About approval of the Regulations on licensing of activities for production, realization and hire of measuring instruments
According to article 5 of the Law of the Republic of Uzbekistan "About licensing of separate types of activity" the Cabinet of Ministers decides
1. Approve:
Regulations on licensing of activities for production, realization and hire of measuring instruments according to the appendix N1.
2. Take into consideration that activities for production, realization and hire of the measuring instruments applied in the spheres specified in article 14 of the Law of the Republic of Uzbekistan "About metrology" are subject to licensing.
3. The commissions in two weeks:
develop and approve regulations on the Commission of the Cabinet of Ministers on licensing of activities for production, realization and hire of measuring instruments and the working group on preparation of expert opinions;
approve members of working group on preparation of expert opinions.
4. To the Uzstandart agency together with the interested ministries and departments in two weeks to develop and submit for approval in the Commission the list of measuring instruments specified according to requirements of the Law of the Republic of Uzbekistan "About metrology" and this resolution which production, realization and hire are subject to licensing.
5. To impose control of execution of this resolution on the Secretariat of the Prime Minister of the Republic of Uzbekistan and the CEO of the Uzstandart agency Buriyev R. A.

Appendix №1
to the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of December 2, 2003 No. 539
1. This Provision determines procedure for licensing of activities for production, realization and hire of measuring instruments.
Activities for production, realization and hire of measuring instruments which are applied in spheres according to appendix 1 to this Provision are subject to licensing.
2. Decisions on issue of licenses, and also in the cases established by the legislation suspension or cancellation of the license, and also its cancellation and renewal are accepted by the Uzstandart Agency (further - the Agency).
For consideration of documents on issue of licenses in the Agency the commission of experts is created. Activities of commission of experts will be organized according to the provision approved by the Agency.
3. Activities for production, realization and hire of measuring instruments are performed by legal entities and physical persons.
4. On the right of implementation of activities for production, realization and hire of measuring instruments standard (simple) licenses are granted.
According to the statement of the license applicant the license is issued in general by sight to activities, or on its part.
5. The license for the right of implementation of activities for production of realization and to hire of measuring instruments is issued for a period of 5 years.
6. When implementing activities for production, realization and hire of measuring instruments treat licensed requirements and conditions:
obligatory compliance with law about metrology;
availability of the necessary certificates, certificates and other documents provided by the current legislation for implementation of the licensed activities;
observance of requirements of normative and legal and regulating documents of the State system for ensuring the uniformity of measurements;
availability of the regulating documentation on measuring instruments, techniques of checking, conditions for storage;
availability in staff of the legal entity of the specialists having special metrological preparation (for license applicants and licensees - legal entities);
availability of the documents confirming special metrological training of the physical person (for license applicants and litsenziatovfizichesky persons);
availability of necessary material and technical resources for production, the realization and hire of measuring instruments conforming to the established requirements.
Specific licensed requirements and conditions from listed in this Item can be provided in the license agreement.
7. For receipt of the license the license applicant submits the following documents to the Agency:
the statement for licensing with indication of: the name and form of business of the legal entity, the place of its stay (postal address), the name of organization of bank and the room of the settlement account in organization of bank - for the legal entity; surnames, name, middle name, data of the identity document of the citizen - for physical person; names of the licensed type of activity (its part) which the legal entity or physical person intends to perform;
the copy of the certificate on state registration of the legal entity - for legal entities;
the copy of the certificate on state registration of the individual entrepreneur - for physical persons;
the document confirming introduction by the license applicant of collection for consideration of the application of the license applicant;
on the right of production of measuring instruments the Uzstandart agencies issued in accordance with the established procedure by the Republican center for rendering metrological services are represented: the certificate of approval like measuring instruments, the description like measuring instruments for the state register or the certificate of metrological certification;
on sales right and hire of measuring instruments data on availability of conditions for storage of measuring instruments are represented.
The requirement from the license applicant of submission of the documents which are not provided by this Provision is not allowed.
8. Documents are brought by the license applicant to the Agency directly, or through means of mail service with the notification on their obtaining.
Documents are accepted by the responsible person of the Agency according to the inventory which copy goes (is handed) to the applicant with mark about date of documents acceptance.
9. The license applicant bears responsibility according to the legislation for submission of the doubtful or distorted data.
10. For consideration by the licensing body of the statement of the license applicant collection in quadruple size of minimum wage for legal entities, in triple size - for physical persons is levied.
The collection amount for consideration of the applications of job seekers of licenses is credited into the account of the Agency.
In case of refusal the license applicant from the submitted application, the collection amount is not subject to return.
11. Licensing of activities for production, realization and hire of measuring instruments is performed according to the scheme according to appendix 2 to this Provision.
The decision on licensing to the license applicant or about refusal in licensing is accepted in time, not exceeding fifteen days from the date of receipt of the statement of the license applicant.
12. The Agency notifies the license applicant within three days after adoption of the relevant decision on the made decision.
The notification on decision making goes for licensing (is handed) to the license applicant in writing with indication of bank account details, payment due date of the state fee.
Along with the notice on decision making the license agreement goes for licensing to the license applicant for signing.
The license agreement determining the mutual rights and obligations of the licensing body and the licensee consists between the Agency and the licensee, and shall contain:
surname, name, middle name, position of persons which signed the agreement;
details of the parties;
the name of type of activity on which implementation the license is granted;
license effective period;
the licensed requirements and conditions shown to the licensee;
responsibility of the parties for violation of requirements and conditions of the license agreement;
procedure for control from the Agency of accomplishment by the licensee of requirements and conditions of the license agreement.
The license agreement is constituted in duplicate - in one copy for the licensee and the Agency.
13. Forms of licenses are documents of the strict reporting, have accounting series, number and degree of security. Samples of forms of licenses are developed and affirm the Agency and are made by its order by typographical method in GPO "Davlat of Belgisa". The head of the Agency bears the personal responsibility for accounting, safety and target use of forms of licenses.
Licenses are drawn up by the Agency and signed by the CEO of the Agency (his deputy).
14. The license is granted by the Agency in three-day time after representation by the license applicant of the document confirming payment of the state fee and signing of the license agreement by it.
15. If the licensee within three months from the moment of the direction (delivery) of the notification on decision making about licensing did not submit the document confirming payment of the state fee for licensing to the Agency or did not sign the license agreement, the Agency has the right to make the decision on cancellation of the license.
16. Licensing it can be refused on the bases, the stipulated in Article 17 Laws of the Republic of Uzbekistan "About licensing of separate types of activity".
The license applicant has the right to appeal the decision on the refusal in licensing, and also action (failure to act) of the official of the Agency according to the procedure established by the legislation.
17. In case of decision making about refusal in licensing the notification on refusal goes (is handed) to the license applicant in writing with indication of specific causes of failure and the term sufficient in order that the license applicant, having removed the specified causes, could submit documents for de novo review. The term specified in the notification on refusal in licensing shall be proportional to time necessary for remedial action.
18. In case of elimination by the license applicant of the reasons which formed the basis for refusal in licensing, de novo review of documents is performed in time, not exceeding five days from the date of receipt of the statement of the license applicant with all necessary documents.
For de novo review of statements of job seekers of licenses collection is not levied.
The application submitted after the term specified in the notification on refusal in licensing is considered again given.
19. In case of transformation of the licensee - the legal entity, change of its name or the place of its stay (postal address) the licensee or his legal successor shall submit after passing of re-registration to the Agency the application for renewal of the license with appendix of the relevant documents confirming the specified data in a month.
In case of change of surname, name, middle name or the residence of the licensee - physical person, the licensee shall submit after passing of re-registration to the Agency the application for renewal of the license with appendix of the relevant documents confirming the specified data in a month.
20. Before renewal of the license the licensee performs the activities specified in it based on earlier granted license.
21. In case of renewal of the license Agency enters corresponding changes in the register of licenses. Renewal of the license is performed within five days from the date of receipt by the Agency of the statement for renewal of the license with appendix of the relevant documents.
In case of renewal of the license collection in half size of the amount paid for consideration of the application of the license applicant about licensing is levied. The amount of collection is credited into the account of the Agency.
22. Prolongation of effective period of the license is performed according to the statement of the licensee.
The application for prolongation of effective period of the license shall be submitted to the Agency no later than two months before expiration of the license.
The decision on prolongation or on refusal in prolongation of effective period of the license is accepted according to the procedure, provided for licensing.
23. Instead of the lost or become useless license which effective period did not expire according to the statement of the licensee the duplicate can be issued.
In case of issue of the duplicate of the license collection in half size of the amount paid for consideration of the application of the license applicant about licensing is levied. The amount of collection is credited into the account of the Agency.
24. Control of observance by the licensee of licensed requirements and conditions is performed by the Agency according to the procedure, established by the legislation.
25. In case of control of observance of licensed requirements and conditions the Agency, within the competence, has the right:
carry out according to the procedure, established by the legislation, scheduled inspections of observance by the licensee of licensed requirements and conditions;
carry out according to the procedure, established by the legislation, unscheduled inspections of observance by the licensee of licensed requirements and conditions in the presence of the facts testimonial of their violations by the licensee;
request and obtain necessary information on the questions arising when conducting checks of observance of licensed requirements and conditions from the licensee;
draw up based on results of checks statements (references) with indication of specific violations by the licensee of licensed requirements and conditions;
pass the decisions obliging to eliminate the licensee the revealed violations, to establish terms of elimination of such violations;
in the cases established by the legislation to pass decisions or to take a legal action concerning suspension or cancellation of the license, and also its cancellation;
in accordance with the established procedure to direct to tax authorities materials about the elicited facts of implementation of activities for production, realization and hire of measuring instruments without license for taking measures, stipulated by the legislation.
26. When checking observance of licensed requirements and conditions by the checking specialists of the Agency the statement in duplicate is drawn up, one of which is given to the licensee, the second copy remains in the Agency.
27. Suspension, cancellation or cancellation of the license is made in the cases and procedure provided by articles 22-24 of the Law of the Republic of Uzbekistan "About licensing of separate types of activity".
28. The decision of the Agency on suspension of action of the license can be appealed in court. In case of recognition of groundlessness of the decision of the Agency Agency by court bears before the licensee responsibility in the amount of the damage suffered by it.
29. The agency keeps the register of licenses. In the register shall be specified:

30. Information containing in registers of licenses is posted on the website of the licensing body and is open for acquaintance.
31. The state fee for licensing for the right of implementation of production, realization and hire of measuring instruments and prolongation of term of its action is levied in quadruple size of minimum wage.
Means of the state fee for issue of licenses are enlisted in the republican budget.
