About approval of the List of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary

According to part two of article 29 of the Law of Ukraine "About radio-frequency resource of Ukraine" the National commission performing state regulation in the field of communication and informatization SOLVED:

1. Approve the List of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary that is applied.

2. Recognize invalid decisions of the National commission on questions of regulation of communication of Ukraine:

of September 6, 2007 No. 914 "About approval of the List of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary", registered in the Ministry of Justice of Ukraine on November 20, 2007 for No. 1297/14564;

of May 14, 2009 No. 1499 "About approval of Changes in the List of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary", registered in the Ministry of Justice of Ukraine on July 20, 2009 for No. 654/16670;

of May 27, 2010 No. 238 "About approval of Changes in the List of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary", registered in the Ministry of Justice of Ukraine on June 24, 2010 for No. 430/17725.

3. To submit to department of regulation and licensing this decision on state registration to the Ministry of Justice of Ukraine.

4. This decision becomes effective from the date of its official publication.

The list of radio-electronic means and the radiating devices for which operation permissions to operate are not necessary

I. General provisions

1.1. Types of radio-electronic means (further - RES) and the radiating devices (further - OP) and essential signs of these RES or IU which operation according to the Law of Ukraine "About radio-frequency resource of Ukraine" is performed without receipt of permissions to operate RES or IU are brought in this List (on bezrazreshitelny basis).

In total RES and IU which types are determined in this List shall be entered in the Register of radio-electronic means and the radiating devices which can be used in the territory of Ukraine in strips of radio frequencies public which is conducted by the National commission performing state regulation in the field of communication and informatization according to Regulations on procedure and form of maintaining the register of radio-electronic means and the radiating devices which can be used in the territory of Ukraine in strips of radio frequencies of the general use approved by the decision of the National commission on questions of regulation of communication of Ukraine of November 3, 2005 No. 117, registered in the Ministry of Justice of Ukraine on December 28, 2005 for No. 1574/11854 (in edition of the decision of the National commission on questions of regulation of communication of Ukraine of November 10, 2011 No. 637).

1.2. RES and IU which are operated on bezrazreshitelny basis according to this List shall not create radio interferences and require protection against interfering influence of RES operated based on permissions to operate.

In case of creation of radio interferences to work of other RES the operator of telecommunications (the owner of RES) shall stop immediately servicing (work) and take measures for the termination of operation of RES until elimination of action of radio interference.

1.3. Operation of RES on bezrazreshitelny basis according to this List does not guarantee work without hindrances from other RES.

1.4. Operation of RES or IU on bezrazreshitelny basis according to this List does not cover requirements which are not connected directly with use of radio-frequency resource of Ukraine and which require additional approvals and receipt of the permissions (the property right, health care, intellectual property right, labor safety, etc.) provided by the laws.

1.5. In this List the terms below are used in the following values:

subscriber station of radio access - RES which is the transmission medium and/or acceptance of data from/to Item of the termination of telecommunication network where these data are created or used using radio technologies of broadband or multiservice radio access under the administration of the base station of wireless access belongs to the terminal equipment, cannot be used for interaction of telecommunication networks;

the adapter - any autonomous realized radio module with the adapted interface and possibility of external connection to the equipment of technological, household purpose, computer aids, etc.;

application in rooms - method of installation and use of RES in rooms of buildings in case of which the coverage provided to such RES is limited to external walls of the building and the capacity flow density created by the antenna of this RES at distance of 100 m from outside walls of the building does not exceed value-110 dB (W / (m - 2 1 MHz);

the integrated (built-in) antenna (integral antenna) - the antenna which is fixed part of the equipment in which the external connector is not applied and which the user cannot disconnect from the equipment for the purpose of connection of other antenna. Such antenna is mounted in or outside of the equipment;

the constructive (external) antenna (dedicated antenna) - the antenna which applies antenna connector with cable or wave guide and which was appointed or developed for one or several specific types of the radio equipment and which is component of set of delivery of radio-electronic means. Length of coaxial cable which connects the antenna to the transmitter of radio-electronic means shall not exceed 3 m. The radio equipment using the constructive antenna shall correspond to the application conditions determined by this List;

the device of short radius of action (Short Range Devices) - RES which is intended for ensuring communication at short distances and is characterized by small value of equivalent is isotropic emitted capacity (further - EIIM) and capability not to create inadmissible hindrances to work of other RES for the realization account of technologies of minimization of interfering impact;

the radio module - RES with functions of the subscriber station of radio access or point of wireless access which is part of devices, blocks, the equipment of technological, household purpose, computer aids, etc. and which provides data exchange in telecommunication network of personal (personal) use or technological appointment and also is used for the organization of radio access to resources of telecommunication networks;

the smart and antenna module - the equipment of RES in which optimization of opportunities of radiation and/or acceptance is performed combination of multielement antennas with channels of transfer and/or acceptance with functions of processing of signals (for example, space multiplexing, forming of the directional pattern, razneseniye by method of cyclic delay of signal, systems on many entrances and exits (by), etc.);

telecommunication networks of personal (personal) use - the telecommunication networks created for ensuring personal needs in which access to resources and data exchange is provided to narrow group of people without provision of telecommunication services. To it telecommunication networks networks which somehow connect parts of telecommunication network public do not belong or provide alternative channel of data transmission between such networks;

point of wireless access - RES with management functions and data exchange between other RES of radio technologies of broadband or multiservice radio access and the providing access of subscriber stations of radio access to telecommunication networks of different function.

Other terms used in this List are used in the values determined by the Laws of Ukraine "About radio-frequency resource of Ukraine", "About telecommunications", Regulations of radio communication of International union of telecommunication and national standards.
