About approval of the Regulations on registration of insurance and reinsurance brokers and conditions of implementation of intermediary activities in the field of insurance and about modification of some regulatory legal acts of the National Bank of Ukraine

According to Articles 7, of 15, 55-1, 56 of the Law of Ukraine "About the National Bank of Ukraine", to Articles 21, of 27, 28 Laws of Ukraine "About financial services and state regulation of the markets of financial services", to Articles 2, of 15, of 36, "About insurance" and for the purpose of enhancement of procedure of intermediary activities in the field of insurance the Board of the National Bank of Ukraine DECIDES: 37 Laws of Ukraine

1. Approve Regulations on registration of insurance and reinsurance brokers and condition of implementation of intermediary activities in insurance field (further - the Provision) which is applied.

2. Ceased to be valid according to the Resolution of Board of the National Bank of Ukraine of 24.12.2024 No. 163

3. No. 84 "About ensuring implementation of powers and accomplishment of functions on state regulation and supervision in the field of the markets of financial services in questions of procedure for disclosure of information and creation of the reporting by participants of the markets of financial services" (with changes) to exclude Item 6 of appendix to the resolution of Board of the National Bank of Ukraine of June 25, 2020.

4. To insurance and/or reinsurance brokers (further - brokers), information on which as of day of entry into force of this resolution is entered in the state register insurance and reinsurance brokers (further - the register):

1) till October 30, 2023 to give to the National Bank of Ukraine questionnaire (in form according to appendix 2 to the Provision);

To give 2) till December 31, 2023 to the National Bank of Ukraine of assurance of any form about:

broker's compliance to requirements of the Provision;

compliance of the head of the broker - the legal entity (the head according to data from the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming) or representations of the insurance and/or reinsurance broker nonresident / broker - physical person entrepreneur to the requirements for professional suitability provided in Item 58 of Chapter 5 of the Section II of Provisions.

5. Persons specified in item 4 of this resolution have the right from the date of entry into force of this resolution, but no later than one month from the date of termination/cancellation of warlike situation in Ukraine, to address the National Bank of Ukraine about the termination of the activities by filing of application in any form.

6. The National Bank of Ukraine within 30 working days from the date of receipt of the statement from the face specified in Item 5 of this resolution makes the decision on the broker's exception of the register and cancellation of the certificate on inclusion (entering) into the state register of insurance and reinsurance brokers and cancels its certificate on inclusion (entering) into the state register of insurance and reinsurance brokers.

The National Bank of Ukraine within five working days from the date of the decision making specified in paragraph one of Item 6 of this resolution enters the corresponding record about the made decision in the register, places information on such decision on the page of official Internet representative office of the National Bank of Ukraine and reports person from whom the application was received about such decision.

7. Certificates (certificates) on training (advanced training) according to the appropriate program of training (advanced training) of the head of the broker - the legal entity or representation of the insurance and/or reinsurance broker nonresident / broker - physical person entrepreneur, the entries into force of this resolution issued about one day, are considered valid until the end of the term of their action.

8. From the date of entry into force of this resolution of the requirement of Rules of creation and submission of the reporting by participants of the market of the non-bank financial services to the National Bank of Ukraine approved by the resolution of Board of the National Bank of Ukraine of November 25, 2021 No. 123, concerning submission of the reporting by brokers of data to the National Bank of Ukraine are not applied.

9. The National Bank of Ukraine considers the document packages given before entry into force of this resolution according to requirements and according to the procedure, the certain legislation of Ukraine existing about day of entry into force of this resolution.

10. The National Bank of Ukraine within 30 working days from the date of, the termination of the term determined in the subitem 1 of item 4 of this resolution following behind day:

1) issues statements from the register (in form according to appendix 3 to the Provision) and updates if necessary information in the register concerning brokers who gave to the National Bank of Ukraine questionnaire according to the subitem 1 of item 4 of this resolution. Certificates on inclusion (entering) into the state register of insurance and reinsurance brokers of the brokers specified in the subitem 1 of Item 10 of this resolution which were granted before entry into force of this resolution are considered cancelled from date of issue of the statement by the National Bank of Ukraine;

2) makes the decision on the broker's exception of the register and cancellation of the certificate on inclusion (entering) into the state register of insurance and reinsurance brokers and cancels its certificate on inclusion (entering) into the state register of insurance and reinsurance brokers if the broker did not give to the National Bank of Ukraine of the questionnaire specified in the subitem 1 of item 4 of this resolution. The National Bank of Ukraine within five working days from the date of the decision making specified in the subitem 2 of Item 10 of this resolution enters the corresponding record about the made decision in the register, places information on such decision on the page of official Internet representative office of the National Bank of Ukraine and reports person concerning whom it is accepted about adoption of such decision.
