In pursuance of the resolution of the President of the Republic of Uzbekistan of December 14, 2006 of NPP-531 "About Measures for Further Development of Production at the Samarkand Automobile Plant and to Updating of the Park of Motor Transport of the Republic" and according to the Laws of the Republic of Uzbekistan "About conservation", "About protection of atmospheric air", "About consumer protection", the resolution of the President of the Republic of Uzbekistan of September 19, 2005 of NPP-183 "About Additional Measures for Streamlining of Export-import Transactions", and also resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of April 19, 2000, of July 6, 2004 N318 "About Additional Measures for Simplification of the Procedure of Certification of Products", the Uzbek agency of standardization, metrology and certification and the State committee of the Republic of Uzbekistan on conservation decide N151 "On Regulation of Import to the Republic of Uzbekistan and Export from Its Territory of Ecologically Dangerous Products and Waste":

1. Approve "The temporary instruction about procedure for ecological certification, on compliance to requirements of ecological class "Euro-2"" according to appendix is not lower than the new vehicles of the categories "Sq.m", "MZ" and "N2" equipped with petrol and diesel engines imported into the Republic of Uzbekistan.

2. Enact since March 1, 2007 in the Republic of Uzbekistan regulating documents of the Russian Federation regarding emissions of hazardous substances for the new imported automatic telephone exchanges of the categories "Sq.m", "MZ" and "N2" conforming to requirements Evro-2, and since January 1, 2010 - to requirements of "Euro-3":

a) GOST P 41.24-2003;

b) GOST P 41.49-2003;

c) GOST P 41.83-2004;

d) GOST P 51832-2001.

3. To the head public administration of ecological certification, standardization and regulation Boshdavekosertifikat in case of Goskompriroda of the Republic of Uzbekistan to provide issue of ecological certificates for the new vehicles of the categories "Sq.m", "MZ" and "N2" equipped with petrol and diesel engines imported into the Republic of Uzbekistan on the basis of recognition of legal acts of the export states of automatic telephone exchange regarding fulfillment of requirements in case of production of automatic telephone exchange to requirements "Euro-2" is not lower or "Euro-2" is not lower than documents submitted by applicants confirming compliance of the specified vehicles on toxicity level to requirements of ecological class.

4. This resolution becomes effective after ten days from the moment of its state registration in the Ministry of Justice of the Republic of Uzbekistan.

This Temporary instruction according to the resolution of the President of the Republic of Uzbekistan of December 14, 2006 NPP-531 "About Measures for Further Development of Production at the Samarkand Automobile Plant and to Updating of the Park of Motor Transport of the Republic" and the laws of the Republic of Uzbekistan "About conservation", "About protection of atmospheric air", "About consumer protection" and resolutions of the President of the Republic of Uzbekistan of September 19, 2005 of NPP-183 "About Additional Measures for Streamlining of Export-import Transactions", and also resolutions of the Cabinet of Ministers of the Republic of Uzbekistan of April 19, 2000 of N151 "On Regulation of Import to the Republic of Uzbekistan and Export from Its Territory of Ecologically Dangerous Products and Waste", of July 6, 2004 N318 "About Additional Measures for Simplification of the Procedure of Certification of Products" determines procedure for ecological certification of the new vehicles of categories "Sq.m" imported into the Republic of Uzbekistan, Than "MZ" and "N2" equipped with petrol and diesel engines on compliance to requirements of ecological class "Euro-2" is not lower.

I. General provisions

1. This Temporary instruction extends to the new vehicles of categories "Sq.m", "MZ" and "N2" equipped with petrol and diesel engines and meeting standards of ecological class "Euros-2" imported by legal entities and physical persons into the Republic of Uzbekistan, except for the vehicles of special purpose corresponding to codes of the Commodity nomenclature of foreign economic activity (Commodity Nomenclature of Foreign Economic Activity) 8703 and 8705 are not lower.

2. In this document the following terms and determinations are applied:

Automatic telephone exchange - the vehicle;

emissions of automatic telephone exchange - the hazardous (contaminating) substances which the fulfilled gases of internal combustion engines and evaporation of fuel of automatic telephone exchange containing the hazardous (contaminating) substances (carbon oxide (SO), hydrocarbons (CmHn), oxides of nitrogen (NOx) and dispersion particles) are;

diesel - the engine working by the principle of ignition from compression;

pollutant - the substance capable to do harm to human health and the environment;

the applicant - legal entity or physical person;

the spark engine - the engine with forced ignition using gasoline or gas fuel;

test cycle - consecutive series of the testing which are carried out with certain frequency of rotation and torque of the engine in the set mode (ESC testing) and in the transitional modes (ETC,ELR testing);

ND - the regulating documentation;

the new vehicle - automatic telephone exchange from the moment of which release there passed no more than 3 years;

body for ecological certification - the Head public administration of ecological certification, standardization and regulation Boshdavekosertifikat in case of Goskompriroda of the Republic of Uzbekistan (further - body of ecological certification);

vehicles of categories "Sq.m" - the vehicles with the engine intended for transportation of passengers, having more than 8 places for sitting, except driver's seat, and the maximum weight less than 5 tons or the modifications of the vehicle created on their base having 3-8 places except driver's seat, with complete mass of equal basic model of the car;

vehicles of categories "MZ" - the vehicles having in addition to driver's seat more than 8 places for sitting and the maximum weight more than 5 tons;

vehicles of categories "N2" - the vehicles having the maximum mass of more 3,5 of tons and less than 12 tons;

the ecological class "Euro" - the classification code characterizing automatic telephone exchanges which level of toxicity meets standards of "Euro-2", "Euro-3", "Euro-4" and "Euro-5".

II. Procedure for issue of the ecological certificate

3. For the purpose of confirmation of conformity of automatic telephone exchange of categories "Sq.m", "MZ" and "N2" to requirements of ecological class not below "Euro-2" ecological certification of the specified categories of the automatic telephone exchange equipped with petrol and diesel engines, the body of ecological certification accredited in the procedure established by the legislation by the Uzstandart Agency is performed.

4. List of the documents necessary for issue of the ecological certificate:

from physical persons:

the request (with the signature and date), addressed to body for ecological certification (appendix N 1) (in the Word format);

the passport (or the reference accounts) the vehicle (date of issue, date of issue of the submitted document);

passport copies of the applicant;

copies of the shipping document with mark about arrival on customs area of the Republic of Uzbekistan (commodity-transport delivery note, invoice, the invoice);

copies of the documents (the conclusions, certificates, certificates) confirming compliance of automatic telephone exchange to regulations of ecological class are not lower than "Euro-2" (in the presence);

from legal entities:

requests (with the signature and date) addressed to body for ecological certification (appendix No. 1);

copies of the shipping document with mark about arrival on customs area of the Republic of Uzbekistan (commodity-transport delivery note, invoice, the invoice);

passports (or the reference accounts) the vehicle (date of issue, date of issue of the submitted document);

copies of the documents (the conclusions, certificates, certificates, etc.) confirming compliance of automatic telephone exchange to regulations of ecological class are not lower than "Euro-2" (in the presence).

5. The body of ecological certification registers the ecological certificate in the magazine and issues the ecological certificate (appendix No. 2) (in the Word format) within no more than 10 days.

6. In case of ecological certification except ND on specific products it is also allowed to be guided by the regulatory legal acts establishing requirements to products taking into account the additional documents (quality certificates, test reports, ecological certificates (conclusions), technical documentation of the supplier) which are available for the applicant.

7. The applicant bears complete responsibility for reliability of the data submitted for review of the request for issue of the ecological certificate.

8. For issue (or refusal in issue) the ecological certificate body of ecological certification:

considers and analyzes the documents submitted in the request;

identifies automatic telephone exchange with the assistance of the representative of customs post or warehouse and/or other faces of the applicant (appendix No. 3) (in the Word format);

analyzes compliance of indicators of automatic telephone exchange to the regulations of emissions of pollutants established vehicles with engines with spark ignition and with engines with ignition from compression;

makes the decision on possibility of issue of the ecological certificate or the reasonable written notice of refusal in its issue.

9. The authorized representative of the applicant can receive the ecological certificate:

in case of the statement from physical person it is necessary to provide the notarized copy of the power of attorney of the applicant on receipt of the certificate by the authorized representative;

in case of the statement from the legal entity it is necessary to provide the power of attorney of the applicant on receipt of the certificate by the authorized representative.

10. The basis for issue of the ecological certificate is acceptance in the exporting country of the legal act (at the time of release of automatic telephone exchange by manufacturer) about introduction in the territory of this state in action of requirements of "Euro-2" in case of production of automatic telephone exchange.

11. In the absence of information on enforcement in the exporting country (where automatic telephone exchanges are made) requirements of ecological class not below "Euro-2" issue of the ecological certificate is performed by recognition of the documents confirming compliance of automatic telephone exchange to regulations of ecological class "Euro-2" is not lower:

ecological certificate or certificate of conformity, origin or quality;

"Euro-2" is not lower than the official letter of manufacturing plant or its plenipotentiary on compliance of automatic telephone exchange to requirements of ecological class;

the message concerning the official approval like the vehicle, issued by administrative authorities of the states which are the parties of the Geneva Accord of March 20, 1958 "About acceptance of uniform conditions of the official approval and about mutual recognition of the official approval of pieces of the equipment and parts of motorized vehicles";

test report of test laboratory (center) of manufacturers;

"Euro-2" is not lower than other technical documents confirming compliance of automatic telephone exchange of categories "Sq.m", "MZ", and "N2" to environmental standards.

12. The ecological certificate is issued for the purpose of submission to customs authority for customs clearance of automatic telephone exchange.

13. For consideration of the request, accomplishment of the procedure of certified works and issue of the ecological certificate or refusal in its issue, on the basis of the agreement signed between body for ecological certification and the applicant the payment according to the rates for services in ecological certification declared by the Ministry of Finance of the Republic of Uzbekistan in the procedure established by the legislation is levied.

14. The ecological certificate is considered valid in the presence:

originals of the sign and seal of body of ecological certification;

numbers and registration dates of the ecological certificate in the magazine.

15. In case of violation of conditions of this Temporary instruction, and also in case of establishment of discrepancy of the imported automatic telephone exchanges to categories "Sq.m", "MZ" and "N2" on the basis of the act of identification, the reasonable written notice of refusal in issue of the ecological certificate is issued to the applicant.

16. The disputes arising on the specified questions are considered according to the procedure, established by the legislation of the Republic of Uzbekistan.

III. Final provision

This Temporary instruction is approved with the State Customs Committee of the Republic of Uzbekistan.
