About introduction of amendments to some acts of the Government of the Russian Federation concerning implementation of purchases of goods, works, services for ensuring the state and municipal needs and purchases of goods, works, services with separate types of legal entities

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning implementation of purchases of goods, works, services for ensuring the state and municipal needs and purchases of goods, works, services with separate types of legal entities.

2. Provisions of Items 1 and 3 of the changes approved by this resolution are applied to purchases, notices on which implementation are placed in unified information system in the field of purchases or invitations to take part in which are sent after January 1, 2021.

3. Provisions of the subitem "e" of Item 16 and Item 17 of the Regulations on procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, about features of inclusion of information in such scheduled plans and about requirements to form of scheduled plans of purchases, No. 1279 approved by the order of the Government of the Russian Federation of September 30, 2019 "About establishment of procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, features of inclusion of information in such scheduled plans and requirements to form of scheduled plans of purchases and about recognition voided separate decisions of the Government of the Russian Federation", undressed 2 appendices to the specified Provision (in edition of this resolution) in part, concerning code of capital construction project or the real estate unit, Item 14 (1) and the subitem "zh" of Item 22 of the Rules of the control provided by parts 5 and 5.1 of article 99 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", approved by the order of the Government of the Russian Federation of August 6, 2020 No. 1193 "About procedure of the control provided by parts 5 and 5.1 of article 99 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", and on change and recognition which voided some acts of the Government of the Russian Federation" (in edition of this resolution), are applied to the relations connected with forming, approval and maintaining scheduled plans of purchases for 2022 financial year, planning period and the next years.

4. This resolution becomes effective from the date of its official publication, except for:

Items 1 and 3, subitems "an" - "in", "д" Item of 7 changes approved by this resolution which become effective since January 1, 2021;

item 4 of the changes approved by this resolution which becomes effective since April 1, 2021;

Item 9, paragraphs two, the sixth - the twelfth subitem "b" of Item of 10 changes approved by this resolution which become effective since July 1, 2021;

the paragraph of the third subitem "b" of Item of 2 changes approved by this resolution which becomes effective since January 1, 2022.

Changes which are made to acts of the Government of the Russian Federation concerning implementation of purchases of goods, works, services for ensuring the state and municipal needs and purchases of goods, works, services with separate types of legal entities

1. In requirements to form of the plan of purchase of goods (works, services) approved by the order of the Government of the Russian Federation of September 17, 2012 No. 932 "About approval of Rules of forming of the plan of purchase of goods (works, services) and requirements to form of such plan" (The Russian Federation Code, 2012, No. 39, Art. 5272; 2015, No. 45, Art. 6259; No. 47, Art. 6585; 2016, No. 51, Art. 7405; 2020, No. 1, Art. 92):

a) in Item 1:

in subitem 5 of the word" (works, services)" shall be replaced with words ", including the purchased works delivered to the customer in case of accomplishment, rendering the purchased services, units of measure of the purchased works, services";

state subitem 6 in the following edition:

"6) data on quantity of the purchased goods including delivered to the customer in case of accomplishment of the purchased works, rendering the purchased services on amount of the purchased works, services in kind. If the subject of the agreement are works on construction, reconstruction, capital repairs, asset demolition of capital construction, information on quantity of the purchased goods is specified concerning goods which in accordance with the legislation of the Russian Federation about financial accounting are subject to acceptance by the customer to financial accounting as separate fixed asset object;";

add with the subitem 16 of the following content:

"16) information on amount of financial provision of purchase at the expense of the subsidy provided for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure by each code of the target expenditure item, expense type code. Such information is specified when planning purchase which financial provision is performed at the expense of the subsidy provided for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure.";

b) in the subitem 1 of Item 1 (figures "15" to replace 1) with figures "16";

c) in appendix to the specified requirements:

add tables with the column 16 "Amount of Financial Provision of Purchase at the expense of the Subsidy Provided for the purpose of Implementation of National and Federal Projects, and also Comprehensive Plan of Upgrade and Expansion of the Main Infrastructure <*>" and the column 17 "Code of the Target Expenditure Item, Expense Type Code <*>";

add with footnote of the following content:

"<*> It is specified when planning purchase which financial provision is performed at the expense of the subsidy provided for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure.".

2. In the order of the Government of the Russian Federation of November 28, 2013 No. 1084 "About procedure for maintaining the register of the contracts signed by customers and the register of contracts containing the data which are the state secret" (The Russian Federation Code, 2013, No. 49, Art. 6427; 2014, No. 32, Art. 4522; 2015, No. 1, Art. 279; No. 24, Art. 3487; 2016, No. 50, Art. 7103; 2017, No. 17, Art. 2566; 2018, No. 24, Art. 3522; No. 28, Art. 4230; No. 44, Art. 6752; 2019, No. 31, Art. 4641; No. 45, Art. 6357; 2020, No. 1, Art. 92; No. 8, Art. 1040; No. 17, Art. 2765; No. 33, Art. 5393):

a) add with Item 6 of the following content:

"6. When implementing purchase by holding open tender electronically taking into account the features provided by part 68 of article 112 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", provision of the subitem "e" of Item 2 of Rules of maintaining the register of the contracts signed by customers, approved by this resolution are not applied to information on the country of goods' origin.";

b) in the subitem "(1)" Item 13 of Rules of maintaining the register of the contracts signed by customers approved by the specified resolution:

after words" (the prices of the contract or its value)" to add with words "(including for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure)";

add with the offer of the following content: "At the same time concerning the purchases provided by the subitem "an" of Item 18 of the Regulations on procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, about features of inclusion of information in such scheduled plans and about requirements to form of scheduled plans of purchases, No. 1279 approved by the order of the Government of the Russian Federation of September 30, 2019 "About establishment of procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, features of inclusion of information in such scheduled plans and requirements to form of scheduled plans of purchases and about recognition voided separate decisions of the Government of the Russian Federation" (further - the Provision), financial provision is performed by each code of capital construction project or the real estate unit created in the state integrated management information system by public finance "The electronic budget" (if subjects of control are persons specified in subitems "a" - "д" Provision Item 2, or persons specified in subitems "e" - "to" Provision Item 2 if for the purpose of joint financing of capital investments in capital construction projects and (or) acquisitions of real estate units are provided to subsidy from the federal budget to the budget of the subject of the Russian Federation) ";";

c) in Rules of maintaining the register of the contracts containing the data which are the state secret, approved by the specified resolution:

in Item 3:

in the subitem "e" of the word", information on the producer of goods concerning the performed contract" to exclude;

the subitem "i" add with words ", the name of the country of goods' origin (when implementing purchase of the goods including delivered to the customer in case of accomplishment of the purchased works, rendering the purchased services), information on the producer of goods concerning the performed contract. At the same time, if subject to purchase are works on construction, reconstruction, to capital repairs, asset demolition of capital construction, information on the country of goods' origin joins in the register of contracts concerning goods which in accordance with the legislation of the Russian Federation about financial accounting are subject to acceptance by the customer to financial accounting as separate fixed asset object";

in paragraph one of Item 6 of the word "part 4" shall be replaced with words "parts 4 and 4 (1)".

3. In Rules of maintaining the register of the agreements signed by customers by results of purchase approved by the order of the Government of the Russian Federation of October 31, 2014 No. 1132 "About procedure for maintaining the register of the agreements signed by customers by results of purchase" (The Russian Federation Code, 2014, No. 45, Art. 6225; 2017, No. 23, Art. 3359; 2018, No. 12, Art. 1699; 2020, No. 1, Art. 92):

a) in Item 2:

in the subitem "d":

after the words "agreement price" to add with the words "price information of commodity unit, work or service";

add with the offer of the following content: "If the subject of the agreement are works on construction, reconstruction, capital repairs, asset demolition of capital construction, commodity unit price information, about the country of goods' origin joins in the register concerning goods which in accordance with the legislation of the Russian Federation about financial accounting are subject to acceptance by the customer to financial accounting as separate fixed asset object.";

add the subitem "z" with the offer of the following content: "If the subject of the agreement are works on construction, reconstruction, capital repairs, asset demolition of capital construction, information on the delivered goods joins in the register concerning goods which in accordance with the legislation of the Russian Federation about financial accounting are subject to acceptance by the customer to financial accounting as separate fixed asset object.";

add with the subitem "p" of the following content:

"o) information on amount of financial provision of purchase at the expense of the subsidy provided for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure by each code of the target expenditure item, expense type code. The specified information joins in the register concerning purchase which financial provision is performed at the expense of the subsidy provided for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure.";

b) in Item 10:

in the subitem "an" of the word "m" - "about" Item 2" shall be replaced with words "m" - "п" Item 2";

to add the subitem "v" after the word "execution" with words "(including acceptance of the delivered goods, the performed work, the rendered service and (or) payment of the agreement)".

4. In the order of the Government of the Russian Federation of March 17, 2015 No. 238 "About procedure for preparation of the report on purchasing amount at small business entities and socially oriented non-profit organizations, its placement in unified information system and modification of the Regulations on the Interdepartmental commission on selection of investment projects, the Russian credit institutions and international financial institutions for participation in the Program of support of the investment projects realized in the territory of the Russian Federation on the basis of project financing" (The Russian Federation Code, 2015, No. 12, Art. 1766; 2016, No. 7, Art. 987; 2019, No. 26, Art. 3459; 2020, No. 17, Art. 2765):

a) in paragraph five of the subitem "b" of Item 2 appendices to the Rules of preparation of the report on purchasing amount at small business entities and socially oriented non-profit organizations, its placement in unified information system approved by the specified resolution:

"part 1 of article 93 of the Federal Law" shall be replaced with words words "part 1";

words", except for amount" shall be replaced with words "and part 12 of article 93 of the Federal Law, except for amount";

b) in the report form about purchasing amount at small business entities and socially oriented non-profit organizations approved by the specified resolution:

line item in paragraph four 2 Sections II:

"part 1 of article 93 of the Federal Law" shall be replaced with words words "part 1";

words", except for amount" shall be replaced with words "and part 12 of article 93 of the Federal Law, except for amount";

line item in paragraph three "part 1" shall be replaced with words 3 Sections III of the word "parts 1 and 12".

5. In Rules of functioning of unified information system in the field of the purchases approved by the order of the Government of the Russian Federation of December 23, 2015 No. 1414 "About procedure for functioning of unified information system in the field of purchases" (The Russian Federation Code, 2016, No. 2, Art. 324; 2017, No. 44, Art. 6514; 2020, No. 1, Art. 92):

a) in Item 2:

state the subitem "b" in the following edition:

"b) control of compliance of information on identification codes of purchases and not exceeding of amount of financial provision for implementation of purchases according to the procedure established by the Government of the Russian Federation according to part 6 of article 99 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs";";

to add the subitem "g" after the word "signatures" with words "which type is provided by the Federal Law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs" and the Federal Law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities",";

in the subitem "d" the word "placement" shall be replaced with words "forming and placement";

b) in Item 3:

the paragraph one to add with words ", and also the cases provided by the Federal Law "About Purchases of Goods, Works, Services as Separate Types of Legal Entities" and regulatory legal acts adopted according to it in case of which information and documents are not placed in unified information system, on the official site";

paragraph two after the word to "questions" to add with words "functioning of unified information system,";

c) in Item 14:

add the subitem "d" with words "(if when holding poll or vote the possibility of viewing of its results is provided)";

in the subitem "zh":

6. In the order of the Government of the Russian Federation of November 27, 2017 No. 1428 "About features of implementation of purchase for needs of defense of the country and safety of the state" (The Russian Federation Code, 2017, No. 49, Art. 7465; No. 50, Art. 7635; 2018, No. 20, Art. 2838; No. 26, Art. 3869; No. 53, Art. 8713; 2019, No. 25, Art. 3262; 2020, No. 1, Art. 92; No. 28, Art. 4421):

a) in Item 2:

in the paragraph the second:

the offer second to state in the following edition:

"In case of sending an inquiry about provision of the statement from the closed register of bank guarantees the beneficiary, state body (local government body) having the right to the direction of such request in case of the direction by the Federal Treasury to the beneficiary, such body of the statement from the closed register of bank guarantees use if technically possible information systems of the Federal Treasury.";

add with the offer of the following content: "The direction of information and the documents containing the data which are the state secret with use of such information systems is not allowed;";

third to add the paragraph with offers of the following content: "In case of the direction of such data, and also in case of the direction the Federal Treasury to the customer of information and documents when maintaining the register of contracts containing the data which are the state secret if technically possible uses information systems of the Federal Treasury. The direction of information and the documents containing the data which are the state secret with use of such information systems is not allowed.";

b) in Item 5 of the word "January 1, 2021." shall be replaced with words "on July 1, 2021".

7. In Rules of registration of participants of purchases in unified information system in the field of purchases of goods, works, services for ensuring the state and municipal needs and maintaining the unified register of participants of the purchases approved by the order of the Government of the Russian Federation of December 30, 2018 No. 1752 "About order of registration of participants of purchases in unified information system in the field of purchases of goods, works, services for ensuring the state and municipal needs and maintaining the unified register of participants of purchases and modification of the order of the Government of the Russian Federation of June 8, 2018 with No. 656" (The Russian Federation Code, 2019, No. 1, Art. 47; 2020, No. 1, Art. 92):

a) to add the subitem "v" of Item 5 with words ", and also identification taxpayer number of the legal entity (in the presence of such number) appropriated in accordance with the legislation of the Russian Federation about taxes and fees";

b) in Item 6:

to add the subitem "b" after words of "the relevant state" with words ", and also identification taxpayer number (in the presence of such number) appropriated in accordance with the legislation of the Russian Federation about taxes and fees";

add with the subitem "p" of the following content:

"o) information on application of special tax regime by physical person "Tax on the professional income" and date of registration (removal from accounting) in tax authority.";

c) add with Item 8 (2) the following content:

"8(2). Information specified in the subitem "p" of Item 6 of these rules is created in unified information system automatically based on the data received from the Federal Tax Service after specifying by the procurement participant when forming for placement in the register of participants of information specified in the subitem "b" of Item 6 of these rules. Compliance of such information is provided by means of use and further updating of information obtained from the Federal Tax Service no later than one working day following behind day of its obtaining.";

d) to add Item 9 after the word "signatures" with words of "such authorized person of the operator of an electronic trading platform";

e) in the offer third Item 10 of the word "subitems "a", "b" shall be replaced with words "subitems "a", "b", "g".

8. In Item 2 of the order of the Government of the Russian Federation of February 28, 2019 No. 223 "About features of holding the closed electronic procedures and procedure for accreditation on specialized electronic platforms" (The Russian Federation Code, 2019, No. 11, Art. 1116; No. 25, Art. 3262; 2020, No. 1, Art. 92; No. 28, Art. 4421; No. 33, Art. 5393):

a) in the subitem "an" of the word "since January 1, 2021." shall be replaced with words "since July 1, 2021", shall be replaced with words the words "till January 1, 2021." "till July 1, 2021";

b) in the subitem "b" of the word "till January 1, 2021." shall be replaced with words "till July 1, 2021";

c) add with the subitem "e" of the following content:

"e) till December 31, 2020 inclusive submission of the requests for procurement action which are carried out according to the order of the Government of the Russian Federation of November 27, 2017 No. 1428 "About features of implementation of purchase for needs of defense of the country and safety of the state" and participation in such purchases are performed including participants of purchases which are accredited till October 1, 2020 on specialized electronic platform, concerning which information and documents are included in the register of participants of the closed electronic procedures according to the procedure, established by the Section III of the Provisions approved by this resolution. At the same time registration in unified information system is not required.".

9. In Regulations on procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, about features of inclusion of information in such scheduled plans and about requirements to form of scheduled plans of purchases, No. 1279 approved by the order of the Government of the Russian Federation of September 30, 2019 "About establishment of procedure for forming, approval of scheduled plans of purchases, modification of such scheduled plans, placements of scheduled plans of purchases in unified information system in the field of purchases, features of inclusion of information in such scheduled plans and requirements to form of scheduled plans of purchases and about recognition voided separate decisions of the Government of the Russian Federation" (The Russian Federation Code, 2019, No. 41, Art. 5713; 2020, No. 1, Art. 92; No. 33, Art. 5393):

a) to state the subitem "e" of Item 16 in the following edition:

"e) in columns 7 - 11 in the line "In total for Implementation of Purchases, including by Code of Budget Classification ______ / by Expense Type Code _________ / by Code of Capital Construction Project or the Real Estate Unit _________" the total amount of financial provision provided for implementation of purchases in the current financial year, planning period and the next years (in case of implementation of purchases, which are planned after planning period), disaggregated on amount of financial provision is specified:

by each code of budget classification (it is specified the customers and persons specified in subitems "a", "d", "e" and "k" of Item 2 this provision and also the customers and persons specified in subitems "b", "g", "zh" and "i" of Item 2 this provision in case of implementation of purchases for the purpose of implementation of national and federal projects);

by each code of expense type (it is specified the customers and persons specified in subitems "b", "g", "zh" and "i" of Item 2 this provision);

by each code of capital construction project or the real estate unit created in the state integrated management information system by public finance "The electronic budget" (further - the Electronic Budget system) (preparation of the project documentation and (or) accomplishment of engineering researches, performance of works on construction, reconstruction and (or) capital repairs, demolition of capital construction projects is specified in case of implementation of purchases by results of which contracts which subject are acquisition of real estate units are signed (including linear objects), and also the contracts provided by parts 16 (if the contract of lifecycle provides designing, construction, reconstruction, capital repairs of capital construction project), 16.1 Articles 34 and part 56 of article 112 of the Federal Law, customers and persons, specified in subitems "a" - "д" Item 2 this provision, and also the customers and persons specified in subitems "e" - "to" Item 2 this provision if for the purpose of joint financing of capital investments in capital construction projects and (or) acquisitions of real estate units are provided to subsidy from the federal budget to the budget of the subject of the Russian Federation).

The amount of financial provision by each code of budget classification, by each code of expense type or by each code of capital construction project or the real estate unit is created automatically on the basis of information, stipulated in Item the 17th this provision;";

b) in Item 17:

word in paragraph one "the state integrated management information system public finance "shall be replaced with words" "The electronic budget" (further - the Electronic Budget system) the Electronic Budget system;

add with the paragraph of the following content:

"The amount of financial provision of purchases by results of which contracts which subject are acquisition of real estate units are signed preparation of the project documentation and (or) accomplishment of engineering researches, performance of works on construction, reconstruction and (or) capital repairs, demolition of capital construction projects (including linear objects), and also the contracts provided by parts 16 (if the contract of lifecycle provides designing, construction, reconstruction, capital repairs of capital construction project), 16.1 Articles 34 and part 56 of article 112 of the Federal Law, is created in unified information system or transferred to unified information system by means of information exchange of unified information system with the Electronic Budget system and regional and municipal information systems in the field of purchases by customers and persons, specified in subitems "a" - "д" Item 2 this provision, and also in subitems "e" - "to" Item 2 this provision if for the purpose of joint financing of capital investments in capital construction projects and (or) acquisitions of real estate units are provided to subsidy from the federal budget to the budget of the subject of the Russian Federation, by each code of capital construction project or the real estate unit created in the Electronic Budget system without inclusion in the schedule.";

c) to state the subitem "an" of Item 18 in the following edition:

"a) about purchase by results of which the contract which subject are acquisition of real estate units is signed preparation of the project documentation and (or) accomplishment of engineering researches, performance of works on construction, reconstruction and (or) capital repairs, asset demolition of capital construction (including linear object), and also the contract provided by parts 16 (if the contract of lifecycle provides designing, construction, reconstruction, capital repairs of capital construction project), 16.1 Articles 34 and part 56 of article 112 of the Federal Law;";

d) 2 appendices to the specified Provision after words "/by expense type code _________" to add the table of the Section with words "/by code of capital construction project or the real estate unit _________".

10. In the order of the Government of the Russian Federation of August 6, 2020 No. 1193 "About procedure of the control provided by parts 5 and 5.1 of article 99 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", and on change and recognition which voided some acts of the Government of the Russian Federation" (The Russian Federation Code, 2020, No. 33, the Art. 5393):

a) in paragraph three of item 4 of the word "the subitem "b"," to exclude;

b) in the Rules of the control provided by parts 5 and 5.1 of article 99 of the Federal law "About Contractual System in the field of Purchases of Goods, Works, Services for Ensuring the State and Municipal Needs", approved by the specified resolution:

to add the subitem "an" of Item 3 after the word of "projects" with words ", and also comprehensive plan of upgrade and expansion of the main infrastructure";

in Item 13:

in the subitem "an" of the word "if technically possible-on the removable machine data carrier" shall be replaced with words "on the removable machine data carrier (if technically possible) or electronically with use of the information systems applied by subjects of control and control facilities (in the presence of such systems),";

in the subitem "b" of the word "control facility" shall be replaced with words "control facility. In case of the direction of object of control on paper, control facility";

in Item 14:

add the subitem "a" with the words "by each code of budget classification";

add the subitem "v" with words ", by each code of expense type. At the same time concerning the procurements conducted for the purpose of implementation of national and federal projects, and also comprehensive plan of upgrade and expansion of the main infrastructure, such inspection is carried out by each code of budget classification";

add with Item 14 (1) the following content:

"14(1). Concerning the purchases provided by the subitem "an" of Item 18 of the Provision check, stipulated in Item 14 these rules, is carried out by each code of capital construction project or the real estate unit created in the state integrated management information system by public finance "The electronic budget" (if subjects of control are persons specified in subitems "a", "b", "g" and "d" of Item 2 of the Provision or persons specified in subitems "e", "zh", "i" and "k" of Item 2 of the Provision if for the purpose of joint financing of capital investments in capital construction projects and (or) acquisitions of real estate units are provided to subsidy from the federal budget to the budget of the subject of the Russian Federation).";

add Item 22 with the subitem "zh" of the following content:

"g) when implementing the purchases provided by the subitem "an" of Item 18 of the Provision, the checking provided by subitems "a", "b" and "g" of Item 20 of these rules are carried out by each code of capital construction project or the real estate unit created in the state integrated management information system by public finance "The electronic budget" (if subjects of control are persons specified in subitems "a" - "д" Provision Item 2, or persons specified in subitems "e" - "to" Provision Item 2 if for the purpose of joint financing of capital investments in capital construction projects and (or) acquisitions of real estate units are provided to subsidy from the federal budget to the budget of the subject of the Russian Federation).";
