About approval of Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation

According to part three of article 3 of the Law of the Russian Federation of June 25, 1993 No. 5242-I "About the right of citizens of the Russian Federation to freedom of travel, the choice of the place of stay and residence within the Russian Federation", Item 7 of article 6 of the Federal Law of May 27, 1998 No. 76-FZ "About the status of the military personnel", Item 1, the paragraph the eleventh the subitem 49 of Item 11 and the subitem 3 of Item 20 of the Regulations on the Ministry of Internal Affairs of the Russian Federation approved by the Presidential decree of the Russian Federation of December 21, 2016 No. 699, Items 2, 6 and Item 45 of Rules of registration and removal of citizens of the Russian Federation from registration accounting in the place of stay and at the place of residence within the Russian Federation, No. approved by the order of the Government of the Russian Federation of July 17, 1995 713, Item 2 of Rules of development and approval of administrative regulations of provision of the state services No. approved by the order of the Government of the Russian Federation of July 20, 2021 1228, and Item 2 of the order of the Government of the Russian Federation of October 14, 2023 to No. 1706 "About features of development, approval, conducting examination and approval of administrative regulations of provision of the state services in 2024 and 2025, including without use of the federal state information system providing maintaining the federal register of the state services" I order:

1. Approve the enclosed Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation.

2. Declare invalid the order of the Ministry of Internal Affairs of Russia of December 31, 2017 No. 984 "About approval of Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation" <1>.

Administrative regulations of the Ministry of Internal Affairs of the Russian Federation on provision of the state service in registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation

I. General provisions

1. These Administrative regulations establish procedure and the standard of provision of the state service "Registration Accounting of Citizens of the Russian Federation in the Place of Stay and at the Place of Residence within the Russian Federation".

2. The service (the list of symbols and reducings is given in appendix to these Administrative regulations) is provided to the physical persons who are citizens of the Russian Federation. The applicant can use the state service personally or through the legal or authorized representative, through person which provided to the applicant premises for temporary residence <2>.

3. The service is provided to the applicant according to categories (signs) of applicants, data on which are placed in the federal state information system "Federal Register of the State and Municipal Services (Functions)", <3> and on the Single portal <4>.

II. Standard of provision of Service

Name of Service

4. Registration accounting of citizens of the Russian Federation in the place of stay and at the place of residence within the Russian Federation.

The name of the body providing Service

5. The service is provided by the Ministry of Internal Affairs of the Russian Federation.

Result of provision of Service

6. In case of the address of the applicant according to the table No. 1, containing in appendix to these Administrative regulations, results of provision of Service are:

a) registration of the citizen of the Russian Federation in the place of stay with issue of the registration certificate in the place of stay;

b) registration of the citizen of the Russian Federation at the place of residence with putting down of stamp <5> about registration at the place of residence in the passport of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation or with issue of the registration certificate at the place of residence for persons which did not reach 14-year age;

c) removal of the citizen of the Russian Federation from registration accounting in the place of stay;

d) removal of the citizen of the Russian Federation from registration accounting at the place of residence, including with putting down of stamp about removal from registration accounting at the place of residence in the passport of the citizen of the Russian Federation proving the identity of the citizen of the Russian Federation in the territory of the Russian Federation;

e) correction of the made typographical errors and (or) error messages in documents given as a result of Service provision.

7. Forming of the register entry as result of provision of Service is not provided.

8. The fact of receipt of provision of Service by the applicant of result is fixed in the State information system of migration registration.

9. Results of provision of Service can be received in the document form on paper in body of registration accounting, in MFTs, at responsible persons or by means of the mailing (in case of registration in the place of stay and registration at the place of residence of the citizen who did not reach 14-year age), or in personal account on the Single portal.

Service provision term

10. Irrespective of category (signs) of the applicant the maximum term of provision of Service constitutes 6 working days from the date of registration in the body of registration accounting of the statement and documents necessary for provision of Service provided to body of registration accounting directly through MFTs, the responsible person, by means of the direction of the mailing or with use of the Single portal.

The amount of the payment levied from the applicant by Service provision and methods of its collection

11. For Service provision collection of the state fee or other payment the legislation of the Russian Federation is not provided.

The maximum term of expectation in queue in case of submission by the applicant of the statement for provision of Service and in case of receipt of result of provision of Service

12. The maximum term of expectation in queue in case of filing of application constitutes 15 minutes.

13. The maximum term of expectation in queue in case of receipt of result of provision of Service constitutes 15 minutes.

The term of registration of a statement about Service provision

14. The term of registration of a statement constitutes 1 working day from receipt date in body of registration accounting of the application submitted by the applicant in body of registration accounting directly through MFTs, the responsible person, by means of the direction of the mailing or with use of the Single portal.

Requirements to rooms in which the Service is provided

15. Requirements to rooms in which the Service is provided are posted on the official sites of the Ministry of Internal Affairs of the Russian Federation, the Center for questions of migration of the Ministry of Internal Affairs of the Russian Federation, territorial authorities of the Ministry of Internal Affairs of Russia at the regional level on the Internet, and also on the Single portal.

Indicators of quality and availability of Service

16. The list of indicators of quality and availability of Service is posted on the official sites of the Ministry of Internal Affairs of the Russian Federation, the Center for questions of migration of the Ministry of Internal Affairs of the Russian Federation, territorial authorities of the Ministry of Internal Affairs of Russia at the regional level on the Internet, and also on the Single portal.

Other requirements to Service provision

17. Services which are necessary and obligatory for Service provision, are not provided.

18. The information systems used for Service provision:

a) State information system of migration registration;

b) Single portal;

c) federal state information system "Single System of Interdepartmental Electronic Interaction" <6>.

19. Provision to the legal representative of the minor who is not the applicant, the results of provision of Service concerning the minor which are drawn up in the document form on paper is impossible if the applicant who is the legal representative of the minor at the time of filing of application expressed in writing desire to receive required results of provision of Service concerning the minor personally.

20. In case of receipt of results of provision of Service concerning the minor by the legal representative of the minor who is the applicant, realization of the right to the results of Service concerning the minor which are drawn up in the document form on paper can be performed by the legal representative of the minor who is not the applicant. In this case the applicant who is the legal representative of the minor at the time of filing of application about provision of Service enters surname, name, middle name (in the presence), data on the identity document of other legal representative of the minor, the representative on receipt of results of provision of the corresponding Service concerning the minor, and also methods of their provision <7>.

Provision of result of Service to the applicant who is the legal representative of the minor, and also the legal representative of the minor who is not the applicant, authorized by the first on receipt of results of Service is performed in time, not exceeding 1 working day from the date of decision making about Service provision.

The results of Service concerning the minor which are drawn up on paper are provided to the applicant who is the legal representative of the minor and also the legal representative of the minor who is not the applicant, authorized by the first on receipt of results of Service:

a) in body of registration accounting on personal acceptance;

b) by means of the direction of the mailing;

c) responsible person;

d) MFTs.

21. The multipurpose centers of provision of the state and municipal services in the presence of the agreement with such MFTs participate in provision of Service.

Authorized officers of MFTs in which Service provision will be organized cannot make the decision on refusal in reception of an application on its provision and documents and (or) information necessary for its provision.

22. Issue to the applicant of results of provision of Service, including issue of the paper documents confirming contents of the electronic documents sent to MFTs by results of provision of Service by bodies of registration accounting and also issue of documents are possible in MFTs.

Creation on paper and assurance of statements from the State information system of migration registration in MFTs is not performed.

Exhaustive list of the documents necessary for Service provision

23. The exhaustive list of the documents necessary according to legislative and other regulatory legal acts for Service provision, with separation into documents and information which the applicant shall provide independently and documents which the applicant has the right to provide on own initiative as they are subject to representation within interdepartmental information exchange is provided in the table No. 2, containing in appendix No. 1 to these Administrative regulations.

24. Data on forms of the statements and documents necessary for Service provision are given in appendix to these Administrative regulations.

25. The bases for refusal in reception of an application and the documents necessary for Service provision, are not provided by the legislation of the Russian Federation.

26. The bases for suspension of provision of Service are not provided by the legislation of the Russian Federation.

27. The bases for refusal in provision of Service are:

a) availability in the statement of unreliable or incomplete information and also if the text of the statement for provision of Service does not give in to reading;

b) the data which are obligatory for specifying in the statement for Service provision are not specified;

c) availability of the application for Service provision which is earlier submitted by the applicant on which ministerial procedures are not complete;

d) the restriction for freedom of travel, the choice of the place of stay and residence set in accordance with the legislation of the Russian Federation within the Russian Federation;

e) failure to provide the documents specified in the table No. 2, containing in appendix to these Administrative regulations;

e) representation by the applicant of the documents specified in the table No. 2, containing in appendix to these Administrative regulations, containing unreliable information;

g) the data provided by the applicant are not confirmed by results of interdepartmental information exchange;

h) specifying by the applicant as the identity document, the document, which effective period less than the term of provision of Service, or the invalid document;

i) the submitted documents do not confirm power of the representative of the applicant by proxy to represent the interests of the applicant by Service provision;

j) the address of expected registration of the minor who did not reach fourteen years specified in the statement or the citizen who is under guardianship is not the residential address (stay) of legal representatives - parents, adoptive parents or guardians <8>;

k) in the document issued as a result of Service provision there are no typographical errors and (or) mistakes;

l) filing of application and documents person which is not belonging to circle of applicants.

28. The bases for refusal in provision of Service taking into account category (signs) of the applicant are given in the table No. 3, containing in appendix to these Administrative regulations.

III. Structure, sequence and terms of accomplishment of ministerial procedures

The list of the ministerial procedures performed by provision of Service

29. The list of the ministerial procedures performed by Service provision:

a) profiling of the applicant;

b) reception of an application and documents and (or) information necessary for Service provision;

c) interdepartmental information exchange;

d) decision making about provision (refusal in provision) Services;

e) provision of result of Service.

Methods of informing the applicant on change of the status of consideration of the application about Service provision

30. Method of informing the applicant on change of the status of consideration of the application is the direction of such information by means of the Single portal <9>.
