RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

About introduction of amendments to some resolutions of the Cabinet of Ministers of Ukraine in connection with formation of Public service for children

The Cabinet of Ministers of Ukraine decides:

1. Bring in resolutions of the Cabinet of Ministers of Ukraine in connection with formation of Public service for children the enclosed changes.

2. To provide to public service for children from the date of entry into force of this resolution accomplishment of functions of the chief registrar of the state register of property objects of improvement and rest of children according to Procedure for maintaining the State register of property objects of the improvement and rest of children approved by the resolution of the Cabinet of Ministers of Ukraine of June 26, 2019 No. 580 "Some questions of maintaining the State register of property objects of improvement and rest of children" (The Official Bulletin of Ukraine, 2019, No. 55, the Art. 1914).

3. This resolution becomes effective from the date of its publication, except the subitem 3 Items 6, of the paragraph of the third subitem 1, of paragraphs of the fourth, seventh, twenty third, twenty fifth, thirty second, thirty fourth, forty first, forty fourth, forty seventh, hundred thirteenth, hundred forty second, hundred forty fifth subitem 2 Items of 13 changes approved by this resolution which become effective along with the Law of Ukraine of May 22, 2024 No. 3728-IX "About introduction of amendments to some laws of Ukraine concerning the solution of the vital issues in the field of health care and the social sphere".

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine in connection with formation of Public service for children

1. In the second offer of the paragraph of the fifth Item 11 of the Regulations on orphanage of the family type approved by the resolution of the Cabinet of Ministers of Ukraine of April 26, 2002 No. 564 (The Official Bulletin of Ukraine, 2002, No. 18, Art. 925; 2016, No. 60, Art. 2052; 2023, No. 58, the Art. 3267) shall be replaced with words the word "Natssotssluzhboy" "Public service for children".

2. In the second offer of the paragraph of the seventh Item 8 of the Regulations on foster home approved by the resolution of the Cabinet of Ministers of Ukraine of April 26, 2002 No. 565 (The Official Bulletin of Ukraine, 2002, No. 18, Art. 926; 2016, No. 60, Art. 2052; 2023, No. 58, the Art. 3267) shall be replaced with words the word "Natssotssluzhboy" "Public service for children".

3. In Items 2, 8-11 Procedures for return of children foreigners to places of their permanent residence approved by the resolution of the Cabinet of Ministers of Ukraine of September 26, 2002 No. 1432 (The Official Bulletin of Ukraine, 2002, No. 39, Art. 1817; 2021, No. 33, the Art. 1929), the word "Natssotssluzhba" in all cases shall be replaced with words "Public service for children" in the corresponding case.

4. In the text of the Procedure for production by guardianship and custody bodies of the activities connected with protection of the rights of the child approved by the resolution of the Cabinet of Ministers of Ukraine of September 24, 2008 No. 866 "Questions of the activities of guardianship and custody bodies connected with protection of the rights of the child" (The Official Bulletin of Ukraine, 2008, No. 76, Art. 2561; 2021, No. 33, Art. 1929; 2022, No. 34, Art. 1855, No. 41, Art. 2227, No. 69, Art. 4176; 2023, No. 58, Art. 3267; 2024, No. 8, the Art. 377), the word "national social service" in all cases shall be replaced with words "Public service for children" in the corresponding case.

5. According to the procedure of implementation of activities for adoption and implementation of supervision of observance of the rights of the adopted children, No. 905 approved by the resolution of the Cabinet of Ministers of Ukraine of October 8, 2008 (The Official Bulletin of Ukraine, 2008, No. 79, Art. 2660; 2021, No. 33, Art. 1929; 2022, No. 44, Art. 2402, No. 67, Art. 4024; 2023, No. 58, Art. 3267; 2024, No. 32, Art. 2024):

Paragraph one of Item 111 after the word "Natssotssluzhby" to add 1) with words ", Public service for children";

2) in the text of the Procedure, except paragraph one of Item 111, of Items 112 and 113, the word "Natssotssluzhba" in all cases shall be replaced with words "Public service for children" in the corresponding case;

1, 5-7, 13-17 to the Procedure the word "Natssotssluzhba" in all cases shall be replaced with words 3) in appendices "Public service for children" in the corresponding case.

6. In Standard regulations on the child care facility of improvement and rest approved by the resolution of the Cabinet of Ministers of Ukraine of April 28, 2009 No. 422 (The Official Bulletin of Ukraine, 2009, No. 33, Art. 1138; 2018, No. 68, Art. 2311; 2021, No. 33, Art. 1929):

Item 8-1 in paragraph three the word "Natssotssluzhby" shall be replaced with words 1) "Public service for children";

The word "Natssotssluzhboy" to replace 2) in Items 8-4 and 8-5 with the word "Minsotspolitiki";

3) in paragraph one of Item 45 of the word "State Control" shall be replaced with words "The state supervision (control)".

7. According to the procedure of carrying out the state certification of child care facilities of improvement and rest and assignment of the corresponding categories by it, No. 426 approved by the resolution of the Cabinet of Ministers of Ukraine of April 28, 2009 (The Official Bulletin of Ukraine, 2009, No. 33, Art. 1142; 2015, No. 82, Art. 2720; 2021, No. 33, Art. 1929):

1) in Item 8:

word in paragraph one", third - in National social service" to exclude;

in the paragraph the second shall be replaced with words the word "Natssotssluzhby" "Public service for children";

The word "Natssotssluzhba" in all cases shall be replaced with words 2) in the text of the Procedure "Public service for children" in the corresponding case.

8. In Item 52 of the Procedure for carrying out evacuation in case of threat of the origin or emergence of emergency situations approved by the resolution of the Cabinet of Ministers of Ukraine of October 30, 2013 No. 841 (The Official Bulletin of Ukraine, 2013, No. 92, Art. 3386; 2016, No. 99, Art. 3215; 2022, No. 69, the Art. 4176) shall be replaced with words the word "Natssotssluzhba" "Public service for children".

9. In the text of the Procedure for ensuring activities of foster homes, orphanages of family type which moved from temporarily occupied territories in the Donetsk and Luhansk regions, the Autonomous Republic of Crimea and Sevastopol or the area of conducting anti-terrorist operation and actions for ensuring national security and defense, the repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions approved by the resolution of the Cabinet of Ministers of Ukraine of June 4, 2015 No. 356 (The Official Bulletin of Ukraine, 2015, No. 46, of Art. 1474; 2019, No. 44, Art. 1533; 2021, No. 33, the Art. 1929), the word "Natssotssluzhba" in all cases shall be replaced with words "Public service for children" in the corresponding case.

10. In Item 8 of the Procedure for provision of the status of the child injured with military operations and armed conflicts approved by the resolution of the Cabinet of Ministers of Ukraine of April 5, 2017 No. 268 (The Official Bulletin of Ukraine, 2017, No. 35, Art. 1105; 2018, No. 36, Art. 1267; 2021, No. 33, the Art. 1929) shall be replaced with words the word "Natssotssluzhba" "Public service for children".

11. The paragraph of the sixth of Item 2 of the Procedure for maintaining the State register of property objects of the improvement and rest of children approved by the resolution of the Cabinet of Ministers of Ukraine of June 26, 2019 No. 580 "Some questions of maintaining the State register of property objects of improvement and rest of children" (The Official Bulletin of Ukraine, 2019, No. 55, Art. 1914; 2021, No. 33, to the Art. 1929) to state in the following edition:

"the chief registrar - the official determined by Public service for children who checks completeness of the data entered by applicants electronically provides carrying out the analysis of the entered data, conditions of filling, maintaining and administration of the Register, gives information help in forming of the Register".

12. In paragraph one of Item 16 of the Procedure for ensuring social protection of the children who are in difficult vital circumstances including the children who were affected by the ill treatment approved by the resolution of the Cabinet of Ministers of Ukraine of June 1, 2020 No. 585 "About ensuring social protection of the children who are in difficult vital circumstances" (The Official Bulletin of Ukraine, 2020, No. 57, Art. 1779; 2021, No. 33, the Art. 1929) shall be replaced with words the word "Natssotssluzhby" "Public service for children".

13. In the resolution of the Cabinet of Ministers of Ukraine of August 26, 2020 No. 783 "Some questions of national social customer service of Ukraine" (The Official Bulletin of Ukraine, 2020, No. 73, the Art. 2300, No. 91, the Art. 2924, No. 97, Art. 3134; 2021, No. 81, Art. 5163; 2022, No. 18, Art. 971; 2023, No. 86, Art. 4962, No. 94, Art. 5557, No. 103, Art. 6171, No. 105, Art. 6292; 2024, No. 20, Art. 1294):

1) in Item 1 of the resolution:

words"," to exclude protection of the rights of children;

shall be replaced with words the word of "control" "supervision (control)";

2) in the Regulations on national social customer service of Ukraine approved by the specified resolution:

in Item 1:

"3. The main objectives of National social service are:

1) implementation of the state supervision (control) of observance of requirements of the legislation for realization of the right to social services, quality assurance of their provision, social support (different types of government assistance, privilege, the housing subsidies and other payments performed at the expense of means of the government budget) and behind observance of the rights of children;

2) implementation of coordination of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils concerning social protection of the population on the organization of work on rendering social support;

3) methodical maintenance of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils on questions of social protection of the population concerning correctness of provision of social support;

4) coordination of activities of suppliers of social services;

5) planning, organization and coordination of activities of territorial authorities of National social service;

6) realization of state policy on questions:

carrying out social work and provision of social services to persons in difficult vital circumstances, and also to persons, concerning which established fact of deprivation of personal liberty owing to military aggression against Ukraine, to veterans of war, the military personnel and members of their families;

social protection of persons which were injured owing to the Chernobyl catastrophic crash, persons with disability, internally displaced persons;

prevention and counteraction to domestic violence, violence on the basis of sex, human trafficking;

providing the equal rights and opportunities of women and men;

social protection of homeless persons, social adaptation of persons who served sentence in the form of restriction of freedom or imprisonment for certain term and also persons exempted from further serving of the specified types of punishments (further - the exempted persons);

volunteer activities;

active and healthy longevity, overcoming negative effects of aging;

humanitarian assistance.

4. National social service for accomplishment of the tasks determined for it:

1) develops suggestions for improvement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries taking into account practice of application of the legislation of the questions which are within its competence and in accordance with the established procedure gives them to Minsotspolitiki;

2) concerning implementation of the state supervision (control) of observance of requirements of the legislation for realization of the right to social services, quality assurances of their provision, social support (different types of government assistance, privilege, the housing subsidies and other payments performed at the expense of means of the government budget) and behind observance of the rights of children:

performs observance by the objects of the state control / monitoring determined according to the procedure of implementation of the state control / monitoring of observance of requirements of the legislation by provision of social support, social services and behind observance of the rights of children, No. 1035 approved by the resolution of the Cabinet of Ministers of Ukraine of October 6, 2021 (The Official Bulletin of Ukraine, 2021, No. 81, the Art. 5163), requirements of the legislation and ensuring its identical application;

develops in coordination with Minsotspolitiki methodical recommendations about implementation of the state supervision (control) by provision of social support, social services and in observance of the rights of children;

exercises the state control of use of the funds of the government budget allocated for provision of social support, in particular during recalculation of its sizes in case of establishment of the facts of excessive payment of means or its provision with violation of requirements of the legislation;

will promulgate on the official website data on implementation of the state control of observance of requirements of the legislation concerning provision of social support, including social services, and behind observance of the rights of children;

exercises the state control, coordination and methodical providing concerning protection of the rights and interests of persons concerning which established fact of deprivation of personal liberty owing to military aggression against Ukraine, veterans of military service, the military personnel and members of their families regarding provision to such persons of social services;

accepts according to competence of response measures for the purpose of elimination of violations of requirements of the legislation concerning provision of social support, social services and observance of the rights of children;

carries out the analysis of violations of requirements of the legislation concerning social support, social services and observance of the rights of children;

uses results of verification concerning the accuracy of the information provided by physical persons for provision of social support checks accuracy of the information about receivers of social support and correctness of charge of the help by it taking into account risk degree of availability of violations;

cooperates with the Representative of the Verkhovna Rada of Ukraine for human rights for implementation of the state supervision (control) of the places determined by Item 8 of article 13 of the Law of Ukraine "About the Representative of the Verkhovna Rada of Ukraine for human rights";

prepares analytical reports by results of performed and will promulgate them on the official website of National social service;

performs other powers on ensuring implementation of the state supervision (control) determined by the Procedure of the state control / monitoring of observance of requirements of the legislation by provision of social support, social services and behind the observance of the rights of children approved by the resolution of the Cabinet of Ministers of Ukraine of October 6, 2021 No. 1035;

3) concerning coordination of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils concerning social protection of the population on observance of requirements of the legislation by provision of social support, including social services:

determines priorities and activities concerning compliance with law by provision of social support, including social services;

provides interaction with subjects of provision of social support, including social services, regarding ensuring single approach to their provision;

analyzes results of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils on questions of social protection of the population concerning provision of social support, including social services;

4) concerning methodical maintenance of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils concerning social protection of the population on observance of requirements of the legislation regarding realization of the right to social services, quality assurances of their provision, social support:

provides increase in competence of employees of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils on questions of social protection of the population, suppliers of social services;

analyzes and generalizes information on social protection of the population regarding payment of public welfare payments, privileges, housing subsidies and other payments at the expense of the government budget, provision of social services to families (persons) which are in difficult vital circumstances, to the orphan children and children deprived of parent guardianship, to persons from their number, to other socially vulnerable segments of the population by results of the held events of the state supervision (control)/monitoring;

5) concerning coordination of activities of suppliers of social services exercises control of system of social work and provision of social services, in particular:

analyzes regional and local programs regarding requirements satisfaction of persons/families in social services;

exercises the state supervision (control) of provision of social services and their quality;

prepares suggestions for improvement of activities of suppliers of social services;

carries out monitoring of provision of social services and their quality;

6) is provided by implementation of the state supervision (control) of observance of the rights of children in organizations of the round-the-clock stay of children of different types, patterns of ownership and subordination, other organizations of social protection of children; in families of guardians, custodians, foster homes, orphanages of family type, families of foster tutors;

7) concerning humanitarian assistance:

carries out according to the procedure, the established Minsotspolitiki, the analysis of data on receipt of the humanitarian assistance and its distribution, checks compliance of the reports on availability and distribution of the humanitarian assistance submitted to the automated system of registration of the humanitarian assistance, to requirements of the legislation, in particular concerning timeliness of their representation, completeness of information reflected in reports, availability or lack of violations of requirements of the legislation concerning distribution of the humanitarian assistance and also the analysis of reports regarding compliance of information on categories of the distributed goods and their amount of information about the inventory recognized by the humanitarian assistance specified in the automated system of registration of the humanitarian assistance;

sends inquiries of rather received, distributed, used humanitarian aid and receives written explanations about causes of infringement of requirements of the legislation;

has easy access to storage locations of the humanitarian assistance;

gets access to the documents necessary for factual determination of obtaining, distribution and use on purpose of the humanitarian assistance;

by results of monitoring provides recommendations about elimination of the revealed violations which are obligatory for accomplishment;

8) concerning prevention and counteraction to domestic violence, violence on the basis of sex:

realizes state policy in the field of prevention and counteraction to domestic violence;

exercises control of activities of support services of injured persons;

coordinates training of specialists, the representing subjects performing actions in the field of prevention and counteraction to domestic violence;

will organize and conducts national social, legal, psychology and pedagogical and other researches on domestic violence, its reasons and effects;

collects, analyzes and distributes information on domestic violence according to the legislation, enhances system of indicators in the form of the state statistical reporting under prevention and counteraction to domestic violence;

provides carrying out monitoring of efficiency of the legislation concerning prevention and counteraction to domestic violence, practice of its application, implementation of actions for questions of prevention and counteraction to domestic violence; provides the methodical and practical help to the subjects performing actions for questions of prevention and counteraction to domestic violence;

prepares and will promulgate the annual status report of realization of state policy in the field of prevention and counteraction to domestic violence;

records data on activities of general and specialized support services of injured persons at the nation-wide level;

9) concerning prevention and counteraction to human trafficking:

provides accomplishment of the State social program of counteraction to human trafficking;

carries out inspection and monitoring of activities of the subjects performing actions in the field of counteraction to human trafficking;

coordinates and controls activities of the organizations giving help to persons which were affected by human trafficking including sends to organizations of the persons which were affected by human trafficking abroad and returning to Ukraine, in case of need provisions of provisional asylum by it;

makes the decision on installation/refusal in installation, prolongation/refusal in prolongation, deprivation of the status of person which was affected by human trafficking;

participates in preparation of the annual report on condition of implementation of actions in the field of counteraction to human trafficking;

performs the actions directed to elimination of premises of human trafficking;

10) concerning providing the equal rights and opportunities of women and men:

participates in development of the actions aimed at providing the equal rights and opportunities of women and men in all spheres of life of society;

prepares offers on forming of the National plan of action for ensuring gender equality;

generalizes accomplishment of the state strategy, action plans concerning gender equality;

performs within the powers provided by the law, control of respect for gender equality in case of the solution of personnel problems in central and local executive bodies;

participates in the organization of training of government employees for providing the equal rights and opportunities of women and men;

prepares evidence-based offers on ensuring gender equality together with other central executive bodies;

will organize in accordance with the established procedure carrying out scientific and expert research concerning providing the equal rights and opportunities of women and men;

carries out monitoring and generalizes results of implementation of actions for providing the equal rights and opportunities of women and men in different spheres of life of society;

keeps account in the procedure established by the legislation and generalizes cases of discrimination on the basis of floor and makes offers on their elimination;

prepares suggestions for improvement of the legislation concerning prevention and counteraction of discrimination on the basis of floor;

11) concerning social protection of persons injured with the Chernobyl catastrophic crash:

checks justification of decision making on certification, obtains information on the necessary number of certificates;

carries out organizational work, analyzes, carries out monitoring and estimation of payment status of compensation and the help, provision of services on sanatorium treatment, free food of children on it is radioactive the contaminated territories and compensation payments to families on the children injured with the Chernobyl catastrophic crash;

exercises the state control and coordination of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils on questions of social protection of the population concerning payment of compensation and the help, provision of services for sanatorium treatment, free food of children on it is radioactive the contaminated territories and compensation payments to families on the children who were injured owing to the Chernobyl catastrophic crash;

performs the actions providing target and effective use of the means intended for payment of compensation and the help, provision of services for sanatorium treatment of free food of children on it is radioactive the contaminated territories and compensation payments to families on the children who were injured owing to the Chernobyl catastrophic crash;

12) concerning social protection of persons with disability:

analyzes and generalizes information concerning the need for providing persons with disability and children with disability cars, provisions of monetary compensation on gasoline, repair and maintenance of cars and on transport servicing, and also analyzes compliance of the amount of such compensation to actual expenses;

analyzes condition of filling of centralized databank on disability problems regarding providing persons with disability with cars, payments of monetary compensation on gasoline, repair and maintenance of cars and on transport servicing;

accepts (cancels) the decision on provision of government assistance to the companies and the organizations of public associations of persons with disability in the form of the tax benefits determined by the legislation, feasibility of provision of returnable/irretrievable financial aid, loans, promotes employment of persons with disability, records provisions of such help and exercises control of its use;

analyzes with participation of public organizations of persons with disability the level of availability to persons with disability and other handicapped categories of the population of objects of social infrastructure, and also brings central and to local executive bodies, local government bodies of the offer on creation of the free circle;

provides realization of provisions of the Convention of the UN on the rights of persons with disability;

provides collection, generalization of the statistical and departmental reporting under social protection of persons with disability;

carries out within the powers provided by the law, requirement analysis in services in sanatorium treatment of persons with disability;

13) concerning social protection of homeless persons, social adaptation of the exempted persons:

will organize within the powers provided by the law, work on homelessness prevention, social protection of homeless persons and their reintegration performs coordination and monitoring of activities of the subjects providing services to homeless persons;

provides realization of state policy on social adaptation of the exempted persons;

provides development of the corresponding actions plans for the purpose of realization of state policy on social adaptation of the exempted persons;

performs general coordination of social patronage of persons serving sentence in the form of restriction of freedom or imprisonment for certain term;

carries out monitoring of provision of social services to persons serving sentence in the form of restriction of freedom or imprisonment for certain term;

takes measures to support of the companies, organizations, organizations and physical persons performing social patronage;

14) concerning volunteer activities:

takes measures to development and promoting of volunteer activities;

promotes distribution of information on volunteer activities;

distributes information on condition of accomplishment of industry and regional programs of assistance of volunteer activities and its support;

will promulgate on the official website the available information on the organizations and organizations which involve in the activities volunteers, in particular those which involve foreigners and persons without citizenship for implementation of volunteer activities in the territory of Ukraine;

promotes public associations and charitable organizations in implementation of volunteer activities;

promotes support and development of international cooperation concerning volunteer activities, generalizes and extends practice of work in the respective sphere;

15) concerning active and healthy longevity, overcoming negative effects of aging:

coordinates actions on the organization and carries out monitoring of implementation of actions for questions of active and healthy longevity, overcoming negative effects of aging;

provides organizational and methodical maintenance of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils concerning social protection of the population on creation of conditions for maintenance of health and active longevity, the organization of social servicing of citizens of advanced age, guardianship and custody over full age incapacitated persons and persons whose capacity to act is limited of their social protection;

carries out information and explanatory work with attraction of financial resources of mass information, will organize holding educational actions for questions of active and healthy longevity, overcoming negative effects of aging;

16) concerning social protection of internally displaced persons:

exercises the state supervision (control) of observance of requirements of the legislation in case of assistance to internally displaced persons;

provides coordination and performs methodological maintenance of activities of structural divisions of the local state administrations, executive bodies rural, settlement, city, district in the cities (in case of their education) councils on questions of social protection of the population of rather social protection of internally displaced persons, in particular children;

17) uses information systems of the single information database about internally displaced persons, unified information system of the social sphere, centralized databank on problems of disability, single electronic databank about the orphan children and children deprived of parent guardianship and family of potential adoptive parents, guardians, custodians, adoptive parents, parents tutors, and also other program resources;

18) will be organized in accordance with the established procedure by carrying out scientific and expert research on the questions which are within the competence of National social service;

19) exercises control of the objects of state-owned property relating to the sphere of management of National social service;

20) considers addresses of citizens on the questions connected with activities of National social service, its territorial authorities, companies, organizations and organizations relating to the sphere of management of National social service;

21) carries out information and explanatory work through mass media on the questions which are within the competence of National social service;

22) is performed by international cooperation on the questions which are within the competence of National social service studies, generalizes and extends experience of foreign states, participates in preparation and the conclusion of international treaties, attraction and coordination of the international technical assistance, represents in the procedure established by the legislation the interests of Ukraine in the international organizations;

23) Minsotspolitiki submits the generalized reports, analytical materials, materials of checks on the questions which are within the competence of National social service, suggestion for improvement of the legislation;

Accepts 24) within the powers provided by the law, participation in realization of state policy in the field of antimine activities;

Carries out 25) within the powers provided by the law, monitoring generalizes and analyzes the need for issue to separate categories of citizens of the corresponding certificates;

26) performs powers of the central body regarding fulfillment of duties which are assigned to National social service according to the Convention on jurisdiction, applicable law, recognition, execution and cooperation concerning parent responsibility and measures for protection of children;
