On accomplishment of the resolution of the Cabinet of Ministers of Ukraine of 05.12.2007 "About licensing of certain types of economic activity in construction" I ORDER to No. 1396:

1. Approve Licensed conditions of implementation of the economic activity in construction connected with creation of objects of architecture which are applied.

2. In accordance with the established procedure to provide to the state architectural and construction inspection (Bondarenko O. M.) submission of this order on state registration in the Ministry of Justice of Ukraine.

3. I reserve control over the implementation of this order.

Licensed conditions of implementation of the economic activity in construction connected with creation of objects of architecture

I. General provisions

1.1. These Licensed conditions establish organizational, qualification, production and special requirements for implementation of the economic activity in construction connected with creation of objects of architecture.

1.2. The economic activity in construction connected with creation of objects of architecture is subject to licensing according to the procedure, determined by the legislation, by the following types:

1) prospecting works for construction;

2) development of town-planning documentation;

3) designing of objects of architecture;

4) construction and installation works;

5) installation of engineering networks;

6) construction of transport constructions;

7) engineering activities in the field of construction.

1.3. The economic activity in construction connected with creation of objects of architecture according to requirements of state standards, construction regulations and rules.

1.4. These Licensed conditions are obligatory for all business entities irrespective of their form of business and pattern of ownership (further - business entities) which perform the works connected with creation of objects of architecture according to the List of works of implementation of the economic activity in construction connected with creation of objects of architecture (further - the List of works), according to appendix 1.

1.5. Forms: statements for licensing for implementation of the economic activity in construction connected with creation of objects of architecture; data on technological base, the list of workers behind professional and qualification level, production technologies, information and legal, normative and technical providing, about the available quality control system of performance of works, about the installation and construction works performed by the applicant; statements for renewal of the license for implementation of the economic activity in construction connected with creation of objects of architecture; statements for issue of the duplicate of the license for implementation of the economic activity in construction connected with creation of objects of architecture; pleas of nullity of the license for implementation of the economic activity in construction connected with creation of objects of architecture; the statements for modification of the list of works of implementation of the economic activity in construction connected with creation of objects of architecture, given in appendices 2-7 to these Licensed conditions.

II. General requirements

2.1. The economic activity in construction connected with creation of objects of architecture shall meet the requirements of DBN B.1.2-14-2009 "General principles of ensuring reliability and constructive safety of buildings, constructions, building constructions and bases" for classes of effects (responsibility) of the building or construction: CC3 - considerable effects, CC2 - average effects, CC1 - insignificant effects.

The right to perform on these classes without the previous experience can be employed business entities which were created as a result of reorganization or created purposefully for performance of works, the objects of architecture of the corresponding classes of effects connected with creation on condition of accomplishment of organizational, qualification and production requirements for the corresponding class.

2.2. The economic activity in construction connected with creation of objects of architecture perform business entities in case of observance of the following conditions:

2.2.1. Organizational:

availability of the approved organizational structure of the company according to the List of works which are declared;

availability in organizational structure of the company of divisions and/or specialists who will provide accomplishment of the administrative leading, technological, planned and contractual, production, legal and support functions and functions on quality control, industrial safety and labor protection, maintaining and storage of regulating and executive documentation;

availability of the approved regulations on the relevant structural divisions and job descriptions of workers according to distribution of obligations, powers and responsibility of persons, staff list;

completeness of the company engineering employees and workers of necessary professions and qualifications according to organizational structure of the company, provisions of the Qualifier of professions (the recreation center 003:2010) approved by Gospotrebstandart's order of Ukraine of 28.07.2010 No. 327 (further - KP), and requirements of the Reference book of qualification characteristics of professions of workers (Release 64), the State committee of construction, architecture and housing policies of Ukraine approved by the order of 13.10.99 No. 249

observance of the procedure for acceptance and registration of citizens established by the legislation for work according to requirements of Chapter III of the Labor code of Ukraine (execution of an employment agreement with hired employee);

in the presence at the company of structural divisions data are provided taking into account their opportunity to perform works which are declared;

availability of state standards, other regulating documents and regulatory legal acts;
