About approval of Aviation rules of the organization and accomplishment of flights of the state unmanned aerial vehicles of the Republic of Belarus

Based on articles 6 and 57 of the Air code of the Republic of Belarus, subitem 7.4 of Item 7 of the Regulations on the Ministry of Defence of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 7, 2006 No. 719, and Item 1 of the resolution of Council of Ministers of the Republic of Belarus of December 4, 2006 "About implementation of the Air code of the Republic of Belarus" the Ministry of Defence of the Republic of Belarus DECIDES: No. 1617

1. Approve Aviation rules of the organization and accomplishment of flights of the state unmanned aerial vehicles of the Republic of Belarus (are applied).

2. Recognize to invalid:

the resolution of the Ministry of Defence of the Republic of Belarus of December 4, 2009 No. 72 "About approval of Aviation rules of the organization and accomplishment of flights of the state unmanned aerial vehicles of the Republic of Belarus";

the resolution of the Ministry of Defence of the Republic of Belarus of August 24, 2010 No. 37 "About entering of amendments into the resolution of the Ministry of Defence of the Republic of Belarus of December 4, 2009 No. 72";

subitem 1.1 of Item 1 of the resolution of the Ministry of Defence of the Republic of Belarus of March 26, 2019 No. 6 "About change of resolutions of the Ministry of Defence of the Republic of Belarus of December 4, 2009 No. 72 and of December 19, 2016 No. 38".

3. This resolution becomes effective after its official publication.

Aviation rules of the organization and accomplishment of flights of the state unmanned aerial vehicles of the Republic of Belarus

Section I. Basic provisions

Chapter 1. General provisions

1. In these Aviation rules the procedure for the organization and accomplishment of flights of the state unmanned aerial vehicles of the Republic of Belarus is regulated, and also the general requirements imposed to the operators of the state unmanned aerial vehicles and persons exercising control of flights of unmanned aerial vehicles are established.

2. For the purposes of these Aviation rules the following reducings and their concepts are applied:

HELL – the aviation dispatcher of airfield if other is not established by these Aviation rules;

Joint stock bank – the rechargeable battery;

ANI – aeronautical information;

The joint-stock company – airfield ensuring flights;

ARZ – aircraft repair plant;

ASP – aviation weapon of destruction;

AT – the aircraft equipment;

ATO – airfield maintenance of flights;

TANK – pilotless aviation complex;

BLA – the state unmanned aerial vehicle if other is not established by these Aviation rules;

VMU – visual weather conditions;

The runway – landing strip;

VRP – air reconnaissance of weather;

AF – the aircraft with crew onboard if other is not established by these Aviation rules;

HOP – group of ensuring flights;

GRP – group of management of flights;

DOSAAF – republican state public association "Volunteer Society for Cooperation with the Army, Aviation, and Fleet of the Republic of Belarus";

IAO – engineering and aviation ensuring flights;

IAS – engineering air service;

IVP – use of airspace;

IPP – the instruction for production of flights;

ITS – technical structure;

KBP – the rate of combat training or other legal document regulating amount, content and the sequence of training of operators of BLA;

KDP – command control office;

KP – the command post;

KSA – complex of the automation equipment;

KTA – control point of airfield;

MU – weather conditions;

NPEK – land search and evacuation team;

OBU – the officer of fighting management;

OK – objective control;

SMALLPOX – particular case in flight;

OYaP – the dangerous phenomena of weather;

Air defense – air defense;

PVP – the visual flight rules BLA;

PMU – instrument MU;

PNA – Item of targeting of aircraft;

PPP – rules of flights of BLA on devices;

PRL – the landing radar;

PRP – the assistant administrator of flights;

PU – control center (KP, KDP, the starting command post, PNA, control center aircraft);

PUA – control center aircraft;

The PEER – search and evacuation works;

RBZ – the head of near zone;

RD – rulezhny path;

RDZ – the head of distant zone;

RZP – the head of zone of landing;

RLI – radar information;

RLK – radar control of flights;

RLO – radar ensuring flights;

Radar station – radar station;

RLE – management on flight operation of BLA (the document regulating flight operation of BLA);

To HORN – republican state body, other state bodies or the organizations, DOSAAF in activities on to which purpose BLA are used if other is not established by these Aviation rules;

RP – the head of flights;

ATN – the radar-tracking system of landing;

RTO – radio engineering ensuring flights;

RTS – radio engineering means;

REB – radio-electronic fight;

SLI – the station of flight testing;

SNO OP – means of land servicing of common application;

SRL – means of radar-location;

CC and RTO – means of communication and RTO;

THAT both P – maintenance and operational repair;

TsES air traffic management – the center of the Single system of air traffic management of the Republic of Belarus;

TsN – target loading.

3. For the purposes of these Aviation rules terms and their determinations in the values established in the Air code of the Republic of Belarus, Rules of use of airspace of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of November 4, 2006 No. 1471, of the Instruction for use of airspace of the Minsk district of the flight information approved by the resolution of the Ministry of Defence of the Republic of Belarus of November 13, 2017 No. 21, and also the following terms and their determinations are used:

air unit the TANK – the military unit or the organization subordinated to the head to the HORN, the having BLA (TANK) legally and using it for flights;

aviation division the TANK – calculation, aviation group, aviation squadron, and also other primary aviation structure;

ATO – complex of the organizational and technical actions aimed at providing flights of SNO OP;

airfield (helidrome) of joint operation – airfield (helidrome) of the state aircraft on which are based AF (BLA) of air units to two and more HORN;

fighting procedure – relative positioning of BLA in case of collateral execution of flight;

visibility – the maximum distance from the location of BLA from which objects by the operator of BLA with use of the technical means established onboard BLA are visible and are identified;

VRP (additional exploration of weather) – special flight of BLA for refining of meteorological and ornithological situation in the area (on routes) the forthcoming flights, and also for check of working capacity of CC and RTO;

time of preparation of BLA for repeated departure – period of time from the moment of switching off of the engine (engines) after flight (landing in case of switching off of the engine (engines) in air) to readiness for rise of BLA (to taxiing-out of BLA from the place of preparation for the place of take-off);

flight time (raid) of BLA – period of time from the beginning of take-off before the end of landing;

time of management of BLA – total time from the moment of the beginning of start of the first engine before flight (in case of take-off) BLA until switching off of engines after accomplishment of flight of BLA (release of landing parachute) during which the operator managed BLA;

the official organizing flights – the commander (chief) of air unit the TANK or other official to who according to the decision of the head to the HORN (governing body of aircraft) the obligation on the organization of flights in air unit the TANK is assigned;

task for flight – the established (set) commander (chief) operator set of elements of flight BLA, procedure and the sequence of their accomplishment, and also condition in case of which they are carried out. Elements of flight are determined in KBP;

control management of BLA – management which is carried out by the trained operator of BLA under control of the operator-instructor for the purpose of check of level of training of the operator to management of BLA and its TsN according to task for flight;

flight change – the period of time determined in the planned table of flights of BLA during which flights are carried out;

MU – set of the meteorological elements and atmospheric phenomena observed in the area or on route of flight of BLA exerting impact on task performance on flight;

navigation situation – set of the elements characterizing basing of aircraft, distribution of airspace, relief, MU, natural lighting, the equipment of the area of flights of BLA (AF) of CC and RTO, means of RLO;

land preparation – process of forming and enhancement at cadets of knowledge, abilities, skills and professional qualities necessary for accomplishment of functional obligations in case of management of BLA (management of flights of BLA);

general preparation – process of reduction in readiness of operators of BLA and persons exercising control of flights (except for cadets), to management of BLA (management of flights of BLA) and accomplishment of tasks on purpose the forthcoming month;

the operator-instructor – the operator of BLA (the operator of TsN) having the admission to instructor work;

the operator of TsN – the face of aviation personnel exercising control of TsN BLA with use of technical means;

governing body of flights – GRP, calculations of PNA on duty and duty shift of the 570th center of air traffic management, and also the calculations of PUA exercising control of flights of BLA (crews of AF);

the organization of flights – complex of the events held under the leadership of the corresponding officials of air unit the TANK and parts (divisions) of providing by determination of tasks of flights of BLA (flight change), procedure and the sequence of their accomplishment and to reduction in readiness of forces and means *, involved in their carrying out to accomplishment, management and ensuring flights of BLA;

governing bodies of aircraft – governing bodies or structural divisions to the HORN which forces perform the organization and management of activities for purpose of air units (divisions) the TANK of the to the HORN;

development like (modification) the TANK or BLA – process of acquisition by aviation personnel of necessary knowledge, the skills providing safe operation the TANK (BLA);

OYaP – values of meteorological elements and the atmospheric phenomena which make impossible safe accomplishment of flights in zone of their arrangement (influence) or create threat of safety of AT in airfield;

PVP – procedure for accomplishment of flights in the conditions allowing the operator to determine with use of the technical means established on BLA location and space provision BLA by land reference points and the natural horizon visually (instrumentalno) to keep the established intervals between AF (BLA), and also between BLA and other material objects in air and on land (water) surface;

reeducation on for the first time the mastered type (modification) the TANK or BLA (further if other is not determined, – reeducation) – the complex of organizational and practical actions held for the purpose of training of operators of BLA for operation for the first time the mastered type (modification) the TANK or BLA to established in KBP (special programs) of level;

the planned table of flights of BLA – the document of the established sample in which graphical and tekstualno are stated (are reflected) the decision of the commander of air unit the TANK (the official organizing flights) on carrying out flights and task to operators of BLA;

training of operators of BLA – process of theoretical and skills training (enhancement) of operators in management of BLA. Types of training of operators in practical management of BLA are determined in KBP (special programs);

division of providing – the organization, service (department) or the military division performing ensuring activities of air unit (division) the TANK by the corresponding types of ensuring flights;

the airfield of BLA – specially prepared parcels of land or the artificial platform suitable for take off and landing of BLA if necessary having marking and equipped with controls, providing for carrying out flights (further if it is specially not stipulated, – the airfield);

the airfield of BLA temporary – the site of land, water or other surface which picked up staff of calculation the TANK (the operator of BLA) suitable for take off and landing of BLA (further if it is specially not stipulated, – the temporary airfield);

PPP – procedure for accomplishment of flights in conditions under which the location and space provision BLA are determined by flight and navigation devices;

preliminary preparation – reduction in readiness of forces and means involved in their carrying out for accomplishment of tasks of flights;

preflight preparation – reduction in readiness of forces and means involved in their accomplishment, management and providing for carrying out flights taking into account the meteorological, ornithological, air and land situation which is specifically developing for this time;

carrying out flights – process of coordinated actions of aviation personnel on accomplishment, management and ensuring flights of BLA;

duration of flight change – time counted from the moment of the beginning of take-off of the first and until the end of landing of the last BLA in flight change. Duration of flight change does not join time for preparation and accomplishment of VRP;

production of flights – process of coordinated actions of aviation personnel on the organization, carrying out and blamestorming session of BLA;

The PEER – complex of the actions directed to timely detection of BLA which was injured disaster, and its evacuation from the place of detection;

the intelligence agent of weather – the operator of BLA who is carrying out VRP;

calculation the TANK – primary tactical unit including the TANK and aviation personnel;

RLK – complex of the actions which are carried out by forces and means of divisions of communication and RTO, divisions of RLO for providing RLI of persons exercising control of flights for the purpose of determination of location of BLA in airspace;

administrative board of air unit the TANK – officials of aviation personnel of air unit the TANK from the commander of aviation division the TANK (the chief of service) and above;

independent management of BLA – management which is carried out by the operator of BLA without control of the operator-instructor;

SRL – land radar complexes (stations, except for ATN), the radio altimeters appointed for RLO;

CC and RTO – the land regular radio engineering and lighting equipment of divisions of communication and RTO intended for ensuring flights;

starting time – period of time during which the operator has the right to manage BLA, and persons which are part of GRP – to manage flights of BLA. Starting time is counted from the actual time of the first departure of BLA;

the BLA type – all BLA of the same standard design, including all their modifications. The BLA type is established by his developer;

management of BLA – traffic control of BLA;

management of flights of BLA – purposeful activities of officials of governing bodies of flights for transfer of flight conditions, teams and information to operators of BLA for timely and safe accomplishment by them of tasks for flight;

steady MU – MU expressed in visibility range sizes, quantity and height of the lower bound of clouds which during execution of tasks for flight will not change towards deterioration and also are absent conditions for formation of OYaP;

TsN – the target equipment and (or) arms established on BLA allowing to carry out tasks on purpose the TANK;

the headquarters of air unit the TANK – governing body (structural division) of air unit the TANK which is directly organizing the activities of air unit the TANK connected with production of flights of BLA.

4. In the HORN, depending on structure of forces and means of their air units, tasks on purpose, if necessary and under approval of specially authorized body in the field of defense local legal acts (further if other is not determined, – local acts HORNS) can be developed in which taking into account the requirements stated in these Aviation rules features of their activities for questions of the organization and accomplishment of flights of BLA in part are determined:

4.1. accomplishment of fighting and special (office) tasks for the purpose of:

reflections of air attack, suppression of the act of terrorism, prevention and the termination of violations of Frontier of the Republic of Belarus or the armed invasion on the territory of the Republic of Belarus;

prevention and the terminations of violations of the requirements stated in Rules of use of airspace of the Republic of Belarus;

ensuring boundary safety of the Republic of Belarus;

conducting investigation and search operations;

carrying out on criminal cases and materials of checks according to statements (messages) on crimes, investigative and other legal proceedings;

search of the crews and aircrafts which were injured disaster, assistance in case of emergency situations of natural and technogenic nature in other cases, life-threatening and (or) to health of citizens;

accomplishment of the special tasks connected with ensuring public safety and law and order;

4.2. amendments:

obligations of persons which are part of calculation the TANK;

requirements imposed to preparation and the admission of persons from structure of calculation the TANK (BLA) to execution of the job responsibilities;

the most admissible quantity and time of managements of BLA for the operator in flight change;

features of the organization and accomplishment of flights on carrying out aviation works;

features of procedure for the organization of management of flights of BLA;

features of the organization and carrying out flights of BLA on the airfield, need of appointment and structure of GRP, GOP, posts and their equipment, appointment of other persons providing flights of BLA;

necessary types of ensuring flights of BLA, amount and content of the events held on them;

procedure for preparation and carrying out PEER of BLA;

the list, forms and procedure for maintaining the necessary documents which are not established in these Aviation rules.

Chapter 2. Types of flights of unmanned aerial vehicles

5. Flights of BLA on purpose are subdivided on fighting, educational and special.

Fighting flight – weeds BLA which is managed by the operator in case of accomplishment of fighting task.

Educational flight – weeds BLA which is managed by the operator in the educational purposes in case of task performance according to KBP (programs of training of operators of BLA).

Special flight – weeds BLA which is managed by the operator in case of accomplishment of office (special) tasks. Test, research and control flights of BLA, flights of BLA, flights on accomplishment of flight checks land CC and RTO, SRL, demonstration flights, flights on accomplishment of VRP (additional exploration of weather) and aviation works also belong to special flights.

6. On accomplishment MU flights of BLA are subdivided into flights in VMU and PMU.

Flights in clouds, between layers of clouds and behind clouds belong to flights in PMU in case of cloudiness of 7 and more points. All other flights belong to flights in VMU.

Chapter 3. State unmanned aerial vehicles

7. BLA are to destination subdivided on fighting and special.

Fighting BLA are intended for accomplishment of fighting tasks.

Special BLA are intended for accomplishment of the tasks connected with use of the special equipment installed on them.

Fighting and special BLA can be used for accomplishment of educational flights on exercises of KBP, programs of training of operators of BLA and special flights.

8. Besides, BLA can be classified in the HORN (by the level of solvable tasks, the principle of creation of management system (level of functional independence of BLA), the principle of creation of carrying power, reusability of application, quantity and type of engines, type of the applied fuel, mass, dimensional, high-rise and high-speed characteristics and other signs characterizing them).

Chapter 4. Senior aviation chief of airfield of the state aircraft

9. The senior aviation chief of airfield of the state aircraft (further if other is not established by these Aviation rules, – the senior aviation chief) is the commander (chief) of air unit (air unit the TANK), as a rule, based on airfield.

In case of absence in airfield of the based air units (air units the TANK) the senior aviation chief is the commander (chief) of military unit (division) or the organization which is constantly based on airfield.

The senior aviation chief is appointed by the head to the HORN under which authority the airfield, or the official, it authorized is (the head of governing body of aircraft).

10. The senior aviation chief will organize observance in airfield of established procedure of ensuring flights.

In case of appointment of air unit as the senior aviation chief of the commander (air unit the TANK) obligations on observance in airfield of established procedure of the organization and accomplishment of flights, and also managements by them are in addition assigned to it.

11. Commanders (chiefs) of other air units (the air units the TANK) which are based on airfield (using airfield), on the questions listed in Item 10 of these Aviation rules submit to the senior aviation chief.

12. The senior aviation chief in case of aviation incident around airfield and zone of responsibility of governing body of flights of this airfield is guided by legal acts in which the procedure for transmission of messages, investigation and accounting of aviation events is established.

Section II. Calculation of pilotless aviation complex

Chapter 5. General provisions

13. Quantitative structure of calculation the TANK the commander (chief) of air unit establishes the TANK proceeding from solvable tasks (classification of BLA) according to the requirements stated in operational documentation the TANK (BLA).

14. Except the operator (operators) of BLA in calculation the TANK the operator (operators) of TsN BLA, the engineer (technician) the TANK and other officials from among aviation personnel having the corresponding specialty (preparation) and fulfilling functional duties as a part of calculation the TANK can be appointed.

In the presence in calculation the TANK of two and more operators one of them is appointed the senior. The chief (commander) of calculation the TANK is appointed the operator of BLA.

15. Calculation the TANK, as a rule, consists of citizens of the Republic of Belarus. Inclusion in calculation the TANK of the foreign citizens having the corresponding specialty (preparation) is performed based on international treaties of the Republic of Belarus, legal acts of the Republic of Belarus by order of (decision) of the head to the HORN.

16. The members of calculation the TANK for accomplishment of flights of BLA are determined in the order of the commander (chief) of air unit the TANK and (or) the planned table of flights of BLA (flight leaf).

17. In case of accomplishment of flight of BLA which duration exceeds regulations of load of the operator according to the decision of the commander (chief) of air unit (the official organizing flights) of calculation the TANK in addition is included the necessary number of operators.

18. The TANK can be included in structure of calculation checking (operator-instructor).

Checking (operator-instructor), carrying out inspection or training of the operator (the cadet, the listener), is senior in calculation the TANK. He is responsible for safety of flight irrespective of whether it manages BLA personally or transferred control to the checked (trained) operator of BLA.

Chapter 6. The general requirements imposed to operators of unmanned aerial vehicles

19. Operators of BLA designate persons from among aviation personnel having the corresponding preparation established in the HORN and cadets (listeners) of organizations of education fit for health reasons for management of BLA and the acting as as a part of calculation the TANK according to RLE.

20. Operators of BLA shall conform to qualifying standards to the state of health.

21. Operators of BLA (operators of TsN) within the job (special) responsibilities shall have knowledge necessary for successful task performance on flight.

Operators of BLA (operators of TsN) shall have knowledge:

in the field of the legislation concerning IVP;

acts of the legislation concerning the organization, accomplishment and ensuring flights, methodical documents;

structures, general principles of work and service regulations of elements (systems, equipment) TANK;

methods of collection, processing, the analysis and use of information obtained from onboard and land control facilities and registration of flight data;

flight operation of BLA in volume of RLE, guidelines and education guidances on BLA of the corresponding types;

procedure for conducting radio exchange and its phraseology;

procedure for application of the flights of BLA CC and RTO used in case of accomplishment to know their main tactical specifications;

procedure for maintaining number-specific (operational) documentation;

aviation meteorology and ornithology;

in the field of safety of flights (safety requirements on stages of flight of BLA, and also signs and actions in case of particular cases and emergencies in air and on the earth).

22. The operator of BLA (the operator of TsN) within the job (special) responsibilities shall be able:

perform preparation for flights, survey and servicing of BLA according to RLE;

perform task for flight with observance of the requirements stated in aviation rules;

operate BLA in flight according to RLE;

reveal and distinguish dangerous factors, predict possibility of their manifestation, and also develop actions for their elimination (localization), decrease in their impact;

determine SMALLPOX, to be effective competently in case of their origin;

perform communication with governing body of flights with observance of procedure for conducting radio exchange and its phraseology;

perform the choice of line item for investment of funds of management of BLA, carry out their expansion and folding as a part of calculation the TANK.

23. Besides, in the HORN (governing bodies of aircraft to the HORN) also other requirements imposed to operators of BLA (operators of TsN) taking into account features of their activities can be established.

Chapter 7. Obligations, rights and responsibility of staff of calculation of pilotless aviation complex

24. Persons from structure of calculation the TANK when carrying out flights of BLA shall:

observe procedure for task performance on flight and the requirements stated in RLE;

to precisely follow instructions of the governing body of flights exercising control of flights of BLA. In case of explicit safety hazard of flight of BLA the operator can make the decision on departure from instructions of governing body of flights, but, whenever possible, according to statutory rules of flights. To calculation the TANK is forbidden to stop communication with governing body of flights under whose management there is flight of BLA, and also to pass without its permission to communication with other governing body of flights;

observe air, land situation and MU. In case of detection of OYaP or dangerous rapprochement with other BLA (AF) to take all feasible measures for ensuring safe continuation of flight of BLA;

take all feasible measures to preserving life and human health, and also, whenever possible, preserving BLA in case of SMALLPOX.

25. The operator of BLA shall:

prepare for management of BLA according to task for flight and for actions in SMALLPOX;

direct preparation and estimate readiness of staff of calculation the TANK to task performance on flight;

nobility:

safety requirements of flights on the planned task for flight;

procedure for use of documents ANI;

the main tactical specifications and procedure for application of the flights of BLA CC and RTO used in case of accomplishment, including in case of their limited use (without use);

the features of piloting of BLA, navigation and operation of BLA engines ensuring safety of accomplishment of flights;

observe the preflight mode;

inspect, check and accept BLA before flight according to RLE;

make the final decision on departure, flight and landing of BLA;

analyze meteorological, ornithological, air and land situation before flight and during flight of BLA, report on OYaP in governing body of flights under control of which it is;

manage BLA according to task for flight;

direct work of staff of calculation the TANK;
