About cases and terms of use of the biometric personal data placed by physical persons in single biometric system with use of mobile application of single biometric system

According to part 13 of article 4 of the Federal law "About Implementation of Identification and (or) Authentication of Physical Persons with Use of Biometric Personal Data, about Modification of Separate Legal Acts of the Russian Federation and Recognition Voided Separate Provisions of Legal Acts of the Russian Federation" Government of the Russian Federation decides:

1. Approve enclosed approved with Federal Security Service of the Russian Federation:

cases and terms of use of the biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system including in the absence of the information about the physical person in single system of identification and authentication;

cases and terms of use of the biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system, the consent of physical person to placement and which processing signed the simple digital signature;

cases and terms of use of the biometric personal data placed in single biometric system with use of mobile application of single biometric system without confirmation of the identity of physical person with use of the identity document of the citizen of the Russian Federation outside the territory of the Russian Federation containing the electronic medium of information with the personal data of the owner of the passport which are written down on it including biometric personal data, the state system of migration and registration registration, and also production, registration and control of the circulation of identity documents.

2. This resolution becomes effective since March 1, 2023 and is effective till March 1, 2029.

Cases and terms of use of the biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system including in the absence of the information about the physical person in single system of identification and authentication

1. The biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system, the consent of physical person to placement and which processing it is signed by the strengthened qualified digital signature strengthened by the unqualified digital signature according to part 2 of article 4 of the Federal law "About Implementation of Identification and (or) Authentication of Physical Persons with Use of Biometric Personal Data, about Modification of Separate Legal Acts of the Russian Federation and Recognition Voided Separate Provisions of Legal Acts of the Russian Federation" (further - the Federal Law) or till January 1, 2027 the simple digital signature which key is received by physical person in case of corporal appearance according to Rules of use of the simple digital signature when rendering the state and municipal services, approved by the order of the Government of the Russian Federation of January 25, 2013 No. 33 "About use of the simple digital signature when rendering the state and municipal services", according to part 10 of article 26 of the Federal Law, in the presence of the information about the physical person in single system of identification and authentication and if the personality of physical person is confirmed with use of the identity document of the citizen of the Russian Federation outside the territory of the Russian Federation containing the electronic medium of information with the personal data of the owner of the passport which are written down on it including biometric personal data, the state system of migration and registration registration, and also production, registration and control of the circulation of identity documents, can be used in the following cases:

a) conducting entrance tests in case of acceptance on training, intermediate and final assessment according to educational programs of the higher education - to programs of bachelor degree, programs of specialist programme, programs of magistracy;

b) implementation of clearing settlements in the organizations of trade and service industry, for the purpose of tax payment, charges, the insurance premiums and other payments which are sources of forming of the income of budgets of budget system of the Russian Federation in the amount which is not exceeding 5000 rubles including the value added tax;

c) participation in programs of the organizations of trade and service industry with use of the bank (payment) and (or) discount (accumulative) cards directed to increase in activity of clients in purchase of goods and services of the specified organizations and bonuses providing charge (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) on the bases established in the appropriate program and also payment depending on quantity of the added bonuses (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) the income in cash or natural form;

d) implementation by credit institutions, not credit financial credit institutions which perform the types of activity specified in part one of article 76.1 of the Federal law "About the Central Bank Russian Federation (Bank of Russia)", subjects of national payment system (further - the organizations of the financial market) additional authentication of the client - physical person in case of its remote servicing with observance of the requirements to ensuring information security established by the legislation of the Russian Federation and regulations of the Central bank of the Russian Federation provided that such client was identified earlier by this organization of the financial market according to the procedure, established by the Federal Law "About Counteraction of Legalization (Washing) of Income Gained in the Criminal Way and to Terrorism Financing";

e) implementation of the financial market of authentication of the client by the organizations - physical person in case of its servicing in case of personal presence at the cases which are not contradicting requirements of the legislation of the Russian Federation and regulations of the Central bank of the Russian Federation provided that such client was identified earlier by this organization of the financial market according to the procedure, established by the Federal Law "About Counteraction of Legalization (Washing) of Income Gained in the Criminal Way and to Terrorism Financing";

e) implementation of payment of journey on transport with use of information systems;

g) implementation of pass in the territory of state bodies and the organizations by means of control and management system for access in the territories of these bodies and organizations, except for the organizations of defense and industrial, atomic power industrial, nuclear, weapon, chemical, fuel and energy complexes, the organizations relating to objects of transport infrastructure, subjects of critical information infrastructure of the Russian Federation, objects, making of act of terrorism on which can lead to emergence of emergency situations with dangerous social and economic effects according to the categorization which is carried out to execution of requirements to anti-terrorist security of objects (territories) developed according to Rules of development of requirements to anti-terrorist security of objects (territories) and the material safety data sheet of objects (territories), approved by the order of the Government of the Russian Federation of December 25, 2013 No. 1244 "About anti-terrorist security of objects (territories)", sensitive sites according to the Presidential decree of the Russian Federation of November 30, 1995 No. 1203 "About approval of the list of the data carried to the state secret";

h) conclusion of service provision agreements of communication;

i) ensuring identification of the visitor of sports competition for the purpose of design of the personified card for visit of sports competition;

j) implementation of authentication in the federal state information system "Single Portal of the State and Municipal Services (Functions)";

k) implementation of identification and (or) authentication with use of mobile application of the federal state information system "Single Portal of the State and Municipal Services (Functions)" without presentation of the identity document of the citizen of the Russian Federation, in case of its personal presence at the cases determined by the Government of the Russian Federation according to regulatory legal act of the President of the Russian Federation;

l) implementation of authentication in departments of mail service of Russian Post joint-stock company;

m) identification of participants of legal procedure;

o) implementation of authentication on the websites on the Internet, except for social networks and blogs, in information systems and mobile applications of the organizations, except for the organizations of the financial market, mobile applications of services of placement of announcements, aggregators of information on goods or services and the organizations realizing educational programs using electronic training and remote educational technologies;

o) implementation of sale of alcoholic products, nonalcoholic tonics (including energy), tobacco products or nikotinsoderzhashchy products, hookahs and devices for consumption of nikotinsoderzhashchy products;

p) implementation of retail trade the medicines for medical application released according to the recipe on medicine including by remote method within carrying out the experiment provided by part 1 of article 55.1 of the Federal law "About Drug Circulation";

c) carrying out consultations, consultations using telemedicine technologies, and also remote medical observation of the state of health of the patient within the Program of experimental legal regime in the field of digital innovations in the direction of medical activities using technologies of collection and processing of data on the state of health and diagnoses of citizens concerning realization of initiative of social and economic development of the Russian Federation "Personal medical assistants", approved by the order of the Government of the Russian Federation of December 9, 2022 No. 2276 "About establishment of experimental legal regime in the field of digital innovations and approval of the Program of experimental legal regime in the field of digital innovations in the direction of medical activities using technologies of collection and processing of data on the state of health and diagnoses of citizens concerning realization of initiative of social and economic development of the Russian Federation "Personal medical assistants";

r) performing medical examinations with use of the medical products providing the automated remote information transfer about the state of health of workers and remote control of condition of their health;

s) ensuring additional authentication when carrying out shareholder voting electronically;

t) carrying out vote electronically within the general meetings of owners of rooms in apartment houses;

x) provision in lease, including short-term (no more than a month), vehicles for the purposes which are not connected with implementation by the physical person specified in paragraph one of this Item, business activity (karshering);

v) identification of drivers of automobile taxi;

w) confirmation of age of the visitor of the museum and (or) spectacular action;

x) confirmation of bonus right and (or) right to free servicing;

y) confirmation of the fact of finding of the citizen of the Russian Federation in live for the purpose of prolongation of payment of insurance pension and fixed payment to insurance pension to the citizen of the Russian Federation leaving (left) on permanent residence of the territory of the Russian Federation to whom the specified pension and fixed payment to it are established according to the Federal Law "About Insurance Pensions";

z) implementation of pass in the territory of the preschool educational organizations and the general education organizations by means of control and management system for access;

aa) implementation of authentication in case of pass on objects of sport and sporting events, except as specified, when identification and authentication of the audience, participants of official sports competitions, the other persons involved in holding such competitions are obligatory and are performed using the personified card for visit of sports competition;

bb) settling in hotel, sanatorium, rest house, boarding house, camping, on tourist center or in other similar organization;

I (1)) carrying out identification of the applicant - physical person for the purpose of creation of certificates of keys of verification of digital signatures by certification center and issue of such certificates to applicants - to physical persons.

2. The biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system in the absence of the information about the physical person in single system of identification and authentication can be used in the following cases:

a) participation in programs of the organizations of trade and service industry with use of the bank (payment) and (or) discount (accumulative) cards directed to increase in activity of clients in purchase of goods and services of the specified organizations and bonuses providing charge (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) on the bases established in the appropriate program and also payment depending on quantity of the added bonuses (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) the income in cash or natural form;

b) implementation of payment of journey on transport with use of information systems;

c) carrying out vote electronically within the general meetings of owners of rooms in apartment houses;

d) ensuring additional authentication for access to personal accounts of the platforms and services rendering services of e-mail, the product delivery of food, nonfoods, and also deliveries by remote method of goods by means of the Internet, viewing of movies.

2(1). The biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system and confirmed according to the procedure, provided by Items 11 (1) or 11(2) Rules of placement of the biometric personal data by physical persons in single biometric system with use of mobile application of single biometric system approved by the order of the Government of the Russian Federation of June 15, 2022 No. 1066 "About placement of the biometric personal data by physical persons in single biometric system with use of mobile application of single biometric system" can be used in cases, the stipulated in Item 1 this document, and also in the following cases:

a) implementation of identification and (or) authentication for acceptance on servicing or customer service - physical persons the organizations performing transactions with the money or other property specified in article 5 of the Federal law "About Counteraction of Legalization (Washing) of Income Gained in the Criminal Way and to Terrorism Financing", regulation, control and of which in accordance with the legislation of the Russian Federation exercises supervision the Central bank of the Russian Federation, in the cases which are not contradicting requirements of the legislation of the Russian Federation;

b) provision of the state and municipal services in case of personal acceptance in the multipurpose centers of provision of the state and municipal services according to the Rules of the organization of activities of the multipurpose centers of provision of the state and municipal services approved by the order of the Government of the Russian Federation of December 22, 2012 No. 1376 "About approval of Rules of the organization of activities of the multipurpose centers of provision of the state and municipal services" in the list according to appendix;

c) implementation of clearing settlements in the organizations of trade and service industry, and also for the purpose of tax payment, charges, the insurance premiums and other payments which are sources of forming of the income of budgets of budget system of the Russian Federation;

d) provision to users of platform of digital ruble of access to platform of digital ruble for the purpose of making of transactions with digital rubles;

e) design of the card for participation in the Pushkin Card program;

e) receipt of measure of social protection (support) with use of the electronic certificates provided by the Federal Law "About Acquisition of Separate Types of Goods, Works, Services with Use of the Electronic Certificate";

g) identification of the identity of the investor for the purpose of provision in Deposit Insurance Agency electronically statements for payment of compensation for deposits according to the procedure, established by the Federal Law "About Deposit Insurance in Banks of the Russian Federation";

h) carrying out identification and (or) authentication of physical person for the purpose of the conclusion or change of the service provision agreement of communication;

i) implementation of pass in the territory of state bodies and the organizations by means of control and management system for access in the territories of these bodies and organizations, including organizations of defense and industrial, atomic power industrial, nuclear, weapon, chemical, fuel and energy complexes, the organizations relating to objects of transport infrastructure, subjects of critical information infrastructure of the Russian Federation, objects, making of act of terrorism on which can lead to emergence of emergency situations with dangerous social and economic effects according to the categorization which is carried out to execution of requirements to anti-terrorist security of objects (territories) developed according to Rules of development of requirements to anti-terrorist security of objects (territories) and the material safety data sheet of objects (territories), approved by the order of the Government of the Russian Federation of December 25, 2013 No. 1244 "About anti-terrorist security of objects (territories)", sensitive sites according to the Presidential decree of the Russian Federation of November 30, 1995 No. 1203 "About approval of the list of the data carried to the state secret".

3. The biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system can be used in the cases specified in Item 2 of this document including if the personality of physical person is not confirmed with use of the identity document of the citizen of the Russian Federation outside the territory of the Russian Federation containing the electronic medium of information with the personal data of the owner of the passport which are written down on it including biometric personal data, the state system of migration and registration registration, and also production, registration and control of the circulation of identity documents, and the consent of physical person to placement and processing of the specified biometric personal data signed the simple digital signature, the right of creation (replacement) and which issue of key according to the procedure, stipulated by the legislation the Russian Federation in the field of use of digital signatures, the operator of single biometric system according to part 3 of article 4 of the Federal Law strengthened by the unqualified digital signature according to part 2 of article 4 of the Federal Law or strengthened by the qualified digital signature has.

4. The biometric personal data placed in single biometric system according to Rules of placement of the biometric personal data by the physical persons in single biometric system with use of mobile application of single biometric system approved by the order of the Government of the Russian Federation of June 15, 2022 No. 1066 "About placement of the biometric personal data by physical persons in single biometric system with use of mobile application of single biometric system" are used no more than 3 years from the date of their placement in single biometric system.

5. Updating of biometric personal data in single biometric system is performed by physical person voluntarily after the term specified in item 4 of this document or at the initiative of physical person before the expiration of such term. Such updating is performed according to requirements to placement of biometric personal data in single biometric system, the statutory rules specified in item 4 of this document.

Appendix

to cases and terms of use of the biometric personal data placed by physical person in single biometric system with use of mobile application of single biometric system including in the absence of the information about the physical person in single system of identification and authentication

The list of services by which provision identification of physical person in case of the personal acceptance in the multipurpose centers of provision of the state and municipal services with use of the biometric personal data placed in single biometric system with use of mobile application of single biometric system and confirmed according to the procedure provided by Items 11 is allowed (1) or 11(2) Rules of placement of the biometric personal data by physical persons in single biometric system with use of mobile application of single biometric system approved by the Order of the Government of the Russian Federation of June 15, 2022 No. 1066 "About placement of the biometric personal data by physical persons in single biometric system with use of mobile application of single biometric system"

1.	State registration of legal entities, physical persons as individual entrepreneurs and peasant farms
2.	Provision in property, lease, permanent (termless) use, free use of the parcels of land which are in federal property without tendering
3.	Issue of the state certificate on the maternity (family) capital
4.	Consideration of the application about the order means (part of means) of the maternity (family) capital
5.	Acceptance, consideration of the applications (notifications) of insured persons for the purpose of realization by them is right during the forming and investment of means of pension accruals and decision making on them
6.	Provision of compensation for expenses on payment of fare to the vacation spot in the territory of the Russian Federation and back to the pensioners who are receivers of insurance pensions on old age and disability and living in the region of the Far North and the areas equated to them
7.	Provision of some measures of social support in type of compensations and money payments to the citizens who were affected by radiation owing to nuclear testing and technogenic catastrophes
8.	Provision of some measures of social support in type of money payments and compensations by the serviceman and to members of their families
9.	Provision to the disabled people (including to handicapped children) having vehicles according to medical indications or their legal representatives of compensation in the amount of 50 percent from the insurance premium paid by them on the agreement of obligatory civil liability insurance of owners of vehicles
10.	Provision of lump-sum allowance to the pregnant wife of the serviceman undergoing military service

Provision of lump-sum allowance in case of the child's birth to the women dismissed during pregnancy, maternity leave and persons dismissed during child care leave in connection with liquidation of the organizations, the termination of activities by physical persons as individual entrepreneurs, the termination of powers by the notaries who are engaged in private practice, and the termination of the status of the lawyer and also in connection with the termination of activities by other physical persons whose professional activity according to the Federal Laws is subject to state registration and (or) licensing, and also persons which are not subject to compulsory social insurance on case of temporary disability and in connection with motherhood including which is studying full-time in the professional educational organizations, the educational organizations of the higher education educational organizations of additional professional education and scientific organizations
12.	Provision of monthly allowance on the child of the serviceman undergoing military service
13.	Provision of monthly allowance on child care to the women dismissed during pregnancy, maternity leave and persons dismissed during child care leave in connection with liquidation of the organizations, the termination of activities by physical persons as individual entrepreneurs, the termination of powers by the notaries who are engaged in private practice, and the termination of the status of the lawyer and also in connection with the termination of activities by other physical persons whose professional activity according to the Federal Laws is subject to state registration and (or) licensing, and also persons which are not subject to compulsory social insurance on case of temporary disability and in connection with motherhood including which is studying full-time in the professional educational organizations, the educational organizations of the higher education educational organizations of additional professional education and scientific organizations
14.	Provision of lump-sum allowance by transfer of the child on education in family
15.	Provision of maternity allowance to the women dismissed during pregnancy, maternity leave and persons dismissed during child care leave in connection with liquidation of the organizations, the termination of activities by physical persons as individual entrepreneurs, the termination of powers by the notaries who are engaged in private practice, and the termination of the status of the lawyer and also in connection with the termination of activities by other physical persons whose professional activity according to the Federal Laws is subject to state registration and (or) licensing
16.	Provision of the parcel of land which is in the state-owned or municipal property without the biddings

i) ensuring identification of the visitor of sports competition for the purpose of design of the personified card for visit of sports competition;

j) implementation of authentication in the federal state information system "Single Portal of the State and Municipal Services (Functions)";

h) implementation of clearing settlements in the organizations of trade and service industry, for the purpose of tax payment, charges, the insurance premiums and other payments which are sources of forming of the income of budgets of budget system of the Russian Federation in the amount which is not exceeding 2500 rubles including the value added tax;

i) participation in programs of the organizations of trade and service industry with use of the bank (payment) and (or) discount (accumulative) cards directed to increase in activity of clients in purchase of goods and services of the specified organizations and bonuses providing charge (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) on the bases established in the appropriate program and also payment depending on quantity of the added bonuses (points, other units characterizing activity of the client in purchase of goods and services of the specified organizations) the income in cash or natural form;
