About procedure for issue of technical permissions in the field of industrial safety

In pursuance of requirements of Article 7, the paragraph (2), Items c) and d) article 17 of the Law No. 803-XIV of 11.02.2000 on industrial safety of hazardous production facilities, with subsequent changes and amendments (The official monitor of the Republic of Moldova, No. 59-62, 2000, Article 401), the Law No. 461-XV of 30.07.2001 on the market of oil products, with subsequent changes and amendments (The official monitor of the Republic of Moldova, No. 107, 2001, Article 821), the Orders of the Government No. 1180 of 30.09.03 "About approval of the Regulations on issue of technical permissions to operate of storages of oil products, oils of gas-filling stations" (The official monitor of the Republic of Moldova, No. 211-214, 2003, Article 1229) and other existing regulations and profile normative and technical documents I ORDER:

1. Create temporarily the Commission on issue of technical permissions in the field of industrial safety for operation of storages of oil products, oil and gas-filling stations, for training, designing, production (production), construction, installation, adjustment, technical diagnostics (including nondestructive control), operation, including maintenance, balancing and commissioning, use, technical retrofitting, repair, expansion, reconstruction, preservation or liquidation of hazardous production facility in the following structure:

Vasile Vulp - the chief of legal management of the Ministry of Economics

Natalia Andriyash is head of department on technical supervision and industrial safety, the Ministry of Economics

Ivan Gushilik is the chief of the Main state inspectorate for technical supervision of hazardous production facilities (GGITNOPO).

2. Approve, according to appendix No. 1, the list of necessary documents for issue of technical permissions for business entities who perform the activities and/or works in the field of industrial safety specified in paragraph 1 of article 10 of the Law No. 803-XIV of 11:02. 2000, excepting works on operation of storages of oil products, oil and gas-filling stations.

3. For operation of storages of oil products, oil and gas-filling stations required documents for issue of technical permissions will be submitted according to instructions of Item 14 of Chapter IV of the Order of the Government No. 1180 of 30.09.03 "About approval of the Regulations on issue of technical permissions to operate of storages of oil products, oil and gas-filling stations" (The official monitor of the Republic of Moldova, No. 211-214, 2003, Article 1229).

4. The main state inspectorate for technical supervision of hazardous production facilities (Mr. Ivan GUSHILIK) to exercise the state control and technical supervision for the purpose of check of safety conditions of hazardous production facilities when implementing on them of activities and/or conducting works, and also extent of observance of requirements of regulations and normative and technical documents in the field of industrial safety, including also approval of the expert opinions issued as appropriate.

5. To management on technical supervision and industrial safety (Mrs. Natalia ANDRIYASH) to develop and perform internal procedures for approval of the draft of the Order of the Government "About Approval of the Regulations on Requirements to Allowing Activities in the field of Industrial Safety and Procedure for Issue of Technical Permissions for Implementation of Activities and/or Works on Hazardous Production Facilities". Accomplishment term - on April 1.

6. Consider invalid orders of the Ministry of Economy and Trade No. 135 of 26.11.2008 "About procedure for issue of technical permissions in the field of industrial safety" and according to No. 94 from

27.05.2009 "About change of the Order No. 135 of 26.11.2008 "About procedure for issue of technical permissions in the field of industrial safety".

7. Publish this order in the Official monitor of the Republic of Moldova.

8. To assign accomplishment of the order to Octavian KALMYK, the deputy minister of economy.

The list of necessary documents for issue of technical permission

1. Designing, installation and construction works

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original).

2. Training

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the training programs and tickets on specialties approved as appropriate.

3. Production

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the internal regulations approved as appropriate;

d) liability insurance for possible damnification in the original (for check) and the copy certified by seal of business entity.

4. Technical diagnostics (including nondestructive control)

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the certificate of accreditation or certification of laboratory with appendices in the original (for check) and the copy certified by seal of business entity.

5. Use, operation

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the contract on accomplishment of activities and/or works on hazardous production facilities in the original (for check) and the copy certified by seal of business entity;

d) liability insurance for possible damnification in the original (for check) and the copy certified by seal of business entity.

6. Expansion, repair, reconstruction, technical retrofitting, preservation or liquidation

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the contract on accomplishment of activities and/or works on hazardous production facilities in the original (for check) and the copy certified by seal of business entity.

7. Mining operations, including works on well-drilling

a) the registration certificate of the company in the original (for check) and the copy certified by seal of business entity;

b) expert opinion of industrial safety (original);

c) the act of mountain branch in the original (for check) and the copy certified by seal of business entity;

d) liability insurance for possible damnification in the original (for check) and the copy certified by seal of business entity.

8. Examination and certification of safety

a) the registration certificate of the company, in the original (for check) and the copy certified by seal of business entity;

b) the list of productions, technologies, the equipment and objects for which technical permission is issued;

c) the procedures for accomplishment of examination and certification of safety approved with body for industrial safety.
