According to the order of the Government of the Republic of Kazakhstan of April 6, 2005 I ORDER to No. 310 "Some questions of the Ministry of Agriculture of the Republic of Kazakhstan":

1. Approve the enclosed Regulations on Committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan.

2. Ceased to be valid according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 04.04.2017 No. 145

3. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) official publication of this order in information system of law of Ad_let;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies;

3) acceptance of other measures following from this order.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective from the date of its signing.

Regulations on Committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan

Chapter 1. General provisions

1. The republican public institution "Committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan" (further - Committee) is the state body and department within competence of the Ministry of Agriculture of the Republic of Kazakhstan (further - the Ministry) performing the strategic, regulating, realizable and control functions in the field of forestry, protection, reproduction and use of fauna and especially protected natural territories assigned to it by the Constitution, the laws, other regulatory legal acts of the Republic of Kazakhstan and this Provision.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is the legal entity subordinated to the Ministry, in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee acts as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

7. The structure, the number of staff of Committee affirms the Responsible secretary of the Ministry of Agriculture of the Republic of Kazakhstan (further - the Responsible secretary) after approval of the Minister of Agriculture (further - the Minister).

8. Legal address of Committee: The Republic of Kazakhstan, Nour-Sultan's city, Esilsky district, Ulitsa Mang_l_k ate 010000,, the house 8, the office building "The house of the ministries".

9. Full name of state body - republican public institution "Committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan".

10. The committee has territorial subdivisions, and also the subordinated organizations according to the list of the territorial subdivisions which are under authority of Committee and the list of the subordinated organizations of Committee according to appendices 1 and 2 to this Provision.

11. This Provision is the constituent document of Committee.

12. Financing of activities of Committee is performed at the expense of means of the republican budget.

13. The committee does not enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are functions of Committee.

If the Committee by legal acts is granted the right to perform the activities which are bringing in incomes, then income gained from such activities go to the income of the government budget.

Chapter 2. Main objectives, functions, rights and obligations of Committee

14. Tasks: accomplishment of strategic, realizable and control functions in the field of forestry, protection, reproduction and use of fauna and especially protected natural territories.

Functions:

1) is performed by ownership and use of the state forest fund within the competence established by the Government of the Republic of Kazakhstan;

2) participates in development of offers on forming of the state forest policy and its realization;

Organizes 3) and provides protection, protection, reproduction of the woods and afforestation, regulates forest utilization in the territory of the state forest fund which is under its functional authority;

4) exercises by checks the state control and supervision of condition, protection, protection, use of forest fund, reproduction of the woods and afforestation;

5) exercises the state control and supervision of accomplishment of actions for protection of the woods against wreckers and diseases, timeliness of the taken measures for the prevention of origin, distribution, accuracy of accounting and forecasting of the centers of wreckers and diseases of the wood, easing and death of plantings from adverse effects of natural, anthropogenous nature;

6) exercises the state control and supervision of withdrawal of cutting areas;

7) exercises the state control and supervision of observance of rules of leave of wood on root and cabins of the wood, other rules of forest utilization on sites of the state forest fund;

8) exercises the state control and supervision of observance of forest seed division into districts, procurement, conversion, storage and use of forest seeds, maintaining nursery economy on sites of the state forest fund;

9) exercises the state control and supervision of use of lands of forest fund according to their purpose and protection of these lands;

10) exercises the state control and supervision of observance of procedure for use of the state forest fund in case of construction works, mining, laying of communications and accomplishment of other works which are not connected with forest management and forest utilization;

11) provides development and approves settlement cutting areas on sites of the state forest fund and age of cabins;

12) is provided by conducting the state accounting of forest fund, the state forest inventory, the state monitoring of the woods and forest management in the territory of the state forest fund;

13) is performed by international cooperation in the field of the forest relations, protection, reproduction, use of fauna, especially protected natural territories, including implementation of international treaties;

14) the report of the head of the structural unit of local executive body of area, city of the republican value, the capital knowing forestry hears and also heads of forest organizations and the nature protection organizations for condition, protection, protection, use of forest fund, reproduction of the woods and afforestation;

Stops 15), limits, stops the forest utilization right on sites of the state forest fund, and also the works constituting danger to condition and reproduction of the woods which are under its authority according to the legislation of the Republic of Kazakhstan;

16) determines the directions of scientific and technical development, organizes scientific research and design and exploration work in the field of protection, protection and uses of forest fund, reproduction of the woods and afforestation, forest selection and forest seed farming;

17) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

Organizes 18) and holds tenders for provision of forest resources in long-term forest utilization on the sites of the state forest fund which are under its authority with participation of representatives of local representative and executive bodies of area, city of republican value, the capital;

19) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

20) considers cases on administrative offenses in the field of the forest legislation of the Republic of Kazakhstan, the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fauna and especially protected natural territories;

21) performs coordination and methodical management of local executive bodies of areas, the cities of republican value, the capital knowing forestry and also forest organizations and the nature protection organizations for protection, protection, use of forest fund, reproduction of the woods and afforestation;

22) approves forest management projects;

23) issues import permits to the Republic of Kazakhstan and export out of its limits of objects of flora, their parts and derivatives, including types of the plants referred to category rare and which are under the threat of disappearance;

Creates 24) according to rules of leave of wood on root on sites of the state forest fund and approves annual amounts of cabins of the wood in the territory of the state forest fund;

25) is approved by forest seed division into districts;

26) provides to forest users sites under construction objects on the lands of the state forest fund which are under its authority where forest resources are provided in long-term forest utilization for the improving, recreational, historical and cultural, tourist and sports purposes; needs of hunting economy; collateral forest use, also approves sketches (outline sketches);

27) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

28) develops base rates for calculation of the extent of the harm done by violation of the forest legislation of the Republic of Kazakhstan;

29) determines requirements to the plans of fire-proof actions developed by forest users in case of long-term forest utilization;

30) exercises the state control of the local executive bodies of areas, the cities of republican value, the capital knowing forestry and which are especially protected by the natural territories;

31) makes the decision on prohibition of cabins of the wood on sites of the state forest fund in case of threat of degradation or death of the woods;

32) performs cross-industry coordination of activities of state bodies in the field of especially protected natural territories;

33) realizes state policy in the field of especially protected natural territories;

34) exercises the state control and supervision of observance of the modes of protection in the woods of especially protected natural territories;

35) makes offers on creation and expansion of especially protected natural territories of republican value, and also transfer of lands of especially protected natural territories to lands of inventory only in the cases established by part two of Item 2 of article 23 of the Law of the Republic of Kazakhstan of July 7, 2006 "About especially protected natural territories" within the competence;

36) is developed by procedure for abolition of the state natural wildlife areas of republican and local value and the state reserved zones of republican value and reduction of their territory;

37) approves the sizes of rates for the services provided by especially protected natural territories of republican value with the status of the legal entity;

Approves 38) natural-science and feasibility statements on creation and expansion of especially protected natural territories of republican value;

39) is approved symbolics (emblem and flag) of the nature protection organization, and also by procedure for development and use of symbolics (emblem and flag) of nature protection organization;

40) approves provisions of the nature protection organizations which are under its authority;

41) approves fishing amounts on the water objects which are part of especially protected natural territories with the status of the legal entity;

42) considers reports of the central and local executive bodies concerning condition, protection, protection, use and financing of especially protected natural territories which are under their authority;

43) will organize project development natural-science and feasibility statements on creation and expansion of especially protected natural territories of republican value which are under its authority, ecological corridors and their approval;

44) performs management of especially protected natural territories which are under its authority, ensuring carrying out their protection, protection and recovery, and also scientific research;

45) will organize scientific activities in especially protected natural territories of republican value;

46) is conducted by the state inventory of especially protected natural territories;

47) is performed by approval of the list of objects of the state natural and reserved fund of local value...;

48) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

49) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

50) issues permissions to implementation of amateur (sports) fishery, meliorative fishing, research fishing, fishing in the reproduction purposes on the water objects which are part of especially protected natural territories with the status of the legal entity based on biological reasons in the presence of the positive conclusion of the state environmental assessment, except for case, stipulated in Item 2 articles 43-1 of the Law of the Republic of Kazakhstan of July 7, 2006 "About especially protected natural territories;

51) exercises the state control and supervision of condition, protection, protection and use of especially protected natural territories and objects of the state natural and reserved fund;

52) is performed by approval of general schemes of the organization of the territory of the Republic of Kazakhstan, interregional schemes of territorial development, complex schemes of town-planning planning and other town-planning documentation mentioning the territories of ecological corridors;

Approves 53) natural-science and feasibility statements on creation and expansion of especially protected natural territories of local value;

54) is performed by approval of management plans especially protected natural territories which are under authority of the central executive bodies;

55) it is excluded according to the Order of the Deputy prime minister of the Republic of Kazakhstan - the Minister of Agriculture of the Republic of Kazakhstan of 25.01.2018 No. 41;

56) is performed by production on cases on administrative offenses within the competence established by the laws of the Republic of Kazakhstan;

57) issues import permits on the territory of the Republic of Kazakhstan and export from the territory of the Republic of Kazakhstan of the animal species falling under operation of the Convention on international trade in the types of wild fauna and flora which are under the threat of disappearance;

58) establishes form of the reporting under certification of the hunter;

Performs 59) and (or) will organize fishing for the purpose of introduction, reintroduction and hybridization, fishing in the reproduction purposes, fishing in zamoroopasny reservoirs and (or) sites, and also performs control fishing;

60) is issued permission to production of introduction, reintroduction, hybridization of animals, and also by use of fauna;

Will organize 61) and (or) provides carrying out scientific research and design and exploration work in the field of protection, reproduction and use of fauna in the territory of two and more areas;

62) will be organized by conducting the state accounting, the inventory and monitoring of fauna;

63) based on scientific recommendations Zamora who will inevitably lead to death of fishes and impossibility of elimination of such threat by carrying out the current fishery melioration of water objects or their parts makes the decision on meliorative fishing of fishes in cases of emergence of threat;

64) realizes state policy in the field of protection, reproduction and use of fauna, and also especially protected natural territories;

65) approves installation of fish-protecting devices of water intaking constructions;

66) establishes quota of withdrawal of objects of fauna for scientific research according to programs of scientific research within limit of withdrawal of objects of the fauna approved by the Government of the Republic of Kazakhstan;

Conducts 67), places and quarterly updates the register of zoological collections on Internet resource;

68) is developed by the list of fishery reservoirs and (or) sites of local value;

69) signs agreements on maintaining fishery and fishery;

70) exercises the state control of observance of procedure of introduction, reintroduction, and hybridization of animals;

71) is checked by activities of users fauna for the purpose of determination of observance of requirements of the legislation of the Republic of Kazakhstan in the field of protection, reproduction and use of fauna;

72) exercises the state control and supervision in the field of protection, reproduction and use of fauna;

73) exercises control of observance of Rules of maintaining hunting, fishery;

74) exercises control of observance of Rules of hunting and fishery;

75) exercises control of observance of standard rates in the field of protection, reproduction and use of fauna;

76) exercises control of observance of procedure for content of animals in bondage or semi-free conditions, and also zoological collections;

77) exercises control over the implementation of actions for protection, reproduction and use of fauna;

78) in case of identification of violations of the law of the Republic of Kazakhstan in the field of protection, reproduction and use of fauna is stopped by activities or make the offer on the prohibition of activities of users fauna according to the procedure established by the legislation of the Republic of Kazakhstan;

79) exercises control over the implementation of terms of the contract by physical persons and legal entities on maintaining hunting and fishery;

80) exercises control of observance of the set restrictions and prohibitions on use of fauna;

81) issues the certificate of catch origin;

82) approves based on biological reasons fishery melioration on the fixed fishery reservoir and (or) the site, the annual adjustment of the fish resources and other water animals this trade inventory which is carried out by users fauna in case of special use;

83) approves decisions of local executive body of area on fixing of hunting grounds and fishery reservoirs and (or) sites;

84) coordinates the feasibility statement and the design estimates developed by the subjects performing the economic and other activity specified in Items 1 and 2 of article 17 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna";

85) is brought by submission to local executive body of area about fixing to physical and non-state legal entities of hunting grounds, and also the fishery reservoirs and (or) sites of local value which are completely located on the parcels of land which are in their private property or temporary land use without carrying out tender according to their request;

86) is approved by the list of the fishery reservoirs and (or) sites of local value exposed on tender on fixing;

87) issues import permits to the Republic of Kazakhstan and export out of its limits of objects of flora, their parts and derivatives, including types of the plants referred to category rare and which are under the threat of disappearance;

Will organize 88) and provides reproduction and the state accounting of fauna in reserve fund of fishery reservoirs and (or) sites and hunting grounds;

89) establishes zones of recreational fishery;

90) is performed by establishment of borders of fishery sites, opening and closings sink (tonevy sites);

91) is approved by movement of all types of water transport with the switched-on engines during the period, forbidden for fishery, on fishery reservoirs and (or) sites, and also in places, forbidden for fishery;

92) take part in development and the forming of statistical methodology according to the procedure established by authorized body;

Prepares 93) and brings according to the procedure, established by the legislation of the Republic of Kazakhstan, the offer on development of technical regulations or changes and (or) amendments in technical regulations, updatings and standardization of regulating documents on standardization;

94) performs preparation of offers on creation of technical committees on standardization, bodies for confirmation of conformity and laboratories on products which are subject to obligatory confirmation of conformity;

95) enables preparation and the realization of plans for development of standards and other documents and their harmonization with the international standards and requirements;

96) is performed by the analysis of scientific and technical level of technical regulations and the standards interconnected with them;

97) performs the organization of works on development of technical regulations and national standards;

98) is performed by participation in development of non-governmental standards;

99) is performed by initiation of development of national standards based on non-governmental standards;

100) makes offers to authorized body on state-owned property by determination of subject and purpose of activities of the republican state company, and also type of the republican state company (on the right of economic maintaining or the state company) performing such activities;

Considers 101), approves, in the cases provided by the Law of the Republic of Kazakhstan of March 1, 2011 "About state-owned property" and approves development plans for the republican state companies and reports on their execution;

102) makes the decision on introduction of restrictions and prohibitions on use of objects of fauna, their parts and derivatives, transfer of fixed terms of use and (or) prohibition on use of fauna objects, establishes places and terms of their use based on the biological reasons issued by the relevant scientific organizations, which are subject to the state environmental assessment;

103) provides information on procedure for rendering the state services in Single contact center concerning rendering the state services;

104) holds competition on fixing of fishery sites of the reservoirs of the international and republican value located in the territory of two and more areas;

105) exercises the state control and supervision of local executive bodies in the field of protection, reproduction and use of fauna;

106) participates in development of professional standards together with National chamber of entrepreneurs, branch associations of employers and branch associations of workers;

Develops 107) and approves forms of acts of officials of the state forest inspection of the Republic of Kazakhstan and the state forest protection of the Republic of Kazakhstan;

108) approves symbolics (emblem and flag) of the forest organization which is under its departmental supervision;

Develops 109) and approves standard regulations on coordination council in case of the state national natural parks;

The committee performs other functions provided by the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

15. Rights and obligations:

1) to enter relations with structural divisions of the Ministry for providing the operational solution of questions of the productive activity entering competence of Committee;

2) to request and receive from other state bodies and officials information, documents and materials necessary for the solution of the questions carried to competence of Committee;

3) to make offers on all questions of the activities;

4) to perform other rights according to the current legislation of the Republic of Kazakhstan.

16. Obligation of Committee is compliance with law of the Republic of Kazakhstan, is right also the interests of physical persons and legal entities protected by the law, including:

1) ensuring availability of standards of the state services;

2) ensuring knowledge of consumers of the state services of procedure for rendering the state services;

3) participation in provision of the relevant information in authorized body on quality evaluation of rendering the state services and control of quality of rendering the state services, authorized body in the field of informatization for evaluating quality of rendering the state services;

4) participation in provision of the relevant information to the non-profit organizations which are carrying out public monitoring in the procedure established by the legislation;

5) consideration of claims and addresses of consumers of the state services.

Chapter 3. Organization of activities of Committee

17. Management of Committee is performed of the chairman of Committee who bears the personal responsibility for accomplishment of the tasks assigned to Committee and implementation of the functions by it.

18. The committee is headed by the chairman appointed to position and dismissed by the order of the Minister of Agriculture of the Republic of Kazakhstan.

19. The chairman of Committee has deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

20. Powers of the chairman of Committee:

1) within the competence signs orders;

Represents 2) to management of the Ministry of the offer on structure and the number of staff of Committee and its territorial subdivisions;

3) appoints to positions and dismisses employees of Committee, heads of the subordinated organizations, branches and representations and their deputies, except vice-chairmen of Committee;

Brings 4) representation to the Responsible secretary of the Ministry about appointment to positions and releases from positions, and also about encouragement and attraction to disciplinary responsibility of heads of territorial subdivisions and their deputies;

5) determines powers of the deputies and heads and deputy managers of territorial subdivisions of Committee, and also approves job descriptions of employees of Committee and heads of the subordinated organizations, branches and representations and their deputies;

6) within the competence takes the measures directed to anti-corruption in Committee and bears the personal responsibility for acceptance of anti-corruption measures;

Encourages 7) and imposes authority punishments on employees of Committee and heads of the subordinated organizations and their deputies, except vice-chairmen of Committee and heads of territorial subdivisions and their deputies;

8) in the procedure established by the legislation resolves issues of sending, provision of leaves, rendering financial support, preparation (retraining), advanced training, encouragement, payment of allowances and awarding of employees of Committee, except vice-chairmen of Committee;

9) in the procedure established by the legislation resolves issues of provision of leaves to heads and deputy managers of territorial subdivisions of Committee, and also heads and their deputies of the subordinated organizations;

10) in the procedure established by the legislation agrees on sending issues (out of limits of the respective area and the abroad), rendering financial support, payment of allowances and awarding to heads and deputy managers of territorial subdivisions of Committee, and also heads and their deputies of the subordinated organizations;

Approves 11) in the procedure established by the legislation preparation (retraining), advanced training, heads and their deputies of the subordinated organizations;

12) is assigned for the period of absence of the head of territorial subdivision of Committee by temporary execution of its obligations to the deputy manager or other employee of territorial subdivision of Committee;

13) approves provisions of the structural divisions and territorial subdivisions which are under authority of Committee and within the competence constituent documents of the subordinated organizations of Committee;

14) approves structure and approves staff lists of the subordinated organizations of Committee;

15) develops offers on forming of state policy in the regulated sphere;

16) determines competence and order of interaction of territorial subdivisions with Committee;

Cancels 17) or stops completely or in part operation of acts of territorial subdivisions and subordinated organizations;

18) is represented by Committee in state bodies and other organizations without power of attorney;

19) performs other powers according to the laws and acts of the President of the Republic of Kazakhstan.

Execution of powers of the chairman of Committee in the period of its absence is performed by person replacing it according to the current legislation.

Chapter 4. Property of Committee

20. The committee can have on the right of operational management the isolated property in cases, stipulated by the legislation.

The property of Committee is created at the expense of the property given it by the owner and also the property (including cash incomes) acquired as a result of own activities and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

21. The property assigned to Committee belongs to republican property.

22. The committee independently does not alienate or otherwise does not dispose of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation.

Chapter 5. Reorganization and liquidation of Committee

23. Reorganization and liquidation of Committee is performed according to the legislation of the Republic of Kazakhstan.
