About creation and functioning of National infrastructure of space data

Based on paragraphs of the eleventh or fourteenth of Article 10, No. 396-Z "About geodetic and cartographic activities" and in pursuance of paragraph two of article 2 of the Law of the Republic of Belarus of December 13, 2021 No. 132-Z "About change of the Law of the Republic of Belarus "About geodetic and cartographic activities" the Council of Ministers of the Republic of Belarus DECIDES: parts three of article 22 of the Law of the Republic of Belarus of July 14, 2008

1. Approve:

The regulations on National infrastructure of space data (are applied);

The regulations on the National geoportal (are applied);

The regulations on procedure for provision in use and uses of sets of basic space data and sets of thematic space data from the list of obligatory sets of space data (are applied);

the list of obligatory sets of the space data, their suppliers, the scope of information included in such sets terms of updating (is attached);

the list of space data, distribution and (or) provision of which it is limited and which are not subject to open publication it (is applied).

2. To provide to the state committee on property till December 31, 2025 creation of the National geoportal.

3. To provide to the republican state bodies, local executive and administrative organs, other organizations subordinated to the Government of the Republic of Belarus:

reduction within year of the regulatory legal acts in compliance with this resolution;

forming and updating of sets of the space data included in the list of obligatory sets of space data, creation, maintaining and (or) upgrade of services for these sets, forming and updating of metadata about these sets of space data and services for them;

placement of obligatory sets of space data and services for these sets included in National infrastructure of space data on the National geoportal;

access to the information resources containing sets of space data, users included in National infrastructure of space data by means of information and communication technologies and also distribution and exchange of sets of space data on the global computer Internet with use of the National geoportal and taking into account the requirements and restrictions determined by the legislation on office information of limited distribution and on trade secret;

acceptance of other measures for implementation of this resolution.

4. This resolution becomes effective in the following procedure:

Items 1, 2 both paragraphs two and the sixth of Item 3 – after official publication of this resolution;

paragraphs the third or fifth Item 3 and regarding functioning of National infrastructure of space data, the National geoportal – since January 1, 2026.

Regulations on National infrastructure of space data

1. This Provision determines procedure for creation, functioning and development of National infrastructure of space data, and also procedure for carrying out the analysis of its functioning.

2. Creation, functioning and development of National infrastructure of space data, the analysis of its functioning will be organized by the State committee on property.

3. In this Provision terms and their determinations in the values established by the Law of the Republic of Belarus "About geodetic and cartographic activities", the Law of the Republic of Belarus of November 10, 2008 No. 455-Z "About information, informatization and information security" and also the following terms and their determinations are used:

the operator of the National geoportal – the state specialized organization subordinated to the State committee on property, authorized by this Committee on creation, maintaining (updating, operation), program and technical support and upgrade of complex of program technical means of the National geoportal, carrying out the analysis of functioning of National infrastructure of space data, and also rendering other services for its functioning;

the user – state body, other organization, physical person, including the individual entrepreneur having information access for search of sets of space data and services for these sets on their metadata by means of the National geoportal and using them for the purpose of which are not contradicting the legislation;

the agreement on access, exchange and use of sets of space data (further – the agreement) – the agreement regulating provision conditions in the use and uses of sets of the space data included in National infrastructure of space data, concluded between the operator of the National geoportal and the supplier.

4. This Provision extends to suppliers, and also to users of sets of space data, services for these sets and metadata about such sets and services.

Suppliers can act at the same time as users of sets of space data, services for these sets, metadata about these sets and services for them.

5. Main objective of creation of National infrastructure of space data is providing by means of information and communication technologies of access for suppliers and users to the distributed information resources of the Republic of Belarus containing sets of space data, and also distribution and exchange of sets of space data in the global computer Internet.

6. Standard components of National infrastructure of space data are:

sets of basic space data;

sets of thematic space data;

National geoportal;

services for sets of space data;

metadata about sets of space data and services for these sets.

National infrastructure of space data is created taking into account ensuring interoperability of sets of space data by means of application of single formats of exchange, provision of sets of space data, single standards of the description and representation of sets of space data, single standards of the description of metadata on sets of space data and services for these sets, single protocols of exchange of information.

7. Fundamental components of National infrastructure of space data are sets of basic space data and sets of thematic space data created at the expense of means republican and (or) local budgets.

Sets of basic space data and sets of thematic space data included in National infrastructure of space data and which are obligatory for use during creation and updating of the state information systems and resources containing space data are determined in the list of obligatory sets of the space data, their suppliers, the scope of information included in such sets, updating terms, approved by the resolution which approved this Provision (further – the list of obligatory sets of space data).

Requirements to sets of space data included in the list of obligatory sets of space data and to services for these sets, to procedure for their creation and updating are established by the State committee on property.

National infrastructure of space data can join sets of basic space data and sets of thematic space data created from data of other information sources created without attraction of financial resources republican and (or) local budgets, state non-budgetary funds, and also means of the state legal entities according to the request about inclusion in National infrastructure of space data of set of space data (further – the request) suppliers (owners) of such sets in the form according to appendix represented to the operator of the National geoportal without inclusion in the list of obligatory sets of space data.

Access to such sets of space data, and also accomplishment of transactions of loading, transformation and other transactions concerning these sets can be performed on paid basis, except as specified, by the established legal acts, decisions of the President of the Republic of Belarus, Councils of Ministers of the Republic of Belarus.

Reference information for filling and application is placed on the National geoportal.

The request is accepted with use of means of the National geoportal only when filling obligatory fields of the electronic commitment form.

The supplier provides access of the National geoportal to the operator to sets of space data, to services for them and to metadata about these sets and services.

The operator of the National geoportal within 15 working days from the date of receipt of the request considers it for the purpose of establishment:

compliance of set of space data and (or) metadata about this set to the requirements to forming, updating, provision established by the legislation in use and to use of sets of space data, creation, maintaining and (or) upgrade of services for these sets and to forming, updating of metadata about sets of space data and services for these sets;

availability of technical capabilities for implementation of access to the declared set of space data and (or) to metadata about it;

availability of more full, exact and (or) urgent ranges of the space data containing similar data on the declared territory;

availability of unreliable information in set of space data and metadata about it;

contents in the request, set of space data and (or) metadata of information on him which distribution on Internet resources is forbidden.

By results of consideration of the request by the operator of the National geoportal one of the following notifications is in triplicate constituted:

about inclusion of set of space data in National infrastructure of space data, containing conclusion about compliance of set of space data to the requirements specified in part nine of this Item;

about refusal of inclusion of set of space data in National infrastructure of space data, containing valid conclusion about discrepancy of set of space data to the requirements specified in part nine of this Item, and possibility of its completion and the repeated direction for inclusion in National infrastructure of space data.

The notifications specified in part ten of this Item till 10 working days from receipt date of the request go the operator of the National geoportal:

the first copy – to the supplier;

the second copy – to the State committee on property.

The third copy of the notification remains at the operator of the National geoportal.
