I ORDER:

1. Bring the following changes in some orders of the Minister of Energy of the Republic of Kazakhstan:

1) in the order of the Minister of Energy of the Republic of Kazakhstan of February 2, 2015 No. 55 "About approval of Rules of obtaining by the power making, power transferring organizations of the passport of availability for service during the autumn and winter period" (it is registered in the Register of state registration of regulatory legal acts for No. 10516, it is published on April 15, 2015 in information system of law of Ad_let):

to state preamble of the order in the following edition:

"According to the subitem 69) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:";

The rules of obtaining by the power making, power transferring organizations of the passport of availability for service during the autumn and winter period approved by the specified order to be reworded as follows according to appendix 1 to this order;

2) in the order of the Minister of Energy of the Republic of Kazakhstan of March 18, 2015 No. 210 "About approval of Rules of holding qualification examinations of rules of technical operation and safety regulations at heads, specialists of the organizations performing production, transfer of electrical and heat energy for control of technical condition and safety of operation of electroinstallations" (it is registered in the Register of state registration of regulatory legal acts for No. 11026, it is published on May 20, 2015 in information system of law of Ad_let):

to state preamble of the order in the following edition:

"According to the subitem 40) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:";

Rules of holding qualification examinations of rules of technical operation and safety regulations at heads, specialists of the organizations performing production, transfer of electrical and heat energy, for control of technical condition and safety of operation of electroinstallations, approved by the specified order to be reworded as follows according to appendix 2 to this order.

2. Recognize invalid some orders of the Department of Energy of the Republic of Kazakhstan according to the list according to appendix 3 to this order.

3. To provide to committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

5. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of obtaining by the power making, power transferring organizations of the passport of availability for service during the autumn and winter period

Chapter 1. General provisions

1. These rules of obtaining by the power making, power transferring organizations of the passport of availability for service during the autumn and winter period (further – Rules) are developed according to the subitem 69) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" (further – the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further – the Law on the state services) and determine procedure for rendering the state service "Issue of the Passport of Readiness to the Power Making and Power Transferring Organizations for Work during the Autumn and Winter Period" (further – the state service).

2. In these rules the following basic concepts are used:

1) the passport of readiness – annually issued document confirming readiness of the power making and power transferring organizations to work during the autumn and winter period;

2) the system operator – the national company exercising centralized supervisory control, ensuring parallel work with power supply systems of other states, maintenance of balance in power supply system, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy and also transfer of electrical energy on national power grid, its maintenance and maintenance in operational readiness;

3) the autumn and winter period – heating season which beginning and completion are established by local executive bodies;

4) the power transferring organization – the organization rendering service in transfer of electrical or heat energy on the basis of agreements;

5) the power making organization – the organization performing production of electrical and (or) heat energy for own needs and (or) realization.

Other concepts used in these rules are applied according to the legislation of the Republic of Kazakhstan on power industry, on local public administration and self-government in the Republic of Kazakhstan, about the state services.

Chapter 2. Procedure for obtaining by the power making, power transferring organizations of the passport of availability for service during the autumn and winter period

3. Passports of readiness of the power making, power transferring organizations for work during the autumn and winter period (further – the passport of readiness) with the established electric power over 5 Megawatts (further – MW), and also having power networks of 110 kilovolts on the balance (further – kV) and above, are issued by state body on the state energy supervision and control according to the subitem 4) of Item 11 of article 6 of the Law in forms, according to appendices 1 and 2 to these rules.

4. Passports of readiness of heating boiler all capacities and thermal networks (main, intra quarter) to work during the autumn and winter period are issued by local executive bodies of the cities of Nour-Sultan, Almaty and Shymkent, areas and cities of regional value (further – local executive body) according to the subitem 3) of Item 10-1 of article 6 of the Law in forms, according to appendices 1 and 2 to these rules.

5. To the power transferring organizations incorporating power networks of 35 kV and below, and also the power making organizations with the established electric power of 5 MW and less, passports of readiness issue territorial subdivisions of state body on the state energy supervision and control according to the subitem 4) of Item 11 of article 6 of the Law in forms, according to appendices 1 and 2 to these rules.

6. Documents acceptance from the power making and power transferring organizations (further – uslugopoluchatel) on receipt of the passport of readiness is performed annually during the period from August 15 to September 30 inclusive, for the system operator till October 25 inclusive by local executive bodies, state body on the state energy supervision and control or its territorial subdivisions (further – the service provider), through the web portal of "the electronic government" www.egov.kz, e-licensing of www.elicense.kz (further – the portal).

The documents which arrived after September 30 return to the applicant without consideration.

7. The list of the main requirements to rendering the state service are stated in the standard of the state service "Issue of the Passport of Readiness to the Power Making and Power Transferring Organizations for Work during the Autumn and Winter Period" according to appendix 3 to these rules.

8. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:

1) to the service provider:

the statement on receipt of the passport of readiness of the power making, power transferring organizations for work during the autumn and winter period in form, according to appendix 4 to these rules;
