About approval of Changes to the Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming

According to the paragraph of Item 3 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 395, the subitem 19 of item 4 of the Regulations on the Public registration service of Ukraine approved by the Presidential decree of Ukraine of April 6, 2011 No. 401, I ORDER third:

1. Approve Changes to the Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming approved by the order of the Ministry of Justice of Ukraine of July 8, 2011 to No. 1828/5, registered in the Ministry of Justice of Ukraine on July 13, 2011 for No. 855/19593, which are applied.

2. To department of interaction with authorities (N.O.'s Bull-trouts) to submit this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes).

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the Chairman of the Public registration service of Ukraine D.M.'s Crow and the director of the department of interaction with authorities of Bull-trouts N. O.

Changes to the Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming

1. Item 2 after words "the charter (provision) of public forming," to add with the words "concerning acceptance note decisions on the termination of public forming".

2. Item 3 after words "lists of arbitration judges of permanent reference tribunals;" to add with words "captures note of the decision on the termination of public forming".

3. To add Item 8 after the paragraph of the sixth with the new paragraph of such content:

"about acceptance note decisions on the termination of public forming;".

With respect thereto the seventh or ninth to consider paragraphs respectively paragraphs the eighth or tenth.

4. State Item 9 in such edition:

"9. The decisions specified in Item 8 of this Procedure are accepted depending on results of legal examination within fixed term only on the bases established by the laws, and also acts of the Cabinet of Ministers of Ukraine and orders of Ministry of Justice of Ukraine adopted on their accomplishment, and in case of registration (approval or acceptance note) changes to statutory documents, adoptions note of information on changes in structure of governing bodies - also based on the charter (provision) of the corresponding public forming. Such decisions are drawn up by orders to which the legal conclusion concerning compliance to the legislation of Ukraine of the constituent documents submitted for legalization (registration) (appendices 1, of 2), concerning compliance to the legislation of Ukraine messages of the organization of labor union on belonging to certain labor union (appendix 3), concerning compliance to the legislation of Ukraine and to the charter (provision) of public forming of changes to statutory documents (appendices 4, of 5), concerning compliance to the legislation of Ukraine and to the statutory document of public forming of information on changes in structure of governing bodies (appendix 6, of 7), concerning compliance to the legislation of Ukraine and to the charter (provision) of public forming of the documents filed for issue of duplicates of the registration certificate (legalization) and/or to the charter (provision) (appendices 8, of 9) is attached, concerning compliance to the legislation of Ukraine and to the charter (provision) of public forming of the documents filed for adoption note of the decision on the termination of public forming (appendix 10, 11), concerning compliance to the legislation of Ukraine and to the statutory document of public forming of the documents submitted for cancellation of record about legalization (registration) (appendices 12, 13), concerning compliance to the legislation of Ukraine and to the charter (provision) of public forming of the documents filed for registration of symbolics (appendix 14), concerning compliance to the legislation of Ukraine and to the statutory document of public forming of the documents submitted for state registration of changes to provision, the regulations, the list of arbitration judges of permanent reference tribunal (appendix 15, 16). The legal conclusion is integral part of the order. In case of adoption of several decisions concerning one public forming such decisions can be drawn up by one order and the legal conclusion.".

5. The paragraph one of Item 23 after words "the charter (provision) of public forming," to add with the words "in acceptance note decisions on the termination of public forming.

6. Add the Procedure with new Item 24 of such content:

"24. The order on adoption note of the decision on the termination of public forming is issued based on the decision of founders (participants) or the body authorized by them on the termination of activities of public forming.".

With respect thereto 24, 25 to consider Items respectively Items 25, 26.

7. Add the Procedure after appendix with 9 new appendices 10, of 11, which are applied.

With respect thereto to consider appendices 10-14 respectively appendices 12-16.
