About introduction of amendments to some orders
I ORDER:
1. Approve the enclosed list of some orders to which changes are made (further – the List).
2. To provide to department of rule-making and international cooperation of the Agency of the Republic of Kazakhstan for public service in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Agency of the Republic of Kazakhstan for public service after its official publication.
3. To impose control of execution of this order on the vice-chairman of the Agency of the Republic of Kazakhstan for public service supervising questions of public service.
4. Determine that since July 12, 2026:
paragraphs the fortieth and forty first Item 16 of the List are effective in the following edition:
"69. The administrator of the procedure of selection provides entering of data into digital monitoring system of rendering the state services on stage of rendering the state service according to the procedure, established by authorized body in the field of digitalization, according to the subitem 11) of Item 2 of article 5 of the Law of the Republic of Kazakhstan "About the state and socially responsible services".
70. Information on procedure for rendering the state services, and also the made changes and (or) additions in the subordinate regulatory legal acts determining procedure for rendering the state service, authorized body in the field of public service goes to the operator of "the digital government", to Single contact center, according to the subitem 13) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services", and also to the Administrator of the procedure of selection performing reception of applications and issue of results of rendering the state service.";

1. Bring in the order of the Chairman of the Agency of the Republic of Kazakhstan for public service and to anti-corruption of September 20, 2016 No. 1 "About approval of Rules, programs and the organization of testing of the citizens arriving on law-enforcement service and service in bodies of civil protection" (it is registered in the Register of state registration of regulatory legal acts at No. 14317) the following changes:

These rules, programs and the organization of testing of the citizens arriving on law-enforcement service and service in bodies of civil protection (further – Rules), are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services", with the subitem 5) of Item 2 of Article 5 and Item 2 of article 16 of the Law of the Republic of Kazakhstan "About public service of the Republic of Kazakhstan", and also according to Item 7 of article 6 of the Law of the Republic of Kazakhstan "About law-enforcement service".";

"The authorized body in the field of public service within three working days from the date of modification and (or) amendments of Rules, staticizes information and sends it to the service provider, the operator of "the digital government", and also to Single contact center.";

"6. For participation in testing candidates no later than one calendar day about day of testing submit the application in form, according to appendix 1 to these rules (further – the statement) through the web portal of "the digital government" (further – the portal).
Data on identity documents, the service provider receives from the corresponding state digital systems through lock of "the digital government".
In case of the address through the portal in "personal account" of the candidate the status about adoption of the statement for rendering the state service is reflected.
Confirmation of documents acceptance is the receipt with indication of date, time and the place of passing of testing in form according to appendix 2 to these rules which is signed by the digital signature of the service provider.
In case of representation by the candidate of incomplete document package according to the list, stipulated in Item 8 Lists, and (or) documents with the expired effective period the service provider refuses reception of an application.
Candidates can get information and advice concerning submission of documents for testing through the web portal of "the digital government" in Single contact center.";
to state part one of Item 22 in the following edition:
"22. In case of receipt by the candidate of result of testing is not lower than the values specified in programs of testing in the integrated digital E-Kyzmet system the certificate on passing of testing for knowledge of state language and the legislation of the Republic of Kazakhstan in form, according to appendix 6 to these rules is created.";

"25. Candidates can receive results of testing for knowledge of state language and the legislation of the Republic of Kazakhstan on form according to appendix 6 to these rules, through the web portal of "the digital government" or by means of the appeal to the State corporation in the presence of the digital signature.";

"30. By results of testing for personal evaluation of the candidate in the integrated digital E-Kyzmet system the conclusion by results of testing for personal evaluation of the candidate for position of law-enforcement service in form, according to appendix 10 to these rules is created.";

"35. The claim to the decision, actions (failure to act) of the candidate concerning rendering the state service can be submitted addressed to the head of the service provider, to the official whose decision, action (failure to act) are appealed.
Consideration of the claim concerning rendering the state services is made by higher administrative authority, the official (further – the body considering the claim). The service provider, the official, whose decision, action (failure to act) are appealed, no later than three working days from the date of receipt of the claim send it and administrative case to the body considering the claim.
At the same time the service provider, the official whose decision, action (failure to act) are appealed, has the right not to send the claim to the body considering the claim if he within three working days makes the favorable decision, will make administrative action, completely meeting requirements specified in the claim.
The claim of uslugopoluchatel which arrived to the service provider who is directly rendering the state service according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state and socially responsible services" is subject to consideration within five working days from the date of its registration.
The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.
If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure.";

"Note: the candidates for holding the post of law-enforcement service and service in bodies of civil protection who received results when passing testing for knowledge of the legislation of the Republic of Kazakhstan are lower than values of passing of testing, pass repeated test not earlier than in three calendar days from the date of testing passing.
In case of satisfaction with the appeal commission of the appeal of the candidate, he is allowed on repeating an examination of testing for knowledge of state language and the legislation of the Republic of Kazakhstan without observance of the above-stated term.
It is issued through the portal of "the digital government" by the automated system of registration of authorized body for public service on testing passing.".
2.
