About approval of Regulations on procedure for maintaining separate state inventories

According to the Law of the Republic of Uzbekistan "About the state inventories" and the Regulations on procedure for creation and maintaining the Single system of the state inventories approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of February 16, 2005 the No. 66 Cabinet of Ministers decides:

1. Approve:

 The provision "About Procedure for Maintaining the State Inventory of Highways" according to appendix No. 1;

The provision "About Procedure for Maintaining the State Inventory of the Railroads" according to appendix No. 2;

 The provision "About Procedure for Maintaining the State Inventory of Transport Pipelines" according to appendix No. 3;

 The provision "About Procedure for Maintaining the State Inventory of Objects of Communication" according to appendix No. 4;

 The provision "About Procedure for Maintaining the State Inventory of Energy Objects" according to appendix No. 5;

 The provision "About Procedure for Maintaining the State Inventory of Zones of the Increased Natural Danger" according to appendix No. 6;

The provision "About Procedure for Maintaining the State Inventory of Zones of the Increased Technogenic Danger" according to appendix No. 7.

2. To report on Goskomzemgeodezkadastr together with the relevant authorized bodies in the Cabinet of Ministers of the Republic of Uzbekistan on forming and the course of maintaining the state inventories according to the Provisions approved by this resolution in July, 2006 and 2007.

3. To impose control over the implementation of this resolution on the corresponding deputy prime ministers of the Republic of Uzbekistan.

Regulations on procedure for maintaining the state inventory of highways

I. General provisions

1. The State Inventory of Highways (SIH) is kept according to the laws of the Republic of Uzbekistan "About the state inventories", "About highways", the Regulations on procedure for creation and maintaining the Single System of the State Inventories (SSSI) approved by the resolution of the Cabinet of Ministers of the Republic of Uzbekistan of February 16, 2005 No. 66, other regulatory legal acts and this Provision.

2. GKAD is system of the updated reliable information about objects of highways, their geographical location, legal status, quantity and quality characteristics and economic evaluation.

3. GKAD is component of ESGK and is conducted for the purpose of accounting and assessment of condition of objects of highways.

4. Objects of GKAD are functioning also highways the under construction, special constructions and other objects of highways located in the territory of the Republic of Uzbekistan.

5. Authorized body on maintaining GKAD is the State committee of the Republic of Uzbekistan on highways.

6. GKAD is intended for providing the state governing bodies, the State committee of the Republic of Uzbekistan on highways interested legal entities and physical persons in the reliable cadastral information on objects of highways.

7. The basic principles of maintaining GKAD are:

completeness of scope of objects of highways of the Republic of Uzbekistan;

application of single system of space coordinates and unified topographical basis;

unity of methodology of forming of the cadastral information on all objects;

reliability, visualization and documentation of the cadastral information;

availability of the cadastral information.

8. Maintaining GKAD is provided with carrying out inventory count, accounting, assessment of objects of highways and provides compulsory use of the cadastral information of the state land cadastre and state inventory of buildings and constructions.

9. State registration of the rights to the parcels of land, buildings and constructions relating to objects of highways is performed by authorized bodies according to the procedure, established for registration of the rights to real estate.

10. The land cadastral information on the parcels of land relating to objects of highways, transferred from the state land cadastre to GKAD shall contain data on structure of lands on purpose, state registration of the rights to the parcels of land (including data on the available restrictions and encumbrances in use of lands, the established servitudes), quantity and quality of lands.

11. The cadastral information on the buildings and constructions relating to objects of highways, transferred from the state inventory of buildings and constructions to GKAD shall contain data on their purpose, state registration of the rights, the main quantity and quality characteristics.

12. Maintaining GKAD is performed on paper and/or electronic media.

13. The systematized cadastral information on objects of highways is transferred to ESGK in accordance with the established procedure.

14. Financing of works on creation and maintaining GKAD is performed at the expense of means of Republican road fund under the Ministry of Finance of the Republic of Uzbekistan.

II. Organization of maintaining GKAD

15. Maintaining GKAD is performed by the following structural divisions of the State committee of the Republic of Uzbekistan on highways:

authorized organization State committee of the Republic of Uzbekistan on highways;

cadastral division of territorial head departments on highways of the Republic of Karakalpakstan and areas (TGUAD).

The common directorship of works on maintaining GKAD is performed by the chairman of the State committee of the Republic of Uzbekistan on highways.

Methodical ensuring maintaining GKAD is performed by the State committee of the Republic of Uzbekistan on highways.

16. Maintaining GKAD is performed according to the scheme according to appendix to this Provision.

17. Authorized organization State committee of the Republic of Uzbekistan on highways:

provides implementation and functioning of the automated information system of the state inventory of highways (AIS GKAD);

develops structure of databases, performs its transfer to the road companies, controls behind correctness of filling of databases;

will organize training of cadastral personnel of TDDSO in work with AIS GKAD;

performs systematization of the cadastral information provided to TGUAD and its entering into AIS GKAD;

exercises control of collection of accounting and estimative information on new objects of highways;

performs operational transfer of the cadastral information in ESGK;

annually in accordance with the established procedure submits in ESGK the status report and use of objects of highways of the State committee of the Republic of Uzbekistan on highways.

18. TGUAD of the State committee of the Republic of Uzbekistan on highways:

perform collection and systematization of the current changes in quantitative and high-quality condition of objects of highways, their environmental impact, ekologo-economic evaluation;

keep cadastral books of objects of highways, fill in databases and transfer them to cadastral department of authorized organization of the State committee of the Republic of Uzbekistan of highways for systematization and introduction in AIS GKAD;

performs registration of new objects of highways, perform collection of accounting and estimative information on them;

19. The owners/users of objects of highways functioning out of system of the State committee of the Republic of Uzbekistan on highways shall provide in authorized organization SAC of Uzavtoyul information on geographical location, legal status, quantity characteristics and assessment of cadastral objects, and also the current changes in their condition.

III. Procedure for maintaining GKAD

20. Maintaining GKAD consists in the inventory of all types of objects of highways, accounting of their quantity and quality characteristics, ekologo-economic evaluation of objects, and also collection, the analysis, processing, systematization, storage, updating and provision of the cadastral information to the interested users in the procedure established by the legislation.

21. The inventory of objects of highways is basis for accounting of their quantity and quality characteristics, ekologo-economic evaluation.

22. All types of objects of highways are subject to primary inventory. At the same time the main indicators which structure is determined by the relevant regulating documents approved by the State committee of the Republic of Uzbekistan on highways in coordination with Goskomzemgeodezkadastr are fixed. By results of the inventory the passport of each object is constituted.

23. The main accounting of quantity and quality characteristics is performed on each object of highways which by the time of registration is put in operation and functions.

The further changes happening in characteristics of objects of highways are fixed in case of the current accounting.

24. Accounting of quantity and quality characteristics of objects of highways includes their classification by economic, technological and ecological signs which structure is determined normative to documents by maintaining GKAD.

Technical parameters and formats of provision of the cadastral information are developed for accounting of quantity and quality characteristics of objects of highways by the State committee of the Republic of Uzbekistan on highways in coordination with Goskomzemgeodezkadastr.

Accounting information is included in the cadastral book of the company and entered into AIS GKAD.

25. The economic evaluation of objects of highways is made for cost determination of each object of highways, for the taxation, privatization and other purposes.
