About some questions Kazakstan Halyk Kenes_

According to article 11 of the Constitutional law of the Republic of Kazakhstan "About the President of the Republic of Kazakhstan" and article 5 of the Constitutional law of the Republic of Kazakhstan "About Kazakstan Halyk Kenes і" I DECIDE:

1. Form public institution "the Secretariat Kazakstan Halyk Kenes і" (further – the Secretariat).

2. Approve enclosed:

1) Regulations on the Secretariat;

2) structure of the Secretariat;

3) changes and additions which are made to some presidential decrees of the Republic of Kazakhstan (further – changes and amendments).

3. Recognize invalid presidential decrees of the Republic of Kazakhstan of December 27, 2024 as No. 747 "About approval of the Regulations on Assembly of the people of Kazakhstan" and of December 29, 2025 No. 1144 "About approval of the Concept of development of Assembly of the people of Kazakhstan till 2030 "Unity in variety".

4. To the government of the Republic of Kazakhstan to take necessary measures for implementation of this Decree.

5. To provide to Administration of the President of the Republic of Kazakhstan together with the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan allocation of the room for placement of management Kazakstan Halyk Kenes_ and the Secretariat.

6. To impose control of execution of this Decree on Administration of the President of the Republic of Kazakhstan.

7. This Decree becomes effective from the date of its signing, except for paragraphs of the seventh, eighth, ninth and tenth Item of 1 changes and amendments which become effective from the moment of forming of the Office of Kurultai of the Republic of Kazakhstan.

Regulations on the Secretariat Kazakstan Halyk Kenes_

Chapter 1. General provisions

1. The secretariat Kazakstan Halyk Kenes_ (further – the Secretariat) is the state body of the Republic of Kazakhstan providing activities Kazakstan Halyk Kenes_.

2. The secretariat Halyk Kenes і" (further – the Constitutional law about Kazakstan Halyk Kenes і), this Provision, other regulatory legal acts of the Republic of Kazakhstan, and also international treaties of the Republic of Kazakhstan performs the activities according to the Constitution of the Republic of Kazakhstan, the Constitutional law of the Republic of Kazakhstan "About Kazakstan.

3. The secretariat is legal entity in form of business of public institution, has seal and forms with the image of the State Emblem of the Republic of Kazakhstan and with the name in the state and Russian languages, and also the corresponding accounts in bank institutions.

4. The secretariat enters the civil relations from own name.

5. The secretariat has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

6. The secretariat is headed by the vice-chairman Kazakstan Halyk Kenes_ – the head who is appointed the President of the Republic of Kazakhstan and Halyk Kenes_ is not member Kazakstan (further – the Head of the Secretariat).

7. The secretariat concerning the competence of the procedure established by the legislation of the Republic of Kazakhstan makes the decisions which are drawn up by orders of the Head of the Secretariat.

8. The structure and limit of the number of staff of the Secretariat affirm according to the legislation of the Republic of Kazakhstan.

9. Secretariat location: Republic of Kazakhstan, 010000, city of Astana, area Esil, Prospekt Mang_l_k El, house 4.

10. This Provision is the constituent document of the Secretariat.

11. The secretariat is forbidden to enter contractual relations with subjects of entrepreneurship regarding accomplishment of the obligations which are powers of the Secretariat.

12. Financial, material and other provision of activities of the Secretariat is performed from the republican budget in compliance with the legislation of the Republic of Kazakhstan.

Chapter 2. Tasks, functions and powers of the Secretariat

13. The secretariat in the activities interacts with the Chairman Kazakstan Halyk Kenes і, Kazakstan Halyk Kenes_n_n Toralkasy (Presidium), vice-chairmen Kazakstan Halyk Kenes і, members Kazakstan Halyk Kenes і, state bodies, the organizations, advisory advisory bodies, standing and interim committees, the industry commissions and working groups Kazakstan Halyk Kenes і, and also with maslikhats and public councils.

14. Tasks:

1) ensuring realization of the purpose and tasks Kazakstan Halyk Kenes_ according to the Constitutional law about Kazakstan Halyk Kenes і;

2) ensuring organizational, legal, material, financial, personnel, methodical, information and analytical support of activities Kazakstan Halyk Kenes і;

3) interaction coordination Kazakstan Halyk Kenes_ with state bodies, the organizations, institutes of civil society and the international organizations.

15. Powers:

1) rights:

request and receive in the procedure established by the legislation of the Republic of Kazakhstan from state bodies, the organizations and institutes of civil society information and materials necessary for ensuring activities Kazakstan Halyk Kenes і, with observance of the requirements to disclosure of the data which are the commercial and protected by the law other secret established by the laws of the Republic of Kazakhstan;

involve experts, scientific and professional communities in preparation of analytical and directory materials concerning activities Kazakstan Halyk Kenes і;

interact with maslikhats and public councils on realization of the purpose and tasks Kazakstan Halyk Kenes і;

2) obligations:

not disclose information, component the commercial, office, protected by the law other secret received when implementing the powers, except as specified, established by the laws of the Republic of Kazakhstan;

accept and consider appeals of physical persons and legal entities according to the procedure and terms which are established by the legislation of the Republic of Kazakhstan;

carry out other obligations, stipulated by the legislation the Republic of Kazakhstan.

16. Functions:

1) ensuring realization of powers Kazakstan Halyk Kenes і, its structures and officials according to the Constitutional law about Kazakstan Halyk Kenes і;

2) preparation and holding Session Kazakstan Halyk Kenes_ and meetings Kazakstan Halyk Kenes_n_n Toralkasy;

3) the organization of work Kazakstan Halyk Kenes_ on realization of power to initiate legislation Kazakstan Halyk Kenes і, including preliminary discussion of drafts of the laws in standing and interim committees, the industry commissions and working groups Kazakstan Halyk Kenes і, and preparation of offers on promotion of initiative about purpose of national referendum within the procedures provided by the Constitutional law about Kazakstan Halyk Kenes і;

4) assistance Kazakstan Halyk Kenes_ in development of conceptual approaches, offers and recommendations about the main directions of domestic policy of the state, strengthening of public consent, national unity and solidarity, to promotion of the fundamental principles of activities of the Republic of Kazakhstan and national values;

5) ensuring participation Kazakstan Halyk Kenes_ in public discussion of the main directions of domestic policy of the state, questions of strengthening of public consent, national unity and solidarity, promotion of the fundamental principles of activities of the Republic of Kazakhstan and national values in the procedure established by the law of the Republic of Kazakhstan;

6) preparation and holding congresses of leaders of world and traditional religions, and also at the request of the President of the Republic of Kazakhstan and the Chairman Kazakstan Halyk Kenes_ of other humanitarian forums having the state value;

7) forming of offers on structure Kazakstan Halyk Kenes і;

8) ensuring implementation Kazakstan Halyk Kenes_ of public control in the forms which are not contradicting the legislation of the Republic of Kazakhstan on the questions connected with the purpose and tasks Kazakstan Halyk Kenes і;

9) organizational and legal providing actions Kazakstan Halyk Kenes_ (Session, meetings Kazakstan Halyk Kenes_n_n Toralkasy, standing and interim committees, the industry commissions and working groups Kazakstan Halyk Kenes і, advisory advisory bodies), including preparation of the agenda, recommendations, materials, drafts of protocols, decisions and control of their execution;

10) the organization of public platforms, consultations and hearings, seminars, conferences, and also other actions for ensuring national dialogue between state bodies, the organizations and institutes of civil society;

11) carrying out information and explanatory work about activities Kazakstan Halyk Kenes_ concerning domestic policy of the state, to strengthening of public consent, national unity and solidarity, promotion of the fundamental principles of activities of the Republic of Kazakhstan and national values;

12) ensuring interaction Kazakstan Halyk Kenes_ with ethnocultural associations, maslikhats and public councils, public and religious associations, and also maintenance of profile public platforms, consultations and hearings;

13) forming and support of the work plan Kazakstan Halyk Kenes і, the network schedule of actions, coordination of preparation of materials according to orders of the Chairman Kazakstan Halyk Kenes_ and Kazakstan Halyk Kenes_n_n Toralkasy;

14) information and analytical and methodical ensuring activities Kazakstan Halyk Kenes і, including monitoring and the analysis of public processes, preparation of information and analytical and other materials;

15) providing publishing activities Kazakstan Halyk Kenes і, public communications, preparation of materials for mass media and the public;

16) ensuring international cooperation and participation of representatives Kazakstan Halyk Kenes_ in the international actions within competence;

17) legal support of activities Kazakstan Halyk Kenes і, including the organization of legal examination of draft documents, approval of drafts of decisions and materials;

18) administrative and staffing Kazakstan Halyk Kenes і, conducting document flow, control of execution of orders, digitalization of processes, providing regime measures and cyber security;

19) forming and ensuring activities of standing and interim committees, industry commissions, working groups and advisory advisory bodies Kazakstan Halyk Kenes_.

Chapter 3. Status and powers of the Head of the Secretariat

17. Management of the Secretariat is performed of the Head who bears the personal responsibility for accomplishment of the tasks assigned to the Secretariat and implementation of the powers by it.

18. The head of the Secretariat has two deputies who are appointed to positions and are dismissed according to the legislation of the Republic of Kazakhstan.

19. Powers of the Head of the Secretariat:

1) performs the common directorship of activities of the Secretariat and bears the personal responsibility for accomplishment of the tasks and functions assigned to it, and also requirements of the legislation on public service;

2) distributes obligations between the deputies and heads of structural divisions;

3) approves internal regulations, instructions of the Secretariat and issues orders;

4) Halyk Kenes_ and to meetings Kazakstan Halyk Kenes_n_n Toralkasy will organize preparation of materials for the Session Kazakstan, provides their legal maintenance;

5) there is at the Session Kazakstan Halyk Kenes_ and meetings Kazakstan Halyk Kenes_n_n Toralkasy with the right of advisory vote;

6) Kazakstan Halyk Kenes і, the Chairman Kazakstan Halyk Kenes_ and Kazakstan Halyk Kenes_n_n Toralkasy provides control of execution of decisions of the Session;

7) is represented by the Secretariat in relations with state bodies, the organizations and institutes of civil society within competence;

8) in the procedure established by the legislation of the Republic of Kazakhstan imposes authority punishments on employees of the Secretariat and resolves issues of their encouragement within the competence in employment relationships;

9) brings to the President of the Republic of Kazakhstan ideas of rewarding of employees of the Secretariat and other persons with the state awards and assignment of honorary titles of the Republic of Kazakhstan by it.

Execution of powers of the Head of the Secretariat in the period of its absence is performed by person replacing it according to the legislation of the Republic of Kazakhstan.

Chapter 4. Property of the Secretariat

20. The secretariat can have on the right of operational management the isolated property in cases, stipulated by the legislation the Republic of Kazakhstan.

21. The property of the Secretariat is created at the expense of the property given it by the owner and also the property (including cash incomes) acquired as a result of own activities, and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

22. The property assigned to the Secretariat belongs to republican property.

The secretariat has no right to alienate independently or to dispose otherwise of the property assigned to it and the property acquired at the expense of the means issued to it according to the plan of financing if other is not established by the legislation of the Republic of Kazakhstan.

Chapter 5. Reorganization and abolition of the Secretariat

23. Reorganization and abolition of the Secretariat are performed by the President of the Republic of Kazakhstan according to the legislation of the Republic of Kazakhstan.
