About introduction of amendments to some acts of the Cabinet of Ministers of Ukraine concerning activities of the Department of Energy and environment protection

The Cabinet of Ministers of Ukraine decides:

Bring in acts of the Cabinet of Ministers of Ukraine concerning activities of the Department of Energy and environment protection of change which are applied.

Approved by the resolution of the Cabinet of Ministers of Ukraine of December 4, 2019 No. 1065

Changes which are made to acts of the Cabinet of Ministers of Ukraine concerning activities of the Department of Energy and environment protection

1. In Item 7 of the Regulations on monitoring of lands approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 1993 No. 661 (ZP of Ukraine, 1994, No. 1, Art. 5; The Official Bulletin of Ukraine, 2019, No. 69, of the Art. 2397) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

2. In the text of the Regulations on procedure for maintaining the state inventory of the fauna approved by the resolution of the Cabinet of Ministers of Ukraine of November 15, 1994 No. 772 (ZP of Ukraine, 1995, No. 1, Art. 27; The Official Bulletin of Ukraine, 2013, No. 82, of the Art. 3041) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

3. In Item 2 of the resolution of the Cabinet of Ministers of Ukraine of December 12, 1994 No. 827 "About approval of lists of minerals of nation-wide and local value" (ZP of Ukraine, 1995, No. 2, Art. 42; Official Bulletin of Ukraine, 2004, No. 25, Art. 1650; 2011, 79, the Art. 2916) words to "The Ministry of Ecology and Natural Resources, the Ministry of Economic Development and Trade" shall be replaced with words No. "To Department of Energy and environment protection, to the Ministry of development of economy, trade and agricultural industry".

4. In item 4 of the Regulations on procedure for the establishment of quotas for production of separate types of minerals approved by the resolution of the Cabinet of Ministers of Ukraine of December 22, 1994 No. 862 (ZP of Ukraine, 1995, No. 3, Art. 54; 1996, No. 5, Art. 154; Official Bulletin of Ukraine, 2000, No. 40, Art. 1687; 2006, No. 22, the Art. 1635) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

5. According to the procedure of the state accounting of fields, inventories and shows of minerals, No. 75 approved by the resolution of the Cabinet of Ministers of Ukraine of January 31, 1995 (ZP of Ukraine, 1995, No. 4, Art. 99; Official Bulletin of Ukraine, 2004, No. 51, Art. 3345; 2006, No. 22, Art. 1635):

The word Minstat to replace 1) in Item 15 with the word Gosstat;

The word "Gosnadzorokhrantruda" to replace 2) in Items 17 and 19 with the word "Gostruda";

The word of Ministry for Protection of the Environment and Natural Resources to replace 3) in the text of the Procedure with the word of Minekoenergo.

6. In paragraphs second and third Item 2 of the Regulations on pioneers of mineral deposits approved by the resolution of the Cabinet of Ministers of Ukraine of February 1, 1995 No. 80 (ZP of Ukraine, 1995, No. 4, Art. 102; The Official Bulletin of Ukraine, 2013, No. 40, of the Art. 1426) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

7. In the text of Health regulations in the woods of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 27, 1995 No. 555 (ZP of Ukraine, 1995, No. 10, Art. 253; The Official Bulletin of Ukraine, 2016, No. 87, of the Art. 2839) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

8. In Item 5 of the Procedure for receipt of the admission (certificate) on the right of the work connected with transportation, storage, application and trade in pesticides and agrochemicals, the Cabinet of Ministers of Ukraine approved by the resolution of September 18, 1995 No. 746 (ZP of Ukraine, 1996, No. 2, Art. 38; Official Bulletin of Ukraine, 2009, No. 3, Art. 82; 2019, No. 90, the Art. 3000) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

9. In Item 6 of the Procedure for the state accounting of the availability and use of pesticides and agrochemicals approved by the resolution of the Cabinet of Ministers of Ukraine of November 2, 1995 No. 881 (ZP of Ukraine, 1996, No. 3, Art. 90; The Official Bulletin of Ukraine, 2011, No. 61, of the Art. 2439) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

10. In the text of the Temporary procedure for the collection of payment for special use of wild animals approved by the resolution of the Cabinet of Ministers of Ukraine of January 25, 1996 No. 123 (ZP of Ukraine, 1996, No. 6, Art. 195; The Official Bulletin of Ukraine, 2004, No. 24, of the Art. 1588) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

11. In the text of the Procedure for providing the bodies exercising the state control of use of pesticides and agrochemicals, standard samples of pesticides and agrochemicals, techniques of the determination of their residual quantities approved by the resolution of the Cabinet of Ministers of Ukraine of February 19, 1996 No. 228 (ZP of Ukraine, 1996, No. 7, Art. 226; Official Bulletin of Ukraine, 2004, No. 24, Art. 1588; 2011, No. 61, the Art. 2439) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo, and the word "Gosvetfitosluzhba" in all cases - the word "Gosprodpotrebsluzhba" in the corresponding case.

12. According to the procedure of provision of the import permit on customs area of Ukraine of the unregistered pesticides and agrochemicals used for carrying out the state testing and scientific research, and also the seed (landing) material processed by them, No. 288 approved by the resolution of the Cabinet of Ministers of Ukraine of March 4, 1996 (ZP of Ukraine, 1996, No. 8, Art. 250; Official Bulletin of Ukraine, 2008, No. 68, Art. 2271; 2018, No. 92, the Art. 3061) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

13. In the paragraph the second Item 6 of the Procedure for maintaining the state water inventory approved by the resolution of the Cabinet of Ministers of Ukraine of April 8, 1996 No. 413 (ZP of Ukraine, 1996, No. 10, Art. 292; The Official Bulletin of Ukraine, 2017, No. 46, of the Art. 1428) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

14. In the resolution of the Cabinet of Ministers of Ukraine of March 27, 1996 No. 354 "About approval of the Procedure for withdrawal, utilization, destruction and neutralization of the unsuitable or prohibited to use pesticides and agrochemicals and container from them" - with the changes made by resolutions of the Cabinet of Ministers of Ukraine of May 7, 2008 No. 433 (The Official Bulletin of Ukraine, 2008, No. 34, the Art. 1144) and of August 10, 2011 No. 853 (The Official Bulletin of Ukraine, 2011, No. 61, the Art. 2439):

1) in Item 2 of the resolution of the word of "Ministry of Ecology and Natural Resources" shall be replaced with words "Energy ministries and environment protection";

2) according to the procedure of withdrawal, utilization, destruction and neutralization of the unsuitable or prohibited to use pesticides and agrochemicals and container from them, approved by the specified resolution:

state Item 1 in the following edition:

"1. The unsuitable or prohibited to use pesticides and agrochemicals and container from them which are recognized as those on the basis of results of researches of scientific institutions which conduct toksikologo-hygienic (medicobiological) researches of pesticides and agrochemicals, certain Gosprodpotrebsluzhboy are subject to withdrawal, utilization, destruction and neutralization.";

in Item 3:

in paragraph one to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo;

in the paragraph the second "The agency of state property" shall be replaced with words words "Fund of state-owned property", and the word of Ministry of Emergency Situations - the word "GSChS".

15. In the paragraph the second Item 5 and in paragraph one of Item 13 of the Procedure for determination of the sizes and borders of the water protection zones and the mode of the conducting economic activity in them approved by the resolution of the Cabinet of Ministers of Ukraine of May 8, 1996 No. 486 (ZP of Ukraine, 1996, No. 10, Art. 318; Official Bulletin of Ukraine, 2002, No. 4, Art. 136; 2012, No. 22, Art. 834, No. 81, Art. 3283; 2017, No. 100, the Art. 3082) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

16. In the text of the Procedure for development of standard rates of the maximum permissible dumping of pollutants into water objects approved by the resolution of the Cabinet of Ministers of Ukraine of September 11, 1996 No. 1100 (ZP of Ukraine, 1996, No. 17, Art. 490; Official Bulletin of Ukraine, 2002, No. 4, Art. 136; 2012, No. 81, Art. 3283; 2018, No. 7, the Art. 265) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

17. According to the procedure of creation of passports of the rivers, No. 347 approved by the resolution of the Cabinet of Ministers of Ukraine of April 14, 1997 (The Official Bulletin of Ukraine, 1997, No. 16, Art. 80; 2012, 22, Art. 834):

1) in the paragraph the second Item 3:

to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo, and the word "and Ukrvodproyekt institute to exclude;

 Item 6 to exclude 2).

18. In paragraph three of Item 11 and in the subitem "an" of Item 58 of the Procedure for maintaining the State ship register of Ukraine and the Ship book of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of September 26, 1997 No. 1069 (The Official Bulletin of Ukraine, 1997, No. 40, p. 24; 2004, No. 30, the Art. 2016) to replace the word "Minagropolitiki" with the word of Minekoenergo.

19. In the text of the Regulations on the state monitoring system of the environment approved by the resolution of the Cabinet of Ministers of Ukraine of March 30, 1998 No. 391 (The Official Bulletin of Ukraine, 1998, No. 13, Art. 495; 2004, No. 25, Art. 1650; 2013, No. 82, the Art. 3041) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

20. In item 4 of the Regulations on the State fund of protection of the surrounding environment approved by the resolution of the Cabinet of Ministers of Ukraine of May 7, 1998 No. 634 (The Official Bulletin of Ukraine, 1998, No. 19, Art. 692; 2006, No. 15, Art. 1080; 2010, No. 70, Art. 2511; 2011, No. 71, Art. 2689; 2012, No. 73, Art. 2938; 2014, No. 77, Art. 2188):

The second words "Minister of Ecology and Natural Resources" shall be replaced with words 1) in the paragraph "The Minister of Energy and environment protection";

The word of Ministry for Protection of the Environment and Natural Resources to replace 2) with the word of Ministry of Energy.

21. According to the procedure of implementation of amateur and sports fishery, No. 1126 approved by the resolution of the Cabinet of Ministers of Ukraine of July 18, 1998 (The Official Bulletin of Ukraine, 1998, No. 29, Art. 1099; 2011, No. 93, Art. 3374):

Item 3 in paragraph four the word "Minagropolitiki" to replace 1) with the word of Minekoenergo;

Paragraph one of Item 9 to state 2) in the following edition:

"9. Requirements concerning implementation of amateur and sports fishery and use of tools and methods of fishing (production), regulations, the prohibited places and its terms are established by rules of amateur and sports fishery by the basseyno-territorial principle (further - rules of fishery) which affirm Minekoenergo on representation Gosrybagentstva.";

The word of Ministry for Protection of the Environment and Natural Resources to replace 3) in the subitem 2 of Item 11 with the word of Minekoenergo.

In the text of the Regulations on boundary regime approved by the resolution of the Cabinet of Ministers of Ukraine of July 27, 1998 No. 1147 (The Official Bulletin of Ukraine, 1998, No. 30, Art. 1127; 2019, No. 90, the Art. 3000) to replace the word of Ministry of Economics with the word of Minekoenergo.

23. In paragraph four of Item 10 and Item 17 of the Procedure for maintaining the register of objects of the education, processing and waste recycling approved by the resolution of the Cabinet of Ministers of Ukraine of August 31, 1998 No. 1360 (The Official Bulletin of Ukraine, 1998, No. 35, Art. 1307; 2013, No. 82, the Art. 3041) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

24. In paragraph three of Item 3 of the legal regime of zones of sanitary protection of water objects approved by the resolution of the Cabinet of Ministers of Ukraine of December 18, 1998 No. 2024 (The Official Bulletin of Ukraine, 1998, No. 51, Art. 1890; 2012, No. 77, the Art. 3120) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.

25. In the paragraph the second Item 6 of the Procedure for conducting exploration works at the expense of means of the government budget approved by the resolution of the Cabinet of Ministers of Ukraine of January 25, 1999 No. 83 (The Official Bulletin of Ukraine, 1999, No. 4, Art. 137; 2006, No. 11, Art. 717; 2009, No. 17, the Art. 533) to replace the word of Ministry for Protection of the Environment and Natural Resources with the word of Minekoenergo.
