Agreements between the Government of the Russian Federation and the Government of the Republic of Kazakhstan on cooperative principles and conditions of relations in the field of transport of March 23, 1992,

Agreements on further deepening of economic cooperation and integration of the Russian Federation and the Republic of Kazakhstan of March 28, 1994,

Agreements on custom union of January 20, 1995,

for the purpose of ensuring stable work of the railroads of the Russian Federation and the Republic of Kazakhstan signed this agreement as follows:

Article 1

The parties recognize the property of rail transport which is part of the railroads of the state of one Party, but located in the territory of the state of other Party, property of the state of the first Party. The list of sites of the railroads concerning which property the property right of the Republic of Kazakhstan and the Russian Federation is recognized is given in appendix 1, being integral part of this agreement.

The specified property of rail transport is recognized the Parties equivalent. At the same time assessment of market value of the specified property is not carried out and compensations in connection with transition of the property right are not made.

The parties guarantee that the specified property of rail transport is free from any third party rights.
