About modification and amendments in some laws of the Republic of Belarus concerning education

Article 1.

Article 2. Bring in the Law of the Republic of Belarus of April 17, 1992 "About provision of pensions" (Vyarkhochnaga Savet's Vedamastsi of Respubliki Belarus, 1992, No. 17, Art. 275; Vedamasts, Natsyyanalnaga to descent Respubl, to, Belarus, 1998, No. 28, Art. 462; National register of legal acts of the Republic of Belarus, 1999, No. 54, 2/51; 2006, No. 114, 2/1252; 2007, No. 4, 2/1289; 2009, No. 16, 2/1558; 2010, No. 5, 2/1630; 2011, No. 140, 2/1877) following changes and amendment:

1. In Article 35:

in word part one "to children, and also persons specified in the Item "in" shall be replaced with words to "persons specified in the part three Items "and" and "v"";

to state the Item "and" of part three in the following edition:

"a) children (including adopted, stepsons and stepdaughters), the brothers, sisters and grandsons who did not reach 18 years (studying, which did not reach 23 years), and also children (including adopted, stepsons and stepdaughters), brothers, sisters and grandsons are more senior than 18 years if they became disabled people before achievement of 18 years. At the same time brothers, sisters and grandsons have pension entitlement if they have no able-bodied parents, and the stepson and the stepdaughter - if they did not receive the alimony from parents according to the procedure, established by the legislation. Persons receiving in the Republic of Belarus outside the Republic of Belarus according to international treaties of the Republic of Belarus in day form of education general secondary, professional, secondary vocational, higher, vocational education, additional education of adults treat students in case of development of contents of the educational program of advanced training of leading employees and specialists, the educational program of advanced training of working (employees), the educational program of retraining of the leading employees and specialists having the higher education, the educational program of retraining of the leading employees and specialists having secondary vocational education, the educational program of retraining of working (employees), the educational program of professional training of working (employees) the educational program of training of persons for receipt in organizations of formation of the Republic of Belarus at faculties of pre-university preparation, preparatory departments (except for persons getting education on specialties (the directions of specialties, specializations) for Armed Forces of the Republic of Belarus, other troops and military forming of the Republic of Belarus, law-enforcement bodies of the Republic of Belarus, the Investigative Committee of the Republic of Belarus, bodies of financial investigations of the State Control Committee of the Republic of Belarus, bodies and divisions on emergency situations of the Republic of Belarus and also the students who are on vacation stipulated by the legislation about education);";

the fourth to exclude part;

the fifth to consider part part four.

2. To state the Item of part two of Article 51 in the following edition:

"g) obtaining in day form of education of professional, secondary vocational, higher and postgraduate education, additional education of adults in case of development of contents of the educational program of advanced training of leading employees and specialists, the educational program of advanced training of working (employees), the educational program of retraining of the leading employees and specialists having the higher education, the educational program of retraining of the leading employees and specialists having secondary vocational education, the educational program of retraining of working (employees), the educational program of professional training of working (employees), the educational program of the training rates (lecture halls, thematic seminars, practical works, trainings, officer rates and other types of the training rates) in the direction of district (city) managements (departments) of work, to employment and social protection, committee on work, employment and social protection of the Minsk city executive committee, passing of preparation in clinical internship;".

3. To exclude from the paragraph of the fourth of part one of Article 72 and the paragraph of the fourth of Article 73 of the word "and part four".

4. In Article 84:

the first offer of part one to state in the following edition:

"To persons which are on the state providing in the public stationary institutions of social servicing, child care residential care facilities, orphanages of family type, military units as pupils, and also in public institutions of professional, secondary vocational and higher education and getting education in these organizations in day form of education, including at faculties of pre-university preparation, preparatory departments, 10 interests of the granted pension (except for pensions on the occasion of the loss of the supporter paid to persons specified in parts one and the second article 85 of this Law), but at least 20 percent of the minimum size of old-age pension are paid.";

in word part three" (the Item "and" of part three of article 35 of this Law)" shall be replaced with words "(including adopted, stepsons and stepdaughters), not reached 18 years";

add Article with the note of the following content:

"Note. Child care residential care facilities for the purposes of application of this Law are understood as children's homes, social and pedagogical organizations, boarding schools for orphan children and children without parental support, the auxiliary boarding schools, special general education boarding schools, special teaching and educational facilities, special medical and educational facilities and other organizations providing conditions for accommodation (content) of children.".

5. In part three of Article 88 of the word" (the Item "and" of part three of article 35 of this Law)" shall be replaced with words "(including adopted, stepsons and stepdaughters), not reached 18 years".

Article 3. Bring in the Law of the Republic of Belarus of December 17, 1992 "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee of the Republic of Belarus, bodies and divisions on emergency situations and bodies of financial investigations" (Vyarkhochnaga Savet's Vedamastsi of Respubliki Belarus, 1992, No. 36, Art. 571; Vedamasts, Natsyyanalnaga to descent Respubl, to, Belarus, 1999, No. 1, Art. 4; National register of legal acts of the Republic of Belarus, 2001, No. 63, 2/777; 2002, No. 9, 2/838; 2003, No. 127, 2/993; 2008, No. 16, 2/1420; 2010, No. 5, 2/1630; 2011, No. 140, 2/1877) following changes and amendment:

1. In Article 30:

to state the Item "and" of part three in the following edition:

"a) children (including adopted, stepsons and stepdaughters), the brothers, sisters and grandsons who did not reach 18 years (studying, which did not reach 23 years), and also children (including adopted, stepsons and stepdaughters), brothers, sisters and grandsons are more senior than 18 years if they became disabled people before achievement of 18 years. 2. In part four of Article 33 of the word", providing professional, secondary vocational and higher education, and the student in these organizations in day form of education, including on" shall be replaced with words "professional, secondary vocational and higher education, and getting education in these organizations in day form of education, including at faculties of pre-university preparation,".

3. In Article 54:

the first offer of part one to state in the following edition:

4. In part four of Article 56 of the word" (the Item "and" of part three of article 30 of this Law)" shall be replaced with words "(including adopted, stepsons and stepdaughters), not reached 18 years".

Article 4. Bring in the Law of the Republic of Belarus of June 18, 1993 "About health care" in edition of the Law of the Republic of Belarus of June 20, 2008 (Vyarkhochnaga Savet's Vedamastsi of Respubliki Belarus, 1993, No. 24, Art. 290; National register of legal acts of the Republic of Belarus, 2008, No. 159, 2/1460; 2010, No. 183, 2/1718) following changes and amendments:

1. To exclude parts one of Article 1 of the word of "the established sample" from paragraphs of the twelfth and twenty second.

2. In Article 8 part three:

after the paragraph of the eighth to add part with paragraphs of the following content:

"determines procedure for assignment (decrease, deprivation) qualification categories to health (pharmaceutical) and other workers of health care;

determines terms, procedure for the organization and passing of internship, criteria according to which the organizations of health care can be bases for passing of internship, and also category of persons which are granted the right of passing qualification examination without passing of internship, and conditions of delivery by them of the specified examination;";

the ninth to consider the paragraph the paragraph the eleventh.

3. To state the paragraph of the seventh part two of Article 10 in the following edition:

"the public institutions of education performing preparation, advanced training and (or) retraining of specialists with the higher or secondary vocational medical (pharmaceutical) education;".

4. In Article 46:

in part five "educational" to replace the word with the word "educational";

third to state the paragraph to part eight in the following edition:

"at the request of child care residential care facilities, public institutions of professional, secondary vocational, higher education, orphanages of family type, tutorial families, foster homes - in cases when children are on the state providing in these organizations, families;".

5. In part one of Article 47 of the word", providing medical (pharmaceutical) education and (or) advanced training and retraining of health (pharmaceutical) workers, for use in educational" shall be replaced with words "educations, performing training, advanced training and (or) retraining of specialists with the higher or secondary vocational medical (pharmaceutical) education, for use in educational".

6. The fourth to state the paragraph to part one of Article 53 in the following edition:

"to development of clinical protocols, educational and program documentation of educational programs by preparation, advanced training and retraining of health (pharmaceutical) workers;".

7. In Article 54:

state part one in the following edition:

"Training of health (pharmaceutical) workers is performed by the public institutions of education performing training of specialists with the higher or secondary vocational medical (pharmaceutical) education according to the legislation of the Republic of Belarus.";

in word part two", providing medical (pharmaceutical) education, pupils, students, undergraduates and graduate students can be attracted according to the procedure, established by the legislation" shall be replaced with words "educations, performing preparation, advanced training and (or) retraining of specialists with the higher or secondary vocational medical (pharmaceutical) education, students can be attracted according to the procedure, established by the Ministry of Health".

8. Article 55 in paragraph one:

words", providing the higher medical (pharmaceutical) education" shall be replaced with words "educations, performing training of specialists with the higher medical education";

to exclude words of "the established sample".

9. In Article 56:

from word part one", constantly living in the Republic of Belarus" to exclude;

the second to state part in the following edition:

"Persons who got the higher medical (pharmaceutical) educations, and also the faces which do not have the specified education, applying for holding the posts of specialists doctors (specialists pharmacists) on condition of passing of internship and delivery after its passing of qualification examination, except for categories of persons which by the Ministry of Health of the Republic of Belarus are granted the right of passing qualification examination without passing of internship have employment eligibility of the specialist doctor (specialist pharmacist).";

add Article with part four of the following content:

"The persons having the higher or secondary vocational medical (pharmaceutical) education, not working on the available specialty more than four years can be allowed to holding the posts of health (pharmaceutical) workers only after confirmation of the qualification and based on testing, carried out according to the procedure, established by the Ministry of Health of the Republic of Belarus, except for persons to whom guarantees of their labor rights are established by legal acts of the Republic of Belarus.".

10. In Article 57:

state part one in the following edition:

"Persons who got the higher medical (pharmaceutical) educations, and also the faces which do not have the specified education, applying for holding the posts of specialists doctors (specialists pharmacists) except for of categories of persons which by the Ministry of Health of the Republic of Belarus are granted the right of passing qualification examination without passing of internship go for passing of internship as the doctor-intern (pharmacist-intern) to the organizations of health care for the purpose of increasing knowledge and acquisition of practical skills for follow-up independent labor activity as the specialist doctor (specialist pharmacist).";

the second to exclude part;

the third or tenth to consider parts respectively parts of the second or ninth;

from parts two and third "professional" to exclude the word;

"professional" to exclude the word from part four.

11. In Article 58:

in word part two", providing the higher medical (pharmaceutical) education and (or) advanced training and retraining of health (pharmaceutical) workers" shall be replaced with words "educations, performing preparation, advanced training and (or) retraining of specialists with the higher medical (pharmaceutical) education";

in word part three", providing the higher medical (pharmaceutical) education and (or) advanced training and retraining of health (pharmaceutical) workers" shall be replaced with words "educations, performing preparation, advanced training and (or) retraining of specialists with the higher medical (pharmaceutical) education".

12. Exclude Article 59.

13. State Article 60 in the following edition:

"Article 60. Training of scientists of the top skills on specialties of branch of science "Medical sciences"

Training of scientists of the top skills on specialties of branch of science "Medical sciences" is performed in the public institutions of education performing preparation, advanced training and (or) retraining of specialists with the higher medical (pharmaceutical) education, and the state medical (pharmaceutical) scientific organizations realizing educational programs of postgraduate education, according to the procedure, established by the legislation of the Republic of Belarus.".

14. In Article 61:

to exclude the word "highest" from part one;

the second to state part in the following edition:

"Preparation in clinical internship is performed in the public institutions of education performing preparation, advanced training and (or) retraining of specialists with the higher or secondary vocational medical (pharmaceutical) education and also in the state medical scientific organizations.".

15. State Article 62 in the following edition:

"Article 62. Advanced training and retraining of health (pharmaceutical) workers

Advanced training and retraining of health (pharmaceutical) workers are performed by the public institutions of education performing preparation, advanced training and (or) retraining of specialists with the higher or secondary vocational medical (pharmaceutical) education, according to the procedure, established by the legislation of the Republic of Belarus.".

Article 5. Voided according to the Law of the Republic of Belarus of 04.01.2014 No. 125-Z

Article 6.

Article 7. Bring in the Law of the Republic of Belarus of October 21, 1996 "About scientific activities" in edition of the Law of the Republic of Belarus of October 17, 2005 (Vyarkhochnaga Savet's Vedamastsi of Respubliki Belarus, 1996, No. 34, Art. 608; National register of legal acts of the Republic of Belarus, 2005, No. 171, 2/1143; 2010, No. 110, 2/1667) following changes and amendments:

1. To state the paragraph of the sixth Article 1 in the following edition:

"training of scientists of the top skills - the type of scientific activities consisting in implementation of educational programs of postgraduate education;".

2. The fifth Article 4 to state the paragraph in the following edition:

"interactions of the scientific organizations with organizations of education, and also the organizations realizing educational programs of postgraduate education including by participation of pedagogical workers and students in the scientific activities performed by the scientific organizations and also participation of scientists of the scientific organizations in the educational process performed by the organizations of education and the organizations realizing educational programs of postgraduate education;".

3. In Article 7 part two:

the fifth to state the paragraph in the following edition:

"organizations of education;";

add part with the paragraph the sixth the following content:

"the organizations realizing educational programs of postgraduate education.".

4. In Article 9:

in word part two to "full-time" shall be replaced with words to "day form of education";

to state the paragraph of the seventh part three in the following edition:

part four in paragraph four shall be replaced with words the word of "theses" "qualification scientific works (theses) (further - theses)".

5. Third to state the paragraph to part one of Article 12 in the following edition:

6. State Article 13 in the following edition:

"Article 13. Training of scientists of the top skills

Training of scientists of the top skills is performed according to the legislation in case of receipt of postgraduate education and is aimed at preparation of theses.".

7. The first offer of part one of Article 14 to state in the following edition:

"For carrying out protection of theses according to the procedure and on the conditions determined by the legislation councils on protection of theses are created.".

8. The second Article 19 to add part with words ", other authorized state bodies according to decisions of the President of the Republic of Belarus if other is not established by the President of the Republic of Belarus".

Article 8. Article 8 of the Law of the Republic of Belarus of November 11, 1999 "About the state minimum social standards" (1999, 89, 2/97) to state the national register of legal acts of the Republic of Belarus to No. in the following edition: "Article 8. The state minimum social standards in the field of education

The state minimum social standards in the field of education are:

free education, including preschool, general secondary, professional, vocational education, additional education of children and youth (except for the additional education of children and youth received at the public children's schools of arts), on competitive basis secondary vocational, higher education;

regulations and standard rates of security of the population with free and public social services, fullness of classes, groups in public institutions of education at implementation of educational programs;

regulations and standard rates personnel and material logistics of public institutions of education in case of implementation of educational programs;

regulations and standard rates of measures of social protection of students.".

Article 9.

Article 10. Bring in the Law of the Republic of Belarus of February 25, 2002 "About consumer cooperation (consumer societies, their unions) in the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2002, No. 28, 2/842) the following changes:

1. In paragraph nine of Article 3 of the word of "educational institutions" shall be replaced with words "organizations of education".

2. The tenth to state the paragraph to part one of Article 12 in the following edition:

"receive professional, secondary vocational, higher, postgraduate education, additional education of adults at the expense of means of the organizations of consumer cooperation;".

Article 11. Bring in the Law of the Republic of Belarus of May 18, 2004 "About the state awards of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2004, No. 88, 2/1037; 2008, No. 1, 2/1386; 2009, No. 171, 2/1589; No. 276, 2/1603) following changes and amendment:

1. Article 11 part one in paragraph four to replace the word of "teenagers" with the word of "youth".

2. In Article 13:

after part three to add Article with part of the following content:

"The women having criminal record, leading immoral life of Mother are not awarded the order.";

the fourth to consider part part five.

3. In paragraph four of part one of Article 18 of the word to "professional training" shall be replaced with words "training of children and".

4. In Article 26 of the word "education and preparation of creative personnel" shall be replaced with words to "training of cultural workers".

5. In Article 28 of the word "education and preparation of scientific personnel" shall be replaced with words to "training of scientists of the top skills".

6. In Article 30 "educational" to replace the word with the word of "educational".

7. State Articles 31 and 32 in the following edition:

"Article 31. Honorary title "The honored teacher of the Republic of Belarus"

The honorary title "The honored teacher of the Republic of Belarus" is given to highly professional pedagogical workers whose pedagogical activities are directed to realization of contents of the educational program of preschool education, educational programs of general secondary, professional, secondary vocational, vocational education, the educational program of additional education of children and youth and programs of education, management of educational activities in case of implementation of these educational programs, programs of education, working in fifteen and more years, for merits in training and education of pupils and pupils, identification and development of their individual and creative capabilities.

Article 32. Honorary title "The honored worker of formation of the Republic of Belarus"

The honorary title "The honored worker of formation of the Republic of Belarus" is given to highly professional pedagogical workers, and also the other persons performing activities in the field of education fifteen and more years for personal deposit in educational development, merits in scientific, nauchnopedagogichesky, pedagogical, innovative activities.".

8. In Article 45 of the word of "level of training of personnel" shall be replaced with words "qualifications of workers of services industry".

9. In Article 57:

the word of "educational" to exclude;

"scientific and pedagogical" shall be replaced with words the word "scientific, nauchnopedagogichesky, pedagogical".

10. In Article 67:

third to state part in the following edition:

"Subsequent representation to rewarding with awards and medals of the Republic of Belarus and assignment of honorary titles of the Republic of Belarus are possible, as a rule, not earlier than in five years after the previous rewarding (assignment), except for rewardings of mothers having many children, persons who are earlier awarded with the medal "For Faultless Service" and the particular cases connected with making of feat.";

in part four of the word "the award "Maternal Glory" or medal are handed" shall be replaced with words "which are awarded the order "Maternal Glory" or medal".

Article 12. Bring in the Air code of the Republic of Belarus of May 16, 2006 (The national register of legal acts of the Republic of Belarus, 2006, No. 78, 2/1214) the following changes:

1. To state the paragraph of the seventh part one of Article 20 in the following edition:

"preparation, retraining and advanced training of aviation personnel;".

2. State Article 38 in the following edition: "Article 38. Preparation, retraining and advanced training of aviation personnel of civil aviation

Preparation, retraining and advanced training of aviation personnel of civil aviation are performed in organizations of formation of the Republic of Belarus, other organizations of education system of the Republic of Belarus and the foreign organizations.

Opening of preparation on education profiles, the directions of education, specialties, the directions of specialties, specializations for civil aviation in the organizations of education system of the Republic of Belarus is performed in the presence of the certificate issued by specially authorized body in the field of civil aviation.

The citizen who had training, retraining or advanced training in the field of civil aviation abroad has the right to implementation of activities for safety of flights of aircrafts and aviation safety, on the organization, accomplishment, and also providing and servicing of flights of aircrafts, airborne transportations and aviation works, for the organization, servicing of air traffic and management of flights in the presence of the certificate on recognition of the education document granted by authorized state body granted in foreign state, and establishment of its equivalence (compliance) to the education document of the Republic of Belarus if other is not established by international treaties of the Republic of Belarus.".

3. In part two of Article 93 of the word "special training" to replace with the word "training".

Article 13. Bring in the Code of the Republic of Belarus about judicial system and the status of judges of June 29, 2006 (The national register of legal acts of the Republic of Belarus, 2006, No. 107, 2/1236; 2010, No. 5, 2/1629; 2011, No. 140, 2/1877) following changes:

1. State Article 98 in the following edition:

"Article 98. Special preparation on judgeship

In the presence in court of vacant position of the judge or authentic data on the planned release of the judge from position the qualification board of judges recommends the candidate for judges registered by it for appointment to vacant position of the judge and passing in need of special preparation what it informs the Ministry of Justice of the Republic of Belarus on.

The candidate for judges having length of service on legal specialty at least three years in central office of the Ministry of Justice of the Republic of Belarus and the organizations of system of the Ministry of Justice of the Republic of Belarus, general and economic courts, legal profession, bodies of prosecutor's office, law-enforcement bodies, the Investigative Committee of the Republic of Belarus according to the joint decision according to the Ministry of Justice of the Republic of Belarus and the Supreme Court of the Republic of Belarus or the Ministry of Justice of the Republic of Belarus and Supreme Economic Court of the Republic of Belarus can be exempted from passing of special preparation on judgeship of general or economic court.

The Ministry of Justice of the Republic of Belarus or Supreme Economic Court of the Republic of Belarus direct the candidate for judges for passing of special preparation to position according to the judge of general or economic court.

Special preparation on judgeship will be organized according to the Code of the Republic of Belarus about education taking into account the features containing in this Article.

Conditions of passing of special preparation on judgeship of general or economic court are determined by the Ministry of Justice of the Republic of Belarus jointly according to the Supreme Court of the Republic of Belarus or Supreme Economic Court of the Republic of Belarus.

Special preparation on judgeship consists in implementation of the educational program of the special preparation necessary for holding the post of the judge, and includes training for up to one year in organization of education with the combined training in one of courts of the republic in which there is vacant position of the judge, under the leadership of the judge appointed respectively the Chairman of the Supreme Court of the Republic of Belarus or the Chairman of Supreme Economic Court of the Republic of Belarus.

Educational and program documentation of the educational program of the special preparation necessary for holding the post of the judge includes educational and thematic plans of special preparation for judgeship and training programs of special preparation for judgeship.

Educational and program documentation of the educational program of the special preparation necessary for holding the post of the judge is developed by the organization of education realizing such educational program and affirms his head under approval according to the Supreme Court of the Republic of Belarus and the Ministry of Justice of the Republic of Belarus or with Supreme Economic Court of the Republic of Belarus.

The final assessment of listeners is held in the form of examination and protection of final work.

In case of refusal in position assignment of the judge to the candidate for judges directed for passing of special preparation to judgeship of general or economic court former work (position), and in case of its otsutstviidrugy equivalent work (position), except as specified is provided to liquidation of the organization.".

2. In part three of Article 104 of the word of "professional training" shall be replaced with words "professional knowledge".

Article 14. Bring in the Law of the Republic of Belarus of January 5, 2008 "About traffic" (The national register of legal acts of the Republic of Belarus, 2008, No. 14, 2/1410; 2009, No. 119, 2/1569; 2011, No. 8, 2/1792) following changes and amendments:

1. In Article 10:

the nineteenth to exclude the paragraph;

to consider paragraphs of the twentieth-twenty second respectively paragraphs the nineteenth-twenty first.
