I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 187 "About approval of Rules of certification and issue of the certificate of the validity of airfield (helidrome)" (it is registered in the Register of state registration of regulatory legal acts at No. 12052) the following changes:

state preamble in the following edition:

"According to subitem 41-38) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" I ORDER:";

The rules of certification and issue of the certificate of the validity of airfield (helidrome) approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of certification and issue of the certificate of the validity of airfield (helidrome)

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of the validity of airfield (helidrome) (further - Rules) are developed according to subitem 41-38) of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services", determine procedure for certification and issue of certificates of the validity of airfields (helidromes) of civil aviation of the Republic of Kazakhstan.

Rules provide effective observance of certified requirements by operators of the certified airfields (helidromes) and creates basis for realization by authorized organization in the field of civil aviation of functions of regulation in the field of safety of flights in the certified airfields (helidromes). The certification process provided in these rules establishes starting base for constant surveillance over safety of flights by operators of the certified airfields and observance of certified requirements by them.

Information on condition of certification of airfields (helidrome) is provided by authorized organization in the field of civil aviation in service of aeronautical information for publication in the collection of aeronautical information according to requirements of the Rules of providing with aeronautical information in civil aviation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of June 30, 2017 No. 420 (it is registered in the Register of state registration of regulatory legal acts for No. 15427).

2. Certifications are subject airfields (helidromes) used by civil aviation and also airfields of joint use and basing in which the flights established in Item 2 of article 66 of the Law are carried out. For the purposes of certification the flights specified in subitems 2), 3), 4), 5) of Item 2 of article 66 of the Law belong to commercial air transportation.

Certification of airfields (helidromes) on the request of the operator of airfield (helidrome) on which the types of flights established in Item 2 of article 66 of the Law are not carried out is allowed.

3. In Rules the following basic concepts are used:

1) authorized organization in the field of civil aviation (further – authorized organization) – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety (further - authorized organization);

2) the certificate of the validity of airfield (helidrome) - the document issued by authorized organization in the field of civil aviation, certifying compliance of airfield (helidrome) to certified requirements (further - the certificate);

3) the operator of airfield (helidrome) - physical person or legal entity of the Republic of Kazakhstan, and also other state according to the international treaties ratified by the Republic of Kazakhstan which uses airfield (helidrome);

4) helidrome at the level of surface – the helidrome located on the land surface or on construction on the Earth's surface;

5) the helidrome raised over surface – the helidrome located on the raised design;

6) vertopaluba – the helidrome located on motionless or floating object in the high sea, for example on the prospecting and/or operational installation used for oil or gas production;

7) the critical airplane - type of the airplane which characteristics impose the most strict requirements to the corresponding elements of physical infrastructure, means and servicing which this airfield is intended to provide;

8) the request - the written appeal of the applicant to authorized organization for passing of the procedure of certified inspection;

9) the applicant - the physical person or legal entity which addressed to authorized organization for receipt of the certificate;

10) the certified airfield (helidrome) – airfield (helidrome) to which operator the certificate of the validity of airfield (helidrome) is issued.

11) certified inspection - the check of airfield, its structural divisions, the equipment, operational procedures, engineering procedures performed by authorized organization for content and operation of airfield, documentation of organizational structure, and also competence of specialists of the applicant on compliance to certified requirements;

12) safety management system of flights (further - SUBP) - system approach to safety management of flights, including organizational structure, hierarchy of responsibility, obligation, the guidelines and procedures

4. The purpose of certification of the validity of airfield (helidromes) is safety of flights of aircrafts on the earth and in air, and also safety of airfield (helidrome) for life and human health, protection of property of citizens and the environment.

The operator of the certified airfield provides compliance to the certified requirements imposed to the operator of airfield.

In case of certified inspection the Operator shows capability and means, and also financial and economic provision and legal capacity, for observance of requirements on:

1) to providing the physical and technical characteristics established to objects of airfields of civil aviation;

2) to procedures of operation, including:

submission of airfield data;

inspection of working area of airfield;

maintenance of working area of airfield;

protection against snow and ice accretion and other dangerous weather conditions in airfield;

control of obstacles;

procedures in the conditions of limited visibility;

electrolighting ensuring flights;

management of the dangers created by birds and wild animals for flights of civil aircrafts;

planning of actions on case of emergency environment in airfield;

rescue ensuring flights;

removal of the airplane which lost capability to move;

operation of vehicles in airfield;

the organization of activities on the platform;

safety management of activities on the platform;

to safety management of flights;

to ensuring servicing of passengers;

access to the controlled area and providing requirements of aviation safety.

5. Certified requirements provide availability at the Operator:

1) the responsible (first) head having powers on allocation of the financial resources necessary for ensuring activities in airfield according to the requirements established by the legislation. The responsible head provides the organization and maintenance of effective management system with activities in airfield;

2) the head(s) responsible for management and control of productive activity in airfield and maintenance and repair of objects of airfield, special equipment, means and the equipment (further – technical directors);

3) inspector (manager) on safety of flights responsible for development, maintenance and daily administration by safety management system of flights. The inspector (manager) on safety of flights is independent of any heads of the organization and has direct access to the responsible head and other heads of the organization for safety issues of flights, directly submits to the responsible head;

4) chiefs of services, divisions, changes which quantity is commensurable with amount of activities, tasks and obligations taking into account organizational structure and number of personnel;

5) organizational structure, the staff list confirming sufficiency of specialists for implementation of activities according to the requirements established by the legislation;

6) proper competence at the personnel performing operational activities, maintenance of objects of airfield, means and the equipment, management of activities in airfield according to appendix 9 to these rules which preparation corresponds to standard programs of professional training of the aviation personnel participating in safety of the flights approved by the order of the Minister of Transport and Communications of the Republic of Kazakhstan of September 28, 2013 No. 764 (it is registered in the Register of state registration of regulatory legal acts for No. 8785);

7) management on ensuring professional training of personnel of the operator of airfield;

8) the approved job descriptions determining obligations and responsibility of administrative board and specialists;

9) the approved master plan, on at least, than 5 years, the development of infrastructure of the airport and land use containing detailed stages and the list of priority tasks, including the plan of realization. The master plan is developed by the operator of airfield on the basis of information on economic feasibility, forecasts of transportations, the current and future requirements imposed, in particular, by operators of aircrafts and also periodically reviewed taking into account amount of air traffic in airfield (for the airfields servicing the international airborne transportations);

10) the operator of airfield of the Management approved as the first head on airfield which is approved with authorized organization. The management on airfield is developed according to provisions of these rules, DOC 9774 AN\969 "Management on Certification of Airfields" IKAO, DOC 9981 "Rules of aeronautical servicing. Airfields" ICAO.

11) safety management systems of flights and the approved Control directive safety of flights, including the description of system of documentation on safety of flights, approved with authorized organization;

12) quality management systems of aeronautical data and the aeronautical information relating to airfield activities;

13) agreements with contract organizations if part of the activities of the operator of airfield entering scope of the certificate of the validity of airfield is performed by contract organizations (maintenance and repair of objects, the equipment and special equipment of airfield, collection of aeronautical data, personnel training, rescue ensuring flights, designing of objects of airfield);

14) internal control systems of observance of certified requirements, requirements of the rules and procedures established in airfield as the operator of airfield, so the third and contract organizations performing activities in airfield;

15) instructions for interaction (coordination) with services of the organizations of civil aviation, in cases stipulated by the legislation the Republic of Kazakhstan;

16) the approved emergency plan for the organization and carrying out wrecking;

17) airport committee, the working group on safety of flights, the working group on safety of transactions on the runways formed according to regulatory legal acts in the field of civil aviation;

18) the necessary number of technical means, the equipment, special equipment, buildings and rooms, individual protection equipment for activities implementation which condition meets safety requirements allows to carry out necessary tasks and functions effectively.

6. Certified requirements to objects of airfield, data presentation on airfield, airfield ensuring flights, control, monitoring and accounting of obstacles in aerodrome environs, management of the dangers created by birds and wild animals, the organizations of work of special transport at the airports of the Republic of Kazakhstan are:

1) requirements of regulations of serviceability of airfields (helidromes) of civil aviation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of March 31, 2015 No. 381 (it is registered in the Register of state registration of regulatory legal acts for No. 12303) and appendices 14 to the International convention of civil aviation. Airfields volume 1 "Designing and Operation of Airfield";

2) requirements of the rules of providing with aeronautical information in civil aviation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of June 30, 2017 No. 420 (it is registered in the Register of state registration of regulatory legal acts for No. 15427), regarding provision of aeronautical data on airfield;

3) requirements of the rules of airfield providing in civil aviation approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of October 7, 2015 No. 978 (it is registered in the Register of state registration of regulatory legal acts for No. 12360);

4) requirements of rules for the organization of work of special transport at the airports of the Republic of Kazakhstan approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of March 26, 2015 No. 327 (it is registered in the Register of state registration of regulatory legal acts for No. 11676);

5) requirements of rules of management of the dangers created by birds and other animals to flights of civil aircrafts in the Republic of Kazakhstan;

6) requirements of rules of issue of operating authorities which can provide safety hazard of flights of the aircrafts approved by the Order of the Government of the Republic of Kazakhstan of May 12, 2011 No. 504;

7) availability developed the User manual, to content and repair of airfields, the approved technologies of work;

8) availability of procedures on fault detection of airfield coverings (acts of fault detection, inspection reports of elements of airfield);

9) availability of assessment procedures of conditions of braking of aircrafts, devices on measurement of coefficient of coupling;

10) availability of the special equipment intended for content of airfield;

11) availability of the approved procedures for the organization of work of special transport in airfield;

12) holding actions for monitoring, assessment and accounting of obstacles and taking measures to their elimination, including not aeronautical fires posing safety hazard of flights, carrying out construction works and other activities around airfield and on priaerodromny the territories.

7. Certified requirements for electrolighting ensuring flights are:

1) requirements of regulations of serviceability of airfields (helidromes) of civil aviation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of March 31, 2015 No. 381 (it is registered in the Register of state registration of regulatory legal acts for No. 12303), regarding electric utility service of airfield and the lighting equipment;

2) requirements of rules of electrolighting ensuring flights of civil aviation of RK approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of March 26, 2015 No. 350 (it is registered in the Register of state registration of regulatory legal acts for No. 11637);

3) availability of technological procedures for inspection and servicing of the electrolighting equipment;

4) availability of technical schemes of the electrolighting equipment.

8. Certified requirements for fire safety, rescue ensuring flights are:

1) requirements of regulations of serviceability of airfields of the validity of physical characteristics to regulations of serviceability of airfields (helidromes) of civil aviation approved by the order of the Minister of investments and development of the Republic of Kazakhstan of March 31, 2015 No. 381 (it is registered in the Register of state registration of regulatory legal acts for No. 12303), regarding crash equipment, type and the number of fire-fighting structure;

2) requirements of the fire safety regulations in civil aviation of the Republic of Kazakhstan approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of March 26, 2015 No. 324 (it is registered in the Register of state registration of regulatory legal acts for No. 12217);

3) requirements of rules of rescue ensuring flights at the airports of the Republic of Kazakhstan approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of March 26, 2015 No. 325 (it is registered in the Register of state registration of regulatory legal acts for No. 12216).

9. Certified requirements for providing civil aircrafts with fuels and lubricants and special liquids are:

1) requirements to the organizations for providing with fuels and lubricants the civil aircrafts approved by the order of the Acting Minister of investments and development of the Republic of Kazakhstan of February 24, 2015 No. 188 (it is registered in the Register of state registration of regulatory legal acts for No. 11856);
