RESOLUTION OF THE MINISTRY OF EMERGENCY SITUATIONS OF THE REPUBLIC OF BELARUS

About approval of regulations of ministerial procedures

Based on the paragraph of third Item 3 of the Presidential decree of the Republic of Belarus of June 25, 2021 No. 240 "About the ministerial procedures performed concerning subjects of managing" of subitem 7.4 of Item 7 of the Regulations on the Ministry of Emergency Situations of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 29, 2006 No. 756, the Ministry of Emergency Situations of the Republic of Belarus DECIDES:

1. Approve:

The regulations of the ministerial procedure performed concerning subjects of managing according to the subitem * 19.7.1 "Receipt of special permission (license) for implementation of activities for ensuring fire safety" (are attached);

The regulations of the ministerial procedure performed concerning subjects of managing according to subitem 19.7.2 "Modification of special permission (license) for implementation of activities for ensuring fire safety" (are attached);

The regulations of the ministerial procedure performed concerning subjects of managing according to subitem 19.7.4 "Cancellation of special permission (license) for implementation of activities for ensuring fire safety based on the notification of the licensee on the termination of implementation of the licensed type of activity" (are attached).

* For the purposes of this resolution the subitem is understood as the subitem of Item of the single list of the ministerial procedures performed concerning subjects of the managing approved by the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548.

2. This resolution becomes effective after its official publication.

Regulations of the ministerial procedure performed concerning subjects of managing according to subitem 19.7.1 "Receipt of special permission (license) for implementation of activities for ensuring fire safety"

1. Features of implementation of ministerial procedure:

1.1. the name of authorized body (jurisdiction of ministerial procedure) – the Ministry of Emergency Situations;

1.2. the name of state body, other organization, performing acceptance, preparation for consideration of the applications of interested persons and (or) issue of executive decisions, – "The Republican Center of Certification and Examination of the Licensed Types of Activity" organization of the Ministry of Emergency Situations of the Republic of Belarus;

1.3. the regulatory legal acts, the international agreements of the Republic of Belarus, the international legal acts containing the obligations of the Republic of Belarus regulating procedure of ministerial procedure:

The law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures";

The presidential decree of the Republic of Belarus of September 1, 2010 No. 450 "About licensing of separate types of activity";

The presidential decree of the Republic of Belarus of June 25, 2021 No. 240 "About the ministerial procedures performed concerning subjects of managing";

the resolution of Council of Ministers of the Republic of Belarus of September 24, 2021 No. 548 "About the ministerial procedures performed concerning subjects of managing";

the resolution of the Ministry of Emergency Situations of the Republic of Belarus of January 28, 2016 No. 2 "About development and functioning of control systems";

1.4. other available features of implementation of ministerial procedure:

1.4.1. the additional bases for refusal in adoption of the statement of the interested person in comparison with the Law of the Republic of Belarus "About bases of ministerial procedures" are determined in paragraph one of part two of Item 21 of the Regulations on licensing of separate types of activity approved by the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450 (further – the Provision);

1.4.2. the additional bases for refusal in implementation of ministerial procedure in comparison with the Law of the Republic of Belarus "About bases of ministerial procedures" are determined in the Provision Item 24 part one;

1.4.3. ministerial procedure of receipt of special permission (license) for implementation of activities for ensuring fire safety (further if other is not determined, – the license) regarding the works and (or) services specified in subitems 10.2 and 10.4 of Item 10 of appendix 1 to the Provision is performed only concerning legal entities of the Republic of Belarus and the foreign organizations;

1.4.4. appeal of the executive decision is performed judicially.

2. The documents and (or) data necessary for implementation of ministerial procedure represented by the interested person:

In case of filing of application the authorized body has the right to demand from the interested person the documents provided in paragraphs the second or seventh part one of Item 2 of article 15 of the Law of the Republic of Belarus "About bases of ministerial procedures".

Privileges by the amount of the payment levied when implementing ministerial procedure are provided by the paragraph third subitem 1.1 parts one (taking into account subitem 1. 8) Item 1 of the Decree of the President of the Republic of Belarus of May 7, 2012 No. 6 "About stimulation of business activity in the territory of averages, small residential locations, the rural zone".
