According to the Presidential decree of Ukraine of 09.12.2010 No. 1085 "About optimization of system of the central executive bodies", Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of 06.04.2011 No. 395, the Regulations on the Public registration service of Ukraine approved by the Presidential decree of Ukraine of 06.04.2011 No. 401, I ORDER:

1. Approve the Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming which is applied.

2. Recognize to invalid:

2.1. The order of the Ministry of Justice of Ukraine of 07.12.2006 No. 92/5 "About approval of the Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming", registered in the Ministry of Justice of Ukraine 07.12.2006 for No. 1287/13161 (with changes).

2.2. The order of the Ministry of Justice of Ukraine of 27.08.2007 No. 693/5 "About approval of Rules of preparation and execution of decisions concerning registration of lawyer associations by the Ministry of Justice of Ukraine", registered in the Ministry of Justice of Ukraine 28.08.2007 for No. 986/14253.

3. (Zerkal O. V.) to submit to department of interaction with authorities this order on state registration according to the Presidential decree of Ukraine of 03.10.92 No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies" (with changes).

4. This order becomes effective from the date of its official publication.

Procedure for preparation and execution of decisions concerning legalization of associations of citizens and other public forming

1. This Procedure is developed according to the Laws of Ukraine "About charity and charitable organizations", "About professional creative specialists and the creative unions", "About labor unions, their rights and guarantees of activities", "About political parties in Ukraine", "About the organizations of employers, their associations, the rights and guarantees of their activities", "About Chambers of Commerce and Industry in Ukraine", "About reference tribunals", "About associations of local government bodies", "About credit unions" and other regulatory legal acts which regulate questions of creation, legalization (registration) and functioning of public forming, according to which legalization (registration) of political parties and their structural educations, charitable organizations, organizations of employers and their associations, the creative unions, labor unions, their associations, associations of credit unions, Chambers of Commerce and Industry, permanent reference tribunals, territorial cells of the All-Ukrainian creative unions and other public forming (further - public forming) is obligatory and it is performed by their legalization or registration.

2. This Procedure determines the procedure of preparation and execution of decisions which are made by results of consideration by the Public registration service of Ukraine and registration services of territorial authorities of Ministry of Justice of documents, concerning legalization (registration) of public forming, concerning registration of symbolics of labor unions, their associations, the organizations of employers, their associations, political parties, charitable organizations, and also decisions, concerning registration (approval or acceptance note) changes to statutory documents, concerning adoption note of information on changes in structure of governing bodies of public forming, rather state registration of changes to provisions, regulations, lists of arbitration judges of permanent reference tribunals, concerning issue of duplicates of the certificate and/or the charter (provision) of public forming, concerning cancellation of record about legalization (registration) of public forming concerning acceptance note decisions on the termination of public forming.

According to this Procedure decisions concerning legalization (registration) of public forming are made; state registration of charitable organizations; state registration of the creative unions; legalizations on compliance to the declared status of labor unions, their associations, acceptances note messages of the organization of labor union on belonging to certain labor union; registration of political parties and their structural educations; legalizations of primary cells of political parties; state registration of the organizations of employers and their associations; state registration of Chambers of Commerce and Industry; state registration of permanent reference tribunals; state registration of associations of local government bodies; state registration of charters of territorial bulks; state registration of branches, departments, representative offices of All-Ukrainian and international charitable organizations; state registration of territorial cells of the All-Ukrainian creative unions; state registration of associations of credit unions and other public forming; registration of the fund charter of social insurance from labor accidents and occupational diseases and charters of other funds of obligatory national social insurance; registration of symbolics of labor unions, their associations, organizations of employers, their associations, political parties, charitable organizations; registration (state registration, approval or acceptance note) changes to statutory documents of public forming, acceptances note information on changes in structure of governing bodies of public forming; state registration of changes to provisions, regulations, lists of arbitration judges of permanent reference tribunals of capture note decisions on the termination of public forming; cancellation of record about legalization (registration) of public forming.

4. Legalization (registration) of public forming consists in conducting legal examination of constituent documents on their compliance to the Constitution and other acts of the legislation of Ukraine, and in cases, stipulated by the legislation, also to the charter (provision) of public forming, decision making about legalization (registration) of public forming, entering of data in the corresponding register and assignment of registration number, issue of the certificate (except public forming to which the legislation does not provide issue of the certificate) or references.
