According to Item 6 of article 192 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan", I ORDER:
2. To provide to department of veterinary and food safety of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let;
3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.
3. To impose control of execution of this order on the supervising vice-Ministers of Agriculture and finance of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of implementation by officials of bodies of state revenues of veterinary health control at automobile check points through customs border of the Customs union, except for laboratory control, and also interaction of authorized body in the field of veterinary science and bodies of state revenues (further - Rules) are developed according to Item 6 of article 192 of the Code of the Republic of Kazakhstan of June 30, 2010 "About customs affairs in the Republic of Kazakhstan".
Rules determine procedure officials of bodies of state revenues of veterinary health control at automobile check points through customs border of the Customs union, except for laboratory control, and also interaction of authorized body in the field of veterinary science and bodies of state revenues.
2. Movement (transportation) of objects (further - controlled goods) through customs border of the Customs union is allowed at the check points intended for these purposes or in other places determined by the order of the Government of the Republic of Kazakhstan of July 9, 2013 No. 697 "About approval of the list of check points through Frontier of the Republic of Kazakhstan and stationary posts of transport control in the territory of the Republic of Kazakhstan" which are equipped and equipped with means of veterinary control according to the Decision of the Commission of the Customs union of January 28, 2011 No. 524 "About Single standard requirements to arrangement of check points" further - Single requirements to arrangement).
3. Officials of bodies of state revenues at automobile check points when importing through customs border of the Customs union of controlled goods irrespective of appointment exercise the state veterinary health control (further - officials of VSK).
4. Controlled goods during the importing, transit, and also when moving in the Customs union from the territory of one state on the territory of other state during the whole time of transportation is followed by the veterinary certificates issued by officials of authorized bodies in the field of veterinary science and competent authorities of exporting countries according to the Single veterinary (veterinary and sanitary) requirements imposed to goods, subject to veterinary control (supervision), approved by the decision of the Commission of the Customs union of June 18, 2010 No. 317.
5. Veterinary certificates, when importing controlled goods to customs area of the Customs union, are drawn up in Russian, and also in language of the exporting country and/or English. Forms of these veterinary certificates are made so that to minimize possibility of their falsification (use of special paper, watermarks, availability of typographical number and other methods of protection).
The veterinary certificates which are drawn up on paper forms are signed by the official of competent authority of the exporting country and shall have seal of this body. On each page of the veterinary certificate unique number of the veterinary certificate and two numbers is necessary, first of which designates sequence number of the page, the second - total number of pages, between these numbers the word "from" is put.
In the text of the veterinary certificate corrections, except for the deletions provided by form of the veterinary certificate or performed in other approved cases are excluded. Such changes are certified by the signature of the official and sealed competent authority of the exporting country.
6. Import, transportation and use of medicines and feed additives for application in veterinary science on customs area of the Customs union is performed on condition of their registration of state members of the Eurasian Economic Union by authorized bodies (further - state members of EEU), information on which is posted on the website of the Eurasian economic commission.
State members of EEU mutually recognize results of registration of medicines and feed additives for application in veterinary science.
Import, transportation of medicines, and also feed additives of chemical and microbiological synthesis are performed without veterinary certificate accompanied by the document confirming their quality and safety, issued by manufacturer.
7. When importing, exporting and transit to controlled goods by officials of VSK apply the following types of control:
1) documentary control;
2) physical veterinary health control.
8. Documentary control consists in check:
the documents confirming safety of controlled goods;
availability of import permits (export) or transit of controlled goods;
compliance of contents of the issued documents to Single veterinary requirements.
9. Physical veterinary health control includes:
examination of controlled goods and survey of animals;
check of compliance of controlled goods to the data specified in the shown documents for the purpose of exception of availability of the controlled goods which are not specified in accompanying documents and exception of joint movement of incompatible goods;
control of compliance of the vehicle to the established veterinary (veterinary and sanitary) requirements necessary for transportation of controlled goods;
control of conditions and mode of movement (transportation);
control of compliance of packaging and marking to the established requirements of the Decision of the Commission of the Customs union of December 9, 2011 No. 881 "About adoption of the technical regulation of the Customs union "Food products regarding its marking"".
At the check point through customs border of the Customs union examination of available part of the transported controlled goods is allowed.
Sampling (samples) for laboratory researches is made according to Regulations on single procedure for conducting joint checks of objects and sampling of the goods (products) which are subject to veterinary control (supervision), No. 94 approved by the Decision of Council of the Eurasian economic commission of October 9, 2014.
By results of examination the statement of veterinary and sanitary examination in form according to appendix 1 to these rules is drawn up.
10. By results of implementation of the specified control types the official of VSK accepts one of the following decisions concerning controlled goods:
about the omission;
about movement suspension;
about import prohibition;
about return.
The decision made on controlled goods is drawn up by the official of VSK by putting down of stamps of veterinary supervision in form according to appendix 2 to these rules, on veterinary and shipping documents.
11. Import of controlled goods to customs area of the Customs union is allowed from the export companies entered in the register of the companies of the third countries according to the procedure, the provided Regulations on single procedure for conducting joint checks of objects and sampling (samples) of the goods (products) which are subject to veterinary control (supervision), the approved Decision of Council of the Eurasian economic commission of October 9, 2014 No. 94.
12. Export of controlled goods from customs area of the Customs union is performed in the presence of the export permit and the veterinary certificate issued by authorized body in the field of veterinary science according to the Rules of issue of veterinary documents and requirements to their forms approved according to subitem 46-4) of article 8 of the Law of the Republic of Kazakhstan of July 10, 2002 "About veterinary science".
13. The exporter observes requirements of the veterinary legislation of the importing country.
14. Import of the controlled goods included in the Single inventory, which are subject to veterinary control No. approved by the Decision of the Commission of the Customs union of June 18, 2010 317, on customs area of the Customs union is performed in the presence of the import permit issued by authorized body of state member of EEU on which territory the controlled goods and (or) the veterinary certificate, according to Single forms of veterinary certificates to the Republic of Belarus imported on customs area of the Customs union are imported of the Republic of Kazakhstan and the Russian Federation of controlled goods from the third countries approved by the Decision of the Commission of the Customs union of April 7, 2011 No. 607, issued by competent authority of the exporting country of controlled goods.
15. Upon completion of documentary control examination of controlled goods is carried out. Examination of the controlled goods moved through the check point is performed: not more often than one batch of the controlled goods (products) which are subject to examination from ten batches of meat or fish, and from twenty batches of other controlled goods over separately taken country, and when importing animals inspection is performed each batch. At the same time identification numbers of animals (tattoos, chips, eartabs, brands) with specified in the veterinary certificate are verified.
In case of identification of violations of veterinary health requirements in the course of implementation of examination of controlled goods examination of five transport units in a row with controlled goods of manufacturer is carried out further.
16. By results of veterinary control by the official of VSK the relevant decision according to Item 10 of these rules is made and on accompanying documents stamps of veterinary supervision in form according to appendix 2 to these rules are put down:
"Import is resolved", "Show to veterinary supervision", "Import is prohibited" or "Return of goods" then the official of VSK assures them seal and the signature with indication of the surname and initials.
In case of decision making about return of goods the declaration and the act of return of load in forms according to appendices 3 and 4 to these rules are drawn up.
17. All necessary data are entered in movement register through the check point of the export and import goods under control to the state veterinary control (further - the Magazine) in form according to appendix 5 to these rules.
18. The importer when importing to customs area of the Customs union of controlled goods observes requirements of the veterinary legislation of the Customs union.
19. Transit through customs area of the Customs union of animals and raw materials of animal origin is performed in the presence of the permission to transit issued by authorized body of state member of EEU through which check point crossing of customs border of the Customs union when importing is supposed. In permission the route is specified.
20. Veterinary control of controlled goods at check points is exercised after submission of the document confirming their quality and safety and (or) the veterinary certificate.
21. Upon completion of documentary control veterinary survey of animals is performed, at the same time:
identification numbers of animals (tattoos, chips, eartabs, brands) with numbers specified in veterinary certificates are verified;
transportation conditions, condition of animals and possibility of their further movement are checked.
Transit through customs area of the Customs union of other controlled goods is performed without examination.
Examination in case of transit of controlled goods (except for animals) is carried out only according to the decision of state bodies of border and customs control at the check point or in the presence of information on discrepancy of controlled goods to declared.
22. By results of control the official of VSK makes the decision and on shipping documents and the veterinary certificate, when importing to customs area of the Customs union, puts stamp of veterinary supervision in form according to appendix 2 to these rules: "Transit is resolved" or "Transit is prohibited", and in export Item from customs area of the Customs union - stamp "Transit is complete" then assures him seal and the signature with indication of the surname and initials.
23. All necessary data are entered in register of movement under control to the state veterinary goods control (products) through the check point in case of transit transportations in form according to appendix 6 to these rules.
24. To the official of VSK who suspended movement of controlled goods in case of rejection of the decision on its further movement (return), it is necessary to inform within 3 hours on it territorial subdivision of department of authorized body in the field of veterinary science (further - territorial subdivision) with indication of the owner of controlled goods, the destination, the exporting country, number of the veterinary certificate (or other document confirming safety of goods), type of the vehicle and its registration number, in electronic form on e-mail of territorial subdivision according to appendix 7 to these rules.
Controlled goods need to be placed in the places equipped and equipped with means of veterinary control according to Single requirements to arrangement.
The territorial subdivision reports to department of authorized body in the field of veterinary science (further - Department) about the suspended movement of controlled goods.
The decision on further movement of the suspended controlled goods is made by Department within 72 hours.
At the same time the official of VSK draws up the act of violations of Single veterinary (veterinary and sanitary) requirements (further - Single vettrebovaniye) when transporting the goods under control to the state veterinary control in form according to appendix 8 to these rules which is handed to the owner of goods (freight forwarder), and other state bodies of control.
Information on controlled goods which movement is suspended is introduced in register of detainees at the check point under control to the state veterinary goods control (products) and the decisions made on them in form according to appendix 9 to these rules.
25. The controlled goods which owner cannot support its origin by the documents certifying safety in the veterinary and sanitary relation are subject to utilization (destruction) according to the order of the Government of the Republic of Kazakhstan of February 15, 2008 No. 140 "About approval of Rules of utilization and destruction of the food products constituting danger of life and to health of the person and animals the environment" without conducting examination at the expense of the owner of such goods or return to the consignor (exporter) (further - Rules of destruction (utilization)).
26. Controlled goods which import is not resolved are subject to export. Export is made by the owner of controlled goods at own expense and with observance of the customs legislation of the Customs union.
27. In case of impossibility of export of the controlled goods inappropriate to Single vettrebovaniye, out of limits of customs area of the Customs union through the check point through which movement of controlled goods of customs area of the Customs union was performed such goods are utilized or destroyed.
28. For the purpose of protection of customs area of the Customs union from drift of causative agents of infectious diseases of animals, including general for the person and animals, and non-admission of turnover of products, dangerous in the veterinary and sanitary relation, officials of VSK at automobile check points on customs border of the Customs union, will organize work on non-admission of import in hand luggage, baggage and mailings for private use of controlled goods by physical persons from the third countries, without the permission and (or) the veterinary certificate of the country of departure of goods except for of import to 5 kilograms inclusive counting on one physical person of finished goods of animal origin in original packing, on condition of wellbeing in the epizootic relation of the country of the producer of the specified goods and the country of export.
29. Interaction of officials of bodies of state revenues at automobile check points through customs border of the Customs union and department of authorized body in the field of veterinary science is performed in the way:
1) data exchange on situation on border, at the check point, provisions of information, having mutual interest;
2) amendments among themselves the data concerning carrying out veterinary health control at automobile check points;
3) planning and holding joint actions for providing veterinary and sanitary actions;
4) allocations according to action plans on situation of necessary forces and means for holding joint veterinary and sanitary actions;
5) messages in accordance with the established procedure on the detained controlled goods not corresponding to Single vettrebovaniye;
6) creations of joint operational (workers) groups of representatives of department of authorized body in the field of veterinary science and officials of bodies of state revenues for the solution of specific objectives and rendering the practical help on places;
7) publications of joint orders, plans, instructions, manuals and management concerning procedure for exchange of information, reception-transmission of the detained controlled goods, and also on other questions of office activities.
30. Officials of VSK need to enter timely data of results on veterinary health control at automobile check points in the relevant Magazines and acts specified in appendices 1-9 to these rules.
31. Officials of bodies of state revenues monthly provide to Department the report in paper and (or) electronic form of survey of the objects under control to the state veterinary health control moved (transported) through frontier according to the order of the Minister of Agriculture of the Republic of Kazakhstan of February 25, 2014 No. 16-07/114 "About approval of forms of veterinary accounting and the reporting" (No. registered in the Register of state registration of regulatory legal acts 9342).
