About approval of Rules of subsidizing of cost of services in water supply to agricultural producers

According to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories" and the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics", I ORDER:

1. Approve the enclosed Rules of subsidizing of cost of services in water supply to agricultural producers.

2. To provide to department of water and biological resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let, and also in the Republican center of legal information for entering into reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan and the intranet portal of state bodies.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of subsidizing of cost of services in water supply to agricultural producers

Chapter 1. General provisions

1. These rules of subsidizing of cost of services in water supply to agricultural producers (further - Rules) are developed according to the subitem 41) of Item 1 of article 6 of the Law of the Republic of Kazakhstan "About state regulation of development of agro-industrial complex and the rural territories", and also according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further - the Law on the state services) and determine procedure for subsidizing of cost of services in water supply to agricultural producers (further - SHTP (uslugopoluchatel)).

2. In these rules the following basic concepts are used:

1) personal account – set of the records containing in the electronic register of the requests for subsidizing allowing to identify the registered person for the purpose of registration of offers and requests for subsidizing and accounting of transactions on them;

2) it is excluded according to the Order of the deputy. The Minister of Agriculture of the Republic of Kazakhstan of 23.12.2022 No. 438

3) No. 186 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 04.06.2024

3-1) translated request (further – the request) – the electronic request for receipt of subsidies for the irrigation water delivered by the water giver of SHTP (uslugopoluchatel);

4) services in supply of irrigation water – water supply by its fence from water source (the river, spring, irrigating system, the distributor, water apportionment), transportation and distribution on conduits (channels, pipelines) and its giving in points of apportionment of water and lemon fields SHTP;

5) the water giver – the physical person or legal entity performing water supply of SHTP and being the subject of natural monopoly on rendering services of water management systems;

6) it is excluded according to the Order of the deputy. The Minister of Agriculture of the Republic of Kazakhstan of 23.12.2022 No. 438

7) subsidizing – the financing of specific receivers of subsidy on non-paid and irrevocable basis performed at the expense of budgetary funds;

8) the state information system of subsidizing (further – GISS) – the organizational arranged set of information and communication technologies, service personnel and technical documentation intended for rendering services in accomplishment of processes of subsidizing giving opportunity of registration of the request receipt of subsidies, and also its processings by means of automatic verification of the request for compliance to subsidizing conditions;

9) the web portal of the state information system of subsidizing (further – the web portal) – the Internet resource placed on the Internet, providing access to the state information system of subsidizing;

10) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

11) the electronic register of requests for subsidizing (further – the register) – set of data on requests for subsidizing of agro-industrial complex, financial institutions, and other data reflected in the state information system of subsidizing;

12) No. 262 is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 14.07.2023

12-1) cadastral number of the irrigated field – the assigned unique code of the irrigated field intended for determination of its location (identification) with use of data of remote sensing of Earth;

12-2) water user – physical person or legal entity which according to the procedure, established by the legislation of the Republic of Kazakhstan, is granted right to use of water resources for satisfaction of own needs and (or) commercial interests;

13) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

3. The state service "Subsidizing of Cost of Services in Water Supply to Agricultural Producers" appears local executive bodies of areas, cities of Astana, Almaty and Shymkent (further – Management (service provider)).

The list of the main requirements to rendering the state service "Subsidizings of Cost of Services in Water Supply to Agricultural Producers" is stated in annex 1 to these rules.

Management (service provider) provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services.

4. Amounts of the delivered SHTP water (uslugopoluchatel) are determined in apportionment point by indications of the metering devices or measuring devices and installations of the water giver or water user entered in the register of state system for ensuring the uniformity of measurements.

5. The size of the allocated subsidies for 1 (one) cubic meter (further – the m 3) of the delivered water is established differentially, in percentage terms from the rates approved according to the Law of the Republic of Kazakhstan "About natural monopolies" (further – the Law on natural monopolies), for SHTP (uslugopoluchatel) the relevant territorial department of Committee on regulation of natural monopolies of the Ministry of national economy of the Republic of Kazakhstan according to the sizes of subsidies for 1 (one) m3 of the acquired irrigation water specified in Item 10 of these rules.

When subsidizing within these rules of SHTP (uslugopoluchatel) pay to the water giver difference between applicable fare and subsidized part of rate, and the rest is paid to the water giver in the form of subsidies. At the same time, all payment terms of subsidies register in the contract between the water giver and SHTP (uslugopoluchatel).

6. Management (service provider) till January 10 of the corresponding year, provides on approval in the Ministry of Agriculture of the Republic of Kazakhstan (further – the Ministry) amounts of budgetary funds for subsidizing of cost of services in water supply to agricultural producers, the cover letter signed by the akim of area, the city of republican value, the capital in case of its absence – signed by person fulfilling its duties. At the same time in case of reduction of amount of subsidy Management (service provider) directs to approval in the Ministry reasons for reduction of amount of subsidy.

The ministry returns the corresponding cover letter the approved amounts of subsidies no later than January 15 of the corresponding year.

7. Management (service provider) annually till February 1 places on the web portal the rates for water supply approved according to the Law on natural monopolies for SHTP (uslugopoluchatel) the relevant territorial department of Committee on regulation of natural monopolies of the Ministry of national economy of the Republic of Kazakhstan.

8. Management (service provider) within 3 (three) working days after approval of individual monthly funding plan on subsidizing of cost of services in water supply of SHTP (uslugopoluchatel) (further – the Funding plan) places it on the web portal.

8-1. In case of failure of GISS containing necessary data for issue of subsidies, Management (service provider) without delay notifies the Ministry on the arisen situation which starts its elimination.

At the same time, after work on elimination of the arisen failure the Ministry within 3 (three) working days constitutes the protocol on technical issue and places it in GISS.

Information exchange of the portal and web portal is performed according to article 43 of the Law of the Republic of Kazakhstan "About informatization".

8-2. The response, cancellation and adjustment of the electronic invoices used for receipt of subsidies is not allowed.

The electronic invoice is requested from IS ESF in the request answer mode with confirmation of the partner in IS ESF before application in GISS (the requested electronic invoice automatically is blocked in IS ESF in case of confirmation of use of the electronic invoice for receipt of subsidies).

In cases of response, cancellation and adjustment of the electronic invoices used for receipt of subsidies, the water giver returns the received subsidies in Management (service provider).

8-3. In case of application from agricultural cooperative, or SHTP (uslugopoluchatel) who is acting on the basis of the agreements on joint economic activity (further – joint activities) according to the civil legislation of the Republic of Kazakhstan, or country or the farm organized in the form of joint venture provision of subsidy, with confirmation of availability of the parcels of land of agricultural purpose on the right of land use and (or) private property registered at members of agricultural cooperative or at agreement parties of joint activities with application of a copy of the agreement on joint economic activity, or at members country or farm is allowed.

At the same time membership in agricultural cooperative proves to be true by attachment to the request of the electronic copy of the statement from the decision of general meeting of members of agricultural cooperative on admission to membership of agricultural cooperative.

Membership in country or farm proves to be true by reconciliation with data of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan.

Chapter 2. Subsidy payment procedure

Paragraph 1. Conditions of receipt of subsidy

9. Subsidies are paid in case of observance of the following conditions:

1) giving of SHTP (uslugopoluchatel) by means of the portal of the request for receipt of subsidies for services in water supply in form according to appendix 2 to these rules;

2) registration of the request in GISS.

Availability of personal account on the web portal gives the chance of SHTP (услугополучателелям) independently to perform registration of the request in GISS, in this case application is not required, and it is considered given from the moment of such registration;

3) availability of personal account in GISS at SHTP (uslugopoluchatel) and water givers which data are confirmed as a result of information exchange of GISS with the state databases "Legal Entities" or "Physical persons";

4) confirmation of purchase costs of services in supply of irrigation water as a result of information exchange of GISS and information system on acceptance and processing of electronic invoices (further – IS ESF) (availability of the corresponding electronic invoice of the water giver);

5) availability at SHTP (uslugopoluchatel) of the parcels of land of agricultural purpose on the right of land use and (or) private property of the respective area confirmed as a result of information exchange of GISS with information system of the single State Immovable Property Cadastre.

9-1. Order taking is performed in the location of the parcel of land from May 1 to November 30 (inclusive) the corresponding year.

Paragraph 2. Procedure of payments of subsidies

10. The size of subsidy for 1 (one) m3 of the acquired irrigation water in case of superficial watering constitutes:

1) for rice cultures – 50 (fifty) percent (further – %) from rate without the value added tax (further – the VAT);

2) for the long-term forage crops cultivated using system of lemon irrigation with the mechanized water rise in Atyrau, Aktyubinsk and West Kazakhstan regions – 85% of rate excluding VAT.

When watering without use of water saving technologies (drop, overhead irrigation (frontal, circular, drum), splinkerny), the size of subsidy for 1 (one) m3 of the acquired irrigation water is established differentially, in % the relation from rates (excluding VAT), irrespective of method of water supply and constitutes:

When watering using water saving technologies (drop, overhead irrigation (frontal, circular, drum), splinkerny), the size of subsidy for 1 (one) m3 of the acquired irrigation water is established differentially, in % the relation from rates (excluding VAT), irrespective of method of water supply and constitutes:

from 4, (((four whole one cell) to 9,0 (nine) tenges on m3	70%

The size of subsidy for 1 (one) m3 of the acquired irrigation water is calculated by the following formula:

S = T*na %, according to the approved sizes of rates,

where:

S – the subsidy size in tenge on m3 of the acquired irrigation water;

T – the approved rate (excluding VAT) tenge on m3.

11. The amount of subsidized irrigation water shall not exceed water use limit by pools and areas (the cities of republican value, the capital) according to article 82 of the Water code of the Republic of Kazakhstan.

Paragraph 3. Payment procedure of subsidies

12. Management (service provider) within 5 (five) working days from the date of enforcement of these rules places on Internet resource of akimat of area, city of republican value, the capital and in subsequent no later than March 1 of the corresponding year places the announcement in mass media, on Internet resource of akimat of area, city of republican value, the capital about the period of acceptance of monthly requests for receipt of subsidies for services in supply of irrigation water.

13. For provision of access to data of the register through the web portal (further – "personal account") SHTP (uslugopoluchatel) and water givers need to have the EDS for independent registration in GISS.

Management (service provider) annually sends the staticized lists of the workers having the EDS to the Ministry.

14. For registration in "personal account" of SHTP (uslugopoluchatel) and water givers are specified:

1) for the physical persons registered as individual entrepreneurs: individual identification number (further – IIN), surname, name and middle name (in case of its availability);

2) for legal entities: business and identification number (further – the BIN), full name, surname, name and middle name (in case of its availability) and IIN of the first head;

3) contact information (postal address, phone, e-mail address);

4) bank account details in bank of the second level of the water giver for receipt of subsidies.

In case of change of the above-stated data SHTP (uslugopoluchatel) or water givers within 1 (one) working day change data in "personal account".

15. Forming and registration of SHTP (uslugopoluchately) request are made in personal account to Management (service provider) in the location of SHTP (uslugopoluchatel) in the following procedure:

1) the request with introduction in it of the data necessary for check of GISS for requirements of Item 9 of these rules is created;

2) the request is registered in GISS by its signing of the EDS of SHTP (uslugopoluchatel) and becomes available in personal account of Management (service provider). The electronic notice on revenues to consideration of the request goes to the e-mail address of Management (service provider) specified on the web portal.

16. The responsible of Management (service provider) within 1 (one) working day from the moment of registration of SHTP (uslugopoluchatel) of the request on the web portal confirms its acceptance by signing with use of the EDS of the adequate notice created by the web portal. This notification becomes available in "personal account" of SHTP (uslugopoluchatel) and the water giver.

17. The responsible of Management (service provider) within 2 (two) working days from the moment of receipt of the request from SHTP (uslugopoluchatel) checks for reliability of the provided data in the request.

18. The responsible of Management (service provider) creates on the GISS web portal of the account for payment on subsidy payment, loaded into information system "Treasury Client", within 1 (one) working day after confirmation by Management (service provider) of adoption of the request according to Item 16 of these rules.

The notification on provision of subsidy in form according to appendix 3 to these rules, or motivated refusal in rendering the state service in form according to appendix 4 to these rules is result of rendering the state service.

In case of shortage of the means provided on subsidizing of cost of services in water supply according to the Funding plan for the corresponding month, the request arrives in reserve (waiting list).

Information on inclusion of the request in reserve (waiting list) is reflected in GISS. The period of finding of the request in reserve (waiting list) does not join rendering the state service in time.

According to the requests which arrived in reserve (waiting list), payment of subsidies is performed on priority according to date and time of receipt of requests next month, or in case of allocation of additional budgetary funds in the current financial year, or in the following financial year.

The result of rendering the state service by means of interaction of the portal and GISS goes to the e-mail address specified to SHTP (uslugopoluchately) and the water giver in case of registration in GISS and in "personal account" of SHTP (uslugopoluchatel) and the water giver in GISS.

18-1. The procedure of hearing is carried out according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK RK).

18-2. The ministry sends information on the made changes and (or) additions to these rules to the operator of information and communication infrastructure of "the electronic government" and to Management (service provider).

The ministry and Management (service provider) within 3 (three) working days from approval date or change of these rules staticize information on procedure for rendering the state service and send to Single contact center.

Chapter 3. Reporting under subsidizing and efficiency evaluation

19. Management (service provider) represents to the Ministry and authorized body of budget implementation the report on use of subsidies for reduction in cost of cost of services in supply of irrigation water on form according to appendix 6 to these rules, for the corresponding financial year no later than December 31.

20. Control and monitoring in the territory of the Republic of Kazakhstan concerning persons who received subsidies of cost of services in water supply is carried out within the current legislation of the Republic of Kazakhstan.

Chapter 4. Procedure for appeal of decisions, actions (failure to act) of the service provider and (or) his officials, concerning rendering the state services

21. The claim to the decision, action (failure to act) of Management (service provider) concerning rendering the state services moves addressed to the chief of the department (service provider), in authorized body by assessment and control of quality of rendering the state services.

In case of receipt of the claim according to item 4 of article 91 APPK RK, Management (service provider) sends it to the body considering the claim (higher administrative authority and (or) the official) no later than 3 (three) working days from the date of receipt. The claim Management (service provider) does not go to the body considering the claim (higher administrative authority and (or) the official) in case of the adoption of the favorable act, making of administrative action which are completely meeting the requirements specified in the claim.

22. The claim SHTP (uslugopoluchatel) according to Item 2 of article 25 of the Law on the state services is subject to consideration:

Management (service provider) – within 5 (five) working days from the date of its registration;

authorized body by assessment and control of quality of rendering the state services – within 15 (fifteen) working days from the date of its registration.

The term of consideration of the claim by Management (service provider), authorized body by assessment and control of quality of rendering the state services according to item 4 of article 25 of the Law on the state services is prolonged no more than for 10 (ten) working days in need cases:

1) carrying out additional studying or check according to the claim or checks with departure into place;

2) receipts of the additional information.

In case of prolongation of term of consideration of the claim the official given authority on consideration of claims within 3 (three) working days from the moment of prolongation of term of consideration of the claim reports in writing (in case of submission of the claim on paper) or electronic form (in case of submission of the claim in electronic form) to SHTP (uslugopoluchatel) who made the complaint about prolongation of term of consideration of the claim with indication of the prolongation reasons.

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure according to Item 5 of article 91 APPK RK.

Appendix 1

to Rules of subsidizing of cost of services in water supply to agricultural producers

List of the main requirements to rendering the state service "Subsidizing of Cost of Services in Water Supply to Agricultural Producers"

7	Working schedule of the service provider and subjects of information	1) the portal – round the clock, except for the technical breaks connected with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service are performed the next working afternoon); 2) the service provider – Monday through Friday inclusive, from 9:00 till 18:30 o'clock, with lunch break from 13:00 till 14:30 o'clock, except for days off and holidays according to the labor law of the Republic of Kazakhstan. Addresses of places of rendering the state service are placed on Internet resource of the corresponding service provider.
8	The list of the documents and data requested at uslugopoluchatel for rendering the state service	Uslugopoluchatel represents on the portal in electronic form, certified by the digital signature (further – the EDS) uslugopoluchatel, the request for receipt of subsidies for services in water supply in form according to appendix 2 to Rules of subsidizing of cost of services in water supply to the agricultural producers approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of June 30, 2015 No. 6-3/597 (it is registered in the Register of state registration of regulatory legal acts No. 12714) (further – Rules).
9	The bases for refusal in rendering the state service established by the laws of the Republic of Kazakhstan	1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them; 2) discrepancy of uslugopoluchatel and (or) provided supplied and the information necessary for rendering the state service, to the requirements established by Rules; 3) lack of consent of the uslugopoluchatel provided according to article 8 of the Law of the Republic of Kazakhstan "About personal data and their protection" on access to personal data of limited access which are required for rendering the state service.
10	Other requirements taking into account features of rendering the state service including rendered electronically	Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and single contact center. Single contact center of service desks concerning rendering the state services: 1414, 8 800 080 7777. The Ministry of Agriculture of the Republic of Kazakhstan and service providers within three working days from the date of change of Rules staticize information on procedure for rendering the state service and send to Single contact center.
