About approval of Changes in some resolutions of NKREKP

According to Item 6 parts three of article 4 of the Law of Ukraine "About the natural gas market", article 14 of the Law of Ukraine "About natural monopolies", to item 4 of the Regulations on the National commission performing state regulation in the field of power and utilities, No. approved by the Presidential decree of Ukraine of September 10, 2014 715, the National commission performing state regulation in spheres of power and utilities decide:

1. Approve Changes in the Code of gas-distribution systems approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2494, registered in the Ministry of Justice of Ukraine on November 6, 2015 at No. 1379/27824, which are applied.

2. Approve Changes in the Rules of supply of gas approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2496, registered in the Ministry of Justice of Ukraine on November 6, 2015 at No. 1382/27827, which are applied.

3. Approve Changes in the Standard agreement of distribution of natural gas approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2498, registered in the Ministry of Justice of Ukraine on November 6, 2015 at No. 1384/27829, which are applied.

4. Bring in the Standard agreement of supply of natural gas to residential customers approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2500, registered in the Ministry of Justice of Ukraine on November 6, 2015 at No. 1386/27831, the following changes:

in the subitem 6 of Item 5.2 of the Section V to replace the word "seven" with the word "twenty";

in line 4 of the column "The Personified Data of the Consumer" of appendix 1 of the word "EIS-code as Subject of the Natural Gas Market, GRM Appropriated by the Operator" shall be replaced with words "the EIS-code appropriated by the Operator of GRM according to requirements of the Code of gas-distribution systems".

5. In paragraph three of Item 2 of the Section IV of Methodology of establishment of payment for accession to gas transmission and gas-distributing systems, the National commission approved by the resolution performing state regulation in spheres of power and utilities, of December 24, 2015 No. 3054, registered in the Ministry of Justice of Ukraine on March 16, 2016 at word No. 396/28526, of "the customer's object" shall be replaced with words "points of measurement (metering station)".

6. To department on regulation of the relations in the oil and gas sphere within two years to perform monitoring of the Section VI of the Code of gas-distribution systems of procedure for determination of size of the attached capacity of object of the consumer provided by Chapter 6 (on which agreement settlements of distribution of natural gas shall be made), proceeding from standard size of commercial VOG.

NKREKP together with the Antimonopoly Committee of Ukraine (under approval) and the Public regulatory service of Ukraine (under approval) in three years after the first establishment of NKREKP of the rates for services of distribution of natural gas calculated taking into account the size of the attached capacity of object of the consumer to perform the comprehensive analysis of the mechanism of determination of size of the attached capacity of object of the consumer and to consider question of feasibility of introduction of amendments to the Code of gas-distribution systems following the results of such analysis.

7. On regulation of the relations in the oil and gas sphere in accordance with the established procedure to provide to department submission of this resolution on state registration in the Ministry of Justice of Ukraine.

8. This resolution becomes effective from the date of its official publication.

Changes in the Code of gas-distribution systems

1. In the Section I:

1) in item 4 of Chapter 1:

add Item after paragraph one with the new paragraph the second the following content:

"Allocation - determination of the actual amount (amount) of natural gas on the consumer's object for certain settlement period according to requirements of the Section VI of this Code;".
