About approval of Methodical instructions about procedure for application of the Minimum social standards of social services in social stationary organizations of the Ministry of social development of the Kyrgyz Republic

For the purpose of implementation of the order of the Government of the Kyrgyz Republic "About approval of the Minimum social standards of the social services provided to persons which are in social stationary organizations of authorized body in the field of social development" of May 17, 2013 No. 273 I order:

1. Approve:

- Methodical instructions about procedure for application of the Minimum social standards of social services in social stationary organizations of the Ministry of social development of the Kyrgyz Republic (further - Methodical instructions) according to appendix 1;

- the questionnaire for carrying out quarterly monitoring of quality of work of specialists of SSU according to appendix 2.

2. To district and city managements of social development, social stationary organizations (further - SSU), to the republican center of medico-social examination to be guided by these methodical instructions.

3. To heads of district and city managements of social development quarterly to carry out monitoring of quality evaluation of work of specialists of SSU which are in the territory of the respective area according to appendix 2. To quarterly represent the research opinion about results of monitoring to Department of social security to the 5th day of the next month.

4. To department of social security quarterly to provide the generalized and analytical information by results of the carried-out monitorings in Management on development of social services to persons with limited opportunities of health and to elderly citizens to the 10th day of the next month.

5. To department of documentary providing and administrative support to bring this order to district and city managements of social development, social stationary organizations, the Republican center of medico-social examination.

6. To impose control of execution of this order on Zh. Polotova - the deputy minister.

Methodical instructions about procedure for application of the Minimum social standards of social services in social stationary organizations of the Ministry of social development of the Kyrgyz Republic

I. General provisions

1. These Methodical instructions are developed for the purpose of rendering methodical management for social stationary organizations of the Ministry of social development of the Kyrgyz Republic (further - the Ministry) by provision of the state social service in the conditions of hospital.

2. Provision of the state social service in social stationary organizations (further - SSU) the Ministries is regulated by the following regulatory legal acts of the Kyrgyz Republic:

- The law of the Kyrgyz Republic "About bases of social servicing of the population in the Kyrgyz Republic";

- The law of the Kyrgyz Republic "About elderly citizens in the Kyrgyz Republic";

- The law of the Kyrgyz Republic "About the rights and guarantees of persons with limited opportunities of health";

- the order of the Government of the Kyrgyz Republic "About approval of the state minimum social standards of content of receivers of services of social stationary organizations and the Center of rehabilitation of faces with limited opportunities of health under the Ministry of social development of the Kyrgyz Republic" of December 30, 2007 No. 640;

- the order of the Government of the Kyrgyz Republic "About payment of monthly monetary compensations instead of privileges" of December 22, 2009 No. 795;

- the order of the Government of the Kyrgyz Republic "About approval of the List of the guaranteed social services rendered to the population of the Kyrgyz Republic" of May 27, 2011 No. 255 (Section I);

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for appointment, payment and the size of temporary disability benefit, maternity allowance and Regulations on procedure for appointment, payment and the size of ritual benefit (on burial)" of November 11, 2011 No. 727;

- the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for evaluating the needs of the population for social services at the local level" of August 2, 2012 No. 535;

- the order of the Government of the Kyrgyz Republic "About approval of the Minimum social standards of the social services provided to persons which are in social stationary organizations of authorized body in the field of social development" of May 17, 2013 No. 273;

3. The minimum social standards of social services provided to persons which are in social stationary organizations of authorized body in the field of social development (further - the Minimum social standards) establish amount, conditions and procedure for provision of social services in SSU of the Ministry intended for the round-the-clock permanent or temporary residence in the conditions of hospital.

Social services in SSU of the Ministry are provided:

- to children with limited opportunities of health with psychoneurological pathologies (further - children with OVZ);

- to persons with limited opportunities of health with psychoneurological diseases (further - LOVZ with psychoneurological diseases);

- to persons with limited opportunities of health, the first and second groups having disability (further - LOVZ);

- to persons, not capable to independent servicing in connection with old age, including to married couples (further - elderly).

4. Social stationary servicing in SSU of the Ministry is performed at the expense of the public budgetary funds.

5. Coordination of process on accommodation of receivers of social services is made by Department of social security of the Ministry.

II. The organization of acceptance and content of receivers of social services in SSU

6. The direction of the citizen needing SSU is performed by district, city managements of social development (further - RUSR/GUSR) at the place of residence of the receiver of services. RUSR/GUSR will approve issue of the direction with Department of social security (further - Department).

The specialist of RUSR/GUSR will organize transfer of benefit (pension) in SSU for forming case of the receiver of social benefit.

The direction in SSU is not issued to citizens if:

- there are medical contraindications;

- do not conform to requirements of Item 2 of the Minimum social standards;

- the complete document package according to Item 10 of the Minimum social standards is not provided;

To the receiver of social services in SSU:

- the monthly social benefit in the amount of 25 percent from the granted allowance is paid;

- the monthly monetary compensation in full is paid.

In SSU also investment parts of the state pension are paid to pensioners insurance.

For example:

1. The citizen B. Asanov has disability of thirds of group. According to Item 2 of the Minimum social standards it is not receiver of social services in SSU.

2. The citizen S. Ivanov also lives in advanced age one. It can freely move and is capable to service itself(himself) independently. According to Item 2 of the Minimum social standards it is not receiver of social services in SSU.

3. The citizen Sh. Esenov has disability of the first group. The solution of MSEK correctly determines type of psychoneurological SSU of the Ministry, but in document package there is no copy of the statement from the individual program of rehabilitation of LOVZ.

RUSR/GUSR cannot issue to the citizen Sh. Esenov the direction in SSU as in document package there is no copy of the statement from the individual program of rehabilitation of LOVZ which is issued by doctors of territorial MSEK.

4. The citizen E. Petrova monthly receives social benefit.

With transition to complete state providing to SSU, the monthly social benefit in the amount of 25 percent from the granted social benefit will be paid to the citizen E. Petrova.

7. The administration of SSU will perform counter check on completeness of document package, availability of medical contraindications to accommodation at SSU and compliance to requirements of the Minimum social standards of the citizen needing SSU.

The specialist of SSU creates case of the receiver of social benefit (pension), open the personal account of the receiver of social services in bank departments.

In the presence of the statement, complete document package and the direction in SSU, the addressed citizen:

- the head of SSU issues the order on acceptance on accounting on social stationary servicing of the turned citizen;

- the duty nurse carries out primary sanitary processing of the arrived citizen;

- the doctor of SSU performs medical examination of the arrived citizen, draws up the clinical record, determines severity of the state of health, constitutes recommendations about accomplishment of medical procedures, daily watches the state of health of the arrived receiver of services within seven days from the date of receipt before purpose of systematic treatment. The doctor of SSU to certain receivers of services makes the recommendation on placement to the special room for adaptation for a period of 10 days;

- the order of the head of SSU the structure of group which bears responsibility for carrying out observation of the arrived citizen within 14 days will affirm. After observation of fourteen calendar days by responsible group will the individual plan of rehabilitation (further - the International Party of Russia) for a period of one year is developed;

- the social worker of SSU or other responsible person for maintaining documentation in SSU opens the personal record of the arrived citizen. The personal record applies personal card and the contract of the arrived citizen with administration of SSU;

- the nurse of SSU carries out medical procedures to the arrived citizen (issue of drugs on doctor's orders, assistance in movement if necessary, measurement of body temperature, arterial pressure, imposing of compresses, bandaging, processing of decubituses, statement of cleaning enemas, etc.) with the maximum accuracy and care without causing any harm, with respect for standards of behavior.

8. According to Item 15 of the Minimum social standards in psychoneurological SSU the Ministries are accepted children with OVZ, LOVZ with psychoneurological diseases.

9. According to Item 17 of the Minimum social standards in SSU of general type of the Ministry lonely elderly citizens and LOVZ are accepted.

In case of acceptance in SSU of general type from elderly citizens the certificate of MSEK of disability is not required.

10. According to Item 19 of the Minimum social standards of the person of no fixed abode (further - the BUM) go to SSU RUSR/GUSR. BOMZh-y are accepted in SSU on understaffed by document package. Specialists of RUSR/GUSR specify missing documents in the direction.

The lost documents of the BUM will be recovered by common efforts of SSU and RUSR/GUSR which issued the directions and also local government bodies according to Item 14 of the Regulations on rules of registration and removal of citizens of the Kyrgyz Republic from registration accounting at the place of residence and the place of the stay approved by the order of the Government of the Kyrgyz Republic of December 4, 2004 No. 886.

11. Conditions of accommodation at SSU shall conform to requirements of fire safety, sanitary and epidemiologic regulations, also requirements to safety of buildings.

12. Control of observance of the sanitary and epidemic mode in SSU of the Ministry is exercised by bodies of sanitary and epidemiological surveillance and the doctor of SSU. The doctor of SSU daily exercises control on compliance to sanitary and epidemiologic regulations of condition of refrigerated storage of products and medicines, medical tools and kitchen oborudovaniye. The doctor bears the personal responsibility for not observance in SSU of requirements sanitary and epidemiologic regulations.

For example, in case of visit of SSU of the Ministry by employees of body of sanitary and epidemiological surveillance violations of the storage condition of dairy products and flour products in refrigeration equipments, finding of syringes on floor, use by kitchen workers of boards for meat products instead of boards for finished products, etc. constantly come to light.

13. Food in SSU shall be various, 4-times, prepared from good-quality products, to conform to sanitary and hygienic requirements, to satisfy needs of receivers of the social services in caloric content providing balance in digestion of food. The head of SSU the current week menu and the perspective menu for the second week depending on season (spring-summer, fall-winter) affirms.

14. IN SSU:

- receivers of social services shall be provided with premises at the rate of 6 sq.m on one adult, 4,8 of sq.m on one child;

- the rules on absorptivity of air are respected.

For example, establishment in premises without regulation of 2-level beds will be negatively reflected on condition of absorptivity of air. In case of establishment in premises of 2-level beds it will be necessary to install the ventilating equipment;

- persons requiring foreign leaving shall live separately from LOVZ and elderly, capable to self-service.

In SSU receivers of social services are provided:

- furniture, leaving objects, kitchen, bath-and-laundry and other processing equipment, equipments and devices of medical appointment, to the relevant requirements of standards and specifications ensuring safety and proper quality of the provided services;

- clothes, footwear and underwear according to the size and growth. The issued clothes shall be convenient for carrying. Bedding (mattress wadded, blanket, pillow, sheet, pillowcase, blanket cover, cover, towels) shall be convenient in use.

15. The head of SSU by the principle of territoriality shall provide in the location of SSU of addition of receivers of services, constitute the contract with the Center of family medicine (further - TsSM) in the location, with provision of the complete list of receivers of services for carrying out fluorographic inspection and medical attendance according to the Program of the state guarantees for providing citizens of the Kyrgyz Republic with the medical and sanitary help.

Once a year in SSU profound medical examination of receivers of social services with laboratory researches with involvement of doctors of narrow specialties is performed.

16. The head of SSU annually creates the budget of SSU and approves by the Ministry. When forming the budget it is necessary to consider real requirements of SSU on financial resources.

For example, furniture in SSU are very worn-out. If, when forming the budget of SSU such requirement is not considered, then respectively it will not be considered during the forming and approval of the budget of the Ministry.

17. By the doctor of SSU it is performed:

- daily observation of the state of health of the arrived receiver of services within seven days from the date of receipt before purpose of systematic treatment;

- daily record in the history of disease, purpose of the further plan of treatment and complex of rehabilitation actions, in case of deterioration in somatic condition or aggravation of mental disturbance of the receiver of services;

- weekly performing medical examination of the receiver of social services who is in bed rest, purpose of the further plan of treatment and complex of rehabilitation actions;

- filling of messenger leaf in MSEK for establishment of group of disability of the receiver of social services.

18. Specialists of SSU:

- the International Party of Russia on each receiver of services, after observation of it within fourteen calendar days from the date of receipt in SSU, for a period of one year is developed.

- individual medical and improving and other rehabilitation actions (morning exercises, physiotherapy exercises, massage, water, fizio-and phytoprocedures, improving walking, …) according to recommendations of the doctor in the special equipped rooms will be organized (rooms shall be net, dry, well aired);

- information on realization of the International Party of Russia in DSO of the Ministry at the end of the accounting year is provided.

19. In SSU survey of MSEK (with participation of psychiatrists) receivers of services SSU of psychoneurological profile for the purpose of the solution of question of their further content is annually carried out to SSU with registration of record in the history of disease.

20. According to the recommendation of the doctor receivers of services, violent and aggressive with mental disturbances, can accommodate to the special room for adaptation for a period of 10 days. During this time by medical personnel it is observed behavior, conversation, the state of health, also their frequency at epileptics is recorded attacks.

21. In SSU leisure of receivers of services (clubs on interests, kruzhkovy work) according to the work plan SSU in interaction with cultural institutions, amateur, professional on-stage performance groups, etc. will be organized.

For persons which are in bed rest, ensuring leisure is carried out directly in living rooms (reading books, magazines, viewing of movies, telecasts, holding lectures, conversations, festive actions), etc.

22. Holding actions for recovery of the lost or broken capabilities of the receiver of services to household self-service or registration of the receiver of social services on established posts of SSU is performed according to the International Party of Russia and medical indications. On permission of the doctor receivers of social services will be attracted in work therapy process. Time of involvement of receivers of services in work therapy shall not exceed 4 hours a day.

For example, the individual program of rehabilitation (IPR) shall provide establishment of the new relation to LOVZ. The new relation shall not limit the rights of the receiver of services and to isolate it from society, on the contrary, it shall provide usefulness of the receiver of social services to society.

Usefulness of the receiver of services in SSU is provided with its attraction to work therapy on permission of the doctor for the term of no more than 4 hours in production workshops, circles of different profile and subsidiary farms of SSU for employment.

Employment of receivers of services in SSU is provided according to the schedule which weekly is developed and affirms administration. Forced labor of receivers of services in SSU is forbidden.

23. In SSU the efficiency evaluation of the carried-out medical and improving procedures by the doctor of SSU with registration of record in the history of disease of the receiver of services, purpose of the further plan of treatment and complex of rehabilitation actions is quarterly performed if somatic and mental condition of the receiver of social services rather stable.

24. In SSU the commission on property which consists of social employees and members of Public council in case of SSU is effective. To the receivers of services who are not learning money in the presence of the member or members of the commission it is issued (acts) money from cash desk (ATM), it is bought necessary products, the statement of expense is drawn up or the log entry about expense is made.

Administration of psychoneurological SSU receive the judgment about recognition of the receiver of services by incapacitated or it is limited capable, within one year.

25. For the purpose of realization of the rights of receivers of the social services suffering from mental disturbances when rendering mental health services in SSU to them, the receiver of services is informed on purpose of rate of psychiatric treatment with the subsequent reflection in the history of disease of consent or refusal of it.

26. The social worker of SSU performs the social and pedagogical services directed to rendering the qualified help to receivers of services in the correct understanding and the solution of the social and pedagogical problems facing them.

In SSU training will be organized according to the special training programs approved by the Ministry of Education and Science of the Kyrgyz Republic. Children with OVZ and LOVZ are distributed on groups, taking into account their age features and social skills.

In SSU individual occupations for recovery of the lost household skills at elderly, forming of feasible labor skills at adults with OVZ are organized.

27. The administration of SSU will organize to receivers of services consultation according to social legal issues (the civil, housing, family, labor, pension, penal legislation and on other industries), gives necessary assistance in preparation and the direction to the corresponding addressees of documents of the receiver of services, in registration and receipt of monetary compensations, pensions, benefits and other social payments by the receiver of services.

28. Preserving personal belongings and values of receivers of social services (the sums of money, jewelry and securities which are not placed in bank department) is provided in accordance with the established procedure.

29. In case of the death of the receiver of services the administration of SSU will organize the notification of the local police inspector, provides the special (certain) room for the died receivers of services, solves problems with the organization of ritual ceremonies taking into account religious affiliation concerning the died receiver of services, in case of absence or refusal of close relatives of the organization of burial.

The administration of SSU issues the order on removal of the died receiver of services from SSU allowance based on the medical certificate about death and death certificates.

If the citizen living in SSU was receiver of pension (the retirement pensioner, on disability, on the occasion of loss of the supporter), the benefit for burial is paid by authorized state body of pension social insurance to relatives or the applicant who actually performed funeral in the place of residence of the dead at the expense of means of Social fund.

If funeral of the pensioner was performed by SSU, the benefit for burial is paid compensated) to social organization by authorized state body of pension social insurance from means of Social fund.

On submission of the relevant documents (the written address with appendix of the certificate of death or the copy of the death certificate, act of the work of funeral) the authorized state body of pension social insurance makes transfer of the amount of benefit for burial of bank to the settlement account SSU.

If the citizen living in SSU was receiver of social benefit, the benefit for burial is paid by management of social development to relatives or the applicant who actually performed funeral in the place of residence of the dead from means of the republican or local budget.

If funeral of the receiver of social benefit was performed by SSU financed from the republican budget, then expense source on the organization of funeral are the means provided in expense budget of the budget of organization.

Funeral of the citizens living in SSU which did not have pension entitlement or to social benefit (if the died citizen was not taken away by relatives), is performed by social organization. Costs for these purposes shall be provided in the budget (expense budget) of SSU from means of the republican budget.

III. The organization of the statement, temporary disposal, transfer and expel of receivers of social services from SSU

30. The statement, temporary disposal, transfer and expel of receivers of social services from SSU is performed according to the procedure and the cases provided by Section 7 of the Minimum social standards.

The statement of receivers of social services from SSU is performed in the following cases:

- according to the written application of receivers of services. For receivers of services, minor and incapacitated, according to the written application of their legal representative (one of parents, the guardian, the custodian);

- to the receiver of services on the next re-examination disability is not established;

- to the receiver of services the III group of disability is established;

- on reaching age of majority of children with OVZ;

- termination or expiration of the agreement on temporary stay in SSU.

Temporary disposal (for up to three months) receivers of services in personal motives is allowed taking into account the conclusion of the doctor of SSU based on the written notice of the ward (close relative) and the commitment letter of the relatives or other persons accepting it of ensuring care of the ward with person. Temporary disposal is drawn up by the order.

31. For the period of absence of the receiver of services in SSU the order of the head of SSU on its removal from SSU allowance is issued.

32. The decision on the direction of receivers of services for up to one year for further rehabilitation in other organization is made by administration of SSU taking into account the conclusion of the cross-disciplinary commission of SSU and in the presence of the commitment letter of the host party on content of receivers of services and ensuring necessary care of them.

Children about OVZ which reached eighteen-year age according to the conclusions of the medical organization and MSEK are transferred to SSU of general type, psychoneurological SSU, or written out home.

33. Transfer of the receiver of social services from the SSU located in one region, in SSU, located in other region is performed in the RUSR/GUSR direction.

Transfer of receivers of services from SSU of the Ministry in similar medical institution of the Ministry of Health of the Kyrgyz Republic for receipt of profound treatment, is performed based on the conclusion of territorial medical medical institution.

Personal belongings are transferred to the disposed receiver of social services. Administration of the accepting SSU the personal record and the medical record of the receiver of social services by the accompanying responsible person of the directed organization are submitted.

Transfer of the receiver of social services from the relevant organization of other state body in SSU of the Ministry is made in the RUSR/GUSR direction in the location of the directed organization. The personal record and the medical record of the receiver of social services are transferred by the accompanying responsible person of the directed organization.

34. In case of achievement of sixteen years by the child the administration of SSU provides the identity certificate (passport).

35. Receivers of services from SSU of general type in the following cases are subject to assignment:

- in case of systematic (more than three times) abuse of regulations of internal rules and procedures, including for bringing and the use of narcotic substances, alcoholic drinks, for spoil of inventory items and other property, to making of illegal actions;

- in case of unauthorized absence in SSU more than two days.

The receivers of social services deducted from SSU can be back accepted in SSU according to the procedure provided by Chapter 3 of the Minimum social standards, but not earlier than in three months after their assignment.

36. The statement, temporary disposal and expel of the receiver of social services, its transfer in other SSU are performed based on the order of the head of SSU. The order provides execution of vypisny or translated documents, appendix of the recommendation of specialists of SSU. Vypisny or translated documents are transferred to hands of the decreasing receiver of social services, or the party accepting him.

In case of the statement, temporary disposal or transfer in other SSU of the receiver of social services (if necessary to the accompanying official or the employee of local public administration) are issued the personal and fixed clothes, footwear on season and its things (documents) which are stored in SSU and also the reference with indication of time of stay in SSU and the reasons of the statement.

37. In case of escape of the receiver of services the administration of SSU without delay notifies the local police inspector, territorial RUSR/GUSR and Department. Search is performed jointly with specialists of department of social servicing of Department.

38. The personal record with copies of documents of the disposed receiver of services is submitted to SSU archive.

IV. The organization of activities of subsidiary farm in SSU

39. SSU can create subsidiary farm based on the existing subsidiary farm or form new subsidiary farm according to Regulations on subsidiary farm of the Ministry of the social development approved by the order of the Ministry No. 40 of 24.04.2014.

The subsidiary farm is created for the purpose of rehabilitation of LOVZ, integration of LOVZ into society, adaptation to life to society, family, to training and work.

Financing of activities of subsidiary farm is performed at the expense of means of the special account of organization.

Receipt of agricultural products is performed according to the Provision on the organization of the financial accounting in budgetary institutions approved by the order of the Government of the Kyrgyz Republic of May 16, 2011 No. 224 and with participation of members of Public council in case of SSU.

The questionnaire for carrying out quarterly monitoring of quality of work of specialists of SSU

1. Direction availability in SSU.
