For the purpose of execution of the Law No. 909-XII of January 30, 1992 on social protection of the citizens who were injured owing to the Chernobyl catastrophic crash (repeated publication: The official monitor of the Republic of Moldova, 2004, Art. No. 80-82, 413), with subsequent changes and amendments, DECIDES: the Government

1. Approve Regulations on procedure for appointment and payment of one-time financial support to improvement to persons which were injured owing to the Chernobyl catastrophic crash to persons with limited opportunities concerning which the causal relationship of restriction of opportunities is established with the Chernobyl catastrophic crash and also one-time financial support for improvement to the staff of divisions of extra risk who became persons with limited opportunities it (is applied).

2. The costs connected with payment of one-time financial support on improvement to persons which were injured owing to the Chernobyl catastrophic crash, to persons with limited opportunities concerning which the causal relationship of restriction of opportunities is established with the Chernobyl catastrophic crash and also with payment of one-time financial support for improvement to the staff of divisions of extra risk who became persons with limited opportunities and its administration are performed at the expense of means of the government budget through the budget of the national social insurance.

3. To impose control over the implementation of this resolution on the Ministry of Labour and Social Protection by means of National cash desk of social insurance.

Regulations on procedure for appointment and payment of one-time financial support to improvement to persons which were injured owing to the Chernobyl catastrophic crash, to persons with limited opportunities concerning which the causal relationship of restriction of opportunities is established with the Chernobyl catastrophic crash, and also one-time financial support for improvement to the staff of divisions of extra risk who became persons with limited opportunities

I. General provisions

1. Object of this provision is the procedure for appointment and payment of one-time financial support to improvement, to persons, participants of mitigation of consequences of the Chernobyl catastrophic crash, and according to one-time financial support for improvement (further – one-time financial support) to persons with limited opportunities owing to nuclear testing, radiation accidents and their effects on nuclear objects civil or military.

II. Categories of persons which have the right to one-time financial support

2. The right to one-time financial support is had:

1) persons specified in article 6 of the Law No. 909-XII of January 30, 1992 on social protection of the citizens who were injured owing to the Chernobyl catastrophic crash;

2) persons with limited opportunities from the categories specified in Item 1 of the Order of the Government No. 575 of September 2, 1992. "About provision of privileges to the staff of divisions of extra risk, the patient with radiation sickness or become persons with limited opportunities".

III. Amount of one-time financial support

3. The amount of one-time financial support is determined proceeding from the average monthly salary by the country established for previous year and constitutes:

1) for persons with limited opportunities from the categories specified in article 6 of the Law No. 909-XII of January 30, 1992 and also for persons with the heavy or expressed limited opportunities from the categories specified in Item 1 of the Order of the Government No. 575 of September 2, 1992 – two average monthly salaries over the country;

2) for persons specified in Item 2 of article 6 of the Law No. 909-XII of January 30, 1992 – one average monthly salary over the country;

3) for persons specified in Item 3 of article 6 of the Law No. 909-XII of January 30, 1992 – 50 percent of the average monthly salary on the country;

4) for persons with average limited opportunities from the categories specified in Item 1 of the Order of the Government No. 575 of September 2, 1992 – 1,5 of the average monthly salary over the country.

To persons belonging to two categories of receivers of one-time financial support it is established, on more favorable price, one benefit.

4. The size of the average monthly salary over the country for previous year is calculated National bureau of statistics, and this information is placed on the official web page of organization.

IV. Procedure for purpose of one-time financial support

5. One-time financial support is appointed and paid once a year and not recalculated in year for which it was appointed.

6. The application for initial establishment of one-time financial support is submitted by the applicant personally, or through the legal representative, or through the representative authorized by the power of attorney or by provision of the representative powers containing in the Register of representative powers based on the digital signature to territorial cash desk of social insurance at the place of residence of the applicant.

The following supporting documents in the original and in the copy, proceeding from circumstances are enclosed to the application:

1) the identity certificate confirming nationality of the Republic of Moldova;

2) the certificate confirming participation in recovery from the accident on the Chernobyl NPP;

3) certificate of the employee of divisions of extra risk;

4) the reference issued by National council on establishment of restriction of opportunities and working capacity or its structures;

5) the power of attorney or the document, confirmatory powers of the person for signing of the statement according to the legislation.

7. Assignment or not assignment of extent of restriction of opportunities proves to be true based on the data transferred to National cash desk of social insurance by National council on establishment of restriction of opportunities and working capacity through platform of interoperability (MConnenct).

8. For initial establishment of one-time financial support the statement with the documents specified in Item 6 of this provision moves in territorial cash desk of social insurance at the place of residence of the applicant till December 31 of the corresponding year inclusive. If the statement and necessary documents are filed after December 31 of the current year, one-time financial support this year is not established and not paid.

9. The statement for initial establishment of one-time financial support is registered in territorial cash desk of social insurance in day of submission of all supporting documents specified in Item 6 of this provision.

10. For initial establishment of one-time financial support the statement and supporting documents are considered within 10 working days from the date of registration. If the National bureau of statistics did not place information on the size of the average monthly salary on the country for previous year on the official web page, the term of consideration of the application is estimated from the date of placement of such information.

10-1. One-time financial support is established by repeatedly National cash desk of social insurance in initiative procedure after placement of information on the size of the average monthly salary over the country by National bureau of statistics on the official web page without the need for submission of the new statement. The national cash desk of social insurance annually informs receivers according to the current legislation on establishment of one-time financial support.

10-2. One-time financial support is established also for year in which there came the death of the receiver.

11. The decision on appointment or on refusal in purpose of one-time financial support is accepted by the chief of territorial cash desk of social insurance.

12. The motivated decision on refusal in provision of one-time financial support is brought to the attention of the applicant according to the legislation within 5 working days from the date of its acceptance and shall contain procedure for its appeal.

13. The statement for establishment of one-time financial support with all documents attached to it, including the decision of territorial cash desk of social insurance, is stored in the personal record of the receiver.

V. Payment procedure of one-time financial support

14. Payment of one-time financial support is performed by means of the payment method chosen by the receiver and available within government electronic payment service (MPay). Accounting of payments of one-time financial support is performed by National cash desk of social insurance.

15. The amounts of one-time financial support which are not paid in time because of body which establishes or pays one-time financial support, are paid without restrictions.

16. To persons living in the centers of placement for aged and persons with limited opportunities (adults), one-time financial support is paid in full.

17. Payment of one-time financial support during imprisonment does not stop. It is transferred into personal account of the prisoner in penal institution.

18. The one-time financial support unclaimed in connection with the death of the receiver, is paid including in year in which the beneficiary died to the spouses/spouses who did not enter repeated scrap, his children, and in case of lack of those - to person which provided proofs that it incurred expenses on burial.

19. If the receiver of one-time financial support left on permanent residence of the country, the established one-time financial support is paid including for year of removal from accounting.

23. Payment of the one-time financial support established and not received by the receiver within 3 months in a row stops.

Payment of one-time financial support is resumed based on the statement of the receiver or the legal representative, or the representative authorized by the power of attorney or by provision of the representative powers containing in the Register of representative powers based on the digital signature, and the identity document of the applicant which moves in territorial cash desk of social insurance at the place of residence, and no more than three years preceding month of the address, but not earlier than month of suspension are performed in retroactive procedure for the period.

VI. Procedure for appointment and payment of one-time financial support to persons, convicts and prisoners in penal institutions

25. For initial establishment of one-time financial support by the convict or to persons containing in penal institutions, the administration of penal institution on their request completes the statement and necessary documents specified in Item 6 of this provision, provided by the convict or person containing in penal institution certifies its signature on the statement and within 5 days sends document package to territorial cash desk of social insurance in the location of penal institution.

26. Payment of one-time financial support to persons, convicts or prisoners in penal institutions, prekrayoshchatsya at the place of residence and is transferred into the current account of this person as the means which are temporarily in use of penal institution which contains person.

27. If the condemned person is transferred to other penal institution, the amounts which are saved up on personal account of the condemned person in the first penal institution are transferred into its personal account opened in penal institution where this person was translated with the notice of National cash desk of social insurance on the made transfers.

28. After release payment of one-time financial support in penal institution stops and resumed body of social insurance at the place of residence from the date of the termination based on the statement, the certificate of release issued by penal institution and the reference confirming payment of one-time financial support by organization.

29. In case of the death of the convict – the receiver of one-time financial support the administration of penal institution reports about it to territorial cash desk of social insurance within 10 days from the date of death. In case of the death of the convict - the receiver of one-time financial support, the half-received amounts of this help are transferred from its personal account to the account of National cash desk of social insurance.

VII. Procedure for financing and reporting

30. The Ministry of Finance monthly lists to National cash desk of social insurance the money intended for payment of one-time financial support.

33. The national cash desk of social insurance transfers into the current account for the financial resources going temporarily into the disposal of penal institutions, money for payment of one-time financial support which shall be distributed on current accounts of prisoners. The administration of penal institution distributes the amounts which arrived in this respect on current accounts of prisoners.

34. Penal institutions to the 4th following reporting submit to National cash desk of social insurance reports on the amounts of one-time financial support received and distributed on current accounts of prisoners.

VIII. Final provisions

35. Responsibility for correctness of appointment and timely payment of one-time financial support are born by National cash desk of social insurance and territorial cash desks of social insurance according to the legislation.

36. Responsibility for proper use and of the budgetary funds allocated for payment of one-time financial support is born at the scheduled time by ranking officers of National cash desk of social insurance and the payment service provider according to the legislation.

37. Ceased to be valid according to the Order of the Government of the Republic of Moldova of 26.09.2023 No. 719

38. Protest of the decisions issued by territorial cash desk of social insurance is performed according to the legislation.

39. Control of correctness of appointment and use according to purpose of the allocated financial resources is performed by authorized regulatory authorities.
