About approval of the Instruction about the reporting of licensed banks under some currency transactions

Based on Articles 11, 51 and 52 Laws on National Bank of Moldova No. 548/1995 (repeated publication: Monitorul Oficial al Republicii Moldova, 2015, Art. No. 297-300, 544), with subsequent changes, with subsequent changes and amendments, article 67 of the Law on currency control No. 62/2008 (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, Art. No. 423-429, 859), with subsequent changes DECIDES: Administrative board of National Bank of Moldova

1. Approve the Instruction about the reporting of licensed banks under some currency transactions it (is applied).

2. Recognize to invalid:

a) since March 21, 2009 - the Instruction about annual statements on some transactions of banks in currency approved by the decision of Administrative board of National Bank of Moldova No. 269 of October 14, 1999. (The official monitor of the Republic of Moldova, 1999, Art. No. 116-117 203), with subsequent changes and amendments;

b) since March 11, 2009 - the Instruction about procedure for creation of the operations statement on purchase/sale of currency, performed by licensed bank of the Republic of Moldova in the foreign exchange market, and account balances of clients of bank in foreign currency, approved by the decision of Administrative board of National Bank of Moldova No. 157 of December 25, 1997. (The official monitor of the Republic of Moldova, 1999, Art. No. 36-38, 122), with subsequent changes and amendments.

3. The last reporting according to provisions of the instructions specified in Item 2 of this resolution shall be provided as follows:

a) in case of the reports regulated by the instruction specified in the subitem and) Item 2 of this resolution, - reports for 2008 are submitted till February 1, 2009;

b) in case of the report regulated by the instruction specified in the subitem b) Item 2 of this resolution, - the report for February, 2009 is submitted till March 10, 2009.

4. Commercial banks shall provide in addition to National Bank of Moldova till March 20, 2009 reports for January and February, 2009 according to the forms and procedure for their filling established by the instruction specified in the subitem and) Item 2 of this resolution (except for the Report on the guarantees in currency obtained and issued by bank), the accounting period is the corresponding month under report.

5. The first reporting according to provisions of the instruction specified in Item 1 of this resolution shall be provided:

a) according to monthly reports - for the accounting period March, 2009;

b) according to the quarterly statement - for the accounting period the I quarter 2009.

Chapter I. General provisions

1. In the Instruction about the reporting of licensed banks under some currency transactions (further - the instruction) the concepts determined by the Law on currency control No. 62/2008 are used (repeated publication: Monitorul Oficial al Republicii Moldova, 2016, Art. No. 423-429, 859), with subsequent changes (further – the Law No. 62/2008). Also for the purpose of this instruction the following concepts are used:

a) currency loans and the credits - loans and foreign currency loans between residents, in foreign currency and in Moldovan lei between nonresidents and residents, and also the loans and the credits tied to the foreign exchange rate;

b) the loans and the credits tied to the foreign exchange rate the loans obtained / the credits issued in Moldovan lei which remaining balance in accordance with the terms of the credit agreement changes depending on evolution of rate of Moldovan leu in relation to foreign currency to which the binding is made;

c) Ceased to be valid according to the Resolution of Administrative board of National Bank of the Republic of Moldova of 23.01.2014 No. 5  

2. For the purpose of this Instruction persons specified in subitems b), c), e) - g) Item 9) and subitems b) - d), f) - i) Item 10) of article 3 of the Law No. 62/2008 concern legal entities.

3. This instruction regulates procedure for creation and submission to National Bank of Moldova of the following reports reflecting some currency transactions performed by licensed bank including at the request of clients:

a) No. 257 is excluded according to the Resolution of National Bank of the Republic of Moldova of 17.12.2011  (became effective 01.01.2012)

b) the report "The transactions on purchase and sale of foreign currency performed by licensed bank" (appendix No. 2);

c) Report "Currency loans and credits of licensed bank" (appendix No. 3);

d) No. 19 is excluded according to the Resolution of Administrative board of National Bank of the Republic of Moldova of 31.01.2013

e) ceased to be valid according to the Resolution of Administrative board of National Bank of the Republic of Moldova of 23.01.2014 No. 5 

f) the report "Transactions of licensed bank with cash foreign currency and with travel checks in foreign currency" (appendix No. 6);

g) ceased to be valid;

h) the report "Transactions according to agreements on the external loans / credits obtained by licensed bank" (appendix No. 8);

h) The report on implementation of transactions according to agreements on the loans/credits relating to direct investments to the Republic of Moldova, received by licensed bank (appendix No. 8).

i) Report "Foreign securities of licensed bank" (appendix No. 9);

j) ceased to be valid according to the Resolution of National Bank of the Republic of Moldova of 02.03.2016 No. 47

k) the report "The average buying rates and sales of the principal foreign currencies concerning activities of licensed bank for cash currency exchange with physical persons" (appendix No. 11);
