About some questions of bodies of the state statistics

(Extraction)

For the purpose of increase in overall performance of bodies of the state statistics, their independence when implementing the state statistical activities I decide:

1. Transform:

The ministry of statistics and analysis in National Statistical Committee which is the republican state body in the field of the state statistics subordinated directly to the President of the Republic of Belarus;

regional and Minsk city managements of statistics in the head statistical offices of areas and the city of Minsk.

2. Approve Regulations on National Statistical Committee of the Republic of Belarus it (is applied).

3. No. 114 is excluded according to the Presidential decree of the Republic of Belarus of 18.04.2023

4. Make changes and additions to presidential decrees of the Republic of Belarus according to appendix.

5. To Council of Ministers of the Republic of Belarus:

5.1. provide:

allocation to National Statistical Committee of budgetary appropriations in connection with transformation of the Ministry of statistics and the analysis to National Statistical Committee;

financing of National Statistical Committee on 2008 and the next years taking into account its number of staff and the functions assigned by this Decree;

5.2. in four-months time to take measures for reduction of acts of the legislation in compliance with this Decree and on its realization.

6. Before reduction of acts of the legislation in compliance with this Decree they are applied in the part which is not contradicting this Decree.

7. This Decree becomes effective in month after its official publication, except for Item 5 and this Item which become effective from the date of official publication of the Decree.

Regulations on National Statistical Committee of the Republic of Belarus

Chapter 1. General provisions

1. The National Statistical Committee of the Republic of Belarus (further - Belstat) is republican state body in the field of the state statistics, pursues state policy in the field of the state statistics, exercises regulation and control, and also coordination of activities of other state bodies, other organizations in this area.

Belstat submits directly to the President of the Republic of Belarus.

2. Belstat in the activities is guided by the Constitution of the Republic of Belarus, the laws of the Republic of Belarus, acts of the President of the Republic of Belarus, including this Provision, other regulatory legal acts and is independent when implementing the state statistical activities.

3. Belstat is legal entity, has the current (settlement) account and other accounts in banks, seal and forms with the image of the State Emblem of the Republic of Belarus and with the name.

4. The central office of Belstat, territorial authorities of the state statistics, and also the state organizations subordinated to Belstat are a part of the system Belstat (further - the subordinate organizations).

The structure of central office of Belstat includes head departments, managements, departments, sectors. In central office of Belstat for the purpose of ensuring its activities and maintenance other structural divisions according to the legislation can be created.

Are under Belstat's supervision:

republican unitary enterprise "Data Processing Center of National Statistical Committee of the Republic of Belarus";

republican unitary enterprise "Center of Information Technologies of National Statistical Committee of the Republic of Belarus".

5. Financing of activities of Belstat is performed at the expense of the means of the republican budget and other sources which are not prohibited by the legislation.

6. Belstat's property is in property of the Republic of Belarus and is assigned to it on the right of operational management.

Chapter 2. Main objectives, rights and Belstat's obligations

7. The main objectives of Belstat are:

7.1. forming of the official statistical methodology conforming to international standards in the field of statistics;

7.2. implementation of the state statistical activities with respect for the principles of the state statistics;

7.3. satisfaction of requirement of society, state and international community for official statistical information.

8. Belstat has the right:

8.1. receive on a grant basis with observance of the requirements established by legal acts from state bodies, other organizations administrative data, other information, including distribution and (or) provision of which is limited, except for the data constituting the state secrets necessary for the organization and carrying out the state statistical observations, forming of official statistical information;

8.2. use on a grant basis with observance of the requirements established by legal acts, information resources (systems), bases (banks) of data of state bodies and other organizations including containing information, distribution and (or) provision of which is limited, to receive from them the data, except for the data constituting the state secrets and also to have to them access, including remote, by means of the nation-wide automated information system if its use is obligatory, or based on the agreement on information exchange and (or) on demand for the organization and carrying out the state statistical observations, forming of official statistical information;

8.3. receive on a grant basis the electronic services rendered by state bodies and other organizations necessary for implementation of the state statistical activities, based on agreements (contracts) for rendering electronic services;

8.4. create and keep the statistical register;

8.5. organize and make centralized state statistical observations;

8.6. establish procedure for representation by respondents of primary statistical data, and also procedure for development, approval, maintaining and use of the statistical qualifiers which are technical regulatory legal acts;

8.7. receive on a grant basis if other is not established by the legislation, from respondents primary statistical data, including information, distribution and (or) provision of which it is limited, in amount and the terms specified in forms of the state statistical observations;

8.8. receive on a grant basis according to the procedure, established by Belstat, from the state organizations authorized on maintaining the state statistics, primary statistical data on the made not centralized state statistical observations and official statistical information;

8.9. attract according to the procedure, established by the legislation, legal entities and physical persons for the organization and carrying out the state statistical observations, and also research and other organizations, scientists and specialists for development of single methodological issues of the state statistics;

8.10. adopt regulatory legal acts concerning maintaining the state statistics and to other questions entering Belstat's competence, and also the decisions obligatory for execution by respondents;

8.11. check reliability of primary statistical data by comparison them with data of source accounting and other documents, visit for this purpose the territory and rooms (except residential) state bodies, other organizations (except for the organizations which according to international treaties of the Republic of Belarus use diplomatic immunity), their separate divisions, and also individual entrepreneurs, to receive data from bases (banks) of these checked subjects;

8.12. require and receive from the respondent necessary explanations, documents (their copy) and other materials under the organization and carrying out the state statistical observations, forming of official statistical information and (or) in case of identification of misstatements in data of the state statistical reporting;

8.13. instruct the respondent obligatory for execution in elimination of the revealed misstatements in data of the state statistical reporting and (or) make changes to official statistical information in case of identification of misstatements in data of the state statistical reporting;

8.14. make explanations about the organization and maintaining the state statistics, use of official statistical methodology in the Republic of Belarus, including in mass media, to comment on the wrong use or interpretation of official statistical information;

8.15. perform cooperation in the field of the state statistics with statistical bodies of foreign states, the international organizations and bodies of interstate educations;

8.16. approve regulations on territorial authorities of the state statistics;

8.17. according to the procedure, established by the legislation to create, reorganize, liquidate the subordinate organizations, to approve their charters;

8.18. extend on paid basis if other is not established by the legislation, official statistical information and to render other information services through the subordinate organizations;

8.19. exercise control of activities of territorial authorities of the state statistics, the subordinate organizations by means of regulation of their activities and realization of powers of the owner with efficiency analysis of their work and development of offers on its increase;

8.20. certify form of external submission of the electronic paper document submitted to body of the state statistics or body of the state statistics;

8.21. perform other rights, stipulated by the legislation.

9. Belstat according to the tasks assigned to him shall:

9.1. develop and approve the official statistical methodology for the organization and carrying out centralized state statistical observations, forming of official statistical information conforming to international standards in the field of statistics;

9.2. develop together with the state organizations authorized on maintaining the state statistics and approve the strategy of development of the state statistics;

9.3. develop and submit for approval in Council of Ministers of the Republic of Belarus the program of statistical works;

9.6. provide to respondents when carrying out centralized state statistical observations access to the specialized software for representation of primary statistical data in the form of the electronic document or provide possibility of representation by respondents of primary statistical data in other form established by Belstat;

9.7. perform methodological management of the organization and carrying out centralized state statistical observations in case of their carrying out;

9.8. provide confidentiality of primary statistical and individual administrative data and their use for the purpose of accomplishment of tasks of the state statistics;

9.9. create and provide official statistical information to the President of the Republic of Belarus, Vsebelorussky people's assembly, Council of Ministers of the Republic of Belarus, National assembly of the Republic of Belarus, other state bodies, and also to extend and provide official statistical information to other users according to the procedure, established by the legislation;

9.10. provide equal access for users to official statistical information and methodology of its forming;

9.11. carry out exchange of official statistical information with statistical bodies of foreign states, and also provide official statistical information according to international treaties of the Republic of Belarus;

9.12. provide maintaining bases (banks) data of official statistical information;

9.13. provide functioning and development of information resources (systems), complexes of the program technical means necessary for implementation of the state statistical activities;

9.14. provide mobilization training of Belstat, and also control and coordination of activities of territorial authorities of the state statistics, the subordinate organizations for their mobilization preparation;

9.15. fulfill other duties according to the legislation.

10. Belstat within the competence performs approval:

drafts of the laws, legal acts of the President of the Republic of Belarus, resolutions of Council of Ministers of the Republic of Belarus concerning the state statistics;

the official statistical methodology developed and approved by the state organizations authorized on maintaining the state statistics;

the projects of the nation-wide qualifiers of the Republic of Belarus used in the state statistical activities and assigned to other republican state bodies and changes in them.

Chapter 3. Governing bodies of Belstat

11. Belstat heads the Chairman appointed to position and dismissed by the President of the Republic of Belarus.

12. The chairman Belstata submits to the President of the Republic of Belarus and is part of Council of Ministers of the Republic of Belarus.

13. The chairman Belstata has four deputies, including one first.

Vice-chairmen of Belstat are appointed to positions and dismissed by the President of the Republic of Belarus on representation of the Chairman Belstat.

14. Chairman Belstata:

14.1. directs Belstat's activities and bears the personal responsibility for accomplishment of the tasks assigned on Belstat;

14.2. introduces in accordance with the established procedure to the President of the Republic of Belarus and in Council of Ministers of the Republic of Belarus projects of regulatory legal acts, and also offers on the questions entering Belstat's competence;

14.2-1. within the competence issues orders, signs Belstat's resolutions and gives the instructions obligatory for execution by workers of system of Belstat;

14.3. approves within the Republic of Belarus established by the President of number structure and the staff list of central office of Belstat, number structure and employees of territorial authorities of the state statistics;

14.4. distributes obligations between Belstat vice-chairmen, determines powers of heads of structural divisions of central office of Belstat;

14.5. appoints to positions and dismisses heads of territorial authorities of the state statistics and the subordinate organizations;

14.6. on representation of heads of territorial authorities of the state statistics and the subordinate organizations appoints to positions and dismisses deputy managers of territorial authorities of the state statistics and the subordinate organizations;
