About approval of the Standard regulations on the organization and functioning of Social service "Orphanage of family type" and Minimum quality standards

For the purpose of implementation of article 10 of the Law on the public assistance No. 547-XV of December 25, 2003 (The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 249), with subsequent changes and amendments, DECIDES: the Government

1. Approve:

1) Standard regulations on the organization and functioning of Social service "Orphanage of family type" according to appendix No. 1;

2) the Minimum quality standards for Social service "Orphanage of family type" according to appendix No. 2.

2. The expenses connected with the organization and functioning of Social service "Orphanage of family type" will become covered by service providers and to be performed within the assignments provided annually in the state budget / the local authority budget Chisinau / the central budget of autonomous territorial education Gagauzia and also at the expense of the means arriving from donations, grants and other sources according to the legislation.

3. Provision of daily benefit for the child will be performed since 2018.

4. Declare invalid:

1) the Order of the Government No. 937 of July 12, 2002. "About approval of the Regulations on orphanage of family type" (The official monitor of the Republic of Moldova, 2002, Art. No. 106-109, 1055) with subsequent changes;

2) the Order of the Government No. 812 of July 2, 2003. "About approval of Standards of the minimum quality for orphanages of family type" (The official monitor of the Republic of Moldova, 2003, Art. No. 149-152, 863).

5. To impose control over the implementation of this resolution on the Ministry of Labour and Social Protection.

Standard regulations on the organization and functioning of Social service "Orphanage of family type"

Chapter I. General provisions

1. The standard regulations on the organization and functioning of Social service "Orphanage of family type" (further - the Standard provision) establish procedure for the organization and functioning of orphanage of family type.

2. The orphanage of family type is the social service giving to children alternative family care in the parent tutor's family (further - Service).

3. Service provider of Social service "Orphanage of family type" is the territorial agency of the social help / responsible structures of social security and protection of the rights of the child of municipium of Chisinau / autonomous territorial education Gagauzia or the private supplier accredited for provision of this service according to the legislation.

4. The service is provided based on this Standard provision and the Minimum quality standards for Social service "Orphanage of family type".

5. The basic concepts used in this Standard provision have the following values:

1) the parent tutor - person providing in the house child care and its education for certain term;

2) the parent tutor's family - persons living in economy of the parent tutor, except for child(children), placed in orphanage of family type;

3) the Commission on protection of the child who is in difficult situation (further - the Commission) - body, authorized to issue the conclusion about approval of measures of family support for the purpose of overcoming situations of risk and the prevention of separation of the child with family, and also measures for protection of the child separated from parents;

4) urgent placement - placement in family of the parent tutor of the child, life or health of which are exposed to inevitable threat, irrespective of environment in which he is, for a period of up to 72 hours. Term can be prolonged at 72 o'clock, but shall not exceed 45 days;

5) the planned placement - planned accommodation of the child in the parent tutor's family for a certain period of time according to provisions of the individual plan of the help;

6) establishment of compliance of the parent tutor to needs of the child for development - process of determination of compliance of the parent tutor to the child offered for placement in orphanage of family type;

7) daily child allowance - the determined sum of money which is daily allocated to the child in the personal order;

8) local body of guardianship - primara of villages (communes) and cities;

9) territorial authority of guardianship - territorial agency of the public assistance (in case of means of territorial structures of the public assistance) / Head department on protection of the rights of the child of municipium of Chisinau / Head department of health care and social protection of autonomous territorial education Gagauzia. In municipiums of Chisinau and Belts territorial authorities of guardianship perform also powers of local body of guardianship, except for the autonomous administrative and territorial units which are part of these municipiums in which powers of local body of guardianship perform primara of the corresponding administrative and territorial units;

10) the individualized plan of services - the plan constituted in writing on the basis of the model approved by the order of the Minister of Labour and Social Protection which includes set of special interventions concerning the child on the basis of assessment of his requirements in connection with his health, the needs for leaving, physical, emotional, educational requirements, carrying out free time, socialization etc., developed and implemented during accommodation of the child in Service.

6. Beneficiaries of services of Service are:

1) the children who are in risk situation, and the children separated from parents, according to provisions of article 8 of the Law No. 140/2013 on special protection of children, being in risk situations, and the children separated from parents;

2) children with limited opportunities, parents or persons on whose care there are children needing time for recovery;

3) the minor parent with the child in situation of risk of separation (further - the minor parent);

4) the pregnant minor if corresponds to the situations specified in the subitem 1) (further - the pregnant minor);

5) child of the minor parent.

6-1. Services in placement without the conclusion of the Commission and the order of territorial authority of guardianship about establishment of the status of the child, temporarily without parental support or without parental support, or about the urgent or planned its placement are provided to the child of the minor parent.

6-2. In case of the child of the minor parent, together with accommodation of the minor parent with the child or after the birth of the child of the minor parent who is in placement or in case of accommodation of the child of the minor parent after accommodation of the parent, the territorial authority of guardianship publishes the separate order about accommodation of the child together with the minor parent.
