In pursuance of subitem 8.1.1 of Item 8 of the Presidential decree of the Republic of Belarus of July 17, 2006 No. 460 "About measures of state regulation of import and export of specific goods (works, services)", based on the Regulations on the State military-industrial committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 30, 2003 No. 597 "About some questions of the State military-industrial committee of the Republic of Belarus", the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of February 2, 2000 No. 39, the State military-industrial committee of the Republic of Belarus and the State Customs Committee of the Republic of Belarus is DECIDED:

1. Approve the enclosed Instruction about procedure for issue of licenses for import of military products, the cryptography and special technical means and export of specific goods (works, services), and also registration of agreements (contracts) under the general license.

2. This resolution becomes effective from the date of its official publication.

Chapter 1. General provisions

1. The instruction about procedure for issue of licenses for import of military products, the cryptography and special technical means and export of specific goods (works, services), and also registration of agreements (contracts) under the general license (further - the Instruction) determines procedure for execution of statements on issue of licenses for import (export) of military products, the cryptography and special technical means and on export of controlled goods (daleezayavleniye), procedure for execution of licenses for import (export) of military products, the cryptography and special technical means and on export of the controlled goods (further - the license) issued by the State military-industrial committee of the Republic of Belarus (further - Goskomvoyenprom) in cases, stipulated by the legislation the Republic of Belarus, forms of licenses, order of registration of agreements (contracts) under the general license, forms of lists on import (export) of military products, the cryptography and special technical means and on export of controlled goods according to the general license (further - the list).

2. In this Instruction the term "military products" is used in the value determined in the Presidential decree of the Republic of Belarus of March 11, 2003 No. 94 "About some measures for regulation of military and technical cooperation of the Republic of Belarus with foreign states" (The national register of legal acts of the Republic of Belarus, 2003, No. 32, 1/4442).

For the purposes of this Instruction:

the cryptography and special technical means are understood as the cryptography tools (works, services), including the cryptographic equipment, and also special technical products intended for secret receipt of information;

are understood as controlled goods: causative agents of diseases (pathogens) of the person, animals and plants, their genetically changed forms, fragments of genetic material and the equipment which can be used during creation of bacteriological (biological) and toxin weapon; chemicals, the equipment and technologies which have peaceful purpose, but can be applied during creation of chemical weapon; nuclear materials, the equipment, special non-nuclear materials and appropriate technologies which can be applied during creation of nuclear weapon; the equipment and materials of dual purpose, appropriate technologies applied in the nuclear purposes (connected with nuclear fuel cycle and production of nuclear materials); the equipment, materials and technologies applied during creation of rocket weapon and other delivery systems of nuclear, chemical, bacteriological (biological) and toxin weapon; goods and dual-use technologies which can be applied during creation of arms and military equipment.

3. For implementation of the external economic transaction in case of rendering services in repair (upgrade) of military products or the cryptography and special technical means licenses are drawn up:

on import (export) to conversion of such goods;

on export (import) of services in their repair (upgrade).

4. Application is issued by the legal entity of the Republic of Belarus (further - the applicant) on printers according to requirements of this Instruction:

for military products or the cryptography and special technical means - according to appendix 1 to this Instruction;

for controlled goods - according to appendix 2 to this Instruction.

5. The statement with its electronic version in the Word format and the documents necessary for receipt of the license attached to it, the applicant sends to department of export control and licensing of management of military and technical cooperation of Goskomvoyenprom (further OEK) with the cover letter.

6. Copies of the submitted documents shall be certified by the signature of the head of the applicant or person authorized by him and the applicant's seal. The documents or their copies containing more than two sheets shall be stitched, pages are numbered.

7. The sample of seal of the applicant and the list of authorized persons with indication of surname, name, middle name, position and the specimen signature are represented by the applicant to OEK. Data on changes in the specified list go to OEK in addition.

8. All notes on quality of execution of statements, contracts (agreements) and other documents submited are reported to OEK to the applicant in writing.
