About enhancement of the controling mechanism system changes of normative legal regulation of business activity "Transformation of business climate"

The government of the Russian Federation decides:

1. Approve Rules of preparation and execution of actions plans ("road maps") of realization of the controling mechanism by system changes of normative legal regulation of business activity "Transformation of business climate".

2. Declare invalid the order of the Government of the Russian Federation of August 10, 2019 No. 1042 "About approval of Rules of implementation of the actions plan "Transformation of Business Climate" (The Russian Federation Code, 2019, No. 34, the Art. 4879).

3. Rules of preparation and execution of actions plans ("road maps") of realization of the controling mechanism system changes of normative legal regulation of business activity "Transformation of business climate"

1. These rules determine procedure for forming, implementation of monitoring and control of execution of actions plans ("road maps") of realization of the controling mechanism system changes of normative legal regulation of business activity "Transformation of business climate" (further - plans).

Plans provide realization by the Government of the Russian Federation and federal executive bodies of actions for enhancement of the regulatory legal base for the purpose of removal of regulatory barriers when implementing business activity, assistance to acceleration of growth rates of investments into domestic economy and improvements of business climate in the Russian Federation.

2. Plans are subject to approval by orders of the Government of the Russian Federation in the separate priority directions (spheres of regulation).

The priority directions (the sphere of regulation) in which plans are developed and affirm are determined by Government Commission on Economic Development and Integration (further - Government commission) by representation of the Ministry of Economic Development of the Russian Federation.

3. Government commission for each priority direction (the sphere of regulation) determines by representation of the Ministry of Economic Development of the Russian Federation:

the federal executive body responsible for plan development, and also for coordination of actions of executives in charge and collaborators of actions of plans for achievement of the expected results (further - the coordinator);

The Deputy Prime Minister of Russia on whom control of implementation of plans will be imposed;

terms of development and submission to Government of the Russian Federation of the corresponding plan;

the head and members of the expert group created for the purpose of the expert maintenance of development of the corresponding plan and implementation of actions provided by the plan (further - expert group).

Expert groups are headed by the representative of entrepreneurial community and created of representatives of coordinators at the level not below the deputy minister - for the federal ministries and the head - for the Federal Services and federal agencies, representatives of the federal executive bodies responsible for plan implementation of actions (further - contractors), at the level of the deputy minister or the head of the structural unit - for the federal ministries and the deputy manager - for the Federal Services and federal agencies, the all-Russian public organizations of subjects of business activity, scientific, public and other organizations.

4. Forming of the draft of the plan is performed by the coordinator according to the methodical recommendations about forming and execution of plans approved by Government commission (further - methodical recommendations), and based on the proposals of expert group, the Ministry of Economic Development of the Russian Federation interested federal executive bodies, public authorities of subjects of the Russian Federation and other interested persons.

Expert groups perform discussion of offers on forming of the plans with involvement of the Ministry of Economic Development of the Russian Federation interested federal executive bodies, public authorities of subjects of the Russian Federation and the organizations and also represent results to the Ministry of Economic Development of the Russian Federation and to the corresponding coordinator.

5. The coordinator provides preparation and entering into the Government of the Russian Federation approved with contractors, the Ministry of Economic Development of the Russian Federation and expert group of the draft of the order of the Government of the Russian Federation about approval of the plan for form according to appendix. As a part of materials data on consideration of the plan by expert group, including on the offers on contents of the plan supported by expert group, but not included developer in the draft of the plan are attached to the draft of the order of the Government of the Russian Federation.

The draft of the order of the Government of the Russian Federation about approval of the plan and (or) about entering of changes into it is subject to consideration at meeting with the Deputy Prime Minister of Russia on whom control of implementation of the plan, with participation of the coordinator, contractors, the Ministry of Economic Development of the Russian Federation and the head of expert group, including for the purpose of removal of disagreements according to the draft of the order of the Government of the Russian Federation will be imposed.

6. After approval of plans contractors enable implementation of actions according to the terms provided by plans.

7. The draft of the legal act developed in pursuance of the plan goes the contractor to expert group to the conclusion about act compliance to the expected result specified in the plan.

8. The contractor represents the draft of the act prepared in pursuance of the plan to the Government of the Russian Federation in accordance with the established procedure with appendix of the conclusion of expert group about act compliance to the expected result.

In case of the positive conclusion of expert group assessment of the regulating impact concerning the draft of the act is not carried out.

9. After adoption of the legal act developed in pursuance of the plan, the contractor sends it to expert group and the Ministry of Economic Development of the Russian Federation.

10. Confirmation of execution of the relevant activity of the plan is performed by expert groups and the Ministry of Economic Development of the Russian Federation according to methodical recommendations.

Settlement of disagreements regarding results of execution of actions of plans is provided at meetings with Deputy Prime Ministers of Russia at which control of implementation of plans is imposed.

11. Contractors provide monthly, to the 15th, in the module on management of implementation of plans of the state automated information system "Management" input and updating of information on the course of realization of the relevant activities of plans which is signed by the strengthened qualified digital signature of the head (deputy manager) or other authorized person.

12. The Ministry of Economic Development of the Russian Federation performs monitoring of implementation of plans and quarterly, to the 20th following reporting quarter represents reports on the course of implementation of plans to the Government of the Russian Federation, and also 2 times a year report on results of execution of plans at meeting of the Government of the Russian Federation at least.

13. General coordination of the controling mechanism system changes of normative legal regulation of business activity "Transformation of business climate" is provided with Government commission.

The presidium of Government commission provides operational monitoring of the course of implementation of plans.

Coordination of activities of coordinators, the contractors interested federal executive bodies, the organizations and expert groups on questions of implementation of plans is performed by the Ministry of Economic Development of the Russian Federation.

14. Monitoring of law enforcement of the separate acts adopted in pursuance of plans is performed according to methodical recommendations.

15. In case of execution of 80 percent of actions plans are subject to updating according to the decision of presidium of Government commission.

Coordinators provide preparation and submission to the Government of the Russian Federation of drafts of the orders of the Government of the Russian Federation providing amendment of the plans new actions approved with the Ministry of Economic Development of the Russian Federation, the interested federal executive bodies and expert groups.

16. Preparation of drafts of orders of the Government of the Russian Federation about modification of plans, including regarding exception of actions, is provided with the coordinators based on proposals of expert groups and contractors in coordination with the Ministry of Economic Development of the Russian Federation interested in federal executive bodies and expert groups.

17. The decision on realization of such actions according to the procedure, by the provided these rules or the Regulations on the organization of project activities in the Government of the Russian Federation approved by the order of the Government of the Russian Federation of October 31, 2018 No. 1288 "About the organization of project activities in the Government of the Russian Federation" is made on actions of the plans having the expected result similar to the result specified in passports of national projects and passports of federal projects project committee on the corresponding national project.

Concerning actions of the plans having the expected result similar to the result specified in actions plans ("road maps") on enhancement of the legislation and elimination of administrative barriers for the purpose of ensuring realization of the National technological initiative Government commission on upgrade of economy and innovative development of Russia the decision on realization of such actions according to the procedure, No. 1184 provided by these rules or the order of the Government of the Russian Federation of September 29, 2017 "On procedure for development and implementation of actions plans ("road maps") on enhancement of the legislation and elimination of administrative barriers for the purpose of ensuring realization of the National technological initiative and introduction of amendments to some acts of the Government of the Russian Federation" is made.

18. Control of adherence to deadlines of implementation of plans is exercised by structural division of the Russian Government Office to which sphere of maintaining questions of the organization of control of execution of acts and orders of the Government of the Russian Federation belong.
