About approval of Rules of training of administrative government employees

(as amended on 28-11-2022)

According to article 36 of the Law of the Republic of Kazakhstan of November 23, 2015 "About public service of the Republic of Kazakhstan" I ORDER:

1. Approve the enclosed Rules of training of administrative government employees.

2. Declare invalid the order of the Minister of cases of public service of the Republic of Kazakhstan of December 29, 2015 No. 17 "About approval of Rules of training of administrative government employees" (registered in the Register of state registration of regulatory legal acts for No. 12648, published on January 15, 2016 in information system of law of Ad_let).

3. And to anti-corruption in the procedure established by the legislation to provide to department of public service of the Agency of the Republic of Kazakhstan for public service:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan" for placement in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan for public service and to anti-corruption.

4. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption supervising questions of public service.

5. This order becomes effective from the date of its first official publication.

Rules of training of administrative government employees

Chapter 1. General provisions

1. These rules of training of administrative government employees are developed according to article 36 of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan" and determine procedure for the organization, passing and summing up training of administrative government employees (further – employees).

2. In these rules the following concepts are used:

1) the directing state body – the state body and its territorial subdivisions sending the employee to state bodies and/or the organizations for passing of training;

2) the accepting state body or the organization – state body or the organization to whom the employee's training is held;

3) training – the activities of the employee out of the place of permanent job directed to acquisition of professional knowledge and practical experience in the corresponding field of activity;

4) the trainee – the employee passing training in state body or other organization for the direction of state body;

5) foreign training – the training performed in the international and foreign organizations;

3. For employees during the period of passing of training the place of employment (the state position) and the salary remains.

The procedure and conditions of expense recovery of the trainee directed to training to other settlement within the Republic of Kazakhstan are determined by the Rules about official journeys within the Republic of Kazakhstan employees of the public institutions containing at the expense of means of the government budget, and also deputies of Parliament of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 22, 2000 No. 1428.

4. Employees with years of service of public service do not go less than 6 (six) months to training.

5. The procedure for the organization, condition and terms of passing of foreign training is determined by the relevant agreement (agreement).

Expense recovery of the trainee directed to training in the international and foreign organizations is performed at the expense of means of the accepting organization if other is not provided by the international treaties ratified by the Republic of Kazakhstan.

6. Employees go to training:

1) from one state body in other state body;

2) from state body in the organization (except for small business entities);

3) in state body:

from central office in territorial subdivisions;

from territorial subdivisions in central office;

from one territorial subdivision in other territorial subdivision.

Chapter 2. Organization and passing of training

7. The directing state body constitutes the plan of training for form, according to appendix 1 to these rules in which the purposes, terms, the place of passing of training, and also the information about the employee (surname, name, middle name (are specified in case of its availability), full name of post with indication of structural division) (further – the plan of training) for each employee directed to training.

The plan of training is developed by the head of the structural unit or person replacing it jointly with the employee directed to training.

In the absence of the head of the structural unit or person replacing him the plan of training is developed by the official having the right of appointment to the state position and releases from the state position or person, replacing it jointly with the employee directed to training.

Concerning the head of the structural unit (person, it replacing) the plan of training is developed by his direct head or the official having the right of appointment to the state position and releases from the state position, jointly with the employee directed to training.

The developed plan of training will be approved with service of personnel management (personnel service) or in case of its absence – structural division (face), to which fulfillment of duties of service of personnel management is assigned (further – service of personnel management), of the directing state body.

The service of personnel management of state body annually sends to structural divisions inquiry for need of plan development of training.

8. The developed plan of training is sent by service of personnel management for approval in state bodies or the organizations in which passing of training is planned.

9. The accepting state body or the organization agrees on possibility of passing of training or refuses approval with indication of cause of failure and offers on their elimination.

The accepting state body considers the plan of training within one month from the date of its receipt.

About the made decision it is reported in the directing state body.

10. In case of elimination of causes of failure taking into account offers of the accepting state body or the organization the plan of training repeatedly goes to the state bodies or the organizations which earlier refused its approval.

The accepting state body or the organization approve the plan of training or, in the presence of the additional bases, refuse approval with indication of cause of failure and offers on their elimination.

11. The approved plan of training affirms the official of the directing state body having the right of appointment to the state position and releases from the state position or person replacing it.

12. In cases of appointment of the employee to other positions, its dismissals, absences from work in connection with temporary disability, stay on social or labor leave, business trip, posting or its directions on retraining, advanced training person who developed the plan of training performs replacement of the employee by other subordinate of the employee to it with modification of the plan of training (regarding surname, name, middle names (in case of its availability) the replaced employee and his position) and the notification of the host party.

In the absence of the candidate for replacement the plan of training is cancelled with the notification of the host party.

13. The training is established for a period of five working days up to one month.

The employee goes to training no more than two times within calendar year.

14. The direction on training of employees is drawn up by the order of the official having the right of appointment to the state position and releases from the state position or person replacing it.

15. In case of absence in the directed draft of the plan of training of specifying for structural division, the service personnel managements of the taking state body or the organization determines one or several structural divisions in which the training will be held what it is reported to the directing state body in case of approval of the plan of training about.

16. The head of the structural unit (person, it replacing) in whom the training is held:

1) advises the trainee;

2) exercises control over the implementation by the trainee of the plan of training and labor discipline;

The service personnel managements of the taking state body or the organization performs coordination behind the organization of training.

17. Duration of day of work for the employees passing training is established according to the labor law.

The fact of absence of the trainee without reasonable excuse within three and more hours in a row in one working day is fixed by service personnel managements of the taking state body or the organization together with the head of the structural unit (person, it replacing) in whom there takes place the training.

Chapter 3. Summing up training

18. The employees who passed training within 5 working days after its completion submit the written report about training results to the official of the sending state body who developed the plan of training.

The written report includes:

1) information on accomplishment of the plan of training;

2) information on the abilities acquired during the training, skills, theoretical and practical knowledge;

3) assessment of the organization of passing of training by the host party.

The officials who developed the plan of training in case of not goal achievement of training and/or omissions for the disrespectful reasons estimate training as unsuccessful and inform service of personnel management of own state body with indication of the reasons for entering into the report.

19. The head of the structural unit (person, it replacing) in whom the training was held, within five working days from the date of completion of training can provide to service personnel managements of the taking state body or the organization response following the results of training on the employee who passed training.

20. The service personnel managements of the taking state body or the organization within ten working days from the date of completion of training sends to the directing state body information on attendance the trainee of training and the copy of response (in the presence) the head of the structural unit (faces, it replacing) in whom the training was held.

The service of personnel management annually sends to authorized body for public service reporting information on passing serving training (including about the employees accepted on training) no later than January 20 of the year following after accounting year in form according to appendix 2 to these rules.

At the same time in case of absence of the employees who passed training (including accepted on training), the specified report does not go.

21. The documents connected with training of employees are stored in service of personnel management of the directing state body at least three years from the date of completion of training.

If technically possible (the corresponding functionality) passing of training is provided by means of the single automated database (information system) on personnel of public service.
