About approval of Changes in some resolutions of NKREKP

According to provisions of article 4 of the Law of Ukraine "About the natural gas market" and article 17 of the Law of Ukraine "About the National commission performing state regulation in the field of power and utilities" the National commission performing state regulation in spheres of power and utilities decides:

1. Approve Changes in the Code of gas storages approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2495, registered in the Ministry of Justice of Ukraine on November 6, 2015 at No. 1380/27825, which are applied.

2. Make changes to the Standard agreement of storage (downloading, selection) gas approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of September 30, 2015 No. 2499, registered on November 6, 2015 for No. 1385/27830, having been reworded as follows it which is applied the Ministry of Justice of Ukraine.

3. Approve Changes in the Technique of determination and calculation of rates for custodial services (downloadings, selection) gas from gas storages in which the mode of regulated access is applied, approved by the resolution of the National commission performing state regulation in spheres of power and utilities, of June 13, 2016 No. 1131, registered in the Ministry of Justice of Ukraine on July 26, 2016 at No. 1035/29165, which are applied.

4. To the operator of gas storages till August 1, 2017 to post the online program of calculation of curves of downloading and gas offtake on the website.

5. This resolution becomes effective from the date of, its publication following behind day in the official printing publication - the Pravitelstvenny Kuryer newspaper.

Changes in the Code of gas storages

1. In the Section I:

1) in Item 3 of Chapter 1:

after paragraph one to add with new paragraphs second and third the following content:

"Administration of transfer of the natural gas which is stored in storages process of introduction by the operator of gas storages of data on transfer of the natural gas which is stored in storages, from one customer to other customer, providing reduction of amount of natural gas on the account of storage of the customer transferring gas, and increase in amount of natural gas on the account of storage of the customer which accepts natural gas;

administration of transfer of the distributed capacity - process of introduction by the operator of gas storage of data on right to use transition by service of annual capacity of storage (downloading, selection) gas from one customer to other customer who is performed according to the procedure determined by this Code;".

With respect thereto paragraphs two - to consider the thirty seventh respectively paragraphs the fourth - the thirty ninth;

to state the paragraph of the sixth and seventh in the following edition:

"Basic season of downloading - period of time during which the customer uses capacity of downloading and which begins from first gas days of April and comes to an end with the last gas days of September. The basic season of downloading can be reduced by the neutral periods, at the same time full implementation of service is guaranteed to customers with the distributed guaranteed capacity of downloading within annual capacity;

basic season of selection - period of time during which the customer uses capacity of selection and which begins from first gas days of October and comes to an end with the last gas days of March;";

after the paragraph of the eighth to add with new paragraphs the ninth - the eleventh the following content:

"Free capacity of selection - part of capacity of selection which right to use is not granted to customers according to the signed agreements of storage (downloading, selection) gas and available to distribution between customers;

free capacity of downloading - part of capacity of downloading which right to use is not granted to customers according to the signed agreements of storage (downloading, selection) gas and available to distribution between customers;

free working amount - part of active amount of gas which right to use is not granted to customers according to the signed agreements of storage (downloading, selection) gas and available to distribution between customers;".

With respect thereto the ninth - the thirty ninth to consider paragraphs respectively paragraphs the twelfth - the forty second;

the fifteenth to state the paragraph in the following edition:

"The agreement of storage (downloading, selection) - the agreement signed between the operator of gas storage and the customer on the basis of the standard agreement of the storage (downloading, selection) approved by the Regulator according to which the operator of gas storage provides to the customer custodial services (downloadings, selection) for the period and on the conditions determined in such agreement and the customer pays to the operator of gas storage the cost of the received services;".

after the paragraph of the sixteenth to add with the new paragraph the seventeenth the following content:

"Substitution - process of virtual downloading or selection of natural gas from gas storage which happens by documentary registration;".

after the paragraph of the twentieth to add with the new paragraph the twenty first such content:

"Individual services - right of access of the customer to capacity of downloading (for month and/or for the days ahead), capacities of selection (for month and/or for the days ahead), working amount (for month) in the form of separate services;".

after the paragraph of the twenty fourth to add with the new paragraph the twenty fifth the following content:

"The minimum obligatory amount - the minimum amount of custodial services (downloading, selection) which is determined by the customer in the request for distribution of capacity and to which the customer agrees to reduce the declared amount in case the operator of gas storage satisfies requests for distribution of capacity in proportion to the declared amounts specified in requests;".
