About approval of Rules, terms of issue and withdrawal of the certificate on assignment of qualification category for specialists in the field of health care, except for specialists in the field of sanitary and epidemiologic wellbeing of the population
According to item 4 of article 176-1 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" I ORDER:
2. To provide to committee of control of medical and pharmaceutical activities of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of regulatory legal acts of the Republic of Kazakhstan of Ad_let;
3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan and the intranet portal of state bodies.
3. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Tsoi A. V.
4. This order becomes effective since October 9, 2015.

1. These rules, terms of issue and withdrawal of the certificate on assignment of qualification category for specialists in the field of health care, except for specialists in the field of sanitary and epidemiologic wellbeing of the population (further – Rules) are developed according to item 4 of article 176-1 of the Code of the Republic of Kazakhstan of September 18, 2009 "About health of the people and health care system" (further – the Code) and determine procedure for assignment of the qualification categories to persons having secondary, postsecondary, higher medical and pharmaceutical education to implementation of professional medical and pharmaceutical activity.
2. In these rules the following concepts are used:
1) the certificate on assignment of qualification category (further – the certificate) – the document confirming assignment of the corresponding qualification category;
2) the official – the head of the organization of health care or person fulfilling the head's duties;
3) the specialist – the worker in the field of health care with medical and pharmaceutical education;
4) assessment of professional readiness and confirmation of conformity of qualification of specialists (further – Assessment) – the assessment procedure of knowledge and skills which is carried out for the purpose of confirmation of conformity of qualification of the specialist to requirements of the professional standard in the field of health care;
5) the applicant – the specialist applying for receipt of the certificate on assignment of qualification category on specific specialty.
3. According to these rules issue of the certificate is carried out for the specialists having average (technical and professional), postsecondary, higher medical, pharmaceutical education, and also the persons which underwent retraining of personnel and (or) acquired postgraduate education, except for specialists of the sphere of sanitary and epidemiologic wellbeing of the population for the purpose of determination of level of their qualification, with assignment of the corresponding qualification category on specific specialty.
4. Reception of applications from applicants and issue of the certificate is performed through the web portal of "the electronic government".
Applicants submit documents for receipt of the certificate not earlier than three months before expiration of the available certificate, or the certificate of the specialist with assignment of qualification category issued till October 9, 2015.
Certificate to the specialist:
with medical education it is issued by the relevant territorial department of Committee of protection of public health of the Ministry of Health of the Republic of Kazakhstan (further - department of Committee) located in the place of the main work of the specialist;
with pharmaceutical education it is issued by the relevant territorial department of Committee of pharmacy of the Ministry of Health of the Republic of Kazakhstan (further - department of Committee of pharmacy) located in the place of the main work of the specialist.
For receipt of the certificate on above the declared category, the specialist is allowed after 3 years from the date of receipt of the existing certificate (the certificate of the specialist with assignment of qualification category).
5. Assignment of qualification category is performed based on positive results of Assessment. Assessment of specialists is carried out according to Item 1 of article 176-1 of the Code.
Persons who received negative result of assessment to receipt of the certificate, are not allowed.
6. The term of issue of the certificate constitutes 5 working days from the moment of delivery of document package specified in Item 9 of these rules the web portal of "the electronic government".
7. The certificate on assignment of qualification category is granted in form according to appendix 1 to these rules in electronic form on specialties, according to the order of the Minister of Health of the Republic of Kazakhstan of November 24, 2009 No. 774 "About approval of the Nomenclature of medical and pharmaceutical specialties" (it is registered in the Register of state registration of regulatory legal acts at No. 5885) (further - the Nomenclature).
Applicants with the higher medical education for receipt of the certificate on specialties, specified in Chapters 1 and 2 of the Nomenclature, except for to specialty "Hygiene and Epidemiology", provide documents confirming completion of training in internship, clinical internship, residency (on the specialties which are not providing the termination of internship, residency - after completion of training in higher educational institution), and (or) cycle of retraining (specialization) in the declared specialty.
Applicants for receipt of the certificate on specialties, the specialties "Hygiene and Epidemiology" specified in Chapters 3 and 4 of the Nomenclature, except for, provide supporting documents average (technical and professional), postsecondary medical education and (or) retrainings (specialization) in the declared specialty, or the higher medical education on specialties "Medical Case", "Pediatrics", "East Medicine", "General Medicine", bachelor degree on specialties "General Medicine", "Nurse business" and (or) advanced training on the declared specialty.
8. The certificate acts on the territory of the Republic of Kazakhstan five years from the date of decision about its issue by the head of department of Committee. After this term the certificate is terminated.
9. For receipt of the certificate the applicant provides the following documents:
the statement in form according to appendix 2 to these rules;
form of data according to appendix 3 to these rules;
result of Assessment on the declared specialty;
the diploma about medical/pharmaceutical education;
the document on the termination of internship, residency, clinical internship on the declared specialty (in case of their availability);
the certificate of retraining on the declared specialty (in the presence);
the certificate on advanced training over the last 5 years on the declared specialty;
the existing certificate, or the certificate of the specialist with assignment of qualification category in the declared specialty (in the presence);
the certificate of the specialist for the admission to the clinical practice, persons who are engaged in clinical practice;
the certificate of recognition and (or) nostrification of education documents, for persons who got medical education outside the Republic of Kazakhstan;
certificates on change of name, middle name (in case of its availability), surnames or about marriage (matrimony) or about annulment of marriage (matrimony), for persons which changed name, middle name (in case of its availability), surname after receipt of education documents.
To the document issued in foreign language the copy of notarized transfer on Kazakh or Russian in addition is provided.
Information on availability of medical/pharmaceutical activities for the declared specialty at the time of filing of application is specified in the form of data, according to appendix 3 to these rules.
10. Criteria of assignment of qualification category in the field of health care:
1) the second qualification category is appropriated to specialists in the presence:
length of service on the declared specialty at least three years, and also implementation of medical activities for the declared specialty at the time of submission of documents;
positive result of assessment of conformity of qualification on the second category;
the document testimonial of advanced training on the declared specialty for the last five years at the time of submission of documents, in total amount of 108 hours, the educations undergone in the scientific organizations and the organizations in the field of health care, including the foreign organizations;
2) the first qualification category is appropriated to specialists in the presence:
length of service on the declared specialty at least six years, and also implementation of medical activities for the declared specialty at the time of submission of documents;
positive result of assessment of conformity of qualification on the first category;
the document testimonial of advanced training on the declared specialty for the last five years at the time of submission of documents, in total amount 162 hours passed in the scientific organizations and the organizations of education in the field of health care including the foreign organizations;
3) the highest qualification category is appropriated to specialists in the presence:
length of service on the declared specialty at least ten years, and also implementation of medical activities for the declared specialty at the time of submission of documents;
positive result of assessment of conformity of qualification on the highest category;
the document testimonial of advanced training on the declared specialty for the last five years at the time of submission of documents, in total amount of 216 hours, the educations undergone in the scientific organizations and the organizations in the field of health care, including the foreign organizations.
In case of response the specialist provides the documents confirming additional passing of professional development course in total amount at least 216 hours on the declared specialty passed after withdrawal of the certificate.
11. For persons which graduated from the highest medical educational institution after 1998 on specialties "Medical Case", "Pediatrics", "General Medicine", and on specialties "East Medicine" and "Stomatology" after 2006, the compulsory provision of the admission to clinical practice is provision of the document on development of the professional training program of internship according to Item 5 of article 21 of the Law of the Republic of Kazakhstan of July 27, 2007 "About education" (further – the Law).
Persons which graduated from the organizations of the higher medical education till 2014 on specialties "Medical Case", "Pediatrics" and "East Medicine" applying for receipt of the certificate on the clinical specialties provided by the Nomenclature and in case of discrepancy of specialty of internship, clinical internship or residency of the declared specialty provide the document on passing of retraining on the declared specialty with indication of training duration in hours according to the Rules of advanced training and retraining of medical and pharmaceutical personnel approved by the order of the Minister of Health of the Republic of Kazakhstan performing obligations of November 11, 2009 No. 691 "About approval of Rules of advanced training and retraining of medical and pharmaceutical personnel and qualification requirements to the organizations realizing programs of additional medical and pharmaceutical education" (registered in the Register of state registration of regulatory legal acts for No. 5904) (further – the order No. 691).
Including to clinical activities till January 1, 2005 and having uninterrupted length of service of work on the declared specialty at the time of submission of documents, passing of retraining on this specialty is not required to persons which started to medical.
For persons which ended training in the organizations of the higher medical education after 2013 applying for receipt of the certificate on the clinical specialties provided in the List of clinical specialties of preparation in residency approved by the order of the Minister of Health of the Republic of Kazakhstan of January 30, 2008 No. 27 "About approval of lists of clinical specialties of preparation in internship and residency" (registered in the Register of state registration of regulatory legal acts for No. 5134) (further – the List of clinical specialties), the compulsory provision of the admission to clinical practice is provision of the document on development of the professional training program of residency according to Item 3 of article 22 of the Law.
12. The persons which graduated from the organizations of secondary medical education and allowed to posts for receipt of the certificate:
1) till January 1, 2005:
in "Nurse business" represent the diploma about secondary medical education in "Nurse business", "Medical case", "Obstetric case", the diploma about the higher education in "Medical case", "Pediatrics", "East medicine", "General medicine", bachelor degree on specialties "General Medicine", "Nurse business", and the document on advanced training in "Nurse business" for the last five years;
in "Medical case" represent the diploma about secondary medical education in "Medical case", "Obstetric case", the diploma on the higher education in "Medical case", "Pediatrics", "East medicine", "General medicine", bachelor degree on specialties "General Medicine", "Nurse business" and the document on retraining or advanced training in "Medical case" for the last five years;
in "Obstetric case" represent the diploma about secondary medical education in "Obstetric case", "Medical case", "Nurse business", the diploma on the higher education in "Medical case", "Pediatrics", "East medicine", "General medicine", bachelor degree on specialties "General Medicine", "Nurse business" and the document on retraining or advanced training in "Obstetric case" for the last five years;
2) till September, 2012 in "Laboratory diagnostics" the certificates allowed to posts for obtaining represent the diploma about secondary medical education in "Laboratory diagnostics", "Obstetric case", "Medical case", "Nurse business", the diploma about the higher education in "Medical case", "Pediatrics", "East medicine", "General medicine", bachelor degree on specialties "General Medicine", "Nurse business" and the document on retraining or advanced training in "Laboratory diagnostics" for the last five years.
13. Persons, with the higher medical education on specialties "Hygiene and Epidemiology", "Stomatology", with secondary medical education on specialties "Nurse Business", "Medical Case", "Obstetric Case", "Laboratory Diagnostics", "Medical technologist", "Hygiene, Sanitation and Epidemiology", "Sanitary Paramedic", "Stomatology", "Dentist", the works on the declared specialty which started medical activities till January 1, 2005 and having uninterrupted length of service at the time of submission of documents, are allowed to receipt of the certificate on the declared specialty.
14. Check of completeness and the correct filling of form of data from the moment of their obtaining is performed within two working days. In case of incomplete submission of documents and data in form according to appendix 3 to these rules, the applicant the motivated answer about the termination of consideration of the application goes.
15. The decision on issue of the certificate is made based on the submitted documents provided in Item 9 of these rules and drawn up by the order of the head of the relevant department of Committee, department of Committee of pharmacy.
16. In case of receipt of the certificate the following is considered:
1) to specialists passing of advanced training on profile specialties is allowed, at the same time the advanced training number of hours on the declared specialty constitutes at least 50% of total amount;
2) in case of break of clinical activities of the applicant, in connection with transition to public service in the field of health care, in length of service on the main specialty it is set off, including the time spent for public service;
3) to the specialists who are independent experts in the field of health care in length of service on profile of specialty the years of service of expert activities are set off from the moment of its accreditation as independent expert;
4) to the specialists who are government employees in the field of health care, working in labor unions (associations) in the field of health care, applying for receipt of category in "public health care / social hygiene and the organization of health care" "health care management" in length of service is set off length of service in the field of health care including in public service, in labor unions in the field of health care;
5) to the specialists the being heads of the medical organizations applying for receipt of category on clinical specialty length of service to positions of the head of the organization, in the presence of length of service on clinical specialty is set off at least three years;
6) to the specialists applying for receipt of the certificate in "nurse business" in length of service on this specialty the labor activity to positions of the paramedic and midwife is set off;
7) to the specialists applying for receipt of the certificate in "general medical practice" in length of service on this specialty the labor activity to positions of the therapist, teenage therapist, pediatrician is set off;
8) to the specialists applying for receipt of the certificate on specialties "therapy" and "pediatrics" in length of service on this specialty the labor activity to positions of the general practitioner is set off;
9) to the specialists who started position of the general practitioner the operating qualification category in "therapy (therapy teenage)", "pediatrics" before the expiration of its action remains;
10) to the specialists applying for receipt of the certificate in "oncology and hematology children's" in length of service on this specialty the labor activity to positions of the doctor on specialties "oncology" and "hematology" is set off.
17. Action of the certificate with assignment of the first, highest category on the corresponding specialty is termless for persons who received the first, highest category three times in a row on the declared specialty.
For receipt of the termless certificate (for permanent term) with assignment of the corresponding qualification category specialists need to submit the following documents:
the statement in form according to appendix 4 to these rules;
form of data according to appendix 5 to these rules;
the certificate on advanced training on the declared specialty for the last five years at the time of submission of documents, in volume of at least 216 hours for specialists with the higher and secondary medical and pharmaceutical education;
copies of earlier granted three equivalent certificates, or certificates with assignment of the first or highest qualification category.
18. The termless certificate with assignment of the highest or first category is issued to specialists in the absence of break between the appropriated categories exceeding 12 months.
The termless certificate with assignment of the first, highest category is issued not earlier than in three months prior to the expiration of the existing certificate, or the certificate of the specialist, but no later than 1 year from the date of expiration of the certificate or the certificate of the specialist, based on the enclosed supporting documents.
19. The basis for refusal in issue of the certificate are:
1) provision by the applicant of negative result of Assessment;
2) not complete and doubtful filling of form of data;
3) discrepancies of documents of the applicant on education (the diploma, the certificate of internship, residency, clinical internship, retraining, advanced training) to the declared specialty;
4) discrepancy of the submitted documents of the applicant on terms of training and in 691 document forms approved by the order on passing of retraining and advanced training;
5) not provision of the documents provided in Item 9 of these rules;
6) discrepancy to criteria of assignment of qualification category, the these rules provided in Item 10.
20. The withdrawal of the certificate is performed by departments of Committee, departments of Committee of pharmacy by results of the state control in the field of health care (further - the state control):
at the official in the presence:
1) at physical persons and legal entities of five and more reasonable addresses on the organization of activities of subjects of health care within one calendar year confirmed with acts of results of check;
2) ten and more cases of occupation clinical practice by specialists of the medical organizations which do not have the certificate of the specialist for the admission to clinical practice (further – the certificate) and (or) licenses for the corresponding type of activity of the organization of health care within one calendar year, by results of the state control;
at the specialist in the presence:
1) from physical persons and legal entities of three and more reasonable addresses on quality of the medical care provided by the specialist within one calendar year confirmed with acts by results of the state control;
2) from physical persons and legal entities of three and more reasonable addresses on quality of the pharmaceutical services provided by the specialist within one calendar year confirmed with acts by results of the state control;
3) identifications of the fact about provision of unreliable information by the specialist in case of receipt of the certificate elicited by results of the state control;
4) implementation of clinical practice by the specialist without certificate availability.
21. The department of Committee, department of Committee of pharmacy which found or obtained information on the cases provided in Item 20 of these rules sends the petition for response to department of Committee, the department of Committee of pharmacy which granted the certificate within thirty working days from the date of identification of such case. The department of Committee, the department of Committee of pharmacy which granted the certificate from the date of receipt of information or the petition for identification of the cases provided in Item 20 of these rules within five working days issues the order (any form) on withdrawal of the certificate.
The department of Committee, the department of Committee of pharmacy which granted the certificate, independently found the cases provided in Item 20 of these rules within thirty working days from the date of identification of such case issues the order (any form) on withdrawal of the certificate.
22. For repeated receipt of the certificate, but not earlier than six months after its response, the specialist provides the documents provided in Item 9 of these rules.
23. Certificates with assignment of qualification category, and also the termless certificates issued to specialists till October 9, 2015 are equated to the certificate with assignment of qualification category and are effective before the expiration of the term specified in them.
24. The applicants who got medical education outside the Republic of Kazakhstan are allowed to receipt of the certificate, after recognition of their education and (or) qualification according to the Rules of recognition and nostrification of education documents approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of January 10, 2008 No. 8 "About approval of Rules of recognition and nostrification of education documents" (it is registered in the Register of state registration of regulatory legal acts No. 5135).
