About approval of the Regulations on the town-planning certificate and permission of construction or liquidation of structures and arrangements

According to the Law of the Republic of Moldova N 835-XIII of May 17, 1996 "About fundamentals of town planning and arrangement of the territory" and for the purpose of establishment in town-planning activities of single system of placement, designing, construction and functioning of buildings and constructions and arrangements of all territory of the country the Government of the Republic of Moldova DECIDES:

1. Approve Regulations on the town-planning certificate and permission of construction or liquidation of structures and arrangements it (is applied).

2. Oblige bodies of local public authority, the legal entities and physical persons involved in town-planning activities in the territory of the Republic of Moldova, to observe the specified provision.

3. For the purpose of application of the Regulations on the town-planning certificate and permission of construction or liquidation of structures to recommend to District councils and primeriya of municipiums and the cities to form in structures of local architectural authorities and in primeriya of rural settlements the departments responsible for activities in the field of town planning and arrangement of the territory.

4. To the Ministry of Education, Youth Affairs and Sports together with the Ministry of ecology, construction and development of the territories to review programs of training of specialists in the field of town planning and arrangement of the territory at Technical university and industrial and construction college for the purpose of introduction of the additional training program of activities in the field of town planning and arrangement of the territory as a part of bodies of local public authority.

5. To the ministry of ecology, construction and development of the territories:

a) organize seminars for specialists of design institutes, primar, secretaries and the chief architects of bodies of local public authority for the purpose of their acquaintance with the Regulations on the town-planning certificate and permission of construction or liquidation of structures and arrangements;

b) exercise control of application of the Regulations on the town-planning certificate and permission of construction or liquidation of structures and arrangements.

6. For the purpose of the solution of questions of placement of objects and arrangements in the territories and in settlements to recommend to district councils, the Gagauzia ATO Executive committee and Chisinau local government board to form in the department the local town-planning councils capable to perform professional technical supply of the physical persons and legal entities participating in activities for arrangement of the territory and town planning.

7. To the ministry of ecology, construction and development of the territories:

make changes and additions to Standard regulations on local town-planning council and to Regulations on Republican town-planning council, connected with the corresponding obligations and responsibility on technical supply of the customers participating in activities for arrangement of the territory and town planning in the country;

exercise control of creation and activities of local town-planning councils, having included licensed specialists of necessary profile in their structure;

organize seminars, consultations for specialists - members of local town-planning councils concerning provision of technical support to customers.

8. To prefectures of counties to control observance of the current legislation and this provision with the made changes and additions in implementation process of master town-planning plans of settlements, plans of arrangement of the territory and implementation of town-planning activities of the country by physical persons and legal entities.

9. Declare invalid Item 5 of the Order of the Government of the Republic of Moldova N 579 of October 17, 1991. "About the organization of single system of the state supervision of quality of construction in the Republic of Moldova".

1.
