projects".

9. In the resolution of the Cabinet of Ministers of Ukraine of October 30, 2013 No. 944 "About approval of the Concept of the State target development program of the airports for the period till 2023" (The Official Bulletin of Ukraine, 2014, No. 3, the Art. 63):

1) in the paragraph the second Item 1 of the word "Ministry of Infrastructure" shall be replaced with words "The state agency of infrastructure projects";

2) in the Concept approved by the specified resolution in the Section "Ways and Methods of the Problem Resolution, Term of Accomplishment of the Program":

in paragraph ten to replace the word of Ministry of Infrastructure with the word Ukrinfraproyekt;

the eighteenth to state the paragraph in the following edition:

Item 2 after words to "The ministry of infrastructure" to add 1) with words ", to the State agency of infrastructure projects";

"National preparation and carrying out agency in Ukraine of final part of the European championship of 2012 on soccer and implementation of infrastructure projects" shall be replaced with words 2) in Item 3 of the word "The state agency of infrastructure projects", and the words "Ministries of Infrastructure" - words of "The state agency of infrastructure projects";
