Rules of calculation and collection of payment for negative impact on the environment;

changes which are made to the Rules of calculation and collection of payment for negative impact on the environment approved by the order of the Government of the Russian Federation of March 3, 2017 No. 255 "About calculation and collection of payment for negative impact on the environment".

2. Recognize invalid decisions of the Government of the Russian Federation according to the list according to appendix.

3. Determine that:

The rules approved by this resolution are applied to the legal relationship which arose since January 1, 2016;

Items 1 - 4, Item 5 except for of the paragraph of the tenth, Item 6 except for of the paragraph of the fifth, Item 7, Items 11 - 12 changes approved by this resolution become effective since January 1, 2019;

Rules of calculation and collection of payment for negative impact on the environment

1. These rules establish procedure for calculation and collection of payment for negative impact on the environment, and also control of correctness of its calculation, completeness and timeliness of its introduction (further respectively - payment, control of calculation of payment).

2. The payment is estimated and levied for the following types of negative impact on the environment:

a) emissions of pollutants in atmospheric air by stationary sources (further - emissions of pollutants);

b) dumpings of pollutants into water objects (further - dumpings of pollutants);

c) storage, waste disposal of production and consumption (further - placement of waste).

3. Features of calculation and collection of payment for emissions of pollutants when burning on torch installations and (or) dispersion of associated petroleum gas are established by the order of the Government of the Russian Federation of November 8, 2012 No. 1148 "About features of calculation of payment for negative impact on the environment in case of emissions in atmospheric air of the pollutants which are formed when burning on torch installations and (or) dispersion of associated petroleum gas" (further - the resolution No. 1148).

4. Control of calculation of payment is exercised by Federal Nature Management Supervision Service and its territorial authorities (further also - the administrator of payment).

5. Payment the legal entities and individual entrepreneurs performing in the territory of the Russian Federation, the continental shelf of the Russian Federation and in exclusive economic zone of the Russian Federation the economic and (or) other activity making negative impact on the environment (further - persons obliged to bring payment), except for shall bring the legal entities and individual entrepreneurs performing economic and (or) other activity only on the objects making negative impact on the environment, the IV categories.

In case of placement of waste, except for solid utility waste, persons obliged to bring payment are legal entities and individual entrepreneurs, when implementing which economic and (or) other activity formed waste.

In case of placement of solid utility waste by persons obliged to bring payment regional operators according to the address with solid utility waste, the operators according to the address with solid utility waste performing activities for their placement are.

6. In case of placement of waste on subjects to placement of the waste excluding negative impact on the environment and determined in accordance with the legislation of the Russian Federation in the field of the address with waste, the payment for placement of waste is not levied.

7. Accounting of persons obliged to bring payment is performed by Federal Nature Management Supervision Service when conducting the state accounting of the objects making negative impact on the environment according to the Federal Law "About Environmental Protection".
