About approval of Safety rules for productions on production and use of aluminum powder, gazo-and water sprayed powders of aluminum and its alloys

According to the Law of Ukraine "About labor protection", the Regulations on the State committee of Ukraine on industrial safety, labor protection and mountain supervision approved by the resolution of the Cabinet of Ministers of Ukraine of 23.11.2006 of N 1640, I ORDER:

1. Approve Safety rules for productions on production and use of aluminum powder, gazo-and water sprayed powders of aluminum and its alloys (further - Rules) (are applied).

2. With enforcement of this order to consider not applied in the territory of Ukraine "The safety rules in case of production of powders and aluminum, magnesium and alloys powders on their basis" approved by Gosgortekhnadzor of the USSR, the Mintsvetmety USSR 11.09.79 (NPAOT 27.4-1.07-79) concerning production of powder and powders of aluminum and its alloys (Chapter 1-4, 5.1-5. 4, 5.8, 6-9).

3. To the head of department of the organization of the state supervision in metallurgy, mechanical engineering, power, construction and Ivanchenko V. I. boiler inspection. in accordance with the established procedure to provide submission of this order on state registration in the Ministry of Justice of Ukraine.

4. To management of normative and legal and legal providing (Prokhorov V. V.) after state registration of Rules to enter changes in the State register of regulatory legal acts on labor protection and to post them on the website of Gosgorpromnadzor.

5. To impose control over the implementation of this order on the vice-chairman of Gosgorpromnadzor Dengin A. P.

Safety rules for productions on production and use of aluminum powder, gazo-and water sprayed powders of aluminum and its alloys

Section 1. General provisions

1.1. These Rules extend on the legal entities and physical person using according to the legislation wage labor on operating plants which design build or reconstruct the companies, workshops, departments, sites on production, use of aluminum powder, gazo-and water sprayed powders of aluminum and its alloys and to production of products from them by methods of powder metallurgy irrespective of departmental subordination of the company, and also during the designing and production of the equipment for them.

1.2. Rules provide requirements to the territory of the companies, production rooms, engineering procedures, production equipment, requirements of rather raw materials and finished goods, application of collective and individual remedies of workers, requirements for providing pozharo-and explosion safety, protection against static electricity, the device of aspiration, heating, water supply, the sewerage, lighting which accomplishment is necessary and obligatory for providing safe working conditions, protection production both the environment in production process and uses of aluminum powder, powders of aluminum and its alloys by methods of spraying of fusions of metal, and also in case of production of products from these powders by methods of powder metallurgy.

1.3. Requirements of Rules are obligatory for all officials and workers who perform works on designing, construction and reconstruction of workshops, sites, departments on production and use of aluminum powder and powders of aluminum and its alloys, and also for all workers performing works on operation, installation, adjustment and repair of the equipment of these companies.

Section 2. Designations and reducings

NPAOT - The regulatory legal act on labor protection;

NAPB - The regulation on fire safety;

Construction Norms and Regulations - Construction regulations and rules (Construction regulations and the rules USSR);

ONTP - All-union regulations of process design;

VNTP - Departmental regulations of process design;

DBN - State construction regulations of Ukraine;

GOST - Interstate standard (State standard of the USSR);

DSTU - State standard of Ukraine;

SN - The construction regulations approved by the State Committee for Construction of the USSR;

SN - The sanitary standards approved by the Ministry of Health of the USSR;

Joint venture - Health regulations;

Chipboard - State health regulations of Ukraine;

DSN - State sanitary standards of Ukraine;

SSBT - Occupational safety standards system (USSR);

SSBP - Occupational safety standards system of Ukraine;

Maximum allowable concentration - Threshold limit value of hazardous substances;

NKGV - Lower concentration bound of explosibility;

Gosgorpromnadzor - the State committee of Ukraine on industrial safety, labor protection and mountain supervision.

Section 3. General requirements

3.1. Designing, construction and reconstruction of the companies, workshops, departments, sites on production and use of aluminum powder, powders of aluminum and its alloys by methods of spraying of fusions of metal gas or water of high pressure, and also productions on production of products from these powders and operation of these productions shall be carried out by methods of powder metallurgy according to the Laws of Ukraine "About labor protection", "About fire safety", "About objects of the increased danger", "About ensuring sanitary and epidemic wellbeing of the population", "About obligatory national social insurance from labor accident and occupational disease which entailed disability", the Labor code of Ukraine, requirements of these Rules, according to requirements of the operating state construction regulations, regulations of process design, interstate and state standards, sanitary standards and rules, requirements of fire safety the list of which is given in appendix.

3.2. Changes in technological schemes and design of the equipment shall be approved with the project organization - the author of the project and developers of technology or with the plant manufacturing the equipment and also with territorial authority of Gosgorpromnadzor. The project organizations shall exercise designer's service of implementation of project decisions concerning labor protection in case of construction or reconstruction of production.

3.3. Acceptance in operation of objects which are again constructed or reconstructed irrespective of subordination of the company shall be carried out according to the Procedure for acceptance to operation complete by construction of facilities, approved by the resolution of the Cabinet of Ministers of Ukraine of 22.09.2004 of N1243 (NPAOT 45.2-2.01-04), and the resolution of the Cabinet of Ministers of Ukraine of 05.05.97 N409 "About Ensuring Reliability and Safe Operation of Buildings, Constructions and Engineering Networks" (NPAOT 45.2-7.01-97).

3.4. At each company based on the project of production the list of dangerous places shall be constituted and approved by the director. Dangerous places shall be noted by means of texts and precautionary signs.

In the operating workshops, departments, sites there shall be passports (certificates) of processing equipment, and on предприятиисертификат (certificate) of state registration of chemicals which are used or made on production.

3.5. On operating plants according to the Standard regulations on security service of work approved by Gosnadzorokhrantrud's order of 15.11.2004 of N 255, registered in Ministry of Justice of Ukraine 01.12.2004 for N1526/10125 (to NPAOT 0.00-4.21-04), and the Standard regulations on labor protection office approved by Gosnadzorokhrantrud's order of 18.07.97 of N 191, registered in Ministry of Justice of Ukraine 08.10.97 for N458/2262 (NPAOT 0.00-4.29-97), security services of work shall be created and labor protection offices are equipped.

3.6. On all operating plants and those which become effective according to the Regulations on development of instructions for labor protection approved by Gosnadzorokhrantrud's order of 29.01.98 of N 9, registered in Ministry of Justice of Ukraine 07.04.98 for N226/2666 (to NPAOT 0.00-4.15-98), and the Procedure for development and approval of the regulations by the owner about labor protection existing at the company, approved by Gosnadzorokhrantrud's order of 21.12.93 of N 132, N20/229 registered in Ministry of Justice of Ukraine 07.02.94 (NPAOT 0.00-6.03-93), the corresponding instructions shall be developed and claimed by the director:

a) on labor protection for workers of each profession and on work types;

b) technological on equipment maintenance;

c) workers on conducting engineering procedures, cleaning and repair of the equipment.

With the above-stated instructions according to established procedure all workers shall be provided. Besides, the set of instructions shall be placed on workers or in specially allotted places. The officials providing instructing and training in questions of labor protection shall be also provided with set of such instructions.

3.7. In case of changes in engineering procedures, schemes of communications or working conditions, and also in case of use of new materials or the equipment in technological instructions and instructions for labor protection necessary changes and additions in accordance with the established procedure shall be made.

3.8. Research and experimental works on operating plants shall be carried out according to specially developed responsible for safety of these works as the worker and approved by the director temporary instructions which provide procedure for the organization and safe accomplishment of such works.

3.9. At each company according to requirements of the Regulations on plan development of localization and liquidation of emergencies and accidents approved by Gosnadzorokhrantrud's order of 17.06.99 of N 112, registered in Ministry of Justice of Ukraine 30.06.99 for N424/3717 (NPAOT 0.00-4.33-99), plans of localization of emergencies and accident elimination shall be developed. Plans of localization of emergencies and accident elimination shall be reviewed and affirm annually prior to the beginning of calendar year the director in accordance with the established procedure.

In case of changes in the engineering procedures or working conditions causing changes of possible emergency necessary changes and additions in accordance with the established procedure till that time as these changes will be entered shall be made to the plan of localization of emergencies and accidents.

Plans of localization and liquidation of emergencies and accidents shall be hung out on technological sites, are studied by production personnel which will participate in accident liquidation, and staff of rescue divisions.

3.10. Taking into account specifics of production and requirements of the Standard regulations on procedure for carrying out the training and examination concerning labor protection approved by Gosnadzorokhrantrud's order of 26.01.2005 of N 15, registered in Ministry of Justice of Ukraine 15.02.2005 for N231/10511 (NPAOT 0.00-4.12-05), shall be developed and approved by orders of the director of provision of the company on training in questions of labor protection, scheduled plans of carrying out training and examination concerning labor protection of which workers shall be informed are created.

3.11. At each company the list of works of the increased danger for which accomplishment it is necessary to get permission of Gosgorpromnadzor according to the resolution of the Cabinet of Ministers of Ukraine of 15.10.2003 of N1631 "About Approval of the Procedure for Issue of Permissions by the State Committee on Supervision of Labor Protection and Its Territorial Authorities" shall be constituted and approved by the director.

3.12. Officials and workers to whose service duties direct performance of works of the increased danger and the works requiring professional selection according to the List of works with the increased danger approved by Gosnadzorokhrantrud's order from belongs

26.01.2005 N 15, registered in Ministry of Justice of Ukraine 15.02.2005 for N232/10512 (NPAOT 0.00-8.24-05), and to the List of works where there is need for professional selection, approved by the order of the Ministry of Health of Ukraine and Gosnadzorokhrantrud of 23.09.94 of N263/121, registered in Ministry of Justice of Ukraine 25.01.95 for N18/554 (NPAOT 0.03-8.06-94), in case of employment shall undergo at the company preliminary special training and examination concerning labor protection about specific working conditions, and further - recurring inspections of knowledge at least once a year.

3.13. Works of the increased danger shall be performed on the work permit. The list of persons having the right to issue of work permits shall be determined and affirm the director.

3.14. Workers and officials shall be provided with overalls, special footwear and other remedies according to the Regulations on procedure for providing workers with special clothes, special footwear and other individual protection equipment approved by Gosnadzorokhrantrud's order of 29.10.96 of N 170, registered in Ministry of Justice of Ukraine 18.11.96 for N667/1692 (to NPAOT 0.00-4.26-96), and Standard regulations of free issue of special clothes, special footwear and other individual protection equipment to the workers and the employee of end-to-end professions and positions of all industries of the national economy and separate productions approved by the resolution of the State committee of the USSR on work and social problems, Presidium of the All-Union Central Council of Trade Unions of 12.02.81 of N47/P-2 (NPAOT 0.00-3.03-81). The procedure for use and check of overalls, special footwear and other individual protection equipment shall be stated in the corresponding instructions for labor protection taking into account specific conditions where they are applied. For cleaning of overalls of dust rooms and mechanisms in case of which device explosion-fire-hazardous properties of powder and dust of aluminum and its alloys shall be considered shall be provided.

3.15. All workers of these productions occupied at works with heavy and harmful working conditions shall be provided with treatment-and-prophylactic food according to NPAOT 0.00-2.03-77, of NPAOT 0.00-1.55-77, milk or equivalent products according to NPAOT 0.00-4.36-87, and also sparkling water.

3.16. At the companies (workshops, sites) sanitary and household rooms, and also Items of public catering according to Construction Norms and Regulations 2.09.02-85 shall be equipped.

3.17. The work-rest schedule at the companies irrespective of pattern of ownership shall be set according to the Labor code of Ukraine.

3.18. In case of accident or labor accident their investigation shall be made according to requirements of the Procedure for investigation and the accounting of accidents, occupational diseases and accidents on production approved by the resolution of the Cabinet of Ministers of Ukraine of 25.08.2004 of N1112 (NPAOT 0.00-6.02-04).

Section 4. Territory of the companies. Buildings and constructions

4.1. The constructed new productions shall be designed so that the current direction of cargo transportation was not broken and counter and cross cargo flows were not created. When designing production, administration and household rooms and communications it is necessary to consider requirements Construction Norms and Regulations 2.09.02-85, Construction Norms and Regulations 2.09.04-87, DBN Construction Norms and Regulations 2.09.02-85, DBN of B.1.1-7-2002, Construction Norms and Regulations 2.09.03-85, Construction Norms and Regulations 2.04.01-85, Construction Norms and Regulations 2.04.02-84, Construction Norms and Regulations 2.04.03-85, Construction Norms and Regulations 2.04.05-91, Construction Norms and Regulations 3.05.01-85, Construction Norms and Regulations 2.04.07-86, DBN of B.2.5-20-2001.

4.2. During the planning of the territory, placement of buildings and constructions according to Construction Norms and Regulations of II-89-80 the sanitary protective zone shall be provided. The size of sanitary protective zone shall be determined according to chipboard 173-96.

Safety of production shall conform to requirements of DSTU 3273-95.

4.2.1. Industrial platforms on which production of powders and aluminum powders, and also production on production of aluminum paste and products from powders is placed shall be protected and have check-points. In the territory safety signs according to GOST 12.4.026-76 shall be established.

4.2.2. Along buildings and constructions journey of the fire fighting equipment according to requirements of the Fire safety regulations in Ukraine approved by the order of the Ministry of Emergency Situations of Ukraine from shall be provided

4.2.3. Roads, drives and approaches to buildings, constructions, fire hydrants and fire reservoirs, and also approaches to fire step-ladders, fire stock, the equipment and fire extinguishing means shall contain operational and to be always free. About fire hydrants indexes which shall be lit in night-time shall be exposed.

4.3. Arrangement, content, operation and repair of railway tracks, moving, railway vehicles, communication, the alarm system and blocking of rail transport in the territory of the company it is necessary to perform according to NPAOT 63.21-1.09-88.

4.4. For projectible workshops approach of railway tracks to factory buildings, warehousing and other facilities shall correspond to approach dimension according to GOST 9238-83 and to the dimensions approved for the companies of metallurgical industry.

In the operating workshops in case of impossibility of finishing dimensions up to the normative sizes there shall be alarm system warning about violation of dimensions.

4.5. The device and operation of rail and motor transport of the companies shall conform to requirements of NPAOT of 27.0-1.01-87, GOST 12.2.022-80 and GOST 12.2.003-91.

Transport mechanisms shall be provided with precautionary devices for giving of sound or light signal of their start, accident, stop or damage.

About checkpoints of the company, in workshops and on sites traffic patterns railway and other modes of transport on the territory of the company, the workshop, site shall be hung out.

4.6. Space-planning decisions when designing productions on production and use of powder and powders of aluminum and its alloys, fireproof devices (fire-proof doors, obstacles, etc.) shall be developed according to Construction Norms and Regulations 2.09.02-85, Construction Norms and Regulations 2.09.03-85, NAPB of A.01-001-2004 taking into account properties of substances and materials which are used or created in production processes and action of dangerous and harmful production factors, to conform to requirements of DBN B.1.1-7-2002, to provide necessary degree of fire resistance of buildings, constructions and designs.

4.6.1. In case of project development shall be classified:

- explosion-fire-hazardous substances, materials, mixes, gases which are used or created in production processes, - according to GOST 12.1.011-78, state standard specification 12.1.041-89;

- hazardous substances - according to GOST 12.1.007-76;

- dangerous and harmful production factors - according to GOST 12.0.003-74.

4.6.2. Based on data on characteristics of explosibility and inflammability of materials which are used or made in production of the created dust, and also gas-allocations, for each workshop, the site, rooms shall be determined:

- categories of productions and buildings on fire and explosion and fire risk according to ONTP 24-86 (NAPB B.07-0.05-86) and DBN B.1.1-7-2002;

- classes of zones of rooms on explosive, fire and explosion and fire risk according to the order of the Ministry of Labour and Social Policy of Ukraine of 21.06.2001 N272 "About approval of Regulations for electrical installation. Electric equipment of special installations" (NPAOT 40.1-1.32-01).

4.6.3. Degree of fire resistance of buildings, constructions and designs, shall be determined depending on purpose of the room, its height (number of storeys), the area of the floor within fire-proof compartment, category of rooms by fire and explosion and fire risk.

4.6.4. Measures of ensuring fire and explosion safety, including by restriction of amount of the combustible substances which are in production, isolation of the combustible circle, use of the means warning to fire distribution shall be provided by the project according to requirements of NAPB A.01.001-2004, state standard specification 12.4.009-83, DBN B.1.1-7-2002.

Rooms in which powders and powder are made or used shall be equipped with automatic installations of the fire alarm and fire extinguishing according to the List of objects same to destination which are subject to the equipment automatic installations of fire extinguishing and the fire alarm, the approved order of the Ministry of Emergency Situations of Ukraine of 22.08.2005 of N 161, registered in Ministry of Justice of Ukraine 05.09.2005 for N990/11270 (NAPB B.06.004-2005). 4.6.5. Ways of evacuation shall provide possibility of bystry exit of workers from rooms directly outside. Exits from rooms shall be located so that they were not directed towards near railway and subcrane tracks or highways.

4.7. In production of powders and powders certain rooms shall be provided for:

- dispersions (spraying) of fusion;

- production of powder by powder grind;
