Based on Item b) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, DECIDES: the Government

1. Approve:

1) Regulations on the organization and functioning of the Ministry of Education and Research, according to appendix No. 1;

2) Structure of central office of the Ministry of Education and Research, according to appendix No. 2;

3) to Organigramm of central office of the Ministry of Education and Research, according to appendix No. 3;

4) the List of the administrative authorities subordinated to the Ministry of Education and Research, according to appendix No. 4;

5) the List of public organizations in the fields of education in which the Ministry of Education and Research is founder, according to appendix No. 5;

6) Ceased to be valid;

7) the List of the state companies in which the Ministry of Education and Research is founder, according to appendix No. 7;

8) The list of the orders of the Government which are recognized invalid, according to appendix No. 8.

2. Establish the extreme number of staff of central office of the Ministry of Education and Research in number of 123 units, with the annual salary fund according to the legislation.

3. In the Ministry of Education and Research four state secretaries, the secretary general of the ministry, the deputy secretary general of the ministry and board act.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on the organization and functioning of the Ministry of Education and Research

I. General provisions

1. The regulations on the organization and functioning of the Ministry of Education and Research (further - the Provision) regulate its mission, functions, spheres of activity and the rights, and also the organization of activities.

2. The Ministry of Education and Research (further - the Ministry) is the central industry body of public management which provides realization of policy of the state in the spheres of activity entrusted to it.

3. The ministry is legal entity of the public law with the location in municipium of Chisinau, has the name, seal with the image of the State Emblem of the Republic of Moldova, treasurer accounts, and also other specific attributes of bodies of public management established by the legislation.

4. In the activities the Ministry is guided by the Constitution of the Republic of Moldova, the Law No. 136/2017 on the Government and other regulations, presidential decrees of the Republic of Moldova, ordinances, resolutions and orders of the Government, and also this Provision.

II. Mission, spheres of activity, main functions and rights of the Ministry

5. The mission of the Ministry is the analysis of situation and problems in the managed spheres of activity, development effective public the politician in the areas provided in Item 6, quality monitoring the politician and regulations and the offer of reasonable measures of intervention of the state as a result of which effective solutions in competences, with providing the best ratio between the expected results and the provided costs will be made.

6. The ministry performs the functions established by this Provision in the following spheres of activity:

1) education;

2) researches and innovations;

3) youth;

4) physical culture and sport;

5) the interethnic relations and functioning of languages in the territory of the Republic of Moldova.

7. The main functions of the Ministry are:

1) development of analyses of ex ante, documents the politician, drafts of regulations in the areas provided in Item 6, including for ensuring execution of regulations and presidential decrees of the Republic of Moldova after their publication in the Official monitor of the Republic of Moldova, in cooperation with the corresponding representatives of civil society and business community;

2) cooperation according to the national legal system with the foreign profile organizations in the areas provided in Item 6;

3) monitoring of assessment and line item of the Republic of Moldova within the international indicators and ratings which belong to its specific areas, and development of offers on their improvement;

4) monitoring of perception by citizens and economic agents public the politician, regulations and the state activities in spheres of activity, specific to the Ministry, and development of offers on their improvement;

5) monitoring of quality public the politician and regulations in the spheres of activity specific to the Ministry, including in cooperation with civil society and private sector;

6) implementation of regulations and implementation of international treaties of the Republic of Moldova in the areas provided in Item 6, creation of reports on their accomplishment;

6-1) approval industry the politician according to chapters about accession to the European Union for the purpose of development of the Contribution of the Republic of Moldova to the Annual packet of expansion of the European Union and gradual preparation for opening of negotiations on accession of the Republic of Moldova for the European Union;

6-2) implementation of the Agreement on association between the Republic of Moldova, on the one hand, both European Union and European Atomic Energy Community and their state members, on the other hand;

7) consideration and creation of the conclusions according to the drafts of regulations developed by other bodies of public management and submitted for consideration;

8) development and submission of offers on the budget in the areas provided in Item 6, development of the annual plan of activities, and also annual monitoring of extent of implementation by development and publication of the corresponding reports;

9) the organization of planning systems, execution, financial accounting and budget reports in the Ministry and, if necessary, in subordinated budget bodies / organizations;

10) coordination and monitoring of activities of administrative authorities and public organizations in which the Ministry performs functions of the founder;

11) implementation of other specific functions.

8. The ministry is allocated with the following rights:

1) to request and receive information necessary for accomplishment of the functions and implementation of powers from other ministries, the central administrative authorities and other public bodies, and also bodies of local public authority;

2) to create advisory boards, ad hoc commissions, working groups with participation of representatives of other ministries, central administrative authorities and public bodies, bodies of local public authority, representatives of scientific community, civil society, business environment and specialists in the corresponding industry for project development of regulations, documents public the politician, implementation of examination and provision of consultations, and also for consideration of other questions concerning it specific spheres of activity;

3) to develop projects on development in competences;

4) to cooperate with bodies of local public authority for realization at the local level of policy of the state in entrusted areas and solutions of common problems;

To represent 5) to the Government of the offer on organization, reorganization or dissolution of the administrative authorities which are under its supervision and also public organizations in which is founder, for the purpose of ensuring realization of mission and accomplishment of the functions;

To delegate 6), if necessary, at discretion, some functions to subordinated administrative authorities, and also public organizations in which is founder if it does not contradict the legislation;

7) to repeal the acts of subordinated administrative authorities, and also public organizations contradicting the legislation in which is founder in quality;

8) to initiate according to the legislation recourse actions concerning the government employees and the employed employees who caused damage of state-owned property and to the government budget;

9) to request access and to receive free of charge through platform of interoperability "MConnect" statistical, financial, fiscal, economic, legal and other information;

9-1) to get free access to the state information resources and systems which are at the disposal of other state bodies or organizational structures falling within the scope of their competence according to regulations and for the purpose of implementation of the obligations;

10) to sign the international agreements according to the legislation;

11) to exercise control of effective use of budgetary and extrabudgetary funds for proper implementation of the activities;

12) to develop and approve instructions and methodical instructions for the questions which are within its competence and also the regulations registered according to procedure and conditions, stipulated by the legislation;

13) to send to the Government appeals about need of suspension of action of some normative and administrative acts or decisions of the bodies of public management contradicting the legislation;

14) to perform other rights based on the special regulations governing the relations in the spheres of activity assigned to the Ministry.

III. Organization of activities of the Ministry

9. Management of the Ministry is performed by the minister who:

1) establishes the tasks and strategic directions of activities of the Ministry following from the Program of activities of the Government and determines ways of their realization;

2) provides accomplishment of the laws, presidential decrees of the Republic of Moldova, resolutions of Parliament, ordinances, resolutions and orders of the Government, and also realization of the functions following from this provision and other regulations;

3) approves programs and plans of activities of the Ministry, and also reports on their execution;

4) provides coordination, supervision and control of activities of bodies of public management in the spheres of activity assigned to the Ministry for realization of the mission and accomplishment of the functions;

5) will organize system of internal managerial supervision;

6) participates with the right of casting vote in meetings of the Government and votes concerning the agenda;

7) makes decisions concerning development and submits to the Government drafts of the regulations connected with the spheres of activity assigned to the Ministry;

8) expresses opinion according to drafts of the regulations developed by other ministries, the central administrative authorities and bodies of public management, and also of other questions considered at meetings of the Government;

9) signs the conclusions according to drafts of the regulations concerning the spheres of activity assigned to the Ministry, developed by other ministries, the central administrative authorities and bodies of public management and also countersigns the resolutions and ordinances approved by the Government in the cases established by the law;

10) conducts negotiations and signs the international agreements according to the procedure, established by the Law No. 595/1999 on international treaties of the Republic of Moldova;

11) issues orders solely within the competence and provides control of their execution;

12) is established sphere of activity of state secretaries, and also by procedure for their substitution;

13) approves provisions of internal divisions of the Ministry;

14) appoints to the state positions, changes, stops and stops employment relationships with government employees according to the legislation;

15) employs and discharges from office the personnel working at contractual basis according to the labor law;

Appropriates 16) class ranks to government employees, encourages them and applies authority punishments according to the legislation;

Submits 17) to the Government and approval of the offer on creation, reorganization or dissolution of the organizational structures which are within the Ministry remit within the assignments provided in the government budget on content of the Ministry;

18) submits to the Government offers concerning regulations on the organization and functioning, structure and the extreme number of staff of the administrative authorities subordinated to the Ministry;

19) appoints to position, changes, stops and stops the office (labor) relations with heads and deputy managers of the organizational structures which are within the Ministry remit, except as specified, which are within the Government remit, according to special regulations;

19-1) submits to the Government for review of the offer on position assignment and release or dismissal from position of the head of the administrative authority subordinated to the ministry according to the legislation;

20) is represented by the Ministry without special mandate in the relations with the central and local authorities of public management, other public bodies, representatives of civil society and business environment, physical persons and legal entities from the Republic of Moldova and from abroad;

Approves 21) or changes the staff list and the scheme of employment of the Ministry within the salary fund and the extreme number of staff established by the Government;

22) performs other powers assigned to it according to the legislation.

10. In the Ministry four state secretaries holding responsible state position, the secretaries general of the ministry and the deputy secretary general of the ministry who are the state employees-upper managers, appointed to position by criteria of professionalism according to the Law No. 158/2008 on the state position and the status of the government employee act.

11. State secretaries and the secretary general of the Ministry submit to the minister.

12. According to the order of the minister on establishment of spheres of activity the state secretary:

1) participates in determination of tasks and strategic directions of activities of the Ministry in areas for which bears responsibility;

2) participates in development of programs and plans of activities of the Ministry, reports on their accomplishment in areas for which bears responsibility;

3) is offered by initiation of drafts of regulations in areas for which bears responsibility, according to the tasks and strategic directions established by the minister;

4) performs powers of the minister of management of the Ministry in case of absence of the minister or impossibility of implementation of the powers by it, notifying on it the Prime Minister;

5) participates in meetings of the Government with the right of advisory vote in case of delegation by his minister and in other cases established by the legislation;

6) is represented by the Ministry, based on the powers conferred to it by the minister in the relations with bodies of the central and local public authority, other bodies of public management, with representatives of civil society, physical persons and legal entities from the Republic of Moldova and from abroad;

7) performs other powers delegated by the minister.

13. The secretary general of the ministry helps the minister with activities for management of the Ministry by realization of functional bonds between management of the Ministry and the case of government employees, between internal divisions of central office of the Ministry, an also between the minister and the organizational structures which are within the Ministry remit.

14. Secretary general of the ministry:

1) provides development of tasks and strategic directions of activities of the Ministry, and also high-quality development of programs and plans of the Ministry;

2) is coordinated by activities of internal divisions of central office of the Ministry for the purpose of accomplishment of tasks and strategic directions of activities of the Ministry;

3) is coordinated by activities of the competences of the Ministry of organizational structures falling within the scope and provide operational interaction between the minister and heads of these structures;

4) provides monitoring, assessment and the reporting under accomplishment of tasks and strategic directions of activities of the Ministry;

5) is controlled by execution of the regulations initiated by the Ministry;

6) provides project development of regulations, is responsible for their quality from the point of view of observance of requirements of the legislation for their development, reasons, approval, public consultation, examination and completion;

7) is provided by approval of the drafts of the regulations relating to the spheres of activity entrusted to the Ministry, developed by other ministries, the central administrative authorities and bodies of public management;

8) performs other powers and specific functions according to this Provision or at the request of the minister.

14-1. The deputy secretary general of the ministry gives to the minister help in implementation of activities for fulfillment of requirements for accession of the Republic of Moldova to the European Union and submits to the secretary general of the ministry.

14-2. The deputy secretary general of the ministry performs the following powers:

1) provides coordination of process of development and monitoring of fulfillment of requirements for accession of the Republic of Moldova to the European Union;

2) is coordinated by activities of subordinated divisions of central office of the Ministry for goal achievement and realization of the tasks established within fulfillment of requirements for accession of the Republic of Moldova to the European Union;

3) provides planning, monitoring, assessment and the reporting on implementation of actions under fulfillment of requirements for accession of the Republic of Moldova to the European Union;

4) provides development and approval of drafts of regulations according to requirements for accession of the Republic of Moldova to the European Union, according to spheres of competence of the Ministry;

5) performs other powers following from this provision or assigned to him by the minister.

15. In case of absence or impossibility of accomplishment of obligations by one of state secretaries the minister by means of the order makes the decision on its substitution by other state secretary or, in case of their lack or impossibility of accomplishment of the obligations by them - the secretary general of the ministry.

16. In case of absence or impossibility of implementation of the obligations by the secretary general of the ministry of its obligation the deputy secretary general or, if necessary, the state employee head of the Ministry appointed according to the order of the minister performs.

17. The minister, state secretaries, the secretary general of the ministry, the deputy secretary general of the ministry, heads of internal divisions of central office of the Ministry bear responsibility within the powers conferred to them for the made decisions and for activities of the Ministry.

18. In the Ministry the board consisting of the minister (the chairman of board), state secretaries, the secretary general of the ministry, heads of internal divisions of central office of the Ministry, and also heads of the organizational structures relating to the sphere of competence of the Ministry and other persons is created.

19. Numerical and the staff of board affirms the minister, but cannot exceed 15 people.

20. The structure of board, according to the proposal of the minister, can include also representatives of other bodies of the central public management, and also representatives of scientific community, business environment and civil society.

21. The board considers at the meetings the questions concerning the organization of activities of the Ministry for promotion of policy in the managed field of activity, solutions of pressing problems, developments and implementation of forecasts for the long-term and short-term periods discusses the questions connected with activities of administrative authorities subordinated to the Ministry, considers drafts of regulations, submits reports and reports on activities of heads of internal divisions of the Ministry and subordinated administrative authorities for discussion.

22. In the work the board is guided by the regulations on it approved by the order of the minister.

23. With accomplishment of the assigned obligations the minister is helped by office which activities are regulated by the legislation.

24. Correspondence of the Ministry is signed by the minister, state secretaries, the secretary general of the ministry, if necessary, the deputy secretary general of the ministry and responsible officials given this right according to the order of the minister.

25. Official documents of the Ministry are signed by the minister, state secretaries, the secretary general of the ministry, if necessary, the deputy secretary general of the ministry and responsible officials given this right including with use of the digital signature.

26. The ministry cooperates with Parliament within the parliamentary commissions and plenary meetings, including through the representative of the Government in Parliament, with other central and local authorities of public management, business environment and civil society.

27. As a part of the Ministry the commissions and the working groups which are convoked for consideration and permission of specific questions can be created. The commissions specialists from different areas can be involved.
